NOTIFICATION

New Delhi, the 23rd December, 2020

G.S.R.793(E). – In exercise of the powers conferred by sub-section (1) of section 59 read with clauses (g) and (h) of sub-section (2) of section 59 of the Lokpal and Lokayuktas Act, 2013 (1 of 2014) and section 40 and sub-section (1) of section 42 of the said Act, the Central Government in consultation with the Comptroller and Auditor General of India hereby makes the following rules to provide the form and time for preparing of Accounts in each financial year and the budget for subsequent financial year(s), showing the estimated receipts and expenditure of the Lokpal and the form for maintaining the accounts and other relevant records and the form of annual statement of accounts of the Lokpal, namely:-

1. Short title and commencement- (1) These rules may be called the Lokpal (Finance and Account) Rules, 2020.
2. They shall come into force on the date of their publication in the Official Gazette.

2. Definitions – (1)In these rules, unless the context otherwise requires,-

(a) ’Act’ means the Lokpal and Lokayuktas Act, 2013 (1 of 2014);

(b) ’Annual Statement’ means Statements of Finance Accounts, Statement of Central Transactions (SCTs) and other materials as applicable in the case of Civil Ministries or Departments of Government of India and in such form as prescribed in the Civil Accounts Manual or any applicable rules;

(c) ’Audit Officer’ means the Comptroller and Auditor General of India or any person appointed by him in this behalf;

(d) ’Budget’ means the budget as referred under rule 43(1) of the General Financial Rules, 2017 read with provisions of the article 112 of the Constitution;

(e) ’financial year’ means the financial year as defined under clause (xiv)of rule 2 of the General Financial Rules, 2017 read with rule 42 of the General Financial Rules, 2017;

(f) ’section’ means the section of the Act.

(2) words and expression used herein and not defined but defined in the Act shall have the same meaning as assigned to them in the Act.

3. Preparation, formulation and submission of the Budget. – The formulation of budget shall be regulated in accordance with the provisions of sub-rule (3) of rule 43 of General Financial Rules, 2017 read with article 112 to 116 of the Constitution;

Explanation. For the purpose of these rules,-

(a) for the preparation of budget estimates, the Lokpal shall adhere to the guidelines as may be issued from time to time by the Ministry of Finance, Budget Division in terms of provisions of sub-rule (4) of rule 43 of General Financial Rules, 2017.

(b) the forms and manner of drawing up the proposed budgetary provision will be regulated in terms of rules 44, 45 and 50 of General Financial Rules, 2017 and the estimate will be reflected in the Demand for Grants of the Ministry in Department of Personnel and Training.

(c) the Lokpal shall also adhere to,-

• (i) the Government Accounting Rules, 1990;
• (ii) the Central Government Accounts (Receipts and Payments) Rules 1983;
• (iii) the Civil Account Manual;
• (iv) the General Financial Rules, 2017.

The undersigned in directed to refer to Department of Personnel & Training Office Memorandum No.125/1/2015-16/ CCSCSB dated 04-12-2015 regarding Scheme for promotion of Adventure Sports & Similar Activities amongst Central Government Employees (Copy enclosed) and to inform that the Youth Hostel Association of India has offered the following programmes for Central Government Employees eligible under the Scheme:

4. The interested and eligible Central Government Employees may submit his/ her application directly to YHAI and a copy of the same may be endorsed to Secretary, CCSCSB, Room No-361-B wing, Lok Nayak Bhawan, Khan Market, New Delhi. It is pertinent to mention that as per this Department’s O.M. No. 125/1/2015-16/ CCSCSB dated 8th December,
   2016, Special Casual Leave may be granted for a period of 10 days for this purpose including journey period. Advance payment for the programme has to be paid directly to the organiser and reimbursement as admissible will be made after successful completion of programme. On completion of said activity, applicant may submit expenditure details (fee receipt & Tickets in original) along with Aadhar Number and Bank Details (Name of Bank, Account Number, IFSC Code and Branch Code) for smooth reimbursement of claim.

5. It is mandatory to submit duly filled in check list along with proforma annexed herewith.

Department of Social Justice & Empowerment invites applications for engagement of Consultants from retired officers from Central Government
Ministries/ Departments/ CPSUs, for engagement as Consultants on contract basis.

The eligibility criteria/ experience and terms and conditions of the engagement are as under:

1. Consultant-Finance (1 post) : Retired officers of Central Government / CPSUs in the level of Section Officer/ Under Secretary or equivalent. Should be capable of examining Annual accounts, financial statements, Board draft resolutions, Department of Public Enterprises (DPE) guidelines and implementation of India Accounting standard prescribed by Ministry of Company Affairs etc. The consultant must be well versed in commercial accounts and in broad understanding of DPE & Ministry of Company Affair’s orders/guidelines etc. Should have competency in drafting of noting and communications and working knowledge in MS Word, MS Excel, MS Power Point etc.
2. Consultant-Establishment (1 post) : Retired officers of Central Government in the level of Section Officer/ Assistant Section Officer or equivalent and having experience in handling Establishment matters and Secretariat procedures. Should have competency in drafting of noting and communications and working knowledge in MS Word, MS Excel, MS Power Point etc.
3. Consultant- Cash Section (1 post) : Retired officers of Central Government in the level of Section Office/ Assistant Section Officer or equivalent and having experience in handling various tasks in Cash Section which includes preparation of salary bills, income tax calculation, bills and vouchers, PFMS etc. Should have competency in drafting of noting and communications and working knowledge in MS Word, MS Excel, MS Power Point etc.
4. Consultant- Coordination (1 post) : Retired officers of Central Government in the level of Section Officer or equivalent and having experience in handling coordination work in the Ministry/ Department. Should have competency in drafting of noting and communications and working knowledge in MS Word, MS Excel, MS Power Point etc.
5. Consultant-Policy/ Scheme (1 post) : Retired officers of Central Government in the level of Section Officer or equivalent. Should have experience in handling work relating to Policy matters/ schemes/ drafting SFC/ EFC/ Cabinet Note etc. Should have competency in drafting of noting and communications and working knowledge in MS Word, MS Excel. MS Power Point etc.
6. Consultant legal (02 posts) : Retired officers of Central Government in the level of Under Secretary/ Deputy Secretary or equivalent with Degree of LLB and having experience in handling legal matters/ court cases related to Supreme Court High Court / CAT etc. Should have working knowledge in MS Word, MS Excel, MS Power Point etc.
7. Consultant- PCR Desk (1 post) : Retired officers of Central Government/ CPSUs in the level of Under Secretary/ Section Officer or equivalent. Should be capable to deal with Amendments in the Acts, Private Member Bill, Resolutions, Parliament Questions/ Assurances, Special Mentions, RTI, matters related to offences of untouchability & atrocities, Public Grievances and preparing & laying of Annual Reports in Parliament, etc. Should have competency in drafting of noting and communications and working knowledge in MS Word, MS Excel, MS Power Point etc.
8. Consultant-Statistics Division (1 post) : Retired officers of Central Government/ CPSUs in the level of Section Officer/ Assistant Section Officer or equivalent. Should be capable to deal with evaluation of Social Audit Scheme, Statistics related matter, Outcome framework, Gender Budgeting, preparation of Annual Report, Tender, Parliament Questions, Public Grievances, VIP References and RTI, etc. Should have competency in drafting of noting and communications and working knowledge in MS Word, MS Excel, MS Power Point etc.

The tenure of contract shall be initially for one year which is extendable on the basis of requirement of the office and performance of the candidate. The Contract can be terminated at any time at the discretion of the Department, if the performance of the person so engaged is not found satisfactory.

The Department of Social Justice & Empowerment reserves the right to accept or reject the applications without assigning any reasons.

Cut-off Age: The age of the applicant shall not exceed 63 years as on last date of receipt of application.

Monthly remuneration: The monthly remuneration and the terms and conditions of Consultants shall be regulated by Guidelines and Procedure for engagement of Consultants in Department of Social Justice & Empowerment (attached).

NOTIFICATION

New Delhi, the 25th November, 2020

G.S.R. 733(E).- In exercise of the powers conferred by sub-section (3) of Section 10 read with section 59 of Lokpal and Lokayuktas Act, 2013 (1 of 2014), the Central Government hereby makes the following rules regulating
the method of recruitment to the post of Staff Car Driver in the Lokpal, namely: –

1. Short title and commencement.- (1) These rules may be called the Lokpal (Staff Car Driver) Recruitment Rules, 2020.
   (2) They shall come into force on the date of their publication in the Official Gazette.
2. Number of post, classification, level in the Pay Matrix.- The number of post, its classification, and the level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.
3. Method of recruitment, age limit, qualifications, etc.- The method of recruitment, age limit, qualifications and other matters relating to the said post shall be as specified in columns (5) to (13) of the aforesaid Schedule.
4. Disqualification.- No person, –
   (a) who has entered into or contracted a marriage with a person having a spouse living; or
   (b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post:
   Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.
5. Power to relax.- Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.
6. Savings.- Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Schedule Castes, the Scheduled Tribes, other backward classes, ex-Servicemen and
   other special categories of persons, in accordance with the orders issued by the Central Government from time to time, in this regard.

Subject:- Exemption from submission of summary of the Medical Report in respect of AIS officers for the PAR period 2019-2020 – reg.

Sir / Madam,

I am directed to refer to the subject noted above and to say that the health check is mandatory for all AIS officers above the age of 40 years. The Annual health check is done in Form IV attached with AIS (PAR) Rules, 2007 as amended from time to time and copy of the Part C i.e. Summary of Medical Report is required to be attached along with his / her PAR. As per the rules, the officer concerned is required to furnish summary of medical report alongwith self-appraisal after getting health check-up done.

Further Extension of timelines for recording of PAR for the year 2019-20 in respect of AIS officers – DoPT

2. In relaxation of AIS (PAR) Rules, 2007, as amended vide Notification dated 23.07.2019, earlier submission of summary of Medical Report was delinked from self-appraisal and was to be furnished by 30 June, 2020 vide letter dated 11th March, 2020. Further, the same was subsequently extended up to 30th December, 2020 vide letter dated 9th June, 2020 for PAR year 2019-2020.
3. In view of the situation arising out of the spread of Novel Coronavirus (COVID-19), it has now been decided with the approval of the competent authority to waive the condition of submission of the summary of Medical Report by AIS officers for the PAR year 2019-2020 as a one-time measure.

Subject:- Digitalisation of APARs in respect of CSSS officers.

e-HRMS, an outline platform was launched for Central Government Employees as part of good governance, to furnish a comprehensive view of the human resource deployed by the Government, so that all processes of personnel management from hiring to retiring will be on digital platform and manual system of handling personnel matters will be dispensed with.

2. In order to fulfill the objectives of the e-HRMS, a total of 20 modules have been developed so far for various service related activities. SPARROW (Smart Performance Appraisal Report Recording Online Window) is one of the applications, which will be merged in the e-HRMS.
3. In order to bring all the physical APARs of CSSS officers into the online SPARROW system, it has been decided to digitalize the APARs of CSSS officers and migrate them into SPARROW portal in a phased manner. The APARs of PPS and above are already available in CS-II Division, whereas the APAR dossiers of PSs and below are maintained in respective cadre units.
4. The legacy APARs of PPS and above officers are already being digitized. In the next stage, APARs of PSs will be taken up for digitization. As a part of this activity, in the first instant APARs of the senior most PSs belonging to Select List 2012 and 2013 and earlier SLs will be taken up.
5. Hence, all the cadre units are requested to send the APAR dossiers of the PSs of SL 2012 and 2013 & earlier SLs, if any, within 5 working days from the issue of this O.M. to CS-II Division to enable the digitization of their APARs.

This may please be treated as “Most Urgent”.

The undersigned is directed to invite attention to this Department’s O.M. No.21011/02/2015-Est(A-II)-Part II dated 22.05.2020, vide which it was decided to delink the submission of summary of Medical Report from recording and completion of APAR for the year 2019-20, in respect of Group ‘A’ officers of Central Civil Services. The timeline for conduct of Annual Medical Examination and submission of the summary of the Medical Report for the year 2019-20 was also extended up to 31.12.2020.

4. The legacy APARs of US and above officers are already being digitized. In the next stage, APARs of SOs will be taken up for digitization. As a part of this activity, in the first instant APARs of the senior most SOs belonging to Select List 2011 and 2012 and earlier SLs will be taken up.

5. Hence, all the cadre units are requested to send the APAR dossiers of the SOs of SL 2011 and 2012 & earlier SLs, if any, within 5 working days from the issue of this O.M. to CS-I Division to enable the digitization of their APARs.
