NOTIFICATION

New Delhi, the 25th November, 2020

G.S.R. 733(E).- In exercise of the powers conferred by sub-section (3) of Section 10 read with section 59 of Lokpal and Lokayuktas Act, 2013 (1 of 2014), the Central Government hereby makes the following rules regulating
the method of recruitment to the post of Staff Car Driver in the Lokpal, namely: –

1. Short title and commencement.- (1) These rules may be called the Lokpal (Staff Car Driver) Recruitment Rules, 2020.
   (2) They shall come into force on the date of their publication in the Official Gazette.
2. Number of post, classification, level in the Pay Matrix.- The number of post, its classification, and the level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.
3. Method of recruitment, age limit, qualifications, etc.- The method of recruitment, age limit, qualifications and other matters relating to the said post shall be as specified in columns (5) to (13) of the aforesaid Schedule.
4. Disqualification.- No person, –
   (a) who has entered into or contracted a marriage with a person having a spouse living; or
   (b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post:
   Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.
5. Power to relax.- Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.
6. Savings.- Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Schedule Castes, the Scheduled Tribes, other backward classes, ex-Servicemen and
   other special categories of persons, in accordance with the orders issued by the Central Government from time to time, in this regard.

In terms of instructions contained in this Department’s OM No. AB-14017/61/2008-Estt.(RR) dated 13.10.2015, the above draft rules are hereby placed on the website of this Department for perusal of all concerned. In exercise of the powers conferred by sub-section (1) of section 59 of Lokpal and Lokayuktas Act, 2013, the President hereby makes the following rules for Group ‘C’ Multi Tasking Staff posts in the Lokpal, namely:-

1. Short title and commencement – (1) These rules may be called the Lokpal (Group ‘C’ PostsMulti Tasking Staff) Rules, 2019.
(2) They shall come into force on the date of their publication in the Official Gazette.

2. Power of Lokpal to make Regulations.

The Central Government hereby vests powers in the Lokpal to make Regulations for the recruitment process.

Provided such recruitment shall be made on the recommendation of the Personnel Committee to be constituted by the Chairperson Lokpal and the said Committee shall be chaired by the Secretary, Lokpal or any other Officer of the Lokpal as authorized by him and shall have at least three Members.

3. Number of post, classification, Pay level in the Pay Matrix:– The number of post, its classification, the pay level or pay scale attached thereto shall be as specified in columns (1) to (4) of the Schedule annexed to these rules.

4. Method of recruitment, age-limit, qualifications, etc. – The method of recruitment to the said post, age-limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.

Calling of applications /nominations for preparation of panel of names for consideration by the Selection Committee for appointment as Chairperson and Members of the Lokpal

Applications / nominations from/of eligible persons are invited for the purpose of recommending panel for consideration by the Selection Committee of the Lokpal for appointment to the positions of Chairperson and Members of the Lokpal.

The necessary details including statutory provisions which spell out the eligibility criteria and the application/nomination form can be accessed through the website of the Department of Personnel and Training viz. https://dopt.gov.in under the link “Lokpal”.

The tenure of appointment, salary and allowances are in terms of provisions of Section 6 and 7 respectively, of the Lokpal and Lokayuktas Act, 2013.

The applications/nominations of eligible and interested candidates complete in all respects in the prescribed proforma should reach latest by 22nd February, 2019 – 5.00 PM. The same may be addressed to the Chairperson, Search Committee for appointment of Chairperson and Members of the Lokpal at Post Box No. 12, GPO, New Delhi – 110001 or may be forwarded bye-mail at the following id “lokpal.searchcomm@gov.in” latest by 22nd February at 5.00 PM. The date/ time stamp of the application/ nomination at the receiving end will be treated as final for the purpose.

The applications/nominations received after the last date and stipulated time will not be entertained.

New Delhi: The Centre has extended indefinitely the deadline to file details of assets and liabilities by central government employees under a mandatory provision of Lokpal Act.

A new format and fresh set of rules are being finalised by the government in this regard.

The last date for filing such details was December 31.

“There is no requirement for filing of declarations of assets and liabilities by public servants now. The government is in the process of finalising a fresh set of rules. The said rules will be notified in due course to prescribe the form, manner and timelines for filing of declaration of assets and liabilities by the public servants under the revised provision of the said (Lokpal) Act.

“All public servants will henceforth be required to file the declarations as may be prescribed by the fresh set of rules,” an order issued by Department of Personnel and Training (DoPT) said.

There are about 50.68 lakh central government employees.

As per rules, notified under the Lokpal Act, every public servant shall file declaration annually pertaining to his assets and liabilities as on March 31 every year or on or before July 31 of that year.

For 2014, the last date for filing returns was September 15. It was first extended till December, then till April 30, 2015 and third extension was up to October 15. The date was again extended to April 15, 2016 and then July 31 for filing of the returns.

The last date was further extended till December 31 after Parliament had passed a bill to amend the Lokpal and Lokayuktas Act, 2013.

The declarations under the Lokpal law are in addition to similar ones filed by the employees under various services rules.

The DoPT had last year also issued an order bringing NGOs receiving more than Rs one crore in government grants and donations above Rs 10 lakh from abroad under the ambit of the Lokpal.

The order had mandated filing of returns of the assets and liabilities by such organisations and their executives – director, manager, secretary or any other officer.

Office Memorandum

Subject: Declaration of Assets and Liabilities by public servants under section 44 of the Lokpal and Lokayuktas Act, 2013 —filing of Returns by public servants on or before 15th April, 2016 – regarding

The undersigned is directed to invite attention to the provisions of section 44 of Lokpal and Lokayuktas Act, 2013 whereby every public servant i.e. all categories of public servants as defined under section 2 (0) read with section 14 (1) (a) to (h) of Lokpal and Lokayuktas Act, 2013, shall make a declaration of his assets and liabilities. The timelines for filing the declarations/information/annual returns under the said Act are as under:

i. The first return of assets and liabilities as on 1st August, 2014 under the Lokpal and Lokayuktas Act, 2013 – on or before 15th April, 2016

ii. The annual return of assets and liabilities as on 31st March, 2015 under the Lokpal and Lokayuktas Act, 2013 – on or before the 15th April, 2016.

iii. The annual return of assets and liabilities as on 31st March, 2016 under the Lokpal and Lokayuktas Act, 2013 – on or before 31st July, 2016.

iv. The annual return of assets and liabilities for subsequent years as on 31st March every year should be filed on or before 31st July of that year.

The aforesaid timelines have already been intimated vide this Department’s OM No. 407/12/2014-AVD-IV(B) dated 28.03.2016 ,

2. All Ministries/Departments are requested to ensure compliance of the aforementioned provisions of the Lokpal and Lokayuktas Act, 2013 and in this regard inform and sensitize the societies/Association of persons/trusts under their administrative/financial control about the requirement of the law and deadlines for filing of necessary declarations/returns. To facilitate smooth compliance & information/provisions of section 44 of the Lokpal & Lokayuktas Act, 2013, this department has already placed in the public domain all the relevant rules framed under the said Act, forms in which declarations are required to be made, FAQs etc..

3. This may please be accorded due priority keeping in view that the declarations & returns for the years 2014 & 2015 are required to be filed by all public servants by 15.04.2016 mandatorily.

(ii) Verify whether personal details are reflected in the system correctly. To verify the details click on the ‘Employee Details’ button. If the details are not correct, first have them rectified through Admin. Division of concerned Department before proceeding further.

 

(iii) Click ‘IPR’ button on the top and then click on ‘Lokpal Returns’ icon.

 

(iv) Click ‘create new PR’ button and select property return year then click on create PR.

 

(v) Read declaration page carefully and click on ‘next’ button.

 

(vi) Form-I: Add one by one details of Public Servant, his/her spouse and dependent children and save details every time. After adding of details click on ‘next’ button.

 

(vii) Form-II: Add Movable Properties Owned By Self/ Spouse/ Dependent one by one by clicking ADD Button and save then click on ‘next’ button.

 

(viii) Form-Ill: Statement of Immovable Property: Add->Select ->IPR year-> Add new property details one by one by clicking ADD Button -> click on ‘next’ button.

 

(ix) Form-IV: Add Statement of Debts and Other Liabilities one by one by clicking ADD button then click on ‘FINISH’ button.

 

(x) Click ‘finish’ button. Property Return Details page automatically opens. Users may select the year by click on the particular year and then click on ‘Final submission of IPR’ button.

Three top ranking retired armed forces commissioned officers – a wing commander, a lieutenant colonel, and a major – currently occupying the posts of joint director and deputy directors with state’s sainik welfare and resettlement department, are accused of drawing dearness allowance or relief from two sources, the state government as well as the defence forces, since several years.

A complaint was filed by Raju N R, a military veteran, on October 20 with the Lokayukta on the irregularity, which is said to have caused the state exchequer a loss of several lakhs. The officials concerned are Wg Cdr (rtd) Eshwar Kodolli, Maj (rtd) Shivaji M Tukkar and Lt Col (rtd) Geetha M Shetty.

Kodolli is currently serving as joint director (i/c), Tukkar is deputy director (Bagalkot and Koppal), and Shetty, deputy director (Shimoga and Davangere). The allegations levelled against them include giving false declaration to the pension disbursing authorities of armed forces to get dearness relief on their defence pension. Once employed by state government (where they draw salary with DA), they are not entitled to DA on defence pension.

“Defence services officers are selected for re-employment in the Karnataka state department of sainik welfare & resettlement (DSWR), and so, state government employees,” Raju told Bangalore Mirror. “Every retired defence services officer is required to render an annual certificate to the Defence Pension Disbursing Authority (PDA) for drawing defence pension. In this certificate, they declare that they are, or are not, re-employed in a government job. Based upon their declaration, the PDA pays DA on their defence pension. The PDA has no means to check the veracity of this declaration, and the defence services officer is honour-bound to make a truthful declaration. A false declaration for personal gain is an act of moral turpitude, which attracts disciplinary action.”

Tukkar has been re-employed with the department of sainik welfare and resettlement since Nov 9, 2009, Shetty since June 13, 2011 and Kodolli since October 20, 2011, as per records available with Raju. But they have continued to draw DR – which is currently 100% on the pension – and DA, Raju said. This despite an armed forces tribunal order in June 2013 in a similar case pertaining to two other officers – Maj (rtd) R S Vishwanath and Col (rtd) CM Uthaiah – to refund the Dearness Relief drawn for the period of their re-employment.

All Central Government employees will now have to compulsorily submit a detailed report on their properties and debt owed by them…

Already, each year, the Group-A officials are required to submit information about the immovable properties owned by them. Now All categories of Central Government employees too have been asked to submit these details. The DOPT has issued relevant orders to this effect.

The Government has issued this order in accordance with the Lokpal rules. According to this rule, Central Government employees will now have to submit all details regarding the cash-in-hand, bank investments, share certificates, stocks and bonds, mutual fund investments, insurance policies, P.F. details, loans, motor vehicles, gold and silver ornaments, and precious metals, to the Government.

The employees have to also submit details of movable and immovable properties owned by their spouses and children. Application forms will be given to all the employees, to be filled up and submitted before the 31st of July for each financial year.

There are more than 50 lakh Central Government employees, including IAS, IPS and IFS officers, all over the country. All of them will have to henceforth submit details of their properties. If the total property owned by the employee is less than his/her four months’ basic salary, or if the total amount is less than Rs. 2 lakhs, then he/she could be considered for exemption from submitting the information.

Those who have already submitted the details will have to re-submit the form for the current financial year on or before September 15, 2014. Information also has to be furnished about the properties owned by the spouse and children.

On January 1, President Pranab Mukherjee gave his approval for the Lokpal Act and regulations. Following this, amendments were made to the Lokpal Act to make it compulsory for all Central Government employees to furnish their property details.
