<p>Sub: <strong>Rotational Transfer Policy applicable to CSS officers &#8211; Modification thereof &#8211; Regarding.</strong></p>



<p>The undersigned is directed to refer to this Department’s O.M. of even number dated 15th July 2015 and subsequent O.Ms dated h October 2016, 1st May 2017 and 30th November 2018 vide which revised Rotational Transfer Policy, applicable to CSS officers, was circulated.</p>



<p>2. The competent authority has now approved the following modifications/ additions in the Rotational Transfer Policy of <a href="https://centralgovernmentnews.com/category/css/" target="_blank" rel="noreferrer noopener" aria-label="CSS (opens in a new tab)">CSS</a> Officers:</p>



<p>(i) <strong>Para-12 (Officers returning from deputation/ long l eave/ long term training etc.)</strong> of the existing RTP guidelines is modified and replaced as under:</p>



<p><strong><span style="text-decoration: underline;">Posting of Officers of CSS on return from Deputation/ Long Leave/ Long Term Training</span></strong></p>



<p>An ASO/ SO/ US/ DS/ Director returning from Deputation/ Long leave/ Long Term Training will be posted to any Ministry/ Department based on the Administrative exigencies, with the approval of the Competent Authority. In such cases this posting will be treated as a fresh tenure. In case it is decided that an officer is to be posted back to the same Ministry/ Department he last served, then his tenure will be limited to the balance period of the tenure prescribed for the grade subject to the availability of the vacancy and subject to the condition that at least one year of balance tenure is left.</p>



<p>(ii) A new sub-clause is added to<strong> para 14 (Preference for Posting)</strong> of the existing RTP guidelines to the effect that:</p>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p>(f) The transferring out of Officers working in Establishment Office, DoPT will be done only with the concurrence of Establishment Officer (EO). The DoPT Administration will consult the EO and maintain a list of such Officers, ready to be sent to CS Division as and when RTP exercise is taken up.</p><p>(g) Any Officer who is not clear from vigilance angle and who may/may not be due for transfer under <a href="https://centralgovernmentnews.com/tag/rotational-transfer-policy/" target="_blank" rel="noreferrer noopener" aria-label="RTP (opens in a new tab)">RTP</a> may be transferred out in case a report is received from the concerned Ministry/ Department. Such an Officer will be posted to a non-sensitive post in any Ministry/ Department without seeking his option for posting irrespective of the tenure of his posting in that Ministry/ Department. No preference will be sought from such officer.</p></blockquote>

<p>The undersigned is directed to circulate the Vacancy Circular No. A-22017/02/2013 Admn-I dated 15th  January, 2020 (along with enclosures) received from Ministry of Health and Family Welfare who have invited application from retired Section Officer or equivalent or higher level and retired Assistant Section Officer or equivalent, well versed with Establishment / Administration Rules and procedure and who have served in Central Secretariat, for engagement as Consultant on contact basis initially for a period of one year or till a vacancy is filled up on regular basis whichever is earlier.</p>

<p>Directorate General of Health Services invites application from retired Section Officer or equivalent or higher level and retired Assistant Section Officer or equivalent, well versed with Establishment / Administration Rules and procedure and ho have-served in Central Secretariat, for engagement as Consultant on contract basis initially for a period of one year or till the vacancy is filled up on regular basis whichever is earlier. The consultant will be deployed in Dte. GHS (HQ) as well as other subordinate offices located in New Delhi. Detailed terms and conditions for engagement of consultants are Annexed. <p><strong>Terms and Conditions for engagement as Consultant in the Directorate General of Health Services.</strong></p>



<ol class="wp-block-list"><li>The consultant shall perform the services as assigned to him / her by his / her controlling officer / Administration Division.</li><li>The normal working hours would be from 9.30 a.m. to 6.00 p.m. with a lunch break of 30 minutes from 1.30 p.m. to 2.00 p.m. from Monday to Friday. The consultant will mark his/her attendance in Aadhar Enabled Biometric Attendance System.</li><li>In special circumstances, the Consultant could be called for services on holidays or beyond normal working hours for which no compensatory leave will be granted.</li><li>The consultancy will start from the date he/she join initially for a period of one year.</li><li>The consultant shall be paid a remuneration as per the formula of last pay drawn minus pension plus DA on existing rate. Mandatory deduction, if any, will be made. The remuneration for services rendered in a month shall be payable in subsequent month.</li><li>Directorate General of Health Services shall have the right to examine/ review the services provided by him/her at any time.</li><li>The consultant shall perform his/her obligations under his/her consultancy with all necessary skills, diligence, efficiency and economy.</li><li>No other facility whatsoever except remuneration shall be provided to him /her by the Directorate General of Health Services in his /her capacity as Consultant.</li><li>The Directorate shall not be responsible for any loss, accident, damages /injury suffered by him/her whatsoever arising in or out of the execution of his /her work, including travel.</li><li>During the terms of the consultancy, he/she shall not be engaged in any private business or professional activity which could conflict with the interest of the Government.</li><li>The Consultant shall treat all official information as confidential and use the same only for purpose of the performance of the services.</li><li>The consultancy can be terminated by either side by giving at least 15 days prior notice.</li><li>He /She will be allowed a day&#8217;s absence per month with remuneration. If this is not availed in a particular month the same shall be carried forward and can be availed in the next or subsequent month, but not more than three days absence in a single spell shall be allowed.</li><li>No typing assistance shall be provided</li></ol>

<p>Sir/ Madam,</p>



<p>Under Training For All (TFA) Scheme, this Department supports State / UT Administrative Training Institutes (ATIs) for conducting inter-alia the following training programmes:-</p>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p>(i) <strong>Intensive Training Programme (ITP)</strong>: to provide saturation training of frontline personnel manning the public service delivery chain, in sectors identified by States, in specific geographical area of a State/UT. This Programme aims to impact upon functional knowledge, skills and attitudinal orientation of the frontline functionaries through appropriately designed training interventions to make public service delivery effective.</p><p>(ii) <strong>12-Day Induction Training Programme</strong>: to develop generic and domain specific competencies in newly recruited Group-B (non-gazetted) &amp; Group-C cutting edge level State/UT Government functionaries for strengthening their capabilities to improve the public service delivery mechanism.</p><p>(iii) <strong>Comprehensive Online Modified Module on Induction Training (COMMIT)</strong>: for newly recruited frontline State/UT government functionaries to develop in them Generic &amp; Doman specific competencies</p></blockquote>



<p>2. In addition to the above, this Department also provides financial assistance under Augmentation of Capacity of Training Institutes (ACTI) for augmenting infrastructure in the form of hardware, software and courseware, networking of training institutions and consolidating the training ware. Under this Scheme, the training Institutes are also supported and encouraged for developing case studies, e-learning packages, training films, organizing workshops, special programmes, seminars etc (approved list of admissible items and item-wise rates are enclosed) Further, this Department is also implementing Faculty Development Scheme (FDS) to broaden and hone the knowledge and skill base of the Master Trainers (MTs) / Recognized Trainers (RTs), developed by this Department and faculty members working in Central Training Institutes (CTls)/ State/UT ATIs. Under this, this Department sponsors the MTs/ RTs/ faculty members of CTIs/ATIs for undergoing domestic short-term/ correspondence courses  conducted by various institutes of repute. The details of the programmes/ training exposures sponsored by this Department, the institutes recognized in this regard and eligibility conditions may be perused in this Department&#8217;s letter dated 28-04-2014 .</p>

<p>Accordingly, proposals are invited from the State/UT ATIs under the above-mentioned components for the financial year 2020-21. It may kindly be noted that the proposals of such State/UT ATIs, which have not furnished the Utilization Certificates in the prescribe format (in original) in respect of the funds already released by this Department, if any, and the ATIs which<br /> have not yet started filing the expenditure details in EAT Module of PFMS, will not be considered.</p>

<p>Subject: <strong>Early Closure of Central Government Offices in connection with Republic Day Parade and Beating Retreat Ceremony during January, 2020 &#8211; regarding</strong></p>



<p>In connection with arrangements for the Republic Day/ At Home Function / Beating Retreat Ceremony, 2020, it has been decided that the Government offices located in tile buildings indicated in <strong>Annexure-A</strong> would be closed from 1300 hours on 25.01.2020 to 13 00 hours on 26.0 1.2020. These buildings would also be closed at 1830 hours on 22.01.2020 and will reopen at 1300 hours on 23.0 1.2020 for the full dress rehearsal.</p>



<p>2. The buildings indicated in <strong>Annexure -B</strong> would be closed on 26.0 1.2020 till 1930 hours for &#8216;At Home Function&#8217;. The buildings indicated in<strong> Annexure-C</strong> would be closed at 1200 noon on 29.01.2020 till 1930 hours on 29.01.2020. The buildings indicated in <strong>Annexure-D</strong> would be closed on 28.01.2020 from 1600 hours till 1930 hours for the full dress rehearsal for Beating Retreat Ceremony.</p>



<p>3. The above arrangements may please be brought to the notice of all cancelled.</p>

<p>Subject: <strong>Review of PPS/PPS (ad-hoc) of CSSS under FR 56(J) and Rule 48 of CCS (Pension) Rules, 1972 &#8211; regarding</strong></p>



<p>The undersigned is directed to refer to this Department&#8217;s OM of even number dated 08.11.2019 and subsequent reminder dated 03.12.2019 on the subject mentioned above and to say that only 18 cadre units of CSSS as shown in Annexure have provided the inputs in respect of those officers who are covered under the extant provisions of FR 56(J) and Rule 48 of C<a href="https://centralgovernmentnews.com/tag/ccs-pension-rules/" target="_blank" rel="noreferrer noopener" aria-label="CS (Pension) Rules (opens in a new tab)">CS (Pension) Rules</a>, 1972.</p>



<p>2. It may be appreciated that this all important exercise is to be carried out on top priority and on a regular &amp; continuous basis. It is unfortunate that the inputs are not being received promptly from a large number of cadre units delaying the process.</p>



<p>3. All the remaining cadre units are, therefore, once again requested to furnish the information as per the proforma attached immediately and the same may be furnished to this Division by 21.01.2020 positively. Soft copy of the same may also be sent to &#8216;dinesh.d13@nic.in&#8217; with a copy to &#8216;sumit.k13@nic.in&#8217;.</p>

<p>Subject: <strong>All India Strike proposed on January 8, 2020 &#8211; Instructions under CCS (Conduct Rules), 1964 &#8211; Regarding.</strong></p>



<p>It has been brought to the notice of the Government that the Central Trade Union (CTUs), except Bhartiya Mazdoor Sangh and their affiliates in different sectors are mobilizing workers employees for their proposed nationwide general strike on January 8. 2020. The strike is mainly to protest against Union Government&#8217;s labour reforms, FDI, disinvestment, corporation and privatization polices and to press for <strong>12 &#8211; point common demands </strong>of the working class relating to minimum wage and social security, among others.</p>

<p>2. The instructions issued by the Department of Personnel and Training prohibit the Government servants from participating in any form of strike including mass casual leave go slow etc. or any action that abet any form of strike / protest in violation of Rule 7 of the CCS (Conduct) Rules. 1964. Besides in accordance with the proviso to Rule 17(1) of the Fundamental Rules. pay and allowances is not admissible to an employee for his absence from duty without any authority.  As to the concomitant rights of an Association after it is formed they cannot be different form the rights which can be claimed by the individual members of which the Association is composed. It follows that the right to form an Association does not include any guaranteed right to strike /protest. There is no statutory provision empowering the employees to go on strike. The Supreme Court has also agreed in several judgments that going on a strike is a grave misconduct under the Conduct Rules and that misconduct by the Government employees is required to be dealt with in accordance with law. Any employee going on strike in any form would face the consequences which besides deduction of wages, may also include appropriate disciplinary action. Kind attention of all employees of this Department is also drawn to this Department&#8221;s O.M. No.33012/1/(s)/2008- Estt.(8) dated 12.9.2008 on the subject for strict compliance (enclosed as Annexure-A).</p>



<p>3. All officers are requested that the above instructions may be brought to the notice of the employees working under their control. All officers are also requested not to sanction Casual Leave or any other kind of leave to the officers and employees. if applied for during the period of proposed strike, and ensure that the willing employees are allowed hindrance free entry into the office premises.</p>



<p><strong>4. In case employees go on strike all Divisional Heads are requested to forward a report indicating the number and details of employees. who are absent from duty on the day of strike. i.e. 08 .01.2020.</strong></p>
