<p><em><strong>POINTS RAISED BY THE GENERAL SECRETARY AIRF IN THE MEETING OF HON’BLE MR WITH THE GENERAL MANAGERS AND DRMS OF THE INDIAN RAILWAYS ON 19.06.2014 IN RAIL MUSEAUM, NEW DELHI</strong></em></p>
<p>&nbsp;</p>
<p style="text-align: left;">At the outset, while thanking Hon’ble MR, MoSR, CRB, other Railway Board Members, General Managers, General Secretary AIRF, <strong>Shri Shiva Gopal Mishra,</strong> raised the issue of digitalisation of records and making all the offices paperless. He also requested Hon’ble MR for introduction of such software which can provide all the information pertaining to employees on their mobile phones, particularly balance of leaves, Basic Pay, Dearness Allowance, Travelling Allowance, House Rent Allowance etc. and deduction being made from the salaries of the employees.</p>
<p style="text-align: left;">He also emphasised the demand for scrapping <strong>New Pension Scheme</strong> that came into effect from 01.01.2004 with restoration of Old Pension Scheme for all the Railway employees and liberalization of SPAD Clause to minimise stress and strain in the staff in the interest of safety.</p>
<p style="text-align: left;">1. <em><strong>IMPROVEMENT OF SAFETY ON THE RAILWAYS</strong></em></p>
<blockquote>
<p style="text-align: left;">(i) Thousands of Railwaymen lay their lives while working round-the-clock 24x7x365 days in all weathers, need a better treatment from the Railways and Government of India. Grievance Handling Machinery, particularly Permanent Negotiating Machinery, has been paralysed. Any grievance raised by a particular staff or union must be resolved within 60 days of raising of the grievance to remove stress of the staff, which is major danger for the safety.</p>
<p style="text-align: left;">(ii) Special attention to be paid for timely filling up of vacancies in Safety Categories. On account of shortage of manpower, the existing staff are compelled to adopt short-cuts, which is a potential threat to safety.</p>
<p style="text-align: left;">(iii) Adequate and proper training facilities be made available for skill development and to acquaint the manpower with latest technological development.</p>
<p style="text-align: left;">(iv) Proper infrastructure for maintenance, both preventive and routine, should be made available with adequate facilities.</p>
<p style="text-align: left;">(v) The New Pension Scheme, i.e. National Pension Scheme, introduced w.e.f. 01.01.2004, has totally eroded the Social Security, and the staff appointed on or after this crucial date is always afraid about their future, which also diverts their proper attention from their duty.</p>
<p style="text-align: left;">(vi) The system of induction to erstwhile Group ‘D’ Safety Categories, now in Grade Pay Rs.1800 and classified as Group ‘C’, needs to be de-centralized, and the old system of engagement in the form of Substitutes at the Divisional/Workshop level be restored with the process of sponsoring the names of the candidates by local Employment Exchange etc. with weightage of at least 5% marks to the wards of Railwaymen.</p>
<p style="text-align: left;">(vii) Modernised Tools and Equipments be made available to the technical staff engaged in maintenance of rolling stock, track, signalling gear etc.</p>
<p style="text-align: left;">(viii) Operating Staff, assigned the work of train passing duty, particularly on intensively utilised section should not be given additional work like commercial duties etc.</p>
<p style="text-align: left;">(ix) In the category of Running Staff, both Loco &amp; Traffic, no vacancies should be allowed to continue for a longer period of time.</p>
<p style="text-align: left;">(x) There should be proper resting facilities at out stations in Running Rooms, including cooking facilities and at home, so that they are not subjected to work without proper rest, which is a potential to endangering the safety.</p>
<p style="text-align: left;">(xi) Running Staff and the staff engaged in train operations should not be compelled to work longer duty hours, for which adequate manpower be made available.</p>
<p style="text-align: left;">(xii) There should be no compromise in the standard of the material and components, for which strict quality check be ensured through internal assessment, creating necessary paraphernalia for this purpose. Responsibility must be fixed on any breach to life cycle of the instrument or material.</p>
<p style="text-align: left;">(xiii) Outsourcing of perennial nature maintenance works in all kinds of rolling stock, track and signalling gears as also the infrastructure should not be resorted to in the larger interest of safe rail operation.</p>
<p style="text-align: left;">(xiv) Increasing trend of outsourcing is also endangering the safety of rail operation because the contractor not only engages untrained manpower, but also violates the Statutory Rules for contractual labours, viz. not paying legitimate wages, not providing even basic facilities in gross violation of Contract Labour(Regulation &amp; Abolition) Act, 1970.</p>
<p style="text-align: left;">(xv) Low paid contractual labour, engaged in perennial nature of departmental works, is found indulged in theft of railway materials. It was accepted by the them CRB, Shri Vivek Sahai, in PREM Group Meeting at the apex level, that, after the introduction of CST, theft incidents have increased and condition has been deteriorated.</p>
<p style="text-align: left;">(xvi) Inadequacy of funds for replacement of outdated assets, including rolling stocks, track and signalling gears, is also a major hurdle in safety of rail operation.</p>
<p style="text-align: left;">(xvii) In the recent days, some of the incidents of fire have caused lots of casualties and given bad name to IR. Previously, there was a separate department of RPF Fire, which used to train the staff and checking fire equipments, had been abolished, leaving Railway System in the hand of private parties, responsible for such incidents. Fire Department in the Railways needs to be restored.</p>
<p style="text-align: left;">(xviii) Track maintenance and problems in keeping block.</p>
<p style="text-align: left;">(xix) Scope of the LARSGESS needs to be widened, so that the staff working in Safety Categories, who are unwilling or incapable of working, can seek Voluntary Retirement with simultaneous appointment to their qualified and capable wards with a view to induct the young bloods in the system for better productivity and efficiency.</p>
<p style="text-align: left;">(xx) Safety Organisation in the Railways is working on ad-hoc basis and those who are rejected in the system are posted there. Safety Counsellors, instead of counselling, do policing and punishing the staff. This mentality needs a change.</p>

<p style="text-align: left;">
<p style="text-align: left;">2.<strong><em> IMPROVING CLEANLINESS IN THE TRAINS AS WELL AS AT STATIONS</em></strong></p>
<p style="text-align: left;">
In our opinion, two types of action plan are required to be framed</p>
<p style="text-align: left;">
<strong>(A) EFFORTS TO BE MADE BY THE RAILWAYS</strong></p>
<blockquote>
<p style="text-align: left;">(i) Latest Mechanised Cleaning System needs to be introduced departmentally with adequate material, tools and plants and imparting proper training to the staff for their effective use.</p>
<p style="text-align: left;">(ii) Toilets in the trains be modernised and converted to bio-toilets to make them eco-friendly.</p>
<p style="text-align: left;">(iii) Cleaning of toilets and fioors of train compartment be done at regular interval on some identified stations, for which sufficient manpower with materials, equipment etc. be made available.</p>
<p style="text-align: left;">(iv) In case of outsourcing of cleaning system, both trains and stations, the contractor, when allotted the works, complies with the terms and conditions of the contract for a short duration of time and subsequently withdraws manpower as provided for in the agreement, and the quality gradually gets deteriorated on this account. The contractual manpower engaged by the contractor, on account of being untrained, low paid and inconsistent, are incapable of maintaining quality of cleaning on, both at the stations and the trains.</p>
<p style="text-align: left;">(v) Paucity of funds is another major factor in non-maintaining of proper cleanliness.</p>
<p style="text-align: left;">(vi) Rail users are also required to be trained through display of pamphlets, posters, documentaries, exhibitions, play/drama/Nukkad Nataks etc., not to spread garbage/wastage etc. everywhere, viz. in the compartment, on railway platform, trains, tracks etc. to maintain cleanliness and for its proper monitoring CCTVs/Cameras may be installed in train compartments and on railway stations.</p>
<p style="text-align: left;">(vii) Rail users should also be counselled for using the toilets etc. in proper manner.</p>
</blockquote>
<p style="text-align: left;">
<p style="text-align: left;">B. (i) Some Statutory Provisions be made to impose some fine on misuse of toilets, spreading garbage/wastage in the train compartments, rail platform and railway tracks etc. on the pattern of Metro Rail.</p>
<p style="text-align: left;">(ii) Proper system for monitoring violation of the above-mentioned Statutory Rules be introduced and ensured.</p>
<p style="text-align: left;">
<p style="text-align: left;">3.<strong><em> IMPROVING CATERING SERVICES ON INDIAN RAILWAYS</em></strong></p>
<blockquote>
<p style="text-align: left;">
(i) Owing to Railways’ accountability for serving proper quality of meals, only Departmentally- run Catering System needs to be restored.</p>
<p style="text-align: left;">(ii) To provide proper quality meals, snacks, breakfast etc. onboard, fully equipped and modernised Departmental Base Kitchens need to be established at major stations with sufficient manpower and proper infrastructure.</p>
<p style="text-align: left;">(iii) Strict quality check, right from raw-material to finished product, needs to be ensured.</p>
<p style="text-align: left;">(iv) Onboard service of edible items be assigned to departmental workforce only.</p>
<p style="text-align: left;">(v) Staff hygiene and their upkeep with proper uniform also need to be ensured.</p>
<p style="text-align: left;">(vi) Staff should be provided with adequate and proper quality equipments and utensils for hassle- free onboard service.</p>
<p style="text-align: left;">(vii) No outsourcing should be resorted to in the interest of quality and standard of catering services.</p>

<p style="text-align: left;">
<p style="text-align: left;">4. <em><strong>IMPROVING THE PUNCTUALITY OF THE TRAINS</strong></em></p>
<p style="text-align: left;">
The factors affecting punctuality can be broadly divided into two major groups</p>
<p style="text-align: left;">
<p style="text-align: left;">(A) REASONS ATTRIBUTABLE TO THE RAILWAYS</p>
<p style="text-align: left;">(i) inadequacy of trained manpower in Running, Operational and Maintenance Categories.</p>
<p style="text-align: left;">(ii) lmproper quality of materials, leading to in-service failure.</p>
<p style="text-align: left;">(iii) Compelled short-cuts in working owing to shortage of manpower etc.</p>
<p style="text-align: left;">(iv) Over-utilization of rolling stock and tracks beyond optimum capacity.</p>
<p style="text-align: left;">(v) Non-provision of proper maintenance corridor, resulting in line failures.</p>
<p style="text-align: left;">(vi) Longer hours of duty of Running Staff and Operating Staff.</p>
<p style="text-align: left;">(vii) Dual System of Law Enforcement Machinery, i.e. GRP and RPF.</p>
<p style="text-align: left;">(viii) Old aged signalling system needs to be replaced by modernised latest signalling.</p>
<p style="text-align: left;">(ix) Single traction system, i.e. either diesel or electric sometimes also leads to loss of punctuality on account of line failure, as such introduction of dual traction system may be introduced.</p>
<p style="text-align: left;">(B) <strong><em>REASONS ATTRIBUTABLE TO RAIL USERS</em></strong></p>
<p style="text-align: left;">(i) Frequent Alarm Chain Pulling(ACP) without any valid reason, resulting in remarkable loss in<br />
running time of trains.</p>
<p style="text-align: left;">(ii) Non-provision of strict Statutory Rules against misuse of ACP System etc. and non<br />
enforcement of existing rules.</p>
<p style="text-align: left;">(iii) Unauthorised trespassing of tracks and level crossing gates.</p>
<p style="text-align: left;">(iv) Overloading by the contractors, in case of leased brake-van etc.</p>
<p style="text-align: left;">(v) En-route violence by the unsocial elements travelling in the trains.</p>
<p style="text-align: left;">(vi) Dislocation of train services in terrorist affected areas.</p>
<p style="text-align: left;">5. <em><strong>IMPROVEMENT IN SERVICES RELATED TO RESERVATIONS, TICKETING ETC.</strong></em></p>
<p style="text-align: left;">(i) Departmental PRS need to be streamlined and strengthened by providing adequate and modern equipments with trained manpower.</p>
<p style="text-align: left;">(ii) Timely replacement of outdated and condemned equipments etc. be ensured.</p>
<p style="text-align: left;">(iii) Mis-utilization of manpower in other than the assigned duties of the Reservation and Booking Staff needs to be curbed.</p>
<p style="text-align: left;">(iv) UTS needs to be augmented so as to create this facility on all the railway station for smooth issuing of tickets to the travelling public.</p>
<p style="text-align: left;">(v) Check and balance to be maintained on e-ticketing system to prevent misappropriation etc.</p>
<p style="text-align: left;">(vi) Smart Card System be introduced to avoid long queues on booking windows.</p>
<p style="text-align: left;">(vii) Credit/Debit Card System may be thought of for issue of Reserved and Unreserved ticket.</p>
<p style="text-align: left;">(viii) Token System with Display Board be introduced in the PRS on all important and major stations to avoid longer queues and stress on the ticket issuing staff.</p>
<p style="text-align: left;">6. <em><strong>CAPACITY ENHANCEMENT ON INDIAN RAILWAYS</strong></em></p>
<p style="text-align: left;">(i) In the present resource constraints, double-decker passenger trains with Light Weight Bogie need to be introduced in all Mail, Express, Superfast, Passenger Trains.</p>
<p style="text-align: left;">(ii) For day-service trains, coaches having larger sitting capacity be utilised in place of conventional passenger coaches, for which, coaches of Jan Shatabadi Trains and Double Decker Trains would be most suitable.</p>
<p style="text-align: left;">(iii) For enhancement of freight loading capacity, new designs of wagons, having larger loading capacity need to be introduced.</p>
<p style="text-align: left;">(iv) Automatic Signalling System be introduced on all major routes to facilitate operation of more and more number of trains on the existing tracks.</p>
<p style="text-align: left;">(v) The length of the Mail, Express, Superfast trains may be further augmented with additional coaches.</p>
<p style="text-align: left;">(vi) Adequate number of Unreserved Express Trains, with newly designed coaches with sitting arrangement, be run on all major routes to cater the requirement of the poor people of the country.</p>
<p style="text-align: left;">(vii) Rather than providing Luggage Van in all passenger train services, separate Parcel Trains be introduced and the Luggage Van be replaced with Passenger Coaches for ordinary unreserved passengers.</p>
<p style="text-align: left;"><strong>7. PRIORITIZATION OF PROJECTS AND RATIONALISATION OF FUNDING</strong></p>
<p style="text-align: left;">(i) Allocation of funds should be given priority for those projects which are near completion so that the money already invested in the projects can be made effective use of on early completion of the same.</p>
<p style="text-align: left;">(ii) Projects of national interest still need to be given emphasis in view of national integrity and fulfilment of the aspirations of the people of the isolated areas.</p>
<p style="text-align: left;">(iii) Keeping in view the large-number of accidents occurring on manned-unmanned level crossings, ROBs and RUBs be given priority, which would not only help averting accidents but also save remarkable amount of revenue.</p>
<p style="text-align: left;">8.<strong><em> INNOVATIVE METHODS FOR ENHANCING THE EARNING AND FUNDING OF NEW PROJECTS</em></strong><br />
(i) Improper ticket checking system, due to shortage of checking staff, causes heavy financial loss to the Railways in the form of ticketless/irregular travelling.</p>
<p style="text-align: left;">(ii) Upgradation system of reserved accommodation is also not working well insofar as improvement in the railway earning is concerned.</p>
<p style="text-align: left;">(iii) Rationalisation of passenger fare with realistic approach is of utmost importance.</p>
<p style="text-align: left;">(iv) Useless wastage of money on the works executed without perspective and foresightness needs to be checked and accountability be ensured.</p>
<p style="text-align: left;">(v) Unwarranted for procurement also needs to be checked.</p>
<p style="text-align: left;">(vi) Timely disposal of surplus and condemned materials needs to be ensured.</p>
<p style="text-align: left;">(vii) Uncalled for intensive use of government vehicle needs to be checked.</p>
<p style="text-align: left;">(viii) Excessive misuse of manpower needs to be affectively curbed.</p>
<p style="text-align: left;">(ix) Freight Booking System needs to be modernised and upgraded to make it user-friendly.</p>
<p style="text-align: left;">(x) Undesired works in the name of beautification at the cost of safety need to be stopped.</p>
<p style="text-align: left;">
<p style="text-align: left;">9. <strong><em>REDUCTION IN EXPENDITURE ON INDIAN RAILWAYS</em></strong></p>
<p>(i) Unnecessary movement of managerial staff with the Saloon/RA should be minimised.</p>
<p style="text-align: left;">(ii) Foreign tours in the name of training to those staff and officers, particularly on the on the verge of retirement need to be stopped.</p>
<p style="text-align: left;">(iii) Musical Chair System on the posts of JAG and above be stopped.</p>
<p style="text-align: left;">(iv) Bungalow Peon System needs to be abolished.</p>
<p style="text-align: left;">(v) Proper utilization of surplus railway land be ensured.</p>
<p style="text-align: left;">(vi) Railways’ buildings need to be utilised for advertisement panels of reputed enterprises.</p>
<p style="text-align: left;">
<p style="text-align: left;">10. <em><strong>SPEEDING UP OF DECISION MAKING ON INDIAN RAILWAYS</strong></em></p>
<p>(i) As already announced by the Hon’ble Prime Minister, there is urgent need of speeding the decision making, for which paperless system, e-governance would be effective tools.</p>
<p style="text-align: left;">(ii) The authority to take decision in a particular matter should be widely known and on the pattern of Single Window System.</p>
<p style="text-align: left;">(iii) Decision in the particular case be ensured in maximum three layers.</p>
<p style="text-align: left;">(iv) There should not be diversified responsibility in decision making.</p>
<p style="text-align: left;">(v) Decentralisation of powers in case of decision making.</p>

<div>With reference to the minutes of the meeting circulated vide letter dated 18/02/2014. it is informed that NFIR furnishes inputs justifying withdrawal of New Pension Scheme in the Railways vide annexure to this letter.</div>

<div>NFIR trusts that a cogent case shall be made out by the Railway Ministry duly incorporating the inputs contained in the &#8220;Annexure” to be sent to the Finance Minister by the Railway Minister, proposing withdrawal of New Pension Scheme in the Railways.</div>

<div><strong>Why Liberalised Pension is required</strong></div>
<div>Indian Railways is one of the largest Railway systems in the World and is fully owned and operated by the Ministry of Railways (Railway Board), Government of India. It plays a significant role in driving economic growth of the country. offering highly affordable, environment-friendly transportation of passengers and freight specially bulk commodities across the country and also for rapid movement of Army, para-military forces and their connected artillery and military hardware to the Nation’s borders. The role of Indian Railways thus cannot be undermined under any circumstances.</div>
<div></div>
<div>Ministry ol Railways (Railway Board) introduced Pension System exclusively for Railway employees who entered Railway service on 16th November 1957. These rules were subsequently modilied as Railway Services (Pension) Rules 1993 and Railway Services (Extraordinary) Pension Rules 1993. It is also worth-mentioning that the Hon’ble Supreme Court in the case of DS Nakara and Others Vis Union of India (AIR-1983-SC-I30) gave following verdict:</div>

<blockquote><p>“Pension is neither a bounty nor a grace bestowed by the sweet will of the employer but is a payment for the past services rendered. It was construed as a right step towards socio-economic justice and a concrete assurance to the effect that the employee in his old age is not left in the lurch.”</p></blockquote>
</div>
<div>2. The New Pension Scheme introduced by the Government of India has not been made applicable to the following:</div>
<div></div>
<div>(a) Peronnel in Armed Forces.</div>
<div></div>
<div>(b) Personnel working in Para-Military establishments.</div>
<div></div>
<div>(c) The State Governments of West Bengal, Kerala and Tripura through their executive instructions consciously decided to continue with the liberalized pension scheme to their employees and not to adopt new pension scheme.</div>
<div></div>
<div>3. <strong>Justification for scrapping the New Pension Scheme:</strong></div>
<div></div>
<div>3.1 <strong>Unique RaiIways working:</strong></div>
<div></div>
<div>3.1.1 Federation wishes to invite attention to the fact that the working of Indian Railway is totally different and distinct as compared to other Departments of the Central Government. Even during the colonial period, the Railways was conceived and operated as an auxiliary wing of the Army, primarily because of its nature of work rendered round the clock, 365 days in the year facing extremely tough working conditions in all seasons may be extreme hot, cold or torrential rains and its well-defined role in rapid movement of troops across the Indian sub-continent, more particularly on the borders when the Railway employees are exposed to the peculiar situations. It is also worth-mentioning that though the Indian Army fights war once in two/three decades. Railway employees are required to face war-like conditions/situations in their day to day work &#8211; may be due to derailment, accidents breaches, bandhs. civil disobedience movements besides providing back up support for Army by ensuring speedy rail movement.</div>
<div></div>
<div>In support of the above contention, NFIR wishes to bring to the notice following excerpts from the Report of “The Railway Safety Review Committee. l998” (Part-I) headed by Retired Judge of the Supreme Court (Justice HR Khanna) where the Committee has observed as under:</div>
<div></div>
<div>‘During the colonial period, the Railways was conceived and operated as an auxiliary wing of the Army, primarily because it provided the transport muscle that enabled rapid movement of troops across the Indian sub continent. There was, however, another less visible but important reason for the close linkage with the Army. The colonizers realized that the Railways, by virtue of its complex nature, required a high degree of discipline and efficiency to be able to perform its role as the prime transport mode. This, in turn, meant a system of working more closely allied to the Armed Forces than the sometimes lax civilian forms. Thus historically, Indian Railways (IR) has functioned differently from other Government Institutions.”</div>
<div></div>
<div>Justice Khanna has therefore observed in the report that it is not only unrealistic but also dangerous to treat the Railways and its problems on par with other Government departments which has unfortunately been the case with the Indian Railways post</div>
<div>independence.</div>
<div></div>
<div>3.1.2 Indian Railways is quite unique in its working and distinctive in character. A lot of challenges are required to be faced to make the railway system safe, reliable, efficient and capable of fulfilling the needs of not only of common public through transportation of passengers and other products like Iron ore, minerals, food-grains etc. but also ensuring safety of the country by reaching the border areas. During the course of performance of duties a number of Railway employees lose their lives and also sustains injuries like Military and para-military forces. The report submitted by the High Level Safety Review Committee, comprising of  Technocrats and Specialists in the field led by eminent scientist Dr Anil Kakodkar had highlighted following figures in respect of railway employees vis-à-vis passengers/general public killed and injured during the year 2007/08 to 2011 :-</div>

<div>The above position is sufficient to prove that the working of Railway staff cannot be treated as less arduous than the Military and Para-military personnel and there is need that Railway employees are exempted from the application of New Pension Scheme, presently called National Pension System and the Railway employees should continued to be governed by the Liberalized Pension Scheme called as Railway Services (Pension) Rules. 1993 and or Railway Services (Extraordinary Pension) Rules, 1993.</div>
<div></div>
<div><strong>3.2 Uniqueness of Indian Railways and the crucial role of railway employees for providing efficient services:</strong></div>
<div>There are only two things which moves uninterruptedly, one is ‘Wall Clock’ and the other is Indian Railways. There are certain factors which epitomizes Indian Railways as Unique such as</div>
<div></div>
<div>&#8211; hazards induced by job environments, sorking conditions and capital health which are totally uncommon. These conditions prevail only in Armed Forces.</div>
<div></div>
<div>&#8211; Rigorous medical standards, periodic updating of skills, workforce to prepare itself to match with changed technological upgradation-Unique to Railways.</div>
<div></div>
<div>&#8211; Railway employees job profile have built in integration of performance-cum-safety, execution-cum-self certification besides extended duty hours demanded by critical operational regime.</div>
<div></div>
<div>&#8211; Like Armed Forces, the Railway employees are expected to remain at their Headquarters/Stations even while availing periodic rest and they should report to duty in emergency and in the event of any untoward eventuality. Without prior permission</div>
<div>they cannot leave Headquarters even during Rest Day. This system is not prevailing in any other Central Government Organization.</div>
<div></div>
<div>&#8211; Even when they avail lease, they are expected to give the address on leave facilitating the Railway management to summon them to take up duty at a short notice. This is akin to that of Armed Forces.</div>
<div></div>
<div>&#8211; Railway employees are expected to rise to the occasion in the event of any crisis like accidents, floods. sabotage etc even while on leave and assist the system.</div>
<div></div>
<div>The above provisions are in-built in various Rules laid down by the Railways.</div>
<div></div>
<div><strong>3.3 Uniqueness in the duties:</strong></div>
<div>The uniqueness in performing the duties of railway employees which are unmatched &amp; second to none, is that the employee has to continue on duty and to wait for his reliever to Lake charge and he is not expected to leave the post al though duty hours are complete unless and until his reliever reports and takes charge, e.g. Train Controller, Station Master, Electric Signal Maintainer, Technical staff Loco Pilots, Guards etc. Thus their nature of duties are akin to that of defence personnel.</div>
<div></div>
<div><strong>3.4 Exposed to Risks :- </strong></div>
<div>While performing duties whether running the trains, maintaining Tracks/S&amp;T assets. attending to under-gears of the rolling stock the staff sneak in between two rails for ensuring train formations fit to run.</div>
<div></div>
<div>Continuously work under open Sky. in remote/jungle areas facing inclement weather conditions, susceptible to air pollution and high decibel noise which are unique so far as hazardous working conditions faced by vast majority of railway employees similar to the conditions faced by army personnel during war time.</div>
<div></div>
<div>Vast majority of Railway employees work at remote places, jungle areas and road side stations where number of amenities do not exist — this is similar to that of Defence forces.</div>
<div></div>
<div>Nature of Railwaymen’s working is against cultural harmony, biological clock i.e. round the clock working in shifts, continuously night duties resulting into irregular living like that of military/para-milìtary personnel.</div>
<div></div>
<div>Railway employees are exposed to anti-social elements in the course of performing duties which is also unique to the Railway System similar to the situations faced by para-military staff;</div>
<div></div>
<div>Railway employees are liable for criminal prosecution in case if accidents as their nature of duties are connected with the movement of trains round the clock with high safety standards while ensuring punctuality &#8211; a peculiar situation which is not faced by the staff of any other Ministry/Department of Central Government.</div>
<div></div>
<div>The duties of Railway employees are strenuous as Indian Railways is an operational transportation network. Continuous stress and strain in the course of performing duties has been resulting in health hazards like Hyper-tension, diabetes, Ulcer, Cardiac problems leading to premature deaths, medical invalidation at a scale larger than Armed para-military forces. It is reported that the number of deaths while on duty or in service or on leave/sick is nearly 10000 per annum. This alarming number of deaths is due to various difficult working conditions.</div>
<div></div>
<div>Rail work force are expected to possess quick reflexes like that of armed forces for ensuring best services to the customers.</div>
<div></div>
<div><strong>4. Indian Railways’ Resources</strong></div>
<div>Indian Railways have their own budget. Dedicated and devoted services of Railway employees is a real contributing factor for running this important transportation system. The earnings generated by the Indian Railways due to continued efficient services of all the categories of employees have not only resulted in substantial earnings but also made I.R., to meet the expenditure towards staff wages, allowances, pension liabilities etc.. thus capable to absorb these commitments from its own resources.</div>

<div><strong>5. Healthy Industrial relations</strong></div>
<div>The country as well as the Indian RaiIways should feel proud of its work force which has been working relentlessly for providing satisfactory services to the Customer. Healthy Industrial Relations have been built by pursuing mutual trust and co-operation among the staff of all categories as well as the management during the last 39 years. Not a single man-day has been lost on employees account during the period of four decades in the Railways due to disciplined work culture in bulk among the employees. The New Pension Scheme has unfortunately resulted into disappointment and frustration among railway employees. This needs to removed for ensuring equal justice to all employees irrespective of their date of appointment whether they are pre 01/01/2004 or post 01/01/2004. Withdrawal of New Pension Scheme in Railways would generate good industrial relations and contribute for improved efficiency and best operating ratio.</div>

<div>1. Discriminatory treatment between two sets of Railway employees viz – one appointed before 01.01.04 and the others appointed on 01.01.2004 and thereafter.</div>
<div>
2. Although the contribution is defined, the benefit has not been defined.</div>
<div>
3. <strong>Extract from Railway Safety Review Committee,</strong> 1998-vide para 2.1.1 and para 2.1.2 the Committee has recommended that the working in the Railways is more closely allied to the armed forces than the sometimes lacks civilian forms. As such railwaymen cannot be bracketed with other Central Govt. Employees for the purpose of Social benefit.</div>

<div>4. Committee on railway safety was appointed by the Ministry of Railway under the Chairmanship of Dr. Anil Kakodkar. Vide para 2.3 of the report is cited below:</div>

<div>It would be seen that number of Railwaymen killed and injured while on duty during the period 2007 – 08 to October, 2011 was much more than passenger and public killed during the year.</div>
<div></div>
<div>5. Railwaymen are the second line of Defence. During Chinese aggression in the year 1962 there was massive exodus of civil population near in Arunachal Pradesh and North Bank of Brahmaputra, currency notes were burnt at the order of Dy. Commissioner, Tezpur (Sonitpur), the jail birds were freed but the Railwaymen did not leave their duty post. In this connection extract from Special Gazette published by the Railway Board during Railway Week, 1963 is given below.</div>
<div>
<blockquote><p><strong>“On the night of 20/21 November, 1962 following the exodous of Civil Population from Rangapara North in the Wake of reported Chinese advance Shri Rakhal Das Banerjee bravely struck to this post in the Station, displaying an extra ordinary sense of duty and great courage, he ensured safe custody of Railway Cash amounting to Rs. 26 lakhs”.</strong></p></blockquote>
</div>
<div>Similarly when Pakistan attacked India during 1965, the Railwaymen at the Western Sector saved lives of thousands and thousands of people by sacrificing their own lives while Bomb was exploded on Oil Tankers (Raway Wagon Tanker) (This News was appeared in the Railwaymen of 1965, may be 1966), they parted the effected wagons from the rest, but in the effort an good number of Railwaymen burnt alive.</div>
<div></div>
<div>Braving insurgency, Railwaymen continued to maintained the services in North Eastern Region, Naxual infested areas in Jharkhand, Madhya Pradesh, Crissa, Andhra Pradesh etc.</div>
<div></div>
<div>In May 2008, Loco Pilot of Lumding N. F. Railway saved lives of many persons at the cost of his own life and he was awarded ‘KIRT1 CHAKRA’. The incident is as under.</div>
<div>
<blockquote><p><strong>“On 15th May, 2008, ShrI N. N. Bora, Loco Pilot, Lumding was booked to work Security Special from Lumding. When the Special reached nearTunnel No. 3 at KM 57/12 between Lumding — Badarpur section terrorist pumped bullets injuring Shri N. N. Bora critically. Despite critical injury Shri Bora’s devotion to duty and presence of mind worked, the train was pushed back to a safer place and Shri Bora succumbed to the u/njury. He could save lives of all his colleagues in the train, sacrificing his life”.</strong></p></blockquote>
</div>
<div>6. <strong>NPS is an additional financial burden in the Railways Exchequer.</strong></div>
<div>Indian Railway is paying pension and family pension and in addition to that the Indian Railway is to contributing 10% of pay and 10% of Dearness Allowance to the Pension Fund (NPS). At present the number of New Pension Holders are 4.5 Lakhs taking the average salary of such newly recruited persons as Rs. 20,000, at present the Railway is paying Rs. 2160 Crores annually towards Pension Fund. This will go on increasing with more and more persons to be recruited vice retirement and the amount will also be compounded because of annual increment, increase in the rates of Dearness allowance, MACP &amp; Promotional benefits. This is the additional burden which the railway will have to bear with its compound effect from coming years to years on the Railway’s Finance.</div>

<div>7.<strong> Effect on Industrial relation</strong></div>
<div>Gradually the number of new recruitees on or after 01.01.2004 will take over the number of persons appointed prior to 01.01.2004 and they will compel their pre 01.01.2004 counterparts to join precipitateve action to secure their (NPS Holders) rightful daim of social security i.e. Pension and Family Pension and this will leads to serious industrial unrest in the Railway Industry.</div>

<div>Taking all these factors into consideration all Railwaymen irrespective of date of appointment should be covered under Pension and Family Pension Scheme.</div>
