Will the 7th CPC fulfil the demands of LDCs and UDCs?

For a number of years now, especially after the 6th CPC, the problems faced by LDCs and UDCs have started gaining prominence. The unity and sense of purpose among them makes them look all set for the kind of victory that Pharmacists had. Common sense of purpose, unity and dedication sure make success possible!

In order to decrease the number of grades, the 6th Pay Commission combined all the different grades between Grade Pay 1300 to Grade Pay 1800 into a single grade – Grade Pay 1800, thereby wiping out the entire Group ‘D’. As a result, everybody became Group ‘C’ employees. Even those who lacked the minimum education levels, illiterates and everybody else were lumped into Group ‘C’. Their Grade Pay was also raised to Rs. 1800. But, at the same time, employees working as LDCs, who have a minimum educational qualification of Class XII and also possess some technical education, were not given any upgrading. Instead, they now had to share their grade with lesser-qualified former Grade ‘D’ employees.

The next huge trouble originated from the MACP. Those who didn’t get any promotion for years are given career upgradations through MACP. LDCs who didn’t get any promotions for more than 10 years were given their next grade pay, from Rs. 1900, their pay rose to Rs. 2000. The increase of mere Rs. 100 turned out to be a huge disappointment to many. Similarly, those with Grade Pay 2400 were hoping for a jump to Grade Pay 4200, but were instead forced to upgrade with only Grade Pay 2800 as per MACP rules. That anger kept seething too, because the different is 1400.

The most important demand of the LDCs and UDCs is to upgrade the current Pay Scale-Grade Pay.

Grades are decided based on the educational qualification of the employees. An LDC possesses a minimum educational qualification of Class XII and also has some technical qualifications. The basic salary of an LDC is just Rs. 1900 + 5830 = Rs. 7730.00. They want it revised to Rs. 2400 + 7510 = Rs. 9910.

The big question is – will the 7th CPC grant this demand?

Sir,

We the undersigned employees belonging to the post of LDC/UDC are working in Farakka Barrage Project, under your kind control as well as under Govt. of India, Ministry of Water Resources beg to lay the following facts for your kind consideration and necessary appropriate action please.

01. That, most of us have joined in Govt. Service between 01-09-1984 prior to 1990 as LDC category, then our Pay Scale was Rs. 260-400/- as per 3rd CPC later on as per 4th CPC w.e.f. 01-01-1986 the Pay Scale was Rs. 950-1500/- and gradually promotional post was UDC / Head Clerk or Assistant respectively and the Pay Scale of UDC was Rs. 4000-6000/- and the Scale of Head Clerk was Rs. 5000-8000/- (Copy of Fixation of Pay or pre-revised and Revised are enclosed for ready reference).

02. The Financial Up-gradation under ACP Scheme was initially introduce in year 1999 i.e. on 09-08-1999 and as per this Scheme a Govt. servant (LDC in the instant case) with 12 years of regular service in the same post, Financial up-gradation to the next Scale of Pay Rs. 4000-6000/- in the same way the 2nd Up-gradation to the Scale of Pay Rs. 5000-8000/- was admissible after 24 years of regular service. There was no further Up-gradation in the ACP Scheme.

03. Consequent upon the recommendation of the 6th CPC and acceptance of GOI, DOPT was pleased to issue MACP Scheme vide OM NO. dated 19-05-2009 in which it was clearly indicated that the MACP Scheme will take prospective effect from 01-09-2008. It was also clearly mentioned in the OM that this order is issued in supersession of all previous orders i.e. ACP Scheme. In the OM a schedule regarding placement from one PB/GP to other upgraded PB/GP has been indicated in the Section-I, Part – A of the First Schedule of the CCS (Revised Pay) Rules 2008.

04. It is further stated that, under the modified MACP Scheme the above said two financial Up-gradation were converted into three Up-gradation as under :-

Sl. No.

Description

PB-1

Grade Pay

01

First Up-gradation on completion of 10 years of regular service

5200-20200

Rs. 2000/-

02

Second Up-gradation on completion of 20 years of regular service

5200-20200

Rs. 2400/-

03

Third Up-gradation on completion of 30 years of regular service

5200-20200

Rs. 2800/-

From the above it is evident that in the PB-1, 5200-20200 having GP Rs. 2400/- and the same PB-1 having GP Rs. 2800/- bears same and identical scale of pay, therefore placement from GP Rs. 2400/- in Pay Band 1 to GP Rs. 2800/- in same Pay Band-1, can not be termed as promotional/up-gradational benefit.

Thus granting of GP Rs.2800/- in same PB i.e. PB-1 is a cause of utter deprivation upon us from having our legitimate and lawful payments i.e. we instead of getting GP of Rs.4200/- in PB-2 is presently getting GP of Rs. 2800/- in PB-1.

In view of the above fact, it is further stated that who have joined before 01-09-1984 in various categories in the Govt. service they have got benefit second financial Up-gradation as per ACP Scheme, later on said employees are entitled for third Up-gradation as per MACP Scheme. In this connection a copy of Judgment of Hon’ble Principal Bench CAT, NewDelhi is enclosed for ready reference and kind

Therefore, we the petitioners are fervently request you to kindly process the case immediately for solving the utter discrimination caused upon us.

Hence we pray before your goodself to kindly unfurl the banner of Justice and save us from the financial crunch we are facing for.

With regards.

ALL INDIA ASSOCIATION OF ADMINISTRATIVE STAFF (NON GAZETTED) GENERAL SECRETARY TKR PILLAI PUBLISHED ON HIS OFFICIAL BLOG TODAY THAT A CASE HAS BEEN FILED FOR UPGRADATION OF THE GRADE PAY OF LDC TO Rs.2400 AND ALSO CONSIDERING TO FILE A SEPARATE CASE FOR GRANTING OF Rs.4200 GRADE PAY TO UDC…

CASE FILED

Dear friends,

A case for the upgradation of the grade pay of LDC to Rs. 2400 has been filed before the CAT Jabalpur by this Association. Since UDC is a promotion post of LDC, the grade pay of the UDC would automatically go up. However, this Association is thinking to file a separate case for granting of Rs. 4200/ Grade pay to UDCs. The case of Steno Grade III (Rs. 2400 GP) is similar to UDC and as such a mention of their name has also been made in the table submitted.

Copy of the case filed will be published in this web site in an appropriate time.

With warm greetings

ALL INDIA ASSOCIATION OF ADMINISTRATIVE STAFF (NG)
MINISTRY OF STATISTICS & PROGRAMME IMPLEMENTATION
Web site: aiamshq.blogspot.in
e-mail: aiams08@gmail.com

Hall No. 201 & 205, Vijay Stumbh,
Zone I, MaharanaPratap Nagar,

No. Assn/1/2014/GS

Dated 10/03/2014

To
The Secretary,
Ministry of Statistics & Programme Implementation,
New Delhi-110001

Sub: 1. Non implementation of cadre restructuring of Administrative Staff in NSSO Offices after long five years since start.

2. Large number of posts of Assistant is lying vacant in NSSO Offices due to not taking up the merger of the posts of Office Superintendents & Assistants after a lapse of long 8 years since 6th CPC.

3. Posts of Administrative Officers are lying vacant very long for want of recruitment rules for the post.
Sir,
This Association had written a letter to your office vide letter No. Assn/2/2012/GS Dated 23/07/2012 to apprise the inordinate delay in implementation of cadre restructuring of Administrative Staff in NSSO Offices thereby bringing you the disappointment of the Staff shouldering heavy responsibilities of Administrative Officers in the NSSO Offices retiring on the post of UDC/Assistants without getting any pay parity (copy enclosed). Thereafter, I have contacted the concerned authorities in the Ministry several times and explained the miseries of the Administrative Staff of the NSSO Offices carrying higher responsibilities without getting a matching pay scale. But despite of a lapse of 1 year and 9 months after the submission of the aforesaid letter no significant development in the implementation of the Cadre restructuring has been taken place.

It is worth mentioning here that this is the only cadre restructuring for Administrative Staff which has been initiated by the Ministry since the very inception of the NSSO. But unfortunately the maiden Cadre restructuring itself has not reached anywhere even after 5 years from its initiation.

2. Non filling of vacancies of Assistant.
Large number of posts of Assistant is lying vacant in FOD Offices where UDCs are discharging duties of Assistant in addition to their own duties as UDC without any additional remuneration and forced to retire on the post itself. FOD has informed that vacant post of Assistant is not being filled up due to the pending merger of the posts of Office Superintendent and Assistant. In the Regional Offices of FOD Office Superintendent with Gazetted status were functioning as Section Officer and DDO and on the ground a request for upgradation of the OS post to the Section Officer was made by this Association immediately after implementation of the 6th Pay Commission. But the same was not considered by the Ministry. And yet, merging of these two posts has not taken place even after 8 years of implementation of 6th CPC. This has largely affected career of the UDC and LDCs of the FOD.

3. Non filling of vacancies of Administrative Officer.
Majority of the posts of Administrative Officer, sanctioned in the FOD Offices has been lying vacant for the reason that the recruitment rule for the post of Administrative Officer has not been finalized. The initiation for change of recruitment rule for the post would have been started immediately after the implementation of the Pay Commission. But it pains to note that after 8 years of implementation of the Pay Commission the recruitment rule for the post has not been modified and due to this only reason, the person qualified to get promoted to the post of AO are suffering.

It is requested to please take a favorable action on the matter immediately.

Yours faithfully

(TKR Pillai)
General Secretary

DEPARTMENT OF EXPENDITURE DIRECTS THE MINISTRY OF STATISTICS & PROGRAMME IMPLEMENTATION TO SEND PROPOSAL FOR UP-GRADATION OF GRADE PAY OF LDC & UDC TO THEM

Dear members/friends,

Department of Expenditure (DoE) vide OM No. 58(2)/E.III(B)/2014 dated 18th February, 2014(enclosed) has forwarded the letter/documents demanding upgradation of the grade pay of LDC & UDC to Rs. 2400 & 2800 respectively, to the Financial Adviser, Ministry of Statistics & Programme Implementation(MoS&PI) with a direction to examine the representations and forwarding the same to DoE for consideration in the form of a proposal, through IFD.

In this respect, this Association has already made it clear that the LDC & UDC issue is a clear anomaly aroused due to the discriminatory recommendation/implementation of the 6th Pay Commission and the same is to be rectified as an anomaly and not as a cadre restructuring. As has already informed you that this Association has decided to file a case in the CAT by 1st week of March for getting implemented the upgradation from the date of implementation of the 6th CPC and the preparation for the same is in full swing. However, since the DoE has directed the MoS&PI in favour of upgradation of Grade Pay of LDC and UDC, a letter demanding implementation of the upgradation from 1.1.2006 is being sent to the Joint Secretary, MoS&PI before filing the case.

Dear friends,

I give hereunder the copy of the letter received from the Department of Expenditure on the issue of upgradation of grade pay of LDC & UDC. A similar letter addressed to FA, DoPT with copy to Shri M Krishnan, Secretary General Confederation has been posted in this web site on 30th November. Association’s view was that the LDC & UDC are common cadres and spread over the entire Government of India offices and as such upgradation in a particular Department or some Departments through cadre restructuring is not possible. As such with the support of Confederation our Association had decided to file a case so that the upgradation of Grade Pay to these cadres may get w.e.f. 1.1.2006. And the preparation for filing the case is under progress and we expect the same would be filed by 1st week of March.

OUR ACTIVITIES ON SECTIONAL DEMANDS :

ALL INDIA ASSOCIATION OF ADMINISTRATIVE STAFF (NG)
MINISTRY OF STATISTICS & PROGRAMME IMPLEMENTATION
Web site: aiamshq.blogspot.in
e-mail: aiams08@gmail.com

Hall No. 201 & 205, Vijay Stumbh,
Zone I, Maharana Pratap Nagar,
Bhopal, Dated 11/01/2013
Circular 1/2014

Dear friends,

Wish you all a very happy new year 2014

This letter is being written to inform you the latest position of the activity and also to seek your active support in some important issues which the Association intends to take up, in the interest of the employees.

1. Restructuring of Administrative Staff in NSSO Offices/filling up of the post of Assistant and Administrative Officers in FOD.

As has already been informed that the Association is in constant touch with concerned authorities in the case of restructuring of Administrative Staff of NSSO Offices and it has informed that at present the case is under consideration of Ministry of Finance/Department of Expenditure. As regards the promotion of UDC to Assistant in FOD Offices, it was informed, the case will only be taken up for consideration after merger of the posts of Assistant/Office Superintendent which is under consideration of MoS&PI. On the other hand in order to fill the vacant posts of AO, finalization of recruitment rule for the post is needed which is under consideration of DoPT.

The Association has been pursuing the matter quite a long time but no result is visibly seen and as such the GS has met the Director General, NSSO at Sardar Patel Bhawan on 08/01/14 and handed over a letter requesting his personal intervention on these issues. (copy enclosed). The DG has assured me of taking his efforts for the early settlement of these cases.

2. LDC & UDC issue:
In this respect please see the letter dated 11/01/2014 posted in our web site. On the issue, Shri M Krishnan, Secretary General Confederation has advised me to prepare seriously for filing a case in the Principle CAT immediately. He further said that the Confederation knows the genuineness of the demand, but we have to convince the importance of the issue to the Government. Simply adding this item in the Confederation Charter will not work at this later stage (at the stage of the constitution of 7th CPC). Thus, in order to convey the seriousness of the issue to the 7th CPC also, filing a case in the Court is essential as the CPC monitor all pending court cases of grievances in its own importance which ultimately would pave way for a better pay scale for the LDC & UDCs in the 7th CPC.

In view of the above this Association is intending to file a case in the Principle CAT Delhi and two Kolkata based Associations are also interested to join us. In this connection necessary documents are being collected so that the case may be filed by March 2014.

3. Issues of MTS.
Promotion of educationally qualified MTS to LDC as a onetime measure, which was put up by our Association is still under consideration of the FOD/Department. The basic issues faced by MTS in the Government of India Offices in general are being presented for discussion in the Confederation meeting before the finalization of the Memorandum for 7th CPC so that they may get a respectable minimum pay and channel for promotion.

4. Two days strike of Confederation on 12 & 13 February 2014.
All of us are aware that the pressure mounted by the Confederation through 26th July 2012 massive Parliament March and thereafter the 12/12/12 nationwide strike in which around 10 lakhs central Government employees participated, became a reason for announcement of the 7th Pay Commission by the Government. The Government has not got the expected support from the employees in the recently conducted Delhi election. Whatever may be the reason the constitution of 7th CPC is still kept pending. Meanwhile Confederation leaders approached the Department of Expenditure to ascertain the reason for the delay but no satisfactory reply has been received. The Central Executive Committee and Extended National Executive Committee meeting of the Confederation held on 9 & 10/1/14 discussed the position in detail and found that after the Parliament session- scheduled to be conducted in the First-Second week of February- the code of conduct for the next General Election will come into force. Thus, if the announcement of Constitution of 7th CPC, 50% merger, interim relief etc before the ending of the parliament session not taken place; we have to wait at least 7-8 months for such an announcement. Thus the extended National Executive meeting of the Confederation has unanimously decided to organize a 48 hour strike on 12 & 13 February so that the seriousness of the matter may be conveyed to the Government before the commencement of the parliament session.

Being an affiliate of the Confederation and also in accordance with the decision taken in the General Body Meeting of the Association to organize all the programmes called by the Confederation, we would like to serve strike notice on 21st January in support of the aforesaid strike. However, a final decision will be taken after consulting the members of Central Executive Committee of the Association.

5. Recognition of the Association:
The Ministry has informally asked us to put up the case for fresh recognition. In this respect we have already requested the Ministry to recognize the present Association. An assurance for not nominating any Group B member for JCM/OCM had also been given. Thus the case for recognition is being sent again for consideration.

6. Financial Position:
Contribution of the members has not been deducting from the Pay roll for the last 3 years on the argument that the Association is not recognized. Several Associations without proper recognition are functioning in various offices of Government of India where units collect funds from the members and send to the Association to meet the day to day expenses, till the recognition of the Association.

Since the issues taken up by us are in its final stage and every break in the activity at this stage will affect detrimentally as regards the finalization/implementation of such issues are concerned. And as such I am continuously spending money from my own pocket for the smooth running of the activity and you have been informed the fact through our previous circulars and was requested all of you to collect funds at unit level to meet the immediate expenses of the Association. But nobody has taken it in its own seriousness and no funds have been received so far. As a result the outflow for the purpose of Association from my pocket swelled to around Rs. 50000/.

It is once again requested to please send collection to the Association to meet the immediate expenses.

With warm regards
Yours Sincerely

(2) Merger of the posts of Office Superintendent and Assistant in FOD Offices.
(3) Promotion of Assistant and Administrative Officers in FOD Offices.

Sir,

It is submitted that the Cadre restructuring of the Administrative Staff in NSSO Offices have been initiated by the Ministry in the year 2010 but implementation of the same has not been done as yet. As a result the duties of Administrative Officer with independent charges in various FOD Offices have been allocated to Assistant with 4200 Grade Pay and UDC with Rs. 2400 Grade Pay. And Assistant & UDC by even after discharging higher responsibility retires on the post itself.

2. More than 60 posts of Assistants are lying vacant to various FOD Offices simply due to the reason that the merger of OS and Assistant has not been taken place. The implementation of Sixth Pay Commission has taken place in the year 2008 but the defect arisen in the implementation of Grade pay to Office Superintendent and Assistant is still persists. Merger of these posts has not been taken place till date and as a result the UDCs are retiring on the post without getting promotion to the post of Assistant.

3. More than 10 posts of Administrative Officers are lying vacant in FOD Offices due to the simple reason that the recruitment rule for the post is not finalized.

FOD has informed that all these cases have already been sent to the Ministry of Statistics.

On the above matters, we request your kind personal intervention for an early settlement/implementation.

Yours faithfully

As published by ALL INDIA ASSOCIATION OF ADMINISTRATIVE STAFF (NON GAZETTED):-

LDC-UDC ISSUE: DEPUTY SECRETARY JCA WRITES TO UNDER SECRETARY CS-II, DOP&T

Dear friends,

I am posting a letter addressed to Shri K Suresh Kumar, Under Secretary, CS II Section, DoPT returning the proposal for the upgradation of Grade pay of LDC and UDC on the ground given therein. This letter was not attached with the original documents while returning the case to the Association by the CS II. Shri Bipin Kumar Pandey has obtained this letter through RTI and forwarded to me through e-mail.

In para II it is stated that no anomaly item related to the upgradation of the grade pay of LDC and UDC is pending with the National Anomaly Committee. The matter was discussed with Shri S.K. Vyas, who representing the Confederation in the National Anomaly Committee. Shri Vyas has informed me that 11 additional items including item related to the LDC & UDC, have been admitted for discussion in the National Anomaly Committee. Shri Vyas further said that the assurance of taking up these items in the final meeting of the National Anomaly Committee was given to the Staff Side. But any initiative to conduct the final meeting of the NAC has not been come up from the side of the Government. Thus the statement given by the Deputy Secretary (JCA) is not in match with the statement of Shri Vyas, Member NAC.

It is to be noted that in Para IV the Deputy Secretary suggested the CS II to take up the upgradation work of the Grade pay of LDC & UDC in consultation with the Department of Expenditure which itself speak the genuiness of the issue.

Office Memorandum

Sub: Upgradation of Grade Pay of LDC and UDC in the Administrative branch of Government of India Offices.

The undersigned is directed to refer to CS II ID No. 25/2/2013-CS. II (B) dated 13/08/2013 relating to PMO ID No. 4/3/2013-PMP4/67682 dated 15.07.2013 on the subject mentioned above.

It is noted that the General Secretary of All India Association of Administrative Staff (NG) has demanded revision of Grade pay of LDCs and UDCs in the Administrative branch of Government of India. This is not an issue of anomaly and no such item was before the National Anomaly Committee.

In this regard it may be noted that the Sixth Central Pay Commission had recommended a hierarchical structure and revised pay scales for the Central Secretariat in Para 3.1.9 of its report. A similar recommendation in respect of Non-Secretariat Organization had been made in Para 3.1.14 of the report. Sixth CPC has granted parity in hierarchical structures and revised pay scales to posts existing in the Central Secretariat and Non-Secretariat Organizations up to the level of Assistant. Accordingly, Sixth CPC granted identical revised pay structures to LDCs, UDCs and Assistants both in Central Secretariat and Non-Secretariat Organizations.

Accordingly, the demand of the All India Association of Administrative Staff(NG) for the revision of the Grade Pay of LDCs and UDCs in the Administrative branch of the Government of India is required to be considered by the CS II Division (which deals with the LDCs and UDCs of CSCS) in consultation with the Department of Expenditure who are the nodal Ministry in respect of CCS (Revised Pay) Rules, 2008. JCA Section has no role in this issue.

This reference in original is accordingly returned to CS-II Division for action as appropriate.
