<h2 class="wp-block-heading">Reduction of time limit for verification of Income Tax Return (ITR)</h2>

<p><strong>Subject: Reduction of time limit for verification of Income Tax Return (ITR) from within 120 days to 30 days of transmitting the data of ITR electronically &#8211; reg.</strong></p>



<p>The Central Board of Direct Taxes (CBDT) vide Circular No. 3/2009 dated 21-05-2009 notified the new Income Tax Return (ITR) forms for Assessment Year 2009-10 and provided the facility of furnishing ITR in the following manner:</p>



<ul class="wp-block-list"><li>i. Furnishing the return in paper form</li><li>ii. Furnishing the return electronically under digital signature</li><li>iii. Transmitting the data in the return electronically and thereafter submitting the verification of the return in form ITR-V to CPC within 30 days after transmitting the data electronically</li><li>iv. Furnishing a bar coded return in paper form.</li></ul>



<p>2. Further as per clarifications provided in para 9 of the said circular, the date of transmitting the data electronically will be the date of furnishing the return if the form ITR-V is submitted within 30 days after the date of transmitting the data electronically. In case, form ITR-V is submitted after the above-mentioned period, it will be deemed that the return in respect of which the form ITR-V has been filled was never submitted and it shall be incumbent on the assessee to electronically re-transmit the data and follow it up by submitting the new form ITR-V within 30 days. Later, the CBDT extended the time-limit for filing ITR-V to 120 days from the date of uploading the return of income. (Press Release dated 27.01.2010).</p>



<p>3. The CBDT vide Notification no. 02/2012/F.No.142/27/2011-SO (TPL) dated 04.01.2012, notified the Centralised Processing of Returns Scheme, 2011 (CPR Scheme 2011). Rule 14 of CPR Scheme 2011 delegates the power to specify the mode, manner and time for verification of ITR-V.</p>



<p>4. It has been decided that in respect of any electronic transmission of return data on or after the date this Notification comes into effect, the time-limit for e-verification or submission of ITR-V shall now be 30 days from the date of transmitting/uploading the return data is electronically.</p>



<p>5. It is clarified that where the return data is electronically transmitted before the due date on which this Notification comes into effect, the earlier time limit of 120 days would continue to apply in respect of such returns.</p>



<p>6. It is further clarified:</p>



<ul class="wp-block-list"><li>(i) Where ITR data is electronically transmitted and e-verified/ITR-V submitted within <strong>30 days of transmission of data &#8211; in such cases the date of transmitting the data electronically shall be considered as the date of furnishing the return of income.</strong></li><li>(ii) Where ITR data is electronically transmitted but e-verified or ITR-V submitted beyond the time-limit of 30 days of transmission of data – in such cases the date of e-verification/ITR-V submission shall be treated as the date of furnishing the return of income and all consequences of late filing of return under the Act shall follow.</li></ul>



<p>7. Duly verified ITR-V in the prescribed format and in the prescribed manner should be sent by speed post only to</p>



<p>Centralised Processing Centre,<br />Income Tax Department,<br />Bengaluru &#8211; 560500, Karnataka.</p>



<p>8. The date of dispatch of Speed Post of duly verified ITR-V shall be considered for the purpose of determination of the 30 days period, from the date of transmitting the data of Income-tax return electronically.</p>



<p>9. This Notification shall be applicable for electronically transmitted Income-tax return data filed on the e-filing portal (www.incometax.gov.in). This issues by the power conferred to the undersigned under the Rule 14 of Centralized Processing of Returns Scheme 2011 (CPR Scheme 2011) dated 04.01.2012, notified by the CBDT Notification No. 02/2012- F.No. 142/27/2011-SO(TPL).</p>



<p>10. This notification will come into effect from 01.08.2022.<br />11. Hindi version to follow.</p>

<p>In view of the challenges faced by taxpayers in meeting the statutory and regulatory compliances due to the outbreak of <strong><a href="https://centralgovernmentnews.com/tag/Covid-19/" target="_blank" rel="noreferrer noopener">COVID-19</a></strong>, the Government brought the Taxation and Other Laws (Relaxation of Certain Provisions) Ordinance, 2020 (‘the Ordinance’) on 31st March, 2020 which, inter alia, extended various time limits. The Ordinance has since been replaced by the Taxation and Other Laws (Relaxation and Amendment of Certain Provisions) Act.</p>



<p>The Government issued a Notification on 24th June, 2020 under the Ordinance which, inter alia, extended the due date for all Income Tax Returns for the FY 2019-20 (AY 2020-21) to 30th November, 2020. Hence, the returns of income which were required to be filed by 31st July, 2020 and 31st October, 2020 were required to be filed by 30th November, 2020. Consequently, the date for furnishing various audit reports including tax audit report under the Income-tax Act, 1961 (the Act) was also extended to 31st October, 2020.</p>



<p>In order to provide more time to taxpayers for furnishing of Income Tax Returns, the due date was further extended vide notification No 88/2020/F. No. 370142/35/2020-TPL dated 29th October, 2020:</p>



<ul class="wp-block-list"><li>(A) The due date for furnishing of Income Tax Returns for the taxpayers (including their partners) who are required to get their accounts audited [for whom the due date (i.e. before the said extension) as per the Act was 31st October, 2020] was extended to 31st January, 2021.</li><li>(B) The due date for furnishing of Income Tax Returns for the taxpayers who are required to furnish report in respect of international/specified domestic transactions [for whom the due date (i.e. before the said extension) as per the Act was 30th November, 2020] was extended to 31st January, 2021.</li><li>(C) The due date for furnishing of Income Tax Returns for the other taxpayers [for whom the due date (i.e. before the said extension) as per the Act was 31st July, 2020] was extended to 31st December, 2020.</li><li>(D) Consequently, the date for furnishing of various audit reports under the Act including tax audit report and report in respect of international/specified domestic transaction was also extended to 31st December, 2020.</li></ul>



<p>Considering the problems being faced by the taxpayers, it has been decided to provide further time to the taxpayers for furnishing of Income Tax Returns, tax audit reports and declaration under Vivad Se Vishwas Scheme. Further, in order to provide more time to taxpayers to comply under various ongoing proceedings, the dates of completion of proceedings under various Direct Taxes &amp; Benami Acts have also been extended. These extensions are as under:</p>



<ul class="wp-block-list"><li>a. The due date for furnishing of Income Tax Returns for the Assessment Year 2020-21 for the taxpayers (including their partners) who are required to get their accounts audited and companies [for whom the due date, as per the provisions of section 139(1) of the Income-tax Act,1961, was 31st October, 2020 and which was extended to 30th November, 2020 and then to 31st January, 2021] has been further extended to 15th February, 2021.</li><li>b. The due date for furnishing of Income Tax Returns for the Assessment Year 2020-21 for the taxpayers who are required to furnish report in respect of international/specified domestic transactions [for whom the due date, as per the provisions of section 139(1) of the Income-tax Act,1961, was 30th November, 2020 and which was extended to 31st January, 2021] has been further extended to 15th February, 2021.</li><li>c. The due date for furnishing of Income Tax Returns for the Assessment Year 2020-21 for the other taxpayers [for whom the due date, as per the provisions of section 139(1) of the Income-tax Act, 1961, was 31st July, 2020 and which was extended to 30th November, 2020 and then to 31st December, 2020] has been further extended to 10th January, 2021.</li><li>d. The date for furnishing of various audit reports under the Act including tax audit report and report in respect of international/specified domestic transaction for the Assessment Year 2020-21 has been further extended to 15th January, 2021.</li><li>e. The last date for making a declaration under Vivad Se Vishwas Scheme has been extended to 31st January, 2021 from 31st December, 2020.</li><li>f. The date for passing of orders under Vivad Se Vishwas Scheme, which are required to be passed by 30th January, 2021 has been extended to 31st January, 2021.</li><li>g. The date for passing of order or issuance of notice by the authorities under the Direct Taxes &amp; Benami Acts which are required to be passed/ issued/ made by 30th March, 2021 has also been extended to 31st March, 2021.</li></ul>



<p>Further, in order to provide relief for the third time to small and middle class taxpayers in the matter of payment of self-assessment tax, the due date for payment of self-assessment tax date is hereby again being extended. Accordingly, the due date for payment of self-assessment tax for taxpayers whose self-assessment tax liability is up to Rs. 1 lakh has been extended to 15th February, 2021 for the taxpayers mentioned in para 4(a) and para 4(b) and to 10th January, 2021 for the taxpayers mentioned in para 4(c).</p>



<p>The Government has also extended the due date of furnishing of annual return under section 44 of the Central Goods and Services Tax Act, 2017 for the financial year 2019-20 from 31st December, 2020 to 28th February, 2021.</p>



<p>The necessary notifications in this regard shall be issued in due course</p>

<p>Last date for submitting Income Tax Returns has been extended to 31st January, 2021</p>

<p><strong>Extension of due date of furnishing of Income Tax Returns and Audit Reports</strong></p>



<p>In view of the challenges faced by taxpayers in meeting the statutory and regulatory compliances due to the outbreak of <strong><a href="https://centralgovernmentnews.com/tag/Covid-19/" target="_blank" rel="noreferrer noopener">COVID-19</a></strong>, the Government brought the Taxation and Other Laws (Relaxation of Certain Provisions) Ordinance, 2020 (‘the Ordinance’) on 31st March, 2020 which, inter alia, extended various time limits. The Ordinance has since been replaced by the Taxation and Other Laws (Relaxation and Amendment of Certain Provisions) Act.</p>



<p>The Government issued a Notification on 24thJune, 2020 under the Ordinance which, inter alia, extended the&nbsp; due date for all Income Tax Returns for the FY 2019-20 (AY 2020-21) to 30th November, 2020. Hence, the returns of income which were required to be filed by 31st July, 2020 and 31st October, 2020 are required to be filed by 30th November, 2020. Consequently, the date for furnishing various audit reports including tax audit report under the Income-tax Act, 1961 (the Act) has also been extended to 31st October, 2020.</p>



<p>In order to provide more time to taxpayers for furnishing of Income Tax Returns, it has been decided to further extend the due date for furnishing of Income-Tax Returns as under:</p>



<ul class="wp-block-list"><li>The due date for furnishing of <strong><a href="https://centralgovernmentnews.com/category/income-tax/" target="_blank" rel="noreferrer noopener">Income Tax</a></strong> Returns for the taxpayers (including their partners) who are required to get their accounts audited [for whom the due date (i.e. before the extension by the said notification) as per the Act is 31st October, 2020] has been extended to 31st January, 2021.</li><li>The due date for furnishing of Income Tax Returns for the taxpayers who are required to furnish report in respect of international/ specified domestic transactions [for whom the due date (i.e. before the extension by the said notification) as per the Act is 30th November, 2020] has been extended to 31st January, 2021.</li><li>The due date for furnishing of Income Tax Returns for the other taxpayers [for whom the due date (i.e. before the extension by the said notification) as per the Act was 31st July, 2020] has been extended to 31st December, 2020.</li></ul>



<p>Consequently, the date for furnishing of various audit reports under the Act including tax audit report and report in respect of international/ specified domestic transaction has also been extended to 31st December, 2020.</p>

<p>Further, in order to provide relief to small and middle class taxpayers, the said notification dated 24th June, 2020 had also extended the due date for payment of self-assessment tax for the taxpayers whose self-assessment tax liability is up to Rs. 1 lakh. Accordingly, the due date for payment of self-assessment tax for the taxpayers who are not required to get their accounts audited was extended from 31st July, 2020 to 30th November, 2020 and for the auditable cases, this due date was extended from 31st October, 2020 to 30th November, 2020.</p>



<p>In order to provide relief for the second time to small and middle class taxpayers in the matter of payment of self-assessment tax, the due date for payment of self-assessment tax date is hereby again being extended. Accordingly, the due date for payment of self-assessment tax for taxpayers whose self-assessment tax liability is up to Rs. 1 lakh has been extended to 31st January, 2021 for the taxpayers mentioned in para 3(A) and para 3(B) and to 31st December, 2020 for the taxpayers mentioned in para 3(C).</p>



<p>The necessary notification in this regard shall be issued in due course.</p>

<strong>CBDT identifies non-filers through Non-filers Monitoring System (NMS) by using Data Analytics and request the Non-filers to assess their tax liability for AY 2018-19 and file the Income Tax Returns (ITR) or submit online response within 21 days</strong></p>

<p>The Non-filers Monitoring System (NMS) aims to identify and monitor persons who enter into high value transactions and have potential tax liabilities but have still not filed their tax returns. Analysis was carried-out to identify non-filers about whom specific information was available in the database of the Income Tax Department. The sources of information include Statement of Financial Transactions (SFT), Tax Deduction at Source (<strong>TDS</strong>), Tax Collection at Source (TCS), information about foreign remittances, exports and imports data etc.</p>
<p>Data analysis has identified several potential non-filers who have carried-out high value transactions in Financial Year 2017-18 but have still not filed <strong>Income Tax Return for Assessment Year 2018-19</strong> (relating to FY 2017-18).</p>
<p>The Department has enabled e-verification of these NMS cases to reduce the compliance cost for taxpayers by soliciting their response online. It is reiterated that there is no need to visit any Income Tax office for submitting response, as the entire process is to be completed online. Taxpayers can access information related to their case from the ‘Compliance portal’ which is accessible through the e-filing Portal of the Department at https://incometaxindiaefiling.gov.in. The PAN holder should submit the response electronically on the Compliance Portal and keep a printout of the submitted response for record purposes. User Guide and FAQs are provided under the &#8220;Resources&#8221; Menu on Compliance Portal.</p>
<p>Non-filers are requested to assess their tax liability for AY 2018-19 and file the Income Tax Returns (ITR) or submit online response within 21 days. If the explanation offered is found to be satisfactory, matters will be closed online. However, in cases where no return is filed or no response is received, initiation of proceedings under the Income-tax Act, 1961 will be considered.</p>

<p>The due date for filing of Income Tax Returns and Audit Reports for Assessment Year 2018-19 is 30th September, 2018 for certain categories of taxpayers. Upon consideration of representations from various stakeholders, the Central Board of Direct Taxes(CBDT) extends the &#8216;due date&#8217; for filing of Income Tax Returns as well as reports of Audit (which were required to be filed by the said specified date) from 30th September, 2018 to 15th October, 2018 in respect of the said categories of taxpayers. However, there shall be no extension of the due date for the purpose of section 234A (Explanation 1) of the I.T. Act, 1961 pertaining to Interest for defaults in furnishing return, and the assessee shall remain liable for payment of interest as per provisions of section 234A of the Act.</p>

<p>In pursuance of the Notification of the Income Tax Returns (ITR) for AY 2016-17 on March 31st, 2016, Central Board of Direct Taxes (CBDT) announces the release of electronic filing of ITRs 1 and 4S on its website https://incometaxindiaefiling.gov.in. Other ITRs will be e-enabled shortly.</p>
<p>Online filing of Appeal before Commissioner (Appeal) using newly notified Form 35 has been enabled for taxpayers mandated to E-file their returns using Digital Signature Certificate. Electronic Verification Code (EVC) option will be available shortly for other category of taxpayers. Reference may be made to Notification 11/2016 dated March 1, 2016 for the various categories of taxpayers required to file appeal online.</p>
<p>In pursuance of Notification No 93/2016 dated 16th Dec 2015, effective from 1April 2016, the following forms have been substituted by new forms and are now available for E-filing:</p>
<ol>
<li>Form 15CA -payments to a non-resident not being a company, or to a foreign company,</li>
<li>Form 15CB-Certificate of an accountant,</li>
<li>Form 15CC -Quarterly statement</li>
</ol>
<p>Vide Notification No 3/2016 dated 14th Jan 2016, CBDT had substituted with effect from 1 April 2016, Forms 9A (Application for exercise of option under clause (2) of the Explanation to sub-section</p>
<p>(1) of section 11 of the Income tax Act, 1961) and Form 10 (Statement to be furnished to the Assessing Officer/Prescribed Authority under sub-section (2) of section 11 of the Income tax Act, 1961). These forms can be filed online using Digital Signature Certificate on the Income Tax Department’s e-filing website. EVC option will be available shortly.</p>

<p>New Delhi: Aimed at making life easier for tax payers, the Income Tax department today said it simplified the process of online rectification of incorrect details of tax deducted at source (TDS) filed in the income tax return (ITR).</p>
<p>Earlier, taxpayers were required to fill in complete details of the entire TDS schedule while applying for rectification on the e-filing portal of the I-T Department.</p>
<p>To avoid this, the finance ministry said a new facility has been provided for pre-fillin ..</p>
<p>To avoid this, the finance ministry said a new facility has been provided for pre-filling of TDS schedule while submitting online rectification request on the e-filing portal to facilitate easy correction or up-dating of TDS details.</p>
<p>“This is expected to considerably ease the burden of compliance on the taxpayers seeking rectification due to TDS mismatch,” an official statement said.</p>
<p>Errors due to incomplete TDS details in rectification applications were leading to delays in processing of such applications, thereby causing hardships to taxpayers, it added.</p>

<p>New Delhi: Facing criticism over the new Income Tax Return (ITR) forms that seek details on bank accounts and foreign trips, Finance Minister Arun Jaitley will hold another round of meeting with officials to simplify the procedure.</p>

<p>Soon after his trip from Washington yesterday, Jaitley had held a meeting with tax officials on the new ITR forms that have evoked sharp reactions from experts and others alike.</p>
<p>“The Finance Minister will be taking another meeting to finalise changes in the new forms,” said a source.</p>
<p>The Central Board of Direct Taxes (CBDT), the apex policy-making body of the Income Tax department, had notified the forms for the current assessment year, seeking additional details to check the menace of black money.</p>
<p>As it stands, the new ITR forms, including the ITR-1 and ITR-2, require an assessee to furnish the number of bank accounts held by the individual “at any time (including opened/closed) during the previous year” with the last balance in the account as on March 31 of the just-concluded fiscal.</p>
<p>The assessee will also have to furnish the name of the bank, account number, address, IFSC code and any possible joint account holder’s name.</p>
<p>On Saturday, Revenue Secretary Shaktikanta Das had said the government will reconsider the new ITR forms to make it simple. Jaitley had called him up from Washington, asking him not to proceed further on the matter.</p>
<p>Experts and consultants have criticised the new forms, saying the government was seeking too much of data. They felt that the addition of new information would make the process of filing returns difficult.</p>

<p>Offices to Remain Open on 26th July and 27th July, 2014, Being Saturday and Sunday, for Accepting the Returns During Normal Office Hours</p>
<p>For the convenience of the taxpayers, the Income Tax Department has decided to keep the offices open for accepting the returns of income during normal office hours on 26th July and 27th July, 2014, being Saturday and Sunday. This direction has been issued by the Central Board of Direct Taxes (CBDT) in exercise of powers conferred under Section 119 of the Income Tax Act, 1961. Special arrangements have also been made by way of opening additional receipt counters, wherever required, on 26th, 27th, 28th, 30th and 31st July, 2014 in order to facilitate the taxpayers in filing their returns of income conveniently and in a timely manner.</p>
<p>The due date for filing of return of income within the meaning of Explanation 2(c) to Section 139(1) of the Income Tax Act, 1961 is 31st July, 2014.</p>
