<p>Subject:- <strong>Preventive measures to contain the spread of COVID-1</strong>9</p>



<p>The undersigned is directed to refer to O.M of even number dated 17th March, 2020 on the above-mentioned subject. The Ministry of Home Affairs (MHA) vide its Order dated 15.4.2020 has now extended the nationwide lockdown till 3rd May, 2020 to contain spread of Coronavirus in the country and has issued the consolidated revised guidelines for strict compliance. Para 18(ii) of these consolidated revised guidelines, inter-alia, provide that all officers of the level of Deputy Secretaries &amp; above are to function with 100% attendance while 33% of the remaining officers/staff are to attend offices as per requirement.</p>



<p>2. The spirit of the guidelines is that crowding in the offices may be avoided and safe social distancing norms may be maintained. It is, however, seen that in some Ministries/ Departments, more than 33% of officials /staff below Deputy Secretary level are being called to offices. This might lead to undesirable crowding in the office jeopardizing the preventive measures in place for containing the spread of <strong><a rel="noreferrer noopener" href="https://centralgovernmentnews.com/tag/covid-19/" target="_blank">COVID-19</a></strong>.</p>

<p>3. It is reiterated that guidelines for attendance for officers/staff at levels below Deputy Secretary, be strictly followed. Heads of Departments (HoDs) may also direct their officers/staff to attend office in staggered timings to further avoid crowding in offices/work spaces. As suggested vide O.M. of even number dated 19th March, 2020, the staggered timings may be as follows :-</p>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p><strong>(a) 9.00 am. to 5.30 p.m.<br />(b) 9.30 a.m. to 6.00 p.m.<br />(c) 10 a.m. to 6.30 p.m.</strong></p></blockquote>



<p>Suitable Roster May, accordingly, be drawn up by the Heads of Department. Needless to say that officials/ staff working from home on a particular day should be available on telephone and electronic means of communications at all times. They should attend office, if called for any exigencies of work.</p>

<p><strong><em>New Promotion Rules for Central Government Employees &#8211; Modified Assured Career Progression Scheme (MACP)</em></strong></p>



<p>Central Government accepted the new 7th pay commission promotion rules and implemented for all groups of Central Government employees</p>



<p>Originally adopted by the 5th Pay Commission in 1996 and subsequently by the sixth pay commission, the system for the guaranteed promotion has adjusted the 12 and 24 year requirements to 10, 20 and 30 years.</p>

<p>If a worker is not promoted for a period of 10 years, he or she moves to the next tier of the pay hierarchy under the MACP rule.</p>



<p>Now the DoPT has now given a significant order in detail regarding the promised promotional structure.</p>



<p>The OM recommends that the 7th Pay Commission should continue to administer the MACP Scheme 10, 20 and 30 years earlier.</p>



<p>The employees move into the next level of the hierarchy in the new pay matrix. As recommended, all positions, including Group A posts, whether individually or not, will be able to benefit from the Scheme.</p>



<p>However, the services of the organized group &#8220;A&#8221; are not covered by the scheme. MACPS may proceed in this manner, except for representatives of Organized Group&#8217;s&#8217; A&#8217; Programs, to extend to all workers up to HAG level.</p>



<p>The Government has considered and approved the recommendations of MACPS&#8217;s Seventh Central Pay Commission. At the age of 10, 20 and 30 the MACPS will continue to be administered. The worker must transfer to the next pay level in the current pay matrix system directly under the program.</p>



<p>The specified Benchmark shall be&#8217; Very Good&#8217; for the granting of financial improvement under the MACP Scheme for all rates.</p>



<p>No increase in the pay level for junior employees would be admissible as a result of pay fixation under the MACP scheme, more than for seniors.</p>

<p style="text-align: center;"> <b>OFFICE MEMORANDUM</b></p>
<p>Subject: <b>CCS (CCA) Rules, 1965 &#8211; Clarification regarding effect of warning, censure etc on promotion</b>.</p>
<p>The undersigned is directed to refer to this Department&#8217;s O.M. No. 11012/6/2008-Estt.(A) dated 7th July, 2008 on the above mentioned subject and to say that vide para 2(iii) of the said OM, it was instructed that where a departmental proceeding has been instituted, and it is considered that a Government servant deserves to be penalized for the offence/misconduct, one of the prescribed penalties may only be awarded and no warning, recordable or otherwise, should be issued to the Government servant. However, while considering cases for empanelment, the ACC has observed that in many cases, rather than exonerating the officer or imposing a penalty on him, administrative warning is issued even when disciplinary proceeding were drawn against him. Administrative warning is not recognized as a penalty.</p>
<p>2. In view of the above, the following position as contained in various instructions issued so far on warning/Censure etc. are reiterated for strict compliance:</p>
<blockquote class="tr_bq"><p>(i) As clarified in the Ministry of Home Affairs O.M. No. 39/21/56-Estt.(A) dated 13 th December, 1956, warning is administered by any authority superior to a Government employee in the event of minor lapses like negligence, carelessness, lack of thoroughness, delay etc. It is an administrative device in the hands of superior authorities for cautioning the Government employees with a view to toning up efficiency and maintaining discipline. There is, therefore, no objection to the continuance of this system. However, where a copy of the warning is also kept in the Confidential Report dossier, it will be taken to constitute an adverse entry and the officer so warned will have the right to represent against the same in accordance with the existing instructions relating to communication of adverse remarks and consideration of representations against them.</p>
<p>(ii) Where a departmental proceeding has been instituted under the provisions of CCS(CC&amp;A) Rules 1965, after the conclusion of disciplinary proceedings, the officer is either exonerated or where it is considered that some blame attaches to the officer, he should be awarded one of the recognized statutory penalties as given in Rule 11 of the CCS (CCA) Rules, 1965 i.e. at least &#8216;Censure&#8217; should be imposed. In such a situation, a warning, recordable or otherwise, should not be issued.</p>
<p>(iii) Warning, letter of caution, reprimands or advisories administered to Government servants do not amount to a penalty and, therefore, will not constitute a bar for consideration of such Government servants for promotion.</p></blockquote>
<p>3. All the disciplinary authorities in Ministries/Departments are, therefore, requested to keep in view the above guidelines while dealing with disciplinary case against the Government servants.</p>

<p>G.S.R… (E) – In exercise of the powers conferred by the proviso to clause (3) of article 320 of the Constitution, the President hereby, makes the following regulations further to amend the Union Public Service Commission (Exemption from Consultation) Regulations, 1958, namely:-</p>
<p>1. (i) These regulations may be called the Union Public Service Commission (Exemption from Consultation) Second Amendment Regulations, 2013.</p>
<p>(ii) They shall come into force on the date of their publication in the Official Gazette.</p>
<p>2. In the Union Public Service Commission (Exemption from Consultation) Regulation, 1958, in the Schedule-II, after item 7 and the entries relating thereto, the following shall be added, namely:-</p>
<p>8. “Recruitment as may be made at any time within a period of three years to the post of Deputy Superintendent of Police in the Central Bureau of Investigation under the Ministry of Personnel, public Grievances and Pensions, the Department of Personnel and Training”.</p>
