<p>G.S.R. 350(E).- In exercise of the powers conferred by sub-section (2) of section 13 read with clause (b) of section 36 of the Administrative Tribunals Act, 1985 (13 of 1985), the Central Government hereby makes the following rules to amend the Central Administrative Tribunal (Salaries, allowances and conditions of service of the officers and employees) Rules, 2017, namely:-</p>



<p>1. <strong>Short title and commencement.</strong>&#8211; (1) These rules may be called the Central Administrative Tribunal (Salaries, allowances and conditions of service of the officers and employees) Amendment Rules, 2020.</p>



<p>(2) They shall come into force on the date of their publication in the Official Gazette.</p>



<p>2. <strong>In the Central Administrative Tribunal (Salaries, allowances and conditions of service of the officers and employees) Rules, 2017, in the Schedule, </strong>&#8211;</p>



<ul class="wp-block-list"><li>in column (2), against serial number 15, for the words “Assistant”, the words “Assistant Section Officer” Shall be substituted;</li><li>in column (2), against serial number 26, for the words “Upper Division Clerk”, the words “Senior Assistant” shall be substituted;</li><li>in column (2), against serial number 29, for the words “Lower Division Clerk”, the words “Junior Assistant” shall be substituted.</li></ul>

<p>Action taken report on the minutes of the standing Committee National Council JCM held on 03.05.2017</p>
<p>Minutes &#8211; Reacting to the comment made by the official side, the staff side pointed out that prima-facie, on introduction of computerized functioning in almost all departments, the functions assigned to LDCs have become redundant.</p>
<p>Decision &#8211; What is required is to get the report from each department and take a conscious decision, as LDC is a common category.</p>
<p><strong>Report of the Ministry of Railways (OM dated 01.12.2017)</strong></p>
<p>In view of functional requirement of Ministry of Railways (Railway Board) and promotional aspects of MTS, proposal to abolish and upgrade all posts of LDCs (LDC now as Junior Secretariat Assistant) to UDCs (now called as Senior Secretariat Assistant) may not be recommended and besides this, RBSCS is patterned on the lines of the CSCS and the existing system is working well, unless there is any change in CSCS, no change is desirable in RBSCS. 7th CPC has also not provided upgradation of to LDCs; therefore to abolish and upgrade all posts of LDCs to UDCs is considered not feasible.</p>

<blockquote class="tr_bq"><p><b>Points to be taken into consideration while finalizing the 7th Pay Commission Report :-</b></p></blockquote>

<p>The demand of the Staff Side to fix the minimum pay to that of Rs. 26,000/- has been completely rejected by the 7th CPC and has arbitrarily fixed the minimum pay as Rs. 18000/, The 7th CPC has mutilated the formula for fixing the minimum wage. The minimum wage recommended amounts to a meager increase of Rs. 2250 from the existing minimum pay of Rs. 7000 + 8750 (125 % DA as on 1.1.2016). From this minimum pay of Rs, 18000/-, as per the recommendation of the 7th CPC itself Rs. 1500/- will be recovered for CGEIGS and 10 % i. e Rs.1800/- will be recovered towards New Pension Scheme from the employees recruited after 1.1.2004 and 6% towards GPF contribution from the employees recruited prior to 1.1.2004 resulting in minus or a very meager  benefit for the low paid employees.</p>

<p>While the minimum wage is fixed as Rs. 18000/- the Secretary level officers are given a huge hike of Rs. 2,25,000 and the Cabinet Secretary’s salary is fixed as Rs. 2,50,000. The ratio between minimum pay and the maximum pay should be not more than 1: 8, the 7th CPC has kept the ratio as 1: 13.88.   The public at large is misled by the statement that a hike of Rs 23.5% is granted to Central Government employees where as the actual increase is only  3 to 4 % as per the calculation given below</p>
</div>
<h3 data-blogger-escaped-style="text-align: left;"><span style="text-decoration: underline;">Calculation of Pay and allowance for the month  of January 2016 as per  Sixth CPC is given below:</span>&#8211;</h3>
<p>Basic Pay Pay = PB Rs.5200 + GP Rs.1800 = Rs.7000/-</p>
<p>Assuming DA 125% as on 1.1.2016 = Rs. 8750/-</p>
<p>(Since he is staying in Quarter) HRA = Nil</p>
<p>T.A. = 600 + DA = Rs. 1350/-</p>
<p><b>Total Gross Amount =Rs. 17100/-</b></p>
<p><b><span style="text-decoration: underline;">Deductions:</span></b></p>
<p>NPS 10% of basic Pay + DA =  Rs. 1575/-</p>
<p>CGEGIS = Rs.    30/-</p>
<p><b>Total Deductions = Rs.  1605/-</b></p>
<p><b>Net Pay (6th CPC) =Rs. 15495/-</b></p>
<h3 data-blogger-escaped-style="text-align: left;"><span style="text-decoration: underline;">Calculation of Pay and allowance for the month  of January 2016 as per  Seventh CPC is given below:-</span></h3>
<p>Basic Pay Pay = Rs.18000/-</p>
<p>7th Pay Commission DA as  on 1.1.2016 = Nil</p>
<p>(Since he is staying in Quarter) HRA = Nil</p>
<p>T.A. = 600 + DA = Rs. 1350/-</p>
<p><b>Total Gross Amount =Rs. 19350/-</b></p>
<p><b><span style="text-decoration: underline;">Deductions:</span></b></p>
<p>NPS 10% of basic Pay =  Rs. 1800/-</p>
<p>CGEGIS (as per 7th CPC recommendation) = Rs.   1500/-</p>
<p><b>Total Deductions = Rs.  3300/-</b></p>
<p><b><br />
</b> <b>Net Pay (7th CPC) =Rs. 16050/-</b></p>
<p><b>The Benefit out of 7th Pay commission is (16050 – 15495) only Rs. 555/- which is 3.2 % of the gross pay of 6th CPC.</b></p>
<p>The minimum wages should be fixed at Rs. 23,100/- as per the calculation given below</p>
<p>Basic Pay Pay = PB Rs.5200 + GP Rs.1800 = Rs.7000/-   (Basic Pay)</p>
<p>100% D.A. which should be merged as per Vth CPC = Rs. 7000/-  (Dearness Pay)</p>
<p>25% DA on the above (total DA 125% &#8211; 100%) =Rs.  3500/-  (D.A.)</p>
<p>40% benefit (as given in VIth CPC) on Pay +DP =Rs. 5600/- (Fixation benefit)(*)</p>
<p>(*)(VIth CPC has given fixation benefit of  40% of the maximum of pre-revised scale)</p>
<p><b><span style="text-decoration: underline;">Total Gross Amount =Rs. 23100/-</span></b></p>
<blockquote class="tr_bq"><p><b><span style="text-decoration: underline;"> Hence the minimum benefit should be not less than 23,100/-</span></b></p></blockquote>

<h3 data-blogger-escaped-style="text-align: justify;"><b>House Rent Allowance</b></h3>
<div data-blogger-escaped-style="text-align: justify;">
<p>The House Rent Allowance has been reduced from the existing 30% to 24%, 20% to 16% and 10% to 8%. More over the 7th CPC has recommended for abolition of various allowances like small family allowance, Cash Handling Allowance and advances like festival advance, Scooter Advance etc. Instead of removing the existing anomalies in the MACP Scheme, the 7th CPC has introduced examination for granting MACP. The 7th CPC has refused to make any recommendations against the New Pension Scheme. For the 2114 spell of 365 days child care leave for women employees the leave wages will be reduced to 80%.</p>

<p><b> We demand the Allowances like Family Planning Allowance, Cash Handling Allowance, Care Taker Allowance should not be abolished.   The Advances like Scooter Advance, Festival Advance, Flood Advance should not be abolished as these are  the meager amount the low paid employees are getting to celebrate festival and other genuine purposes.  CCL should be granted for 2 years without reducing it to 80% in the 2nd year.</b></p>

<p>Benefit on promotion before the 7th pay commission is more than the amount of promotion to be given after  implementation of the 7th Central Pay Commission :-</p>

<p>Suppose an UDC get promotion to Assistant before 1.1.2016.</p>

<p>On promotion one increment in the same Level should be given   Rs. 36400/- .  As there is no pay near to that  his pay will be upgraded to 36,500/- minimum of the Pay matrix No. 6</p>

<p><b> His pay will be only Rs. 36,500/- if he get a promotion after 7th Pay Commission.</b></p>

<p><b>Hence the loss is    (41100-36500)   =   4600/- </b></p>
</div>

<p><b> It is one of the example in many cases the loss will be more than this.</b></p>
</div>

<p>Hence it is suggested that the rate of increment should be minimum 5% and on promotion 2 increment should be given otherwise there will be lot of difference in the pay of  employees who got promotion one day before the implementation of 7th Pay commission and those who got promotion after implementation of the 7th pay commission.</p>

<h3 data-blogger-escaped-style="text-align: justify;"><b>Rate of Increment shown in the Pay Matrix  is less than  3%</b></h3>
<div data-blogger-escaped-style="text-align: justify;">
<p>Please see the Pay Matrix given on page No. 89.</p>
</div>

<div data-blogger-escaped-style="text-align: justify;">
<p>          Level 2,   Index 2,   the pay is shown as 20500,  after giving an increment of 3%  it should be 21,115/-  but the next index is only Rs. 21,100/- (level 2 index 3)    next pay also should be 21115 + 633 =21748 but the next index (level 2 index 4) is only 21700/-   in Level 6 index 14 also it should be 50500 + 1515 = 52015/- whereas it is given only 52000/-.  In many places even though the increment is shown as 3%,  it is rounded off to lesser amount causing  the employees at financial  loss.  In VIth pay, while calculating increment,  commission if the last digit  is 1 or above it used to  round  off to next 10.  So here also if the amount is 10 or above it should be rounded off to the next 100.  Kindly look into the matter.</p>

<p>&#8221; A serious grievance has been made by all services that Cadre Reviews have not taken place for years together, which has resulted in great anguish and frustration among the services.  Though it is essentially an administrative matter, it has a serious impact on the status and emoluments of employees.  On account of delay in Cadre Reviews, many Central Services lag behind and that gives rise to frustration and ultimately effects governance.  We have tried to cover this issue in the appropriate chapter in this report.  Therefore, the government should take a call and give them a proper representation in the government.</p>

<p>        <b> 6.2.10   (pare No. 106) </b>  The services have contended that there is an urgent requirement for the Defence Forces to undertake periodic cadre reviews to remain current in their manpower structuring, and to enable the forces to adapt to the changing operational scenario at all times, without affecting the pyramidal structure in the services.  <b>The commission recognizes the importance of Cadre Reviews in aligning a service to the ever changing organizational needs and to maintain congruence between functional needs and legitimate aspirations of its officers.</b></p>

<p><b> 7.3.12 (page No. 170) </b>The various service Associations highlighted that in very many cadres refiews have not been carried out for long.  <b>Extant instructions are that a cadre review should be undertaken at least once in a period of five years. </b> The fact that these instructions have not been followed in many cases has bred resentment and frustration.</p>

<p>7.3.13.  The process of cadre restructuring and the reported delays affecting the genuine career aspirations of employees at all levels, was discussed with the Department of Personnel and Training (DoPT).  The department acknowledged that while the ideal periodicity is five years, in various cases, reviews are delayed due to many reasons. <b> Significant amongst these is non submission of proposals by the cadre controlling authorities. </b> As far as DOPTs concerned, the procedure as well as the templates (for proposal submission) is stated to have been well formulated and disseminated.  It was also informed that meetings of the Cadre Review Committee (CRC) are held regularly.</p>

<p>The maiden cadre review proposal in respect of Ministerial Staff, started in the year 2003 reached nowhere.  Whereas  cadre review of Group A Officers has been processed and implemented during the corresponding period. Thus cadre review procedure for group B &amp; C staff should be implemented at the before the implementation of VIIth Pay Commission, so that our staff will be benefited.  It is therefore, urged upon the respective authority that Cadre Restructuring of Ministerial Staff in particular and Group ‘B’ &amp; ‘C’ Staff in General should be considered before implementation of 7th CPC. Otherwise the same grievances and difficulties regarding continuation of operational scenario of Ministerial job will be existed after this CPC implementation.</p>

<p>There is a huge difference in the pay scales of E&amp; AO as a specialized Gr ‘B’ Officer and other Group B Officers of Survey of India in 4th and 5th CPC.</p>
<p>The Duties of E &amp; AO is much more than that of Group &#8220;B&#8221; Gazetted Officers (Technical) of Survey of India.</p>
<p>The duties of E &amp; AO are:-</p>
<p>To function as DDO. To supervise both Establish &amp; Accounts Section of the GDC. To Assist the Director in functioning as Administrative Head and Controlling Officer of the GDC/Directorate, etc. The Grade Pay of Section is Rs. 4800/- as per 6th Pay Commission. There are many Section Officers (Office Suptds.) are working under E &amp; AO.</p>
<p>Hence the grade pay recommended by 6<sup>th</sup> CPC for E &amp; AO is not correct. The Grade Pay of E &amp; AO should be 5400/- considering the duties and responsibilities allotted to him/her.</p>
<p>As per VIIth Pay Commission report Para No. 7.1.4 (Page No. 140), the Grade Pay of Section Officer is a promotion post for Assistant (GP 4600). Initially on promotion, the SO is at GP 4800 and after four years is entitled to a non-functional upgrade to GP 5400 (PB-3), effectively two level higher.</p>
<p><b> As per VIIth pay commission report Para No. 11.27.19 (ii) page No. 684, the Superintendent of Income Tax are getting the Grade pay of Rs. 4600/-. There are many Office Superintendents working under an E &amp; A.O. Hence it is suggested to consider to upgrade the Grade of Rs. 5400/- to E&amp; AO. </b></td>

<td valign="top">The duties of Office Superintendent in Survey of India is one and the same of Section Officers in other Departments. It includes supervising and checking the works of the Ministerial Section and to allot the work to the ministerial staff. Supervision of preparation of reports/returns, seniority lists/gradation list, budget estimates, audit reports, pension cases, work of cashier, internal auditing. Compilation/consolidation/monitoring and disbursement of Budget, Reconciliation, correspondence on audit paras, Data Entry and Respective Correspondence, work related to recruitment. To check the reply of legal cases/RTI caes and to ensure their timely submission. Training and guiding the junior ministerial staff, etc.</p>
<p>The Section Officers of other Departments are getting the Grade pay of Rs. 4800/-. Please refer the letter of 7th CPC regarding recruitment of staff, wherein the pay of Section Officers/equivalent is mentioned as Rs. 4800/-.</p>
<p><b> The name of Office Superintendent should be changed as Senior Section Officer in the proposed Restructuring proposal and the G.P should be determined accordingly. </b></td>

<td valign="top">As per the recommendation of 6th CPC the pay scale of Assistants was upgraded in the pre-revised scale of Rs. 6500-10500 as par with the Central Secretariat Assistants (Grade pay 4200 in the revised scale). In the meantime the grade pay of Central Secretariat Assistants has been raised from Rs. 4200/- to Rs. 4600/- but the same was not done in the case of Assistants of Survey of India. The Assistants were designated as Head Clerk before the creation of the GDCs and they were working as Section Officers in Units/field Parties.</p>
<p>Please refer the letter of 7th CPC regarding recruitment of staff, wherein the pay of Assistants are mentioned as Rs. 4600/- (copy enclosed).</p>
<p>As per VIIth Pay Commission Report page No. 145, the commission has strongly recommended parity in pay between the field staff and headquarter staff upto the rank of Assistants.</p>
<p>&#8221; <b> <i> The Commission accordingly strongly recommends parity in pay between the field staff and headquarter staff upto the rank of Assistants on two grounds—firstly the field staff are recruited through the same examination and they follow the same rigour as the Assistants of CSS and secondly there is no difference in the nature of functions discharged by both. Therefore to bring in parity as envisaged by the VI CPC, this Commission recommends bringing the level of Assistants of CSS as per with those in the field offices who are presently drawing GP of 4200. The pay of those Assistants/Stenographer who have in the past, been given higher Grade pay would be protected&#8221;. </i> </b></p>
<p><b><i> </i></b> The Assistants of Central Secretariat already got the benefit of fixing their pay with Grade pay of 4600/- and they enjoyed this benefit from 1.1.2006 to 31.12.2015 and their pay will be fixed based on this pay. In order to maintain the parity the same benefit should be extended to the Assistants of Survey of India also.</p>
<p><b>The name of Assistants should be changes as Junior Section Officer in the proposed Restructuring proposal.</b></td>

<td valign="top">The minimum qualification for the post of LDC has been changed from X to XII but the pay scale of LDC has not changed. The Grade pay for all other posts whose minimum qualification is XII is starting from 2400. For example Hindi Typist, Data Entry Operator, etc. An LDC has to do typing/data entry operation in addition to Preparation of bills, diary and despatch, file management, assistance related to reports/returns/estimates etc. Hence the grade pay of LDC should be Rs. 2400/-.</p>
<p><b>The name of UDC should be changed as Administrative Assistant Grade II in the proposed Restructuring proposal.</b></td>

<p>7th Pay Commission has turned down the genuine issue of LDC &amp; UDC on the ground that the government has stopped direct recruitment for the clerical cadre and gradually phasing out the existing incumbents( Please see Para 11.22.100, Para 11.52.32, Para 11.52.32,. Para 7.7.37 &amp; 11.35.28).  Issuing of such an order without the knowledge of Staff side may not be possible. Thus reason given for rejection of the demand is not convincing.</p>

<p>Besides Confederation/Staff Side JCM, several Departments had recommended upgradation of grade pay of LDC &amp; UDC of Administrative Offices especially the LDC&amp; UDCs of subordinate offices of Government of India.</p>

<div data-blogger-escaped-style="text-align: justify;">
<p>But the fact is that Staff Selection Commission is frequently conducting recruitment for the post of LDC. Combined higher secondary examination for the selection of LDC also has been conducted recently. Moreover, no alternative recommendation to replace the LDC post is given in the report.  It is to be noted that the normal ratio of LDC and UDC in subordinate offices is 3:1 and thus LDCs have been allocated responsible sections and in many smaller offices LDC alone is handling the work of entire Administration.  The direction set in the recommendation of the Commission is to contractorise all the Administrative posts below the post of Assistants. This should be prevented at any cost and a respectable pay scale for LDC &amp; UDC should be ensured. Without the active support of the Confederation/JCM this cannot be done.</p>
</div>

<h3 data-blogger-escaped-style="text-align: justify;">LDC &amp; DATA ENTRY OPERATOR</h3>

<p>On the other hand rejecting Central Secretariat Clerical service demand of parity with DEO (Grade Pay 2400), the commission observes “Even though the entry requirements are similar, historically the pay scales of the two posts have been different. Besides, they comprise two distinct cadres with different set of roles and responsibilities. Hence, the demand for parity of pay of LDC with DEOs cannot be acceded to by the Commission.”(Para 11.35.38).</p>

<p>Historically these cadres may be different set of roles but the fact is that functions of LDC are more complex than that of DEO and same was brought before the commission by various Associations/Administrative Authorities. Earlier pay Commissions have fixed Pay Scale to DEO considering their work on computer. But today LDCs are selected on the basis of their expertise in computer operation also.</p>
</div>

<p>As you know, in subordinate offices DoPT manual is not followed for allocating work to LDCs there.  In order to bring the reality, some comments among the hundreds of comments posted in our web site/received through e-mail is given in annexure I, II &amp; III. Please go through it.</p>

<h3 data-blogger-escaped-style="text-align: justify;"><b>  Parity of pay of Assistant/Stenographers with Central Secretariat.</b></h3>

<p>Sixth Pay Commission has recommended parity for Assistant of subordinate offices with the Assistants of Central Secretariat and recommended Rs. 4200 grade pay for the genuine reason given in its report. But while implementing the report, grade pay of Assistant of Central Secretariat has been increased to Rs. 4600. All the Associations/Federations including this Association had demanded parity of pay of these cadres with Central Secretariat. JCM Staff Side through its memorandum had demanded parity with the Assistant/Stenographers of Central Secretariat. But in place of increasing the grade pay of Assistants/Stenographers of Subordinate offices, the Pay Commission has reduced the grade pay of Central Secretariat Assistant/Stenographers (Para 7.1.4(J). While implementing 7th Pay Commission Report, Government may not accept the degradation of the grade pay of the cadres of Central Secretariat. Thus necessary action to keep the Grade Pay (4600) of Assistant/stenographers of Subordinate offices including NSSO Offices at par with their counterpart at Central Secretariat is required.</p>
</div>

<p>The Assistants of Central Secretariat have  already got the benefit of fixing their pay with Grade pay of 4600/- and they enjoyed this benefit from 1.1.2006 to 31.12.2015 and their pay will be protected as per the recommendations of the 7th Pay Commission Report.  In order to obtain the parity between the Assistants of Central Secretariat and Field offices,  the  benefit of fixing their pay with a Grade pay of Rs. 4600/- from 1.1.2006 to 31.12.2015 should  be extended to the Assistants of Survey of India also.</p>

<p>Similarly, the Non Functional Selection Grade granted to the UDCs of Central Secretariat has also been withdrawn by the 7th CPC in its report (Para 7.1.4(J). Our demand is that the NFSG may be restored and the benefit of the same should be extended to the UDCs of subordinate offices also.</p>
</div>
<h3 data-blogger-escaped-style="text-align: justify;"><b> Grant of MACP on Promotional Hierarchy:</b></h3>
<div data-blogger-escaped-style="text-align: justify;">
<p>The report of the Commission is confusing and contradictory. Please see Para 5.1.12, 5.1.44, 7.4.8, 74.13, 11.52.45 etc. The Pay Commission has drafted MACP recommendation to fool the employees and giving benefit to Government.  MACP should be granted on hierarchical scale, if both Levels are same it should be given in the immediately next level.</p>

<h3 data-blogger-escaped-style="text-align: justify;">Transport Allowance</h3>

<p>In A1 cities the employees crossed the limit of Pay Rs. 7440/ in pay band 5200-200200 was getting transport allowance Rs. 1600+DA. But 7th CPC has recommended only Rs. 1350 for these employees. The disparity is to be removed.</p>

<h3 data-blogger-escaped-style="text-align: justify;">Abolition of interest free advance:</h3>

<p>Pay Commission has recommended abolition of 12 advances including, Festival Advance, LTC Advances, Tour/Tr TA Advance Medical Advance etc. This will affect the touring staff and low paid employees. If this recommendation is accepted, no low paid employee can avail LTC.</p>

<h3 data-blogger-escaped-style="text-align: justify;">Abolition/Reduction of Care Taking Allowance</h3>

<p>As per recommendation contained in Para 8.3.23 of the 7th CPC report, the present care taking allowance has been abolished and in place Extra Work Allowance at  a  uniform rate of 2  percent  of Basic Pay per month. This will affect detrimentally to the caretaking work in various NSSO Offices especially in FOD Offices where permanent care takers are not appointed and the person assigned the duties of caretaking are doing heavy responsibilities.</p>

<p><strong>LDC-UDC ISSUE-GOVERNMENT STAND REITERATED</strong></p>
<p>On the issue of LDC/UDC 7th Pay Commission reiterated the deceiving stand of the Government. Despite of realizing the issue as genuine, Government had not taken a positive decision at their level. The tens of thousands of LDC &amp; UDC, solely responsible for the smooth running of many of the subordinate offices, were hoping that 7th Pay Commission will study the problem faced by them and take a positive decision. Staff Side JCM having convinced the importance of the issue, had also recommended merger &amp; upgradation of the Grade Pay of LDC &amp; UDC to Rs. 2800. But here we see that 7th Pay Commission has not taken any decision on the issue except giving some confusing and misleading statements to vindicate the stand taken by the Government as true. Extracts of some of their views on LDC UDC issue spread over various chapters of the reports is given below:</p>
<p><strong>Higher GP 2400 to LDC and consequent upgradation of pay for other civilian posts in the Ministerial hierarchy.</strong></p>
<p>11.22.100 The Academy has urged that LDC should be placed in higher GP 2400 as against the existing GP 1900 at par with grade pay of Data Entry Operator (DEO), on the grounds that both LDC and DEO enter service on the basis of same educational qualification i.e., Class XII and that the functions of LDC are more complex than that of a DEO. This issue has been dealt in Chapter 7.7. Recommendations made there would apply in this case also.</p>
<p>11.52.32 They have demanded upgradation in pay of certain category of non-industrial posts viz., LDC, UDC, Accountant, Junior Head Clerk, Head Clerk, Office Superintendent and Assistant Manager (Admin).</p>
<p><em><strong>Analysis and Recommendations</strong></em><br />
11.52.33 The Commission has not received the views of the ministry/department on the issue. However, posts like LDC, UDC, Accountant are common to a number of ministries/ departments. Recommendations regarding their pay are contained in Chapter 7.7 and Chapter 11.35. The Commission does not find any justification for increase in pay scale of the other cadres.</p>
<p>But in Chapter 7.7 no direct recommendation except to decline the demand of LBSNAA to increase the promotional quota of MTS to LDC, is visible. The extract of Para 7.7.37 is give below:</p>
<p><em><strong>Analysis and Recommendations</strong></em><br />
7.7.37 Looking at the qualification requirements and their job profile, the Commission does not recommend any changes in the pay structure or the promotional prospects of the MTS. Regarding MTS in Delhi Police, the Commission is of the view that since MTS is a common category, any special dispensation to MTS in Delhi Police is not justified. In so far as the MTS of LBSNAA are concerned, the Commission notes as per the recruitment rules for LDC, presently only 5 percent of MTS can get promoted to LDC through limited departmental examination. However, since the government has stopped direct recruitment for the clerical cadre and gradually phasing out the existing incumbents, their demand cannot be accepted.</p>
<p><strong>LDCs</strong><br />
11.35.27 There are demands that 50 percent posts of LDCs be earmarked for filing up by promotion/departmental examination by MTS. It has been argued that the educational qualification for the post of MTS is Class X and they are recruited through SSC for performing the work of Peon, Mali, Cobbler, and Sweeper etc. Since most of the MTS join the post with higher qualification of Higher Secondary and Graduation, there is high rate of attrition in the MTS cadre.</p>
<p><em><strong>Analysis and Recommendations</strong></em><br />
11.35.28 As per the recruitment rules for LDC, presently 5 percent of MTS can get promoted to LDC through limited departmental examination. Since government has already stopped direct recruitment for the clerical cadre and gradually phasing out the existing incumbents, this demand cannot be accepted. Moreover enhancement of promotional quota is an administrative matter to be considered by the relevant<br />
administrative ministry.</p>
<p>Between the lines it can be read that the Government prevented the 7th Pay Commission to not consider the LDC/UDC issue positively and reiterated the wrong statement of the Government that that Government of India has stopped direct recruitment of LDC through Staff Selection as its recommendation. But the fact is that Staff Selection Commission is frequently conducting recruitment for the post of LDC and without the permission of the Government how they can done at their own. Combined higher secondary examination for the selection of LDC also has been conducted recently. If we take the intention of Government of phasing out the LDC post as true, then where is the alternative recommendation? Who will do the arduous work done by the young and energetic LDCs in the subordinate offices? It is to be noted that the normal ratio of LDC and UDC in subordinate offices is 5:2 and thus LDCs have been allocated responsible sections and in many smaller offices LDC alone is handling the work of entire Administration.</p>
<p>On the other hand rejecting Central Secretariat Clerical service demand of parity with DEO the commission observes “Even though the entry requirements are similar, historically the pay scales of the two posts have been different. Besides, they comprise two distinct cadres with different set of roles and responsibilities. Hence, the demand for parity of pay of LDC with DEOs cannot be acceded to by the Commission.”(Para 11.35.38).</p>
<p>Our view is that historically these cadres may be different set of roles but the fact is that functions of LDC are more complex than that of DEO and same was brought before the commission by various Associations/Administrative Authorities. Earlier pay Commissions have fixed Pay Scale to DEO considering their work on computer. But today LDCs are more expertise in computer than DEO for doing work in computer, but the demand of parity with DEO is rejected. Extract of Para 11.35.38 is given below:</p>
<p><strong>Central Secretariat Clerical Service</strong><br />
11.35.38 The Central Secretariat Clerical Service (CSCS) consists of the following grades:<br />
i. Upper Division Clerk (GP 2400)<br />
ii. Lower Division Clerk (GP 1900)<br />
LDC and Data Entry Operator (DEO)<br />
11.35.39 It has been demanded that LDC of CSCS drawing pay in GP 1900 be placed in GP 2400 at par with the DEOs on the grounds that post VI CPC, the entry requirements for the two posts is almost similar.</p>
<p><em><strong>Analysis and Recommendations</strong></em><br />
11.35.40 Even though the entry requirements are similar, historically the pay scales of the two posts have been different. Besides, they comprise two distinct cadres with different set of roles and responsibilities. Hence, the demand for parity of pay of LDC with DEOs cannot be acceded to by the Commission.</p>
<p>From the above it is clear that Government is adamant on not granting pay scale to LDC &amp; UDCs in subordinate offices at par with the duties assigned to them. Even though the 7th CPC claimed that they have recommended pay scales on the principle of equal pay for equal work, the genuine issue of LDC/UDC is ignored. Thus we are forced to represent against the recommendation to the Government/JCM (Staff Side). All our LDC/UDC friends are requested to raise the issue in their respective Association/Office to force them to represent the issue to the implementation committee for consideration. Also please join all action programmes including strike action, called by the JCM (Staff Side), as published in this web site from time to time, to combat the situation.</p>

<p style="text-align: center;"><strong>CHANGE OF NOMENACLATURE OF LDC &amp; UDC IN CENTRAL SECRETARIAT</strong></p>
<p>DOPT HAS DECIDED TO CHANGE THE NOMENCLATURE OF LDC &amp; UDC OF CENTRAL SECRETARIAT OFFICES. BUT NOTHING IS HEARD IN RESPECT OF CHANGE OF NOMENCLATURE/MERGER OF LDCS AND UDCS OF SUBORDINATE OFFICES. IT IS TO BE NOTED THAT IMMEDIATELY BEFORE THE FINALIZATION OF 6TH PAY COMMISSION REPORT, GOVERNMENT HAD UPGRADED THE PAY SCALE OF THE ASSISTANT IN CENTRAL SECRETARIAT FROM RS. 5500-9000 TO 6500-10500 THAT PAVED THEM TO GET AN EDGE OVER THE PAY OF THE ASSISTANTS OF SUBORDINATE OFFICES. LIKEWISE IT MAY BE A MOVE TO GIVE MORE BENEFITS TO THE LDC &amp; UDCS OF CENTRAL SECRETARIAT IN 7TH CPC.</p>
<p>IT IS TO BE NOTED THAT THIS ASSOCIATION HAS CONTINUOUSLY RAISING THE MERGER AND UPGRADATION OF GRADE PAY LDC &amp; UDC. THE CASE WAS SENT TO JCA SECTION WITH RECOMMENDATION BY THE DOPT BUT THE JCA RETURNED THE SAME TO DOPT WITH A REMARK THAT “<strong>THIS IS NOT AN ISSUE OF ANOMALY AND NO SUCH ITEM WAS BEFORE THE NATIONAL ANOMALY COMMITTEE”</strong> AND SUGGESTED THAT ESTABLISHMENT II MAY PROCESS THE CASES WITH THE CASE OF LDC &amp; UDCS OF CENTRAL SECRETARIAT IN CONSULTATION WITH THE MINISTRY OF FINANCE. BUT DOPT HAS RETURNED THE CASE TO THIS ASSOCIATION WITH A DIRECTIVE TO TAKE UP THE SAME WITH MINISTRY OF FINANCE DIRECTLY.</p>
<p>IT IS WORTH TO MENTION HERE THAT <strong>JCA HAD RETURNED THE CASE WITH A PLEA THAT THIS IS NOT AN ISSUE OF ANOMALY AND NO SUCH ITEM WAS BEFORE THE NATIONAL ANOMALY COMMITTEE. WHEREAS ON 9TH JUNE WHEN THE LAST MEETING OF THE NATIONAL ANOMALY COMMITTEE HELD, ITEM NO. 4 –”UPGRADATION OF PAY BAND AND GRADE PAY OF LDCS AND UDCS” WAS DISCUSSED. WHEN THERE WAS NO ITEM WAS PENDING WITH THE JCA, THEN HOW THIS ITEM SURFACED IN THE ANOMALY COMMITTEE MEETING</strong>. SIMILARLY THE CONCERNED OFFICER IN DOPT HAD ORALY INFORMED ME THAT THE CASE OF LDC &amp; UDC WAS RETURNED BECAUSE HIS SECTION IS DEALING THE CASES OF LDC &amp; UDC OF CENTRAL SECRETARIAT ONLY AND THE LDC &amp; UDC OF CENTRAL SECRETARIAT HAD NOT DEMANDED THEIR PAY UP-GRADATION.</p>
<p>THE STATE OF LDCS POSTED IN SUBORDINATE OFFICES HAD DISCUSSED IN THIS WEBSITE SEVERAL TIMES. THEY ARE ALLOCATED WITH WORK WORTH TO BE ALLOCATED TO UDC/ASSISTANT AND IN MOST OF THE CASES OFFICERS ARE TAKING DECISION ON THE FILE PUT UP BY THE LDCS WHERE AS IN CENTRAL SECRETARIAT SUCH FILES INITIATES BY UDC/ASSISTANT LEVEL. THUS IT IS HIGH TIME THE GOVERNMENT SHOULD TAKE A DECISION ON THE UPGRADATION OF GRADE PAY AND NOMENCLATURE OF LDC &amp; UDCS WORKING IN THE SUBORDINATE OFFICES BEFORE THE FINALIZATION OF PAY COMMISSION REPORT.</p>

<p>Subject: <b>Continuation of ad-hoc appointment in the grade Of UDCs of CSCS -reg.</b></p>
<p>The undersigned is directed to refer to this Department’s O.M of even number dated 9th January, 2015 on the subject mentioned above, vide which Cadre Units were permitted to continue ad-hoc appointments in the grade of UDCs up to 30/06/2015. Further continuance of these appointments has been reviewed in this Department and it has been decided that the period of the ad-hoc appointment of those LDCs of CSCS who are working as UDCs of CSCS on ad-hoc basis may be extended upto 31.122015 or till they are appointed on regular basis, whichever is earlier.</p>
<p>2. Continuance of ad-hoc appointment shall not confer on the appointees any right to continue in UDC Grade indefinitely or for inclusion in the Select List of UDC of CSCS or to claim seniority in UDC Grade Of CSCS.</p>
<p>3. Other terms and conditions mentioned in the relevant OMs will remain unchanged.</p>

<p><strong>NAC Meeting today : Upgradation of Pay for LDC and UDC will be discussed</strong></p>
<p>The Secretary, NCJCM Staff Side has already informed that a meeting NAC will be held after the final Meeting of NCJCM with 7th Pay Commission. Accordingly the DOPT is holding the National Anomaly Committee Meeting today at 3.00 PM at New Delhi. The office Memorandum issued to all Staff Side Members 0f The National Anomaly Committee stated that..</p>
<blockquote><p><em>“In continuation of meeting held on 29/5/2015 the next meeting of the National Anomaly Committee is scheduled to be held under the Chairpersonship of Joint Secretary (Establishment) on 9th June, 2015 at 3.00 P.M. in the Conference Hall (Room No. 190) North Block, New Delhi. Agenda Notes for the meeting as suggested by the Staff Side are enclosed.</em><br />
<em> All the concerned are requested to kindly make it convenient to attend the meeting.”</em></p></blockquote>
<p>The agenda points finalized for discussion in the NAC meeting</p>
<p>There are 12 Items listed in the Agenda Notes for Discussion ,</p>
<p>At Item Number 4 the issue of Upgradation of Pay Band and Grade Pay of LDC, UDCs and stenographers Gr.III In Subordinate offices is included for discussion. it is established in the point that LDCs may be placed in PB-i with Grade Pay of Rs.2800 and UDCs may be placed in PB-2 with Grade Pay of Rs.4200</p>
<p><strong>ITEM No.4 : Upgradation of Pay Band and Grade Pay of LDC, UDCs and stenographers Gr.III In Subordinate offices.</strong></p>
<p>Group ‘D’ employees have been placed in PB-I with Grade Pay Rs. 1800 and entry qualification now prescribed in Matriculation.</p>
<p>LDC/UDCB have been assigned the same PB-I with Grade Pay of Rs. 1900 and Rs. 2400.</p>
<p>Assistants and Stenographers of Central Secretariat who were in the pre revised pay scale of Rs.5500-9000 PB-2 with Grade Pay of Rs. 4200 has been granted upgraded pay scale in PB-2 with Grade Pay of Rs.4600 with retrospective effect from 1.1.2006. (0M dated 17.11.2009).</p>
<p>The result is that vertical relativity between Group ‘D’ and LDCs has been drastically reduced on the one hand and on the other vertical relativity between UDC sand Stenographer Gr.III of subordinate offices vis a vis the Assistants and Stenographers of Central Sectt. has been widened. In both way the relativities vis-à-vis Group D’ and LDCs and vis-à-vis UDCs/Stenographer III and Assistants have been disturbed without assigning any reasons therefore.</p>
<p>With a view to maintain the well established relativities it is proposed that LDCs may be placed in PB-i with Grade Pay of Rs.2800 and UDCs may be placed in PB-2 with Grade Pay of Rs.4200.</p>

<p style="text-align: center;"><strong>OFFICE MEMORANDUM</strong></p>
<p>Subject :- <strong>Promotion of LDC as UDC of Central Secretariat Clerical Service (CSCS) on ad hoc basis-continuance of Ad-hoc appointment regarding.</strong></p>
<p>The undersigned is directed to refer to this Department’s O.M of even number dated 3rd July, 2014 on the subject mentioned above, vide which Cadre units were permitted to continue ad-hoc appointments in the grade of UDCs up to 31.12.2014. Further continuance of these appointments has been reviewed in this Department and it has been decided that the period of the ad- hoc appointment of those LDCs of CSCS who are working as UDCs of CSCS on ad-hoc basis may be extended up to 30.06.2015 or till regular UDCs become available, whichever is earlier.</p>
<p>2. Continuance of ad-hoc appointment shall not confer on the appointees any justify to continue in UDC Grade indefinitely or for inclusion in the Select List of UDC of CSCS or to claim seniority in UDC Grade of CSCS.</p>
<p>3. Other terms and conditions mentioned in the relevant OMs will, remain unchanged.</p>
<p>4. Copies of the order along with the details of the officials (date of birth, date of Joining, Rank No., Select List Year, etc) may be endorsed to this Department for record.</p>

<p>UNIFORMITY Citing ‘equal pay for equal work’ principle, Delhi High Court tells Centre to grant pay parity to ordnance factory employees</p>
<p>Employees at Ordnance Factories (OF) – who have been contesting their omission from the benefits of the sixth pay commission for over seven years have finally more than one reason to rejoice.</p>

<p>Reining in the principle of ‘equal pay for equal work’ at public offices, the Delhi High Court has directed the Centre to grant pay parity to employees in the OF with that of identically ranked official in the Central Secretariat Service (CSS) and Central Secretariat Stenographer’s Service (CSSS).</p>
<p>The direction will be applied retrospectively from 2006 — when the sixth CPC was implemented. Not only this, the HC order will come in handy for the employees of the OF when the seventh central pay commission is implemented.</p>
<p>The HC order came in response to a petition filed by Ordnance Factory Employees Association challenging the decision of the finance ministry declining their request for the assistants working in the OF Board to be given same pay scale as was given to similarly placed officials in CSS, CSSS, Ar my Headquarters, UPSC and other services.</p>
<p>The starting point of discrimination against the employees of the OF Board came soon before the acceptance of recommendation of the sixth CPC when a pay upgradation of employees of CSS and CSSS was made in September 2006.</p>
<p>While the OFs and Armed Forces Head Quarters (AFHQs) — both non-secretariat organization — were excluded from the pay upgradation, the latter took the matter to the Central Administrative Tribunal (CAT) and got an order in its favour.</p>
<p>In the case of OF Board, the central government took the view that since it was a nonattached office working outside the Secretariat, there cannot be parity of pay scales. The OF Board was denied benefit of upgradation and the replacement scales given by the sixth CPC. The CAT, too, took a similar stand and denied any relief to the OF Board.</p>
<p>The matter finally reached the Delhi HC last year and after over a year of deliberation a bench of Justice S Ravindra Bhat and Justice Vipin Sanghi termed the discrimination meted out to the OF Board as “over-classification.”</p>
<p>The HC said the discrimination was illogical and artificial. It also took note that the cadre structure of CSS and CSSS is identical to that of the OF. In all the above organisations, the cadre of upper divisional clerks (UDCs) is filled by the feeder of the cadre of the lower divisional clerks (LDCs).</p>
<p>The cadre of assistants on the OF Board is filled by promotion from the feeder cadre of UDCs with at least five years of experience on regular basis.</p>
<p>“The OF Board was treated historically as equals to CSS/CSSS employees and enjoyed equal pay and all benefits flowing from equal pay,” the high court noted adding, “This was based on the previous four instances of determinations by successive pay commissions that they performed equal work.”</p>
