OFFICE MEMORANDUM

Subject : Accumulation of paid leave without encashment facilities for Gramin Dak Sevaks (GDS) – reg.

A proposal for allowing accumulation of paid leave without encashment facilities was under consideration of the Department for quite some time. The Department had also sought suggestions/feed back of the Circles/stakeholders on the proposal.

2. After examination of the proposal and feed back of all the stakeholders, Rule-7, regarding paid Leave of the GDS, of GDS (Conduct and Engagement) Rules, 2020, has been amended as under:

• 7. Leave

The Gramin Dak Sevaks may be granted paid leave at the rate of 20 days in a year (10 days for every half year). Paid leave for 10 days will be credited to his account at the beginning of half year, starting 1st January or 1st July;

A GDS will be allowed to carry forward unavailed paid leave to the maximum extent of 45 days at any given time;

Paid leave shall be credited to the leave account of GDS at the rate of 1.67 days for each completed calendar month of engagement which a GDS is likely to render in a half-year of the calendar year of engagement/discharge/cessation of engagement;

While affording credit of paid leave, fractions of a day shall be rounded off to the nearest day. A fraction of 0.5 or above will be taken as one day of leave, while fraction of less than 0.5 will be ignored and Provided that –

• Where a Sevak fails to resume duty on the expiry of the maximum period leave admissible and granted to him/her, or
• Where such a Sevak who is granted leave for a period less than the maximum period admissible to a Sevak under these rules, remains absent from duty for any period which together with the leave granted exceeds the limit upto which a GDS shall, unless the Government, in view of the exception circumstances of the case, otherwise decides, be removed from engagement after following the procedure laid down in Rule 10.

3. The above change in the said Rule-7 of GDS (Conduct and Engagement) Rules, 2020, will effective from 01.01.2026.

4. Based on the feed back sought of the stakeholders, an FAQs is also provided in Annexure-I to this OM for the guidance of all concerned.

Sir/Madam,

I am directed to refer to various references received in the Department seeking clarification on the subject noted above and the scope of applicability of 20A(4)(a) of AIS (Leave) Rules, 1955.

2. In this context, it may be noted that 20A(4)(a) of AIS (Leave) Rules, inter-alia, mentions about payment of cash equivalent of leave salary of the applicable leaves standing at the credit of a member of Service (moS), who has been permitted by the State Government to voluntarily retire from service while under suspension or who is retired by the Central Government in public interest while under suspension.

However, reference are being received in this Department seeking clarifications regarding payment of leave encashment to such members of service who were under suspension or against whom the disciplinary/criminal proceeding (s) were pending at the time of retirement / superannuation.

3. In view of the above, the matter has duly been examined under AIS (Leave) Rules, 1955 and other relevant rule provisions / instructions. Accordingly, it is clarified that “In case of a moS who is under Suspension or against whom Disciplinary / Criminal Proceedings are pending at the time of his retirement / superannuation, the authority competent to grant leave may withhold whole or a part of leave encashment, if in the view of such authority there is a possibility of some money becoming recoverable from him on conclusion of the proceedings against him. On conclusion of the proceedings, he will become eligible to the amount so withheld after adjustment of Government dues, if any”.

4, The aforesaid clarification may kindly be brought to the notice of all officials / authorities concerned for necessary action.

DA on Encashment of Leave & Gratuity – Regarding

Lately, GoI, MoF, New Delhi letter, No. 1(5)/E.V/2020 dated 07/09/2021 regarding Central Govt employees retired during the period from January 2020 to June 2021- calculation of Gratuity and Cash payment in lieu of Leave – regarding’, is doing rounds in the environment, however, the same has not been received in this office through proper permissible channel of official communication till date. There have been several enquiries from Army Officers & Army Authorities on this account, through various modes & various channels of communication. MoD, New Delhi order on the above subject, has not been received. As and when MoD orders are received, necessary action will be taken by the O/o the PCDA (O), Pune. This has been put up for kind information of Indian Army Officers to avoid queries in this matter along with the attached anxiety.

FOREWORD

Department of Pension and Pensioners Welfare has been leveraging technology year after year, to make the system seamless and more and more convenient for the elderly Pensioners, while taking other steps for bringing about changes in pension policy towards providing a life of dignity for them and their dependents. Some of the major initiatives/support measures taken in this regard include providing Doorstep Service for submission of Digital Life Certificate through Postal Department besides the facility to submit life certificate online through Jeevan Pramaan Portal. This is considered to be a step towards making the Pensioners “Atamnirbhar” as the DLC can now be given from the comfort of one’s home also.

Over the past few years, this Department has also taken a number of decisions to liberalize and simplify the rules and procedures to make the life of our honored pensioners and their dependents simpler and dignified. Rules have been relaxed for divorced daughters to receive Family Pension and now a daughter is entitled to receive the Family Pension even if the divorce has not finally taken place but the divorce petition had been filed by her during the lifetime of her deceased parent employee/ pensioner. Earlier Rule provided for payment of Family Pension to a divorced daughter only if the divorce had taken place during the lifetime of deceased parent pensioner or his spouse. The new Rule not only brings ease to the life of pension receiving individuals but also ensures respectable and equitable rights for the divorced daughters in society. Rule 64 of CCS (Pension) Rules, 1972, was relaxed in order to ensure immediate provisional sanction of pensionary benefits amid the unprecedented situation of COVID-19, wherever an employee is likely to retire before finalization of his dues or is unable to submit the pension claim form. . The Government has very recently made amendment of income criteria for grant of family pension to children/siblings suffering from a mental or physical disability.

While the DOPPW has been striving to bring about, from time to time, necessary changes, it is all the more important to keep the pensioners aware of various developments in the pension administration system. Keeping this in view the Department has now decided to bring about Booklet titled “Know Your Retirement Benefits”, which I am sure, will be helpful in creating awareness amongst pensioners. It will also serve as a guide for officers and dealing staff dealing with pension-related matters in Ministries/ Department/ Organisation.

I am happy and proud to release this Booklet of Department of Pension and Pensioners Welfare which will be a help in determining the retirement benefits entitlements of Pensioners and their dependents.

Subject:- Central Civil Services (Leave Travel Concession) Rules, 1988 Fulfillment of procedural requirements clarification reg.

The undersigned is directed to refer to para (c) of this Department’s O.M. of even number dated 09.02.2017 on the subject noted above regarding reimbursement in cases where a Government servant travels on LTC up to the nearest airport/ railway station/ bus terminal by authorized mode of transport and undertakes rest of the journey to the declared place of visit by private transport/ own arrangement (such as a personal vehicle or private taxi etc.).

2. Para (c) of the aforesaid O.M. provides as under:

“(c) In case, there is no public transport available in a particular stretch of journey, the Government servant may be reimbursed as per his entitlement for journey on transfer for a maximum limit of 100 Kms covered by the private/ personal transport based on a self-certification from the Government servant. Beyond this, the expenditure shall be borne by the Government servant”.

3. With regard to the above provision, many references are received in this Department seeking following clarifications:-

Special cash package equivalent in lieu of LTC fare for central government employees during the Block 2018-2021

(i) Whether the 100 Kms limit specified in DoPT’s O.M. No. 31011/3/ 2015-Estt.A-IV dated 09.02.2017 is for the whole journey (i.e. to and fro combined) or separately for onward and return journey, i.e. 100 Kms for onward and 100 Kms for return journey?

(ii) How assistance shall be provided in cases where various members of a family avail LTC separately and thus avail the facility of private taxi/ transport separately? Whether in such cases also reimbursement as above shall be provided individually to each family member?

4. The matter has been considered in this Department and it is clarified that the 100 Kms limit as prescribed in DoPT’s O.M. No. 31011/3/ 2015-Estt.A-IV dated 09.02.2017 is to be seen from one side. Hence, for the to and fro journey, the fare reimbursement shall be provided for a total of 200 Kms (100 Kms each side).

5. As regards the second situation described in para 3(ii) above, it is stated that in cases where members of the family avail LTC separately, they shall also be eligible for reimbursement of taxi fare/ private transport separately as per DoPT’s O.M. No. 31011/ 3/ 2015-Estt.A-IV dated 09.02.2017.

Subject : Recovery of Dress allowance from leave encashment in r/o retiring Industrial employees of MES.

Ref. :- This office letter no. PT/3088/CGDA/ Vol-IX dated 07/12/2020.

It was advised vide the letter quoted under above reference that “Recovery amount may only be kept reserve from leave encashment and rest of the benefit be released in r/o the employees who retire and leave encashment claims being received.”

2. The above decision of the competent authority at this end was also conveyed to Hqrs office, vide its letter AT/Army-BR/ A/Civ/2366/Dress Allow/ Vol-II dated 05/01/2021 have intimated that the recovery from leave encashment of retiring employee may lead to contempt of court.

3. In view of the above, it is advised not to effect recovery of the dress allowance from leave encasement of retiring industrial employees of MES and the recovery if effected in any case may be refunded to comply with the stay on recovery of dress allowance amount already paid to Industrial employees of MES as directed by hon’ble CAT, Lucknow.

Sub: Special cash package equivalent in lieu of Leave Travel Concession Fare for Central Government Employees during the Block 2018-21.

In view of Covid-19 pandemic and resultant nationwide lockdown as well as disruption of transport and hospitality sector, as also the need for observing social distancing, a number of Central Government employees are not in a position to avail themselves of LTC for travel to any place in India or their Hometowns in the current Block of 2018-21.

2. With a view to compensate and incentive consumption by Central Government employees thereby giving a boost to consumption expenditure, it has been decided that cash equivalent of LTC, comprising Leave Encashment and LTC fare of the entitled LTC may be paid by way of reimbursement, if an employee opts for this in lieu of one LTC in the Block of 2018-21 subject to the following conditions:-

a) The employee spends the money of a larger sum than the entitlement on account of LTC on actual expenditure.

b) Cash equivalent of full leave encashment will be allowed, provided the employee spends an equal sum. This will be counted towards the number of leave encashment on LTC available to an employee.

C) The deemed LTC fare for this purpose is given below :-

d) The cash equivalent may be allowed if the employee spends a sum 3 times of the value of the fare given above.

e) The amount both on account of leave encashment and fare shall be admissible if the employee spends (i) an amount equal to the value of leave encashment and; (ii) an amount 3 times of the cash equivalent of deemed fare, as given above on purchase of such items / availing of such services which carry a GST rate of not less than 12% from GST registered vendors / service providers through digital mode and obtains a voucher indicating the GST number and the amount of GST paid.

f) The admissible payment shall be restricted to the full value of the package [leave encashment as admissible for LTC and deemed fare] or depending upon the spending as per example given at Annexure-A.

g) While TDS is applicable in the case of leave encashment, since the cash reimbursement of LTC fare is in lieu of deemed actual travel, the same shall be allowed exemption on the lines of existing income-tax exemption available to LTC fare. The legislative amendment to the provisions of the Income-Tax Act, 1961 for this purpose shall be proposed in the due course. Hence, TDS shall not be required to be deducted on the reimbursement of deemed LTC fare.

3. Head of the Departments / DDOs may make reimbursement under this package as per the details given above on receipt of invoices of purchases made / services availed during the period post the issuance of this order from the employees who are desirous to avail this package. It may be noted that in order to avail this package an employee should opt for both leave encashment and LTC fare.

4. An amount upto 100% of leave encashment and 50% of the value of deemed fare may be paid as advance into the bank account of the employee which shall be settled based on production of receipts towards purchase and availing of goods and services as given in Para 2(e). The claims under this package (with or without advance) are to be made and settled within the current financial year. Non-utilization / under-utilization of advance is to be accounted for by the DDOs in accordance with the extant provisions relating to LTC advance i.e. immediate recovery of full advance in the case of non-utilisation and recovery of unutilized portion of the advance with penal interest.

5. These orders will take effect from the date of issuance of this Office Memorandum and will be in force during the current financial year till 31st March, 2021.

6. All the Ministries/ Departments are requested to bring the contents of this OM to the notice of all its Attached and Subordinate offices for their information.

Dear Sir,

Sub: Computation of gratuity and leave encashment in the case of persons retired/ to be retired after 1.1.2020 Consequent upon the denial of DA/DR

We invite your kind attention to the orders in F. No. 1/1/2020-E II (B) dated 23.04.2020 wherein the decision of the Government to deny the dearness allowance dearness relief to the employees and pensioners respectively has been conveyed. We had written two letters in the matter on 23rd April 2020 and on 26th May 2020. The undersigned had taken up the issue also with the Cabinet Secretary. when he assured of an informal discussion in the matter with the Staff Side. However. no talks have taken place thereafter. It is not for the first time that the Government is by pausing the National Council. Staff Side. On the last occasion. when the National Council met. we had pointed out the inordinate delay in convening the meetings. We are constrained to believe that the Government wanted the negotiating body to have a burial. I am however duty bound to convey the growing resentment of the employees over this unprecedented decision. As the Government has decided to deny the dearness relief to the pensioners. the pensioner community is in great financial stress as many of them are compelled to spend exorbitant amount for the treatment of Covid.

It has been brought to our notice that the denial of DA and freezing the same forced 18 months from 1.01.2020 to 1.07.2021 has created a piquant situation for the lower level administrative functionaries to correctly compute the retirement benefits in the case of those civil servants who are retiring after the date of issue of the above cited O.M. The definition of “emoluments” for the purpose of computing the gratuity as also the leave salary (of the accumulated leave) includes Dearness allowance as admissible and not as paid or payable to the Government servant. Without exception. every administrative Department has computed the entitlement on this account only with reference to the Basic pay Dearness allowance paid or received by the concerned individual i.e 17%, Either 21% w.e.f 1-1-2020 or figure increase in percentage are not taken into account while calculating gratuity and leave salary. Since the order of the Finance Ministry clearly stipulates that the Dearness Allowance admissible to the Government servants would be restored on 1.07.2021. the computation of Gratuity and leave salary without taking into account the DA as admissible to the individual Government servant is incorrect. Annexed to this letter is an example as to how the individual loses out if the present faulty, computation procedure is followed It could be seen from the given example, the concerned Government servant will lose a staggering sum of Rs. 57116 because of this faulty computation.

The Government is required to pass the orders as and when the DA has become due, Freezing it for certain period of time or denying it altogether for a specified duration are altogether different issues. Our objection to the adopted policy has already been conveyed to the Government. The faulty computation of Gratuity and Leave salary is not even intended by the order issued by the Government on 23rd April, 2020.

We, therefore. request you to kindly get the matter examined and ensure that

(i) Orders are issued as and when the Dearness allowance has to be revised on the basis of the cost of living index;
(ii) Direct the administering Ministries to compute the emoluments of persons who are to retire during the period of freezing, taking the correct amount of DA as admissible to receive and not what has been paid to him for computing gratuity and leave salary
(iii) The orders revising the rate of DA DR are to be issued in April, 2020, before September, 2020 and again in April, 2021.

I am directed to refer to this office letter of Even no. dated 06.08.2020 on the above cited subject and to say that the updation of service particular e.g. Last pay drawn, qualifying service etc in the ERP / SAP as per the details in PPOs generated by CCAs have not been carried out in respect of large number of retirees under BSNL VRS-2019. The task was required to be completed by 14.08.2020. Non-updation in ERP/ SAP is delaying the finalizing of the Ex-gratia amount, Leave encashment and calculation of arrears / over-payment. This activity has to be completed on top priority before the amount of 4th instalment of Ex-gratia amount is received from DOT so that total Ex-Gratia is calculated accurately before the payment of 4th installment of Ex-Gratia and there is no mismatch in the PPO data and ERP data.

2. Further, the ERP HCM team has reported that in respect of around 640 retirees (circlewise summary enclosed) under the BSNL VRS-2019 Leave encashment has not been paid. In this regard, it is again requested to release the payment of encashment of EL / HPL immediately as per the extant instructions on the issue.

3. Non completion of activity by 14.8.2020 has been viewed very seriously by DIR(HR). Therefore, CGMT concerned may bestow their personal attention to complete the task latest by 05.09.2020 without fail.

Subject: Notional pay fixation after currency of Minor penalty is over in case of ACP / MACP.

Sir,

With due regards, your attention is invited to the financial hardships being faced by the employees who are imposed with the minor penalty under CCS (RP) Rules, 1965 and during the currency of such penalty they become eligible for promotion or financial upgradation under ACP/ MACP. As per present system, the said promotion/ ACP/ MACP is actually granted with effect from the date of expiry of penalty period.

For example, the penalty of reduction of pay by one stage from the present Basic Pay of Rs. 15320 (Pay in pay band 12520 + GP 2800) to Rs. 14870 (Pay in Pay Band 12070 + GP 2800) for a period of one year without cumulative effect w.e.f. 05.12.2015 was imposed on a employee of Small Arms Factory, Kanpur as disciplinary measure. It was further directed that he will earn increment of pay during the period of reduction and that on expiry of this period, the reduction will not have the effect of postponing his future increment of pay.

During the currency of penalty, he completed 10 yrs regular service in the same grade pay (GP 2800) on 01.01.2016. Hence, he became entitled for financial upgradation under MACP-III in the Grade Pay of Rs. 4200 but he could not be granted the MACP-III due to the currency of penalty. Meanwhile, consequent upon the acceptance of the recommendations of 7th CPC, the CCS (RP) Rules, 2016 was introduced and his pay was revised and fixed accordingly as Rs. 39200 in Level-5.

As per penalty order, he was granted his Annual Increment on 01.07.2016 and his reduced pay was re-stored on completion of the currency of the penalty of one year without cumulative effect. Thereafter, he was granted the benefit of MACP-III on 05.12.2016 in GP 4200 {Level-6 under CCS (RP) Rules, 2016} and his pay was fixed as Rs. 43600 in Level-6. After granting Annual Increment on 01.07.2017 his pay was fixed as Rs. 44900/-.

If he had not been awarded with the penalty of reduction of pay and MACP would have been granted then his pay would have been fixed Rs. 44900 w.e.f. 01.01.2016 and after granting Annual Increment on 01.07.2016 & 01.07.2017 his pay would have been fixed Rs. 46200 & 47600 respectively. Thus he is drawing less Basic Pay (46200 – 43600=Rs. 2600 per month from 05.12.2016 to 30.06.2017, 47600 – 44900 = Rs. 2700 per month from 01.07.2017 to 30.06.2018 and so on).

This difference of basic pay will also adversely affect his Pension, Gratuity and Leave Encashment on his superannuation in the year 2025. This loss is of permanent nature whereas the imposed penalty was having the without cumulative effect. This causes financial hardships and discontentment.

This financial hardship is due to implementation of instructions contained in DoP&T O.M. No. 22034/5/2004-Estt.(D), Dated 15.12.2004 which states that since the promotion is to take effect only from a date subsequent to the expiry of the currency of the penalty, the officer would be entitled to pay fixation in the promotional grade with effect from the date of actual promotion only. Even if a junior person to him in the panel is promoted earlier, it will have no bearing on the pay to be allowed on promotion to the officer on whom a penalty was imposed, and there shall be no stepping up of his pay.

The above instruction also applies in case of granting of financial upgradation under ACP/ MACP. Hence, the hardship may be mitigated if the following is inserted/amended in the above OM dated 15.12.2004:

“The officer undergoing minor penalty (withholding of increments or reduction of pay without cumulative effect) will not be granted financial upgradation under ACP/ MACP during the currency of penalty but after completion of penalty the MACP as well as pay fixation will be granted ‘notionally’ from the date of eligibility (during the currency of penalty) and the actual financial benefit of such MACP as well as pay fixation will be granted after completion of penalty.”

You are requested to take appropriate action so that DoP&T may amend and insert as said herein above in the referred O.M. Dated 15.12.2004.
