<p>Dear Sir,<br />On behalf of the Staff Side Members of National Council JCM and the entire Central Government Employees and Pensioners I wish you a very happy and prosperous New Year 2025 in advance. It is now 09 years after the implementation of the 7 CPC recommendations and the next Wage revision and Pension revision is due from 01.01.2026, since the wages of the Central Government Employees and Pension of the Central Government Pensioners are revised once in 10 years. This periodicity is maintained from the implementation of 4th CPC, i.e., from 01.01.1986. This office vide letter referred above have requested your good self (Copy enclosed for ready reference) that the Government may constitute the 8th Central Pay Commission immediately. It is now more than 06 months after we submitted our request. So far we have not received any positive response from the Government.</p>



<p>Sir, you will appreciate that the 7th Central Pay Commission was constituted well in advance ie., on 28.02.2014, almost 02 years before the implementation date of 01.01.2016. However, just 01 year only is left for the next wage / pension revision. The Pay Commissions used to take almost 02 years period for Submitting their final report to the Government and the Government takes 03 to 06 months for considering and implementing its recommendations. In this back drop I feel there is no justification in further delaying the matter. Hence it is once again requested that you may kindly take up the matter with the Hon’ble Prime Minister and Finance Minister for immediate constitution of the 8th CPC.</p>

<h3 class="wp-block-heading">Subject:  Benefit of Central Government Employees Group Insurance Scheme on Re- Classification of posts according to Grade Pay of Master Craftsman.</h3>



<p>Sir,</p>



<p>With due regards, it 1s submitted that the Ministry of Finance (Department of Expenditure) vide its Notification G.S.R. 552 (E), Dated 28th July 2009 has amended the Central Civil Service (Revised Pay) Rules, 2008 whereby Master Craftsmen has been granted the Grade Pay of Rs. 4200/- and Highly Skilled Workers are split in a ratio of 50 : 50 and re-designated as Highly Skilled Worker Grade-II (Grade Pay of Rs. 2400 in Pay Band PB &#8211; 1) and Highly Skilled Worker Grade-I (Grade Pay of Rs. 2800/- in Pay band PB &#8211; 1).</p>



<p>Accordingly the pay scale of Master craftsman has been revised from Rs. (4500 &#8211; 7000) to Rs. (5000 &#8211; 8000) vide MOD letter F. No. 11(5)/2008/ D(Civ-I) Dated 28th Aug, 2009 as per SRO &#8211; 11 E and the post of Highly Skilled (4000 &#8211; 6000) has been bifurcated in the ratio of 50 : 50 whereby 50 per cent incumbents have been upgraded as Highly Skilled grade &#8211; I in the pay scale of Rs. (4500 &#8211; 7000). As per above notification, the artisan staff in MOD 1s restructured w.e.f. 01.01.2006 as under </p>



<ol class="wp-block-list">
<li>Skilled (5200 &#8211; 20200) plus 1900 Grade pay</li>



<li>Highly Skilled-II ( — Do–  ) plus 2400 Grade pay</li>



<li>Highly skilled-I ( — Do–  ) plus 2800 Grade pay</li>



<li>Master Craftsman (9300 &#8211; 34800) plus 4200 Grade pay</li>
</ol>



<p>It is also submitted that Department of Personnel &amp; Training vide their S.O. 946 (E), dated 9th April, 2009, re-classified the posts on the basis of Grade Pay and accordingly the Grade Pay of Rs.4200/- has been classified as Group ‘B’ .</p>



<p>In order to facilitate the Central Government Employees, at a low cost and on a wholly contributory and self financing basis, the twin benefits of an insurance cover to help their families in the event of death during service and a lump sum payment to augment their resources on retirement, the CGEGIS 1980 was introduced and Para 5.2 of GOI, Min of Finance O.M. dated 31-01-1989 and 09-08-1989 stipulates that rate of subscription for the scheme shall be Rs. 60/- for Group ‘B’ Employees and the amount of insurance cover will be Rs. 60000/- (Sixty Thousand).</p>



<p>This issue (deduction of subscription of CGEGIS) has been raised by BPMS in the Steering Committee meeting for 89″ Departmental Council (JCM) (MOD) as Agenda Point No. 106 and the minutes forwarded vide MOD ID No. 5(1)/2010/D (JCM), dated 27th Aug, 2010 stipulates that CGDA has issued to all the controllers to deduct the monthly subscription towards CGEGIS as per re-classification of posts in compliance with MOD ID No. 10(1)/2012/ D(Civ.ID), dated 29.06.2012.</p>



<p>It is learnt that the subscription of CGEGIS from MCM in DGQA is still being deducted only Rs. 30/- per month which is applicable for Group ‘C’ employees, whereas the Master Craftsman is to be construed as Group ‘B’ employees and their subscription should have been deducted @ Rs. 60/- per month w.e.f. 01.01.2006. It 1s worth to mention here that other Dtes/HQrs of MOD including erstwhile OFB has implemented the above instruction except DGQA. Copy of the OFB letter 1s enclosed for your ready reference.</p>



<p>Hence, you are requested to issue necessary directives to the concerned authorities so that MCM of DGQA may also be entitled for subscription of CGEGIS @ Rs. 60/- per month.</p>

<p>Dear Sir,</p>



<p>This Office is receiving representations from individual employees as well as from the employees organisation of various Ministries / Departments with regard to an unsettled anomaly in the date of increment which has cropped up after the implementation of 6th CPC recommendations. Details of the case with illustration is given below for your favorable consideration as a onetime measure.</p>



<p>During the year 2006 prior to publication of 6th CPC recommendations several promotions MACP / appointment took place in the month of January-2006. Accordingly individuals who have been promoted/MACP granted in Jan-2006 were supposed to get next increment in Jan’2007. But due to fixation of uniform annual increment fixed as 15t July of the every year by 6th CPC, The individuals got next increment in July-2007 instead of Jan-2007 ie. after 17 months ( more than 12 months) Instead of 12 months.</p>

<p>In order to address the such 6th CPC anomalies, vide ref(3) DoE has given an option of annual increment twice in a year 1.e. Jan &amp; July vide CC5(RP) rules,2016 and FR&amp;SR part-I w.e.f. 01/01/2016. But for the cases of MRCP/ Promotion/ Appointment between 2-jan to 3O June 2006 to 2015 whoever was granted the benefit of Entry Pay are not addressed. This batch got its first Increment after completion of 13 to 17 months service Instead of 12 months. But in same years i.e, between 2006¬2015 the individuals got MACP/PromotioniAppolntment between 2nd July to 31 December got the benefit July increment within the year. This situation is resulting the financial loss, incremental seniority loss and terminal benefits loss to the retiring employees.</p>



<p>In view of the above position we propose the following two option for the favorable consideration of the DOP&amp;T and Department of Expenditure for issuing of necessary government orders.</p>



<p><strong>Option 1:</strong></p>



<p><strong>The above illustration is self-explanatory that the individual if given increment in Jan/July-2007 will get next increment in reasonable period. Therefore, such individuals may be given an increment on next Jan/idly to rectify the anomaly risen w.e.f. 1/1/2006 onwards, The issue may be considered by amending the effect date of ref(3) OM retrospectively from 01/01/2006 in place of existing 01/01/2016</strong></p>



<p>Or</p>



<p><strong>Option 2:</strong></p>



<p><strong>Option may be given to those whose date of increment fallen beyond one year i.e. on 2-jan to 30 th June 2006 to 2015 entry pay due to 6th CPC uniform increment (July of every year) to switch over from 6th CPC to 7thCPC on 01/01/2016, so that their DNI can be January as per the guidelines of ref (3) M0F/DoE memorandum.</strong></p>

<h4 class="wp-block-heading"><strong>5.12. Item No. NC-48/6 / 21: Withdrawal of orders of DA/ DR freeze (DoE).</strong></h4>



<p>Leader, Staff Side, stated that the 32 lakh Central Government Employees and 50 lakh pensioners have been affected by this decision of the Government and there is a need to immediately release the next instalment of DA/ DR and arrears from 01.01.2020. He said that it was a drastic decision to pause DA/ DR for one and half year &amp; that more than 80% of the serving employees as well as pensioners are low paid and are worst hit by this decision.</p>



<p>Shri Guman Singh, Member, Staff Side stated that while the Government has decided to freeze the DA/ DR in a situation when the cost of living is increasing rapidly, causing increased hardship to the employees.</p>



<p>Shri Sadhoo Singh, Member, Staff Side, stated that the retired staff has been specially hit hard by the freeze of DA/ DR.</p>



<p>Shri J.R. Bhosle, Member, Staff Side, also spoke regarding the need to roll back the Government’s decision in this regard.</p>



<p>Secretary, Staff Side, mentioned that the Hon’ble MoS, Finance made a commitment to release the withheld three instalments of DA/ DR (due from 01.01.2020, 01.07.2020, and 01.01.2021) on the Door of the Parliament which sought to be honoured.</p>



<p>Addl. Secretary (Pers.) , DoE informed that the decision to withhold three instalment s of DA/ DR was taken with the approval of the Cabinet, as per which, arrears are not to be paid. Chairman stated that the decision was taken by the Government in view of difficult circumstances faced due to the Pandemic and extremely heavy burden on the exchequer to deal with the various requirements such as vaccination, development of infrastructure etc. He assured that the Government is fully sensitive to the difficulties being faced by the employees and the pensioners and that a decision in this regard would be taken by the competent authority in due course.</p>



<p><strong>Decision: The chairman informed that the matter will be placed before the Competent Authority for an appropriate decision as early as possible.</strong></p>

<h2 class="wp-block-heading">Agenda Points for National Council JCM meeting</h2>



<ol class="wp-block-list"><li>Availability of option to switch over to <a href="https://centralgovernmentnews.com/7th-pay-commission-latest-news/" target="_blank" rel="noreferrer noopener">7th CPC</a> pay scales after the date of Gazette Notification of CCS (PR) Rules 2016. If an employee gets Promotion/ Financial up-gradation after notification date i.e. 25th July 2016.</li><li>Night Duty Allowance should be paid to authorised category worker in Railway &amp; Defence without ceiling according to 7th CPC Pay Scales.</li><li>Trade union activities should be allowed in Hospitals/ Training Esttd./ Station HQ under Ministry of Defence.</li><li>Important Office Bearers of Registered Trade Unions should be granted the status of <strong>“Protected Workman”</strong> under the provision of the Industrial Dispute Act 1947 and Industrial dispute (Central) rules, 1957.</li><li><strong>“Head of Departments”</strong> should be empowered to decide the <strong>“ Hazardous Operations”</strong> for the purpose of Payment of “Risk allowance” in Min of Defence.</li><li>All the vacant posts in Group ‘B’, ‘C’ and erstwhile Group ‘D’ should be filled up without further delay.</li><li>CGEGIS benefits should be enhanced so that minimum insurance be enhanced to Rs 15 Lakh.</li><li>Medical Cashless facility should be extended to all the serving employees.</li><li>DOP&amp;T should clarify that promotion/up gradation granted under the ACP scheme in the post to those grades which now carry the same grade pay/ level due to merger of pay scale/ up-gradation of posts recommended by the 7th CPC shall be ignored for the purpose of granting up-gradation under MACP.</li><li>Grant of One Increment on the notional basis regarding the calculation of all pensionary benefits to the employees retiring on 30th June and whose DNI is 1st July.</li><li>Cadre review of MTS employees under Min of <a href="https://centralgovernmentnews.com/category/defence/" target="_blank" rel="noreferrer noopener">defence</a> for providing the opportunity of promotional avenues.</li><li>Govt has decided to Benchmark ‘Very Good’ for the purpose of MACP on the recommendation of 7th CPC. The decision has led to the exploitation of employees. Therefore the decision should be considered for MACP.</li><li>Employees should be given the option to Opt MACP whether from 01-01-2006 or 01-09-2008 whichever is more benefits to them.</li><li>All the employees should be granted the benefits of the old pension scheme viz CCS (pension) rules 1972 if their appointments are based on the vacancies notified prior to 01-01-2004 viz the date of implementations of National Pension System (Earlier Known as New Pension System). It is worth to mention here that various Hon’ble CATs/High Court have delivered Judgements in favour of likewise employees.</li><li>Govt is the largest litigant in this country. To reduce the litigation the benefits under Judgement pronounced in a matter should be extended to all similarly placed employees.</li><li>Correlation of hourly rate of industrial workers (Piece Worker) of OFB based on 7th CPC Pay Scale with the effect of 01/01/2016.</li><li>Scrap New Pension Scheme (NPS) and reintroduce the Old Pension Scheme CCS Pension Rule 1972.</li><li>5% recruitment quota should be enhanced for all dependents of deceased employees of Central Govt. and with the giving, one-time relaxation to all awaited dependents should be provided Job.</li><li>On the matter of Corporatisation of OFB under the working ministry of Defence should be reviewed and after restructuring these ordnance factories kept in the govt. entity.</li><li>The order of Corporatization to railway workshop returned back. The private sector should be kept out from the railway and the operation of the railway should be kept as a government entity so that the interest of economically weak citizens of India could be protected.</li><li>The decision of GOCO model of EME Base Workshop under MOD should be stopped and provide the workload to EME base workshop. Issue necessary orders to provide spare parts timely.</li><li>In various departments under MOD so many workers have been replaced and reverted on the behalf of restructuring, transferred employees are facing troubles in other places. Some institutions have been closed or merged. Therefore necessary action should be taken to stop these activities in DGQA, DRDO, and EME.</li><li>Policy formation for direct recruitment of trained trade Apprentice of Railway &amp; Defence as per the amended provision of section-22 of apprentice act 1961.</li><li>MACP should be provided in a promotional hierarchy instead of the next pay level.</li><li>The Government employee should be permitted to change their Hometown / Permanent Address on two occasions instead of one.</li></ol>

<h3 class="wp-block-heading">Sub: Brief of the meeting held today with the Cabinet Secretary (Government of India)</h3>



<p>Met today with the Cabinet Secretary (Government of India) and handed him over a copy of our letter dated 16th January 2021, expressing our anguish over the freezing of Dearness Allowance/ Dearness Relief payable to the Central Government Employees and Pensioners/ Family Pensioners. I also demanded for payment of Dearness Allowance/ Dearness Relief with arrears since 01.01.2020.</p>



<h2 class="has-text-align-center wp-block-heading"><strong><a href="https://centralgovernmentnews.com/expected-da-2021/" target="_blank" rel="noreferrer noopener">Expected DA 2021</a></strong></h2>



<p>During the course of the discussion, the Cabinet Secretary said that the country was passing through an unprecedented situation, that is why, Government had to take such an action, but he further said that there should not be any doubt that freezing of Dearness Allowance/ Dearness Relief will continue even after 30th June 2021.</p>



<p>I also asked him that, no action has been taken in our letter dated 11th January 2021 (Reg. the undue delay in settling the issues discussed in the meeting of the Standing Committing of NC/JCM and 47th meeting of the NC/JCM). He immediately called Addi. Secretary(Esstt.), DoP&amp;T, and asked her to organize all the meetings due as well as to get implemented the issues agreed in the meetings of the NC/JCM referred to above.</p>

<h3 class="wp-block-heading"><strong>Sub: Payment of Dearness Allowance to Central Government employees and Dearness Relief to Central Government pensioners at current rates due to improved Covid and financial situation in the country.</strong></h3>



<p>Respected Madam,</p>



<p>Vide Office Memorandum dated 23rd April, 2020 of Government of India Ministry of Finance , Department of Expenditure letter No. 1/1/2020-E-II-B, the additional DA for CG employees and DR for pensioners was freezed from 1st January 2020 till 1st July 2021 due to the reason “view of the crisis arising out of <strong><a href="https://centralgovernmentnews.com/tag/covid-19/" target="_blank" rel="noreferrer noopener">COVID-19</a></strong>”. These orders are applicable to all Central Government employees and Central Government pensioners. Which has affected both the serving employees and pensioners and especially to those who have retired during the period 1st Jan 2020 to 1st Jan 2021.</p>



<p>The Covid-19 situation in India has improved considerably and under control with a vast population of the country are unaffected by the Covid-19, The Covid cases in September 2020 was around 95,000 cases daily , on 4th January 2021 is around17,000 cases which is lowest in six months, with less mortality rate.</p>



<p>The economic situation in the country has also improved compared to April- May 2020 situation, where the industrial production had gone down to minus 57% and in October to plus 3.6 % Industrial production has vastly improved with a recovery , the financial position of the country has also improved considerably the GST collections has shown a positivity in last four months.</p>

<p>The Goods and Service Tax collection for December 2020 touched a record high of Rs 1.15 lakh crore. This is the highest ever collections since the implementation of the countrywide tax in July 2017.</p>

<p>The Central Government employees have attended their assigned duties even during the pandemic situation, many have lost their sacrificed their life for the nation building, hence there contribution should be taken into the account.</p>



<p>The additional financial implication on account of this increase in Dearness Allowance for additional 11% DA is due which works out to 13,000 crores annually, which is manageable under the existing financial conditions , more over this will benefit about 49.93 lakh Central Government employees and 65.26 lakh pensioners who pump this money into the market which also improves the economy considerably and about 30% of the amount spent is collected back by the Government by way of taxes.</p>

<ol class="wp-block-list"><li>Senior Section Engineers (SSE) in the category of Technical Supervisors were given no improvement in the Cadre Restructuring since 1984 and Junior Engineers (JE) are eligible for only one promotion in their cadre as apparent from the following table – in spite of manifold increase in duties and responsibilities of the Technical Supervisors&nbsp;<em>I&nbsp;</em>Rail Engineers:</li><li><strong>NO IMPROVEMENT FOR SSE IN THE CADRE STRUCTURE OF TECHNICAL SUPERVISOR</strong></li></ol>

<ol class="wp-block-list" start="3"><li>There has been no upgrading or Cadre Restructuring of the Apex Grade of Group ‘C’ ever on the Railways – (either in 1979, 1984, 1993, 2003 or 2013). Consequently there is extreme stagnancy &amp; resultant frustration amongst the incumbents of the Apex Grade ‘C’- especially amongst the Technical Supervisors&nbsp;<em>I&nbsp;</em>Rail Engineers on the Railways.</li><li>The post of SSE in the pay scale 2375-3200 in 4th CPC, Rs.7450-11500 in 5th CPC, G.P Rs.4600 in 5th CPC and Pay Level-7 in 7th CPC had not received any upgradation in the past five cadre restructuring exercises.</li></ol>



<ol class="wp-block-list" start="5"><li>There has been substantial increase in the duties and responsibilities over the years of the Technical Supervisors&nbsp;<em>I&nbsp;</em>Rail Engineers (JEs &amp; SSEs) due to modernisation and advancement of technology on the Railways – but this has not been recognised or remunerated in any manner whatsoever – especially in the case of Senior Section Engineers.</li><li>Most of the employees get 3 or 4 promotions or even more in their service in Railways, except JEs &amp; It is pertinent that JEs with Diploma in Engineering and one year training and SSEs with Graduate in Engineering and one year of on the job training – are getting stagnated in the Apex Group C scale without any further avenue of promotion except in rare 2% cases. JEs enter in Pay Level-6 will get only one promotion to Pay Level-7. SSE with Graduate in Engineering qualification enter in Pay Level-7 and will remain stagnant in the entry grade itself. The JEs &amp; SSEs rot at Pay Level-7 throughout their career since they have very meager number of posts in Group-B.</li></ol>



<ol class="wp-block-list" start="7"><li>Less than 2% of Technical Supervisors – (entering with Diploma or Degree in Engineering) – reach Group B level and only a small fraction thereof reach Group A level- due to very meager number of Posts in Group A &amp; B vis-a-vis Group ‘C’ and non­ implementation of DoPTs orders regarding Classification of Posts – issued after the last five Pay Commissions on the Railways. Large majority of Technical Supervisors do not get promotion to the Gazetted cadre except in a very few cases and that too at the fag end of their career. Even after acquiring long years of experience and expertise they remain and mostly retire in the Supervisory cadre itself.</li></ol>



<ol class="wp-block-list" start="8"><li>Terms of reference of Cadre Restructuring Committees have not allowed the CRC Committees to do the cadre restructure exercise in pan-railways approach taking all management &amp; cadre issue into Instead work of CRC committee had been restricted to Group ‘C’ defeating basic purpose of CRC.</li><li>In the new scenario of high speed train operation, technological improvements, improved passenger amenities, handling of higher volume of traffic and management requirements thereof, it is requested that Combined “Cadre Restructuring” of posts in Group ‘A’, ‘B’ &amp; ‘C’ may please be considered to upgrade adequate number of Group C posts to Group A &amp; B – to fully meet with the job requirements of the posts of Technical Supervisors on Railways – keeping in view the following facts:</li><li>In the Technical Departments of Engineering, Mechanical, Electrical, Signal &amp; Telecommunications and Stores, only 3447 Group B posts for 77 lakh posts of Group C &amp; D, i.e. just 0.44% posts are available in Group-B – as indicated in the Tables below:</li><li><strong>Analysis of Staff Strength in the Technical departments of IR as on 31st March 2019</strong></li></ol>

<ol class="wp-block-list" start="12"><li>In fact, number of Group-B posts in Technical departments of Railways had witnessed negative It was reduced from 4274 to 3447 between the year 2009 and 2019. Thus strength of Group-B posts was reduced by 20% in a period of ten years.</li><li>In spite of more complex nature of duties and higher responsibilities on account of requirements of Safety &amp; modernisation, Railways have the lowest %age of Gazetted posts in Group A &amp; B vis-a-vis total strength – in comparison to total strength of all Central Government departments.</li></ol>

<ol class="wp-block-list" start="14"><li>In the present scenario of huge investments and fast &amp; prompt completion of new projects, more number of posts in gazetted cadre is essentially required, so that decision making and accountability can be broadened in the administrative hierarchy.</li><li><strong>Railway Board made a principle decision for combined cadre restructuring long back, part of minutes of Board meeting is given under,</strong><ol><li>It would be relevant to point out that on Indian Railways, Group ‘B’ officers constitute only 5% of its total workforce whereas, the average in respect of Group ‘B’ officers for All India Central Government employees comes to 5.6% i.e. 10.6 times higher as compared to Railway Group ‘B’ officers. Further, with reference to the Ministry of Culture which has the second lowest percentage of Group ‘B’ officers this ratio is 1:6 as compared to Railways. In this context, it is imperative that for efficient and effective utilization of existing manpower resources on Railways, the ratio of Group ‘B’ officer vis-a-vis non gazetted employees is to be improved keeping in view the functional consideration.</li><li>b) While the proposal for upgradation on above lines was under consideration the earlier AM (Staff) discussed the matter with both the Federations regarding upgradation of certain percentages of Group ‘C’ posts to Group ‘B’ gazette post and also regarding simplification in the selection procedure for Group ‘B’ Based on the said deliberations a Note for Discussion in Board’s Meeting was submitted. The said Note was considered in full Board meeting held on 29.11.2011 and Board directed as under:-</li><li>c) <strong>“Board directed that a comprehensive proposal on restructuring involving Group ‘C’, Group ‘B’ and Group ‘A’ cadres be worked out to enable Board to take a considered view”</strong></li></ol></li><li>7th CPC in its report for Technical Supervisors vide para 40.113 recommended that, <em>“Considering</em> <em>the feedback provided by the Railway Board and upon close analysis of the cadre structure, we are of the view that there is </em>some <em>element of stagnation at the GP 4600 stage. Accordingly , it is suggested that Railway Board should consider enhancing</em> <em>the number of posts in the next higher level” </em>…</li><li>It is therefore requested that the combined cadre strength of Technical Departments including all posts in Group- A, B and C on Indian Railways may please be restructured as under – so as to be comparable with, if not higher than, the All India Average % age of Group A, B &amp; C of Central Government employees in other Departments:</li></ol>

<p>Your attention is invited to the letter cited under reference above wherein beneficiaries under CGHS have been extended the facility to avail <strong><a href="https://centralgovernmentnews.com/tag/covid-19/" target="_blank" rel="noreferrer noopener">Covid-19</a></strong> related treatment in private hospitals empanelled under <a href="https://centralgovernmentnews.com/category/cghs/" target="_blank" rel="noreferrer noopener">CGHS</a>.</p>



<p>The pandemic is spreading rapidly with the passage of every day and it is observed that those personnel who are covered under the CSMA scheme are finding it extremely difficult to avail timely and proper treatment in the absence of guidelines.</p>
