<p>Enclosed please find herewith a D.O. from Secretary, Department of Legal Affairs, Ministry of Law &amp; Justice in connection with mandatory e-filing of cases/petitions by the Government in all matters from 01.01.2022. Para 3 of the D.O. calls for extending the use of ICT tools available in the local offices by the concerned Government counsels for facilitating e-filing in respect of cases pertaining to UOI.</p>

<p>You may recall that Hon’ble Dr. Justice D.Y. Chandrachud, Judge, Supreme Court of India and Chairperson e-Committee has communicated to all the Chief Justices of the High Courts on 09.10.2021 urging them to ensure that e-filing of cases/petitions by the Government in all matters is made mandatory from 1st January 2022 and that there should be no physical filing of cases by the Government in any matter thereafter.</p>



<p>2. In this context, kindly refer to my earlier D.O. letter of even number dated 03.12.2021 wherein you were requested to take necessary steps and to also ensure mandatory e-filing in respect of litigation on behalf of Union of India by your Ministry/Department. including Autonomous Bodies/ Subordinate Offices/ Attached Offices and PSUs under administrative control of your Ministry, before the Courts across India w.e.f. 1st January, 2022.</p>



<p>3. I shall be grateful if you could kindly sensitize all the concerned officers and offices under your Ministry/Department, including Autonomous Bodies/Subordinate Offices/Attached Offices and PSUs for extending the use of ICT tools available in their local offices by the concerned Government Counsels for facilitating e-filing in respect of cases pertaining to UOI. This will go a long way in bridging the technology gap and aid in the efforts of Union of India to migrate their filing in digital mode before the courts w.e.f. 01.01.2022 till the time the infrastructural facilities are augmented by the Ministry of Law and Justice.</p>

<p>Sub: <strong>Concerned Branch for Stepping of Pay on issues arising other than RSRP Rules</strong></p>



<p>The issue as to which Directorate will deal with the subject relating to Stepping up of Pay was under consideration because of ongoing differences between Directorates. The following has been decided with the approval of the Competent Authority:</p>

<ul class="wp-block-list"><li><strong>Stepping up</strong> of cases between senior and junior officials due to implementation of various provisions of different Pay Commissions would be dealt with by Pay Commission Directorate (PC-VI/PC-VII as the case may be);</li><li><strong>Stepping up</strong> of cases between senior and junior officials due to being on leave/deputation/ working on ex-cadre post by the senior employee and promotion of junior employee during this period i.e on aspects other than RSRP rules would be dealt with by F(E) Directorate.</li></ul>



<p>2. Henceforth all court cases/ RTI reference /Railway reference/ representation etc., would accordingly be handled by F(E) and PC Directorate respectively.</p>

<p>Sub: <strong>Railway Services (Revised Pay) Rules, 2016 &#8211; Clarification regarding fixation of pay under Rule 13 on promotion in various situations where feeder and promotional categories lie in same level in the Pay Matrix.</strong></p>



<p>Consequent to implementation of 7th CPC recommendations, doubts have been arisen on applicability of provisions under Rule 1313 (FR-22)(I) (a)(1) of R-II vis-a-vis Rule 13 of Railway Services (Revised Pay) Rules, 2016 in cases where certain feeder and promotional posts of Railways lie in the same/identical Level(s) in the Pay Matrix.</p>

<p>During 6th CPC pay regime, similar situations were arisen and the matter was examined in consultation with Ministry of Finance and Federations and detailed instructions were issued vide Board’s letter No. PC-VI/2011/IC/1 dated 12.09.2013 (RBE No. 95/2013).</p>



<p>In the Pay Matrix recommended by <a href="https://centralgovernmentnews.com/7th-pay-commission-latest-news/" target="_blank" rel="noreferrer noopener" aria-label="7th CPC (opens in a new tab)"><strong>7th CPC</strong></a>, only replacement scales have been recommended for the categories covered under Board’s letter dated 12.09.2013 and no changes in circumstances have been observed, therefore, the guidelines contained therein will continue to be applicable in respect of following categories :-</p>

<p>This issues with the concurrence of the Finance Directorate of Ministry of Railways. However, above have been done only on provisional basis and is subject to the concurrence of Ministry of Finance. Further, it may be ensured that before the benefit is extended, a declaration from the concerned employee may be obtained to refund the amount in case, Ministry of Finance does not agree to this proposal.</p>
