Subject: Clarification related to grant of financial upgradation under MACP

This HOrs. had taken up a case with DoP&T seeking clarification on the date from which financial upgradation under MACPS is to be granted in respect of an employee who had been found “Not Fit” by the initial Screening Committee due to not meeting the prescribed benchmark (based on APAR grading) but in subsequent year/ years he was recommended “Fit” by the Screening Committee after meeting the prescribed benchmark.

2. Clarification issued by the DoP&T vide its ID Note No. 1462926/21/CR dated 04.10.2021 is as follows:-

“The matter has been examined. It is clarified that due to the reason of the employee being declared ‘Unfit’ for not meeting the prescribed benchmark (based on APAR grading) by the initial Screening Committee and if the employee is recommended ‘Fit’ by the Screening Committee for subsequent year/years, on his meeting the prescribed benchmark, financial upgradation under MACPS would be granted to the employee from the date” of meeting of that Screening Committee, which has recommended him ‘Fit’ for grant of MACP. Further, this would have consequential effect of deferment of the subsequent financial Upgradation under MACPS in the extent the previous financial upgradation gets postponed.”

Will the PRIME MINISTER be pleased to state:

(a) whether as per various order of DoPT in case of Modified Assured Career Progression (MACP), the APAR for five years proceeding T-2nd year may be taken as reckoning APARs i.e., if the due date of MACP comes in the year 2013-14 then the reckoning APAR shall be 2011-12, 2010-11, 2009-10, 2008-09 and 2007-08, if so, the details thereof; and

(b) the details of the procedure to be followed if the Screening Committee of the MACP does not meet as per time schedule of the DoPT order?

ANSWER

(a) & (b): The same procedure, as prescribed in case of promotion for the Departmental Promotion Committee (DPC), is observed by the Screening Committee for grant of Modified Assured Career Progression (MACP). As per instructions contained in DoPT’s O.M. No. 22011/4/2013-Estt.(D) dated 08.05.2017, the Annual Performance Appraisal Reports (APARs) for five preceding T-2nd year may be taken as reckoning APARs from the vacancy year 2019 onwards 1.e. for the vacancy year 2019, the reckoning APARs shall be 2012-13 to 2016-17. The scheduling of the meeting of the Screening Committee on MACP has no relation to the procedure to be followed by the Committee.

क्या प्रधानमंत्री यह बताने की कृपा करेंगे किः

(क) क्‍या मोडिफाइड अश्योर्ड करियर प्रोगेशन स्कीम (एमएसीपी) के मामले में कार्मिक एवं प्रशिक्षण विभाग के विभिन्‍न आदेश के अनुसार अंतिम द्वितीय वर्ष से क्रमागत पांच वर्षों की वाषिक कार्य निष्पादन मूल्यांकन रिपोर्ट (एपीएआर) को वार्षिक कार्य निष्पादन मूल्यांकन रिपोर्ट (एपीएआर) की गणना में शामिल किया जाएगा अर्थात यदि एमएसीपी की नियम तिथि वर्ष 2013-14 के अंतर्गत आती है, तो वर्ष 2011-12, 2010-11, 2009-10, 2008-09 और 2007-08 की एपीएआर पर विचार किया जाएगा, यदि हां, तो तत्संबंधी ब्यौरा क्या है; और

(ख) यदि एमएसीपी की स्क्रीनिंग समिति की बैठक कार्मिक एवं प्रशिक्षण विभाग (डीओपीटी) के आदेश की समय सारिणी के अनुसार नहीं होती है, तो अपनाई जाने वाली प्रक्रिया का ब्यौरा क्या है?

(क) एवं (ख) : मोडिफाइड अश्योर्ड करियर प्रोगेशन स्कीम (एमएसीपी) प्रदान करने हेतु स्क्रीनिंग समिति द्वारा वही समान प्रक्रिया अपनाई जाती है, जो विभागीय पदोन्‍नति समिति (डीपीसी) द्वारा पदोन्नति के मामले हेतु निर्धारित है। कार्मिक एवं प्रशिक्षण विभाग के दिनांक 08.05.2017 के कार्यालय ज्ञापन सं. 22011/4/2013-स्था.(घ) में निहित निर्देशों के अनुसार, रिक्ति वर्ष 2019 से वार्षिक कार्य निष्पादन मूल्यांकन रिपोर्ट की गणना में अंतिम द्वितीय वर्ष से क्रमागत पांच वर्षों की वार्षिक कार्य निष्पादन मूल्यांकन रिपोर्ट (एपीएआर) को शामित्र किया जाएगा अर्थात वर्ष 2019 हेतु, वर्ष 2012-13 से 2016-17 तक की एपीएआर की गणना की जाएगी। एमएसीपी की स्क्रीनिंग समिति की बैठक की समय-सारिणी का समिति द्वारा अपनाई जाने वाली प्रक्रिया से कोई संबंध नहीं है।

Sir,

I am directed to refer to letters F. No. GCCO/CCA/Misc/ 6/2020-Admn-O/o CC-CGST-Zone- Jaipur dated 22.02.2021 and F. No. GCCO/CCA/Misc/ 94/2020-CCA- O/o CC-CGST-Zone- Lucknow dated 08.02.2021 received from Jaipur and Lucknow Zone respectively on the subject cited above.

2. In this context, it is informed that the issue was referred to DOP&T for clarification. DOP&T vide I.D. No. 1448864/ 21/CR Dated 29.06.2021 has clarified that “for the purpose of MACP Scheme, service rendered on assumption of charge of the post on regular basis alone will be counted for determining eligibility for next financial upgradation as the MACP Scheme provides that financial upgradation will be admissible to an employee only on spending 10 years after actual joining in the post. Therefore, the period of notional promotion till assumption of charge of the post on promotion shall not count for determining eligibility for a financial upgradation under MACP Scheme”.

Kind attention of Railway Board is invited to NFIR’s demand contained in PNM Agenda Item No. 15/2017 relating to the reckoning of GP 4200/Pay Level-6 as entry pay for grant of financial upgradation under MACPS to the Station Masters category in Railways. Though the Railway Board has issued instructions vide RBE No. 26/2020 dated 25/02/2020 not to reckon the promotion from the post of ASM (GP 2800/-) to SM (GP 4200/-) but unfortunately, these instructions have been given effect only from 16/02/2018. This decision of the Railway Board is not only erroneous but also unjustified in view of the fact that the post of ASM GP 2800 stood upgraded to GP 4200 w.e.f. January 1, 2016; therefore the Federation has been rightly requesting the Board to review its decision for giving effect to the instructions from 01/01/2016.

It is further brought to the notice of the Railway Board that the entry qualification of Station Master GP 2800 (6th CPC) was “University Degree or its equivalent’’ and similar in the entry qualification for filling the posts of SM GP 4200/Pay Level-6 even after upgradation through merger w.e.f. 01/01/2016. The only change introduced in the recruitment rules vide RBE No. 22/2018 dated 16/02/2018 is that the employees of Level-1 (i.e. GP 1800) of Operating Department of Railways with five years’ service are eligible to appear for 25% “General Selection posts”. This change should not impact negatively so far as granting MACP to the Station Master Category w.e.f. 01/01/2016. Therefore, the date was chosen by the Railway Board i.e. date of issuance of the Board’s letter dated 16/02/2018 for MACPS should not be interpreted differently for depriving the benefit under MACPS to those Station Masters who got upgraded GP 4200/Pay Level-6 w.e.f. 01/01/2016.

NFIR, therefore, once again urges upon the Railway Board (DG/HR) to kindly intervene and see that modified instructions are issued soon to give effect to Board’s instructions vide RBE No. 26/2020 dated 25/02/2020 w.e.f. 01/01/2016 instead of 16/02/2018. Federation may kindly be replied to the action taken.

Reference from Federation (NFIR and AIRF) and a few Railways have been received for ignoring the promotion/ upgradation from ASM (GP 2800) to SM (GP 4200) for grant of financial upgradation under MACPS to those employees who have further been absorbed in other cadres by way of selection on lateral induction or due to medical de-categorisation. The matter has been examined in consultation with Finance Directorate and it has been decided that the benefit of Board’s letter dated 25.02.2020 (RBE No. 26/2020) would also be extended to such employees who have progressed to other cadres by way of lateral induction/ selection or due to medical de-categorization and would be granted financial upgradation under MACPS by ignoring their promotion /financial upgradation from ASM (GP 2800) to SM (GP 4200) irrespective of their progression in other cadres.

Latest clarification on MACP scheme – Financial upgradation, to Junior Cashier promoted from the post of Senior Shroff / JAA / Senior clerk

2. The benefit of the financial upgradation in such cases would accrue from 16.02.2018 onwards, even if financial upgradation happens to become due before 16.02.2018 as a consequence of ignoring the promotion from ASM to SM.

3. This issues with the concurrence of Finance Directorate of Ministry of Railways.

Sub: Cases pending or decided by Hon’ble High Courts/ Tribunals regarding preponement of effective date of Modified Assured Career Progression (MACP) Scheme – reg.

The undersigned is directed to say that the matter relating to grant of benefits w.e.f. 01.01.2006 instead of w.e.f. 01.09.2008 under the MACP Scheme to civilian Central Government employees is presently sub-judice before the Hon’ble Supreme Court of India in a number of cases tagged with SLP Nos. 10811-10813/2018 in the matter of Union of India Vs. Shri Ranjit Samuel, and that all similar matters are being heard together by the Hon’ble Apex Court.

2. A large number of references are being received in this Department based on orders of the Hon’ble Tribunals (CAT Benches) and Hon’ble High Courts seeking advice on implementation of such orders allowing grant of benefits under the MACP Scheme from 1.1.2006, as against 1.9.2008, the date provided in the MACP Scheme.

3, Since such orders of Hon’ble Tribunals /High Courts are at variance with the extant MACPS guidelines and for the fact that the primary issue of date of effect of MACPS is sub judice before the Hon’ble Supreme Court of India, this Department is constrained to advise various Ministries/ Departments to either seek review or agitate the matter in higher courts, by challenging such orders.

4, Accordingly, Ministries /Departments are, therefore, advised to defend such cases or challenge the orders (where decision has been taken by the Hon’ble Tribunal/High Court) contrary to MACPS guidelines, by bringing the fact that the issue is pending before the Hon’ble Supreme Court of India, to the notice of Hon’ble Tribunals/High Courts.

“The issue regarding grant of financial ungradation under MACPS to Jr. cashier by not reckoning their appointment / promotion from Sr.Shroff/ JAA/ Sr. Clerk to Jr. Cashier’s post has been under consideration. Since appointment / promotion from Sr. Shroff / JAA / Sr. Clerk to Jr. Cashier post involves promotion from one cadre to another cadre carrying same payscale / Grade Pay wihout benefit of pay fixation, it has now been decided in consultation with Finance Directorate and Establishment Directorate of Railway Board that regulating MACP benefits to such staff, the appointment from the post of Sr. Shroff / JAA / Sr. Clerk to the post of Jr. Cashier should not be constructed as promotion and, therfore, may not be reckoned for the purpose of grant of financial upgradation under MACPS”

This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

Whether MACP scheme entitles financial upgradation of pay to the next grade pay or to the grade pay of the next promotional post as envisaged under the ACP scheme
