<p>Subject:- <strong>Submission of Immovable Property Return (IPR) for the year 2019 (as on 31.12.2019) by the Officers of Central Secretariat Services (CSS) reg.</strong></p>



<p>In terms of Rule 18 of CCS (Conduct) Rules, 1964, the Immovable Property Return is required to be furnished by the CSS Officers in the grade of Under Secretary and above, latest by 31 .01.2020. IPR should be submitted by all the CSS Officers through Web Based Cadre Management System which is hosted at <strong>cscms.nic.in</strong>. A copy of the print out (IPR submitted online) duly signed, should also be submitted to CS.I (PR/CMS) Section, which is the custodian of <a href="https://centralgovernmentnews.com/immovable-property-return-ipr-filing-for-the-year-2019-instructions-to-ias-officers/" target="_blank" rel="noreferrer noopener" aria-label=" (opens in a new tab)">Immovable Property Return</a> (IPR) of these Officers. <strong>Assistant Section Officers and Section Officers of CSS</strong> will also submit the print out (IPR) duly signed, to their respective <strong>Admin/ Vigilance Division</strong>.</p>



<p>Ministries/ Departments are therefore, requested that the contents of this O.M. may be widely circulated to the notice of all CSS Officers/Officials working under their respective control. They should also ensure that the IPR for the year 2019 (as on 31.12.2019) is submitted within the stipulated time by all the CSS Officers. <strong>The officers are also informed that non-submission of IPR within the stipulated date, would invite the denial of vigilance clearance for empanelment, deputation and applying to sensitive posts and assignment to training programme (except mandatory training) as the IPR status needs to be checked for the said purpose(s).</strong></p>

<p>It is, therefore, requested that all the CSS Officers may be directed to file their Immovable Property Return (IPR) for the year 2019 (as on 31.12.2019) well in time, latest by 31.01.2020, through Web Based Cadre Management System only. IPRs received beyond the stipulated date, shall not be regarded as conforming to the extant guidelines. <strong>It is also stated that the date of filing of IPR will start from 01st January, 2020 and the &#8220;Immovable Property Returns&#8221; window shall be opened/provided at cscms.nic.in. automatically from that date only.</strong></p>

<p>Subject: <strong>Closed Holidays for the year 2020 &#8211; Date for Dusshera regarding</strong>.</p>



<p>In continuation of this Department&#8217;s OM of even number dated 18-6-2019 circulating therewith List of  holidays for the year 2020, the undersigned is directed to state that some Central Government Employees Coordination Committees located in different States have sent representations for change in the date of Dusshera (Vijaya Dasami) holiday on 26-10-2020 (Monday) instead of 25-10-2020 (Sunday) in their States. </p>

<p>It is hereby informed that the decision of CGEWCCs located in different States, to declare Dussehra as closed holiday for the Central Govt. Offices on 26-10-2020 (Monday), is not in accordance with the holiday policy of the Government of India. However, Restricted Holiday on 26-10-2020 (Monday) for Dussehra (Vijay Dashmi) can be celebrated by the Central Government Offices, as specifically mentioned in DoPT&#8217;s OM NO.12/1/2019/JCA 2 dated 18.06.2019, at para 3.1 that &#8220;no change of dates is permissible in regard to festivals and dates indicated&#8221;.</p>

<p>Subject: <strong>Below Benchmark grading in ACRs prior to reporting period 2008-09 – Empanelment cases.</strong></p>



<p>Reference
 is invited to this Department 0.M. No.21011/1/2010-Est(A) dated 
13.04.2010, vide which decision of the Government was conveyed that if 
an employee is to be considered for promotion in a future DPC and his 
ACR prior to the period 2008-09, which would be recknonable for 
assessment of his fitness in such future DPCs, contain final grading 
which are below the benchmark for, his next promotion, the concerned 
employee will be given a copy of the relevant. ACR for his 
representation, if any, before such ACRs are placed before the DPC. 
Subsequently, vide D.M. of even number dated 22.05,2014, it was further 
clarified that in cases where benchmark at one level varies from a 
benchmark at another level ;post and where the ACRs prior to the period 
2008-09 are also reckonable for assessment of his fitness in any DPC 
subsequent to the next promotion (including any empanelment/financial 
upgradation), a copy of the ACR shall be given to the officer concerned,
 for representation, if any.</p>



<p>2. The matter has been 
considered in this Department with reference to empanelment for holding 
posts at the level of Joint Secretary/Additional Secretary/Secretary 
under Central Staffing Scheme (CSS). The process of empanelment under 
CSS and the process of empanelment for promotion in the cadre, are 
distinct. Unlike promotion in the cadre, where a fixed benchmark is 
prescribed, empanelment for holding posts under CSS is done on the basis
 of evaluation of ,ACRs/APARs, overall service record, vigilance status 
of officers and Multi-source Feedback from relevant stakeholders etc. as
 per the extant, guidelines in this regard. There is no pre-determined 
benchmark, as such, for empanelment under CSS.</p>



<p>3. It 
is, therefore, clarified that the provisions of DoP&amp;Ti’s D.M. 
No.21011/01/2010-Estt(A) dated 13.04.2010 are not applicable to 
empanelment for holding Joint Secretary/Additional Secretary/Secretary 
level posts under the Central Staffing Scheme. The word ’empanelment’ 
appearing in Para 2(c) of D.M. No.21011/01/2010-Estt(A) dated 22.05.2014
 implies empanelment for promotion to a cadre post and not empanelment 
for holding a post under the Central Staffing Scheme.</p>

<p>The undersigned is directed to refer to DoVI’s O.M. No. 21011/08/2013- Estt.(AL), dated 25.03.2013 and to say that references have been received with regard to leaving Head Quarters/Station while on CCL and availing LTC during CCL.</p>



<p>In this regard, it is has now been decided that:</p>



<ul class="wp-block-list"><li>An employee on CCL may be permitted to leave headquarters with the prior approval of appropriate competent authority.</li><li>LTC may be availed while an employee is on CCL.</li><li>An employee on CCL may proceed on foreign travel provided clearances from appropriate competent authorities are taken in advance.</li></ul>

<p>Subject: <strong>Introduction of SPARROW for CSCS Officials.</strong></p>



<p>The undersigned is directed to refer to this Department’s O.M. No. 22- 15/2018-CS-I (APAR) dated 1st June, 2018 wherein it was decided to extend the online recording of APAR on SPARROW to all the officials of CSCS from the FY 2018-2019.</p>



<p>2. NIC has informed that the website enabling online filing of APAR for CSCS officials has been made live and is accessible through https://sparrow-cscs.eoffice.gov.in/</p>



<p>3. The Ministries/Departments are required to send details in respect of officers to be reported upon (ORU) in the proforma annexed if not already sent to this Similarly, particulars in respect of various functionaries to perform roles of the custodian, PAR Manager, EMD may also be provided.</p>



<p>4. It may be ensured that all the ORUs have either been provided DSC or e‑sign facility for submission of online APAR on SPARROW.</p>

<p>Subject:<strong> Implementation of Government&#8217;s decision on the recommendations of the Seventh Pay Commission-Revision of rate of Training Allowance.</strong></p>
<p>In continuation of this Departments O.M. No. 13024/01/2016-Trg. Ref. dated October 24, 2018 on the subject cited above, the undersigned is directed to state that the contents of para 1 (ii) and (iii) of the said O.M. may be read as follows:</p>
<blockquote><p>Para 1 (ii): &#8216;Training Allowance will be admissible only to faculties who join the training academies/institutes/establishments for imparting training for a specified period of time and are then likely to go back&#8217;</p>
<p>Para 1 (iii): &#8216;Training Allowance will not be admissible to those permanent faculties of training academies/institutes/establishments who have been recruited directly by the training academies/institutes/establishments for imparting training&#8217;</p></blockquote>
<p>2. The concurrence of the Comptroller and Auditor General of India has also been obtained vide their UO No. 124- /03-2017/Vol.II dated July 2, 2018.</p>
<p>3. This issues with the approval of the Competent Authority.</p>

<p>I am directed to refer to the Department of Pension and Pensioner Welfare&#8217;s OM No. 38/49/16-P&amp;PW(A) dated 12th February, 2018 (copy enclosed) regarding &#8220;<strong>Revision of Provisional pension</strong>&#8220;.</p>
<p>2. The applicability of the provisions of the aforesaid OM regarding grant of Provisional Pension sanctioned under Rule 69 of the CCS(Pension) Rules, 1972 has been considered by this Department and it has been decided to make the provisions of the aforesaid Office Memorandum of Department of Pension and. Pensioner Welfare regarding &#8220;Revision of Provisional Pension&#8221; applicable mutatis-mutandis, to the All India Service Pensioners to whom provisional pension was sanctioned under Rule 6 of All India Service(Death-Cum Retirement-Benefits) Rules, 1958.</p>

<p>Sub:- <strong>Revision of provisional pension sanctioned tinder Rule 69 of the CCS (Pension) Rules, 1972</strong></p>
<p>The undersigned is directed to say that in implementation of the decision taken on the recommendations of the 7th CPC, orders were issued vide this Departments&#8217; OM No. 38/37/2016- P&amp;PW(A)(ii) dated 04.08.2016 for revision of pension of pre-2016 pensioners/family pensioners w.e.f 01.01.2016 by multiplying the pre-revised pension/family pension by a factor of 2.57. Subsequently, vide OM No: 38/37/20 I6-P&amp;PW(A) dated 12.05,2017, it has been decided that the pension/family pension of all Central civil pensioners/Family pensioners, who retired/dial prior to 01.01.2016, may be revised w.e.f. 01.01.2016 by notionally fixing their pay in the pay matrix recommended by the 7 th CPC in the level corresponding to the pay in the pay scale/pay band and grade pay at which they retired/died.</p>
<p>2. Instructions were issued vide this Department&#8217;s OM of even number dated 30.11.2016 for extending the benefit of OM dated 4.8.2016 to the following categories of pensioners drawing provisional pension under Rule-69 of the CCS (Pension) Rules, 1972,</p>
<blockquote><p>(i) Retired before 1,1.2016 and sanctioned provisional pension under Rule-69 of the CCS (Pension) Rules on account of departmental/judicial proceedings or suspension.</p>
<p>(ii) Suspended before 1,1.2016 and sanctioned provisional pension, based on their pre-revised pay under Rule-69 of the CCS (Pension) Rules on retirement on or after 1.1.2016.</p></blockquote>
<p>3. It has now been decided that provisional pension sanctioned in the above cases may be revised w.e,f. 1,1.2016 in accordance with the instructions contained in this Department’s OM No.38/37/2016-P&amp;PW(A) dated 12th May, 2017. Higher of the two formulations i.e. OM dated 4.8.2016 or OM dated 12.5.2017 would he the revised provisional pension 1.1.2016 in such  cases.</p>
<p>4. This issues with the approval of Department of Expenditure. Ministry of finance ID N0.1(21)/E-V/2016 dated 15,01.2018.</p>

<p>The undersigned is directed to say that the Hon’ble Supreme Court in its judgment in the case of R. K. Sabharwal vs. State of Punjab, had, inter-alia, observed that “the reserve category candidates can compete for the non-reserve posts and in the event of their appointment to the said posts their number cannot be added and taken into consideration for working out the percentage of reservation.”</p>
<p>2. As per instructions issued vide this Department’s OM No. 36012/2/96-Estt.(Res) dated 02.07.1997, in direct recruitments to Central Government jobs and services, the reserve category candidates who are selected on the same standard as applied to general candidates will not be adjusted against reserved vacancies. As per instructions issued vide DOP&amp;T OM No. 36011/1/98-Estt.(Res) dated 01.07.1998, only when a relaxed standard is applied in selecting a reserved candidate, for example in the age limit, experience, qualification, permitted number of chances in written examination, etc., such candidates will be counted against reserved vacancies.</p>
<p>3. It has been brought to the notice of this Department by the Hon’ble Parliamentary Committee on Welfare of OBCs that these instructions are not being followed in some cases in direct recruitments to Central Government jobs and services. It is, therefore, reiterated that while making Direct Recruitments, guidelines issued vide this Department’s OM No. 36012/2/96-Estt.(Res) dated 02.07.1997 and OM No.36011/1/98-Estt.(Res) dated 01.07.1998 may be kept in view by all concerned.</p>
<p>4. All Ministries/ Departments are requested to bring the contents of this O.M. to the notice of all concerned for information and compliance.</p>

<p><strong>Subject: Child Care Leave (CCL) &#8211; Clarification Reg.</strong></p>
<p>The undersigned is directed to refer to DoP&#8217;Ts O.M. No. 21011/08/2013- Estt.(AL), dated 25.03.2013 and to say that references have been received with regard to leaving Head Quarters/Station while on CCL and availing LTC during CCL.</p>
<p>2. In this regard, it is has now been decided that:</p>
<blockquote><p>(i) An employee on CCL may be permitted to leave headquarters with the prior approval of appropriate competent authority.</p>
<p>(ii) LTC may be availed while an employee is on CCL.</p>
<p>(iii) An employee on CCL may proceed on foreign travel provided clearances from appropriate competent authorities are taken in advance.</p></blockquote>
