<p>On Friday, the Supreme Court issued an interim order allowing disabled candidates who passed the civil service exam to apply for IPS. The Supreme Court also granted applications to the Indian Railway Protection Force (IRPF), Delhi, Daman and Diu, Dadra and Nagar Haveli, Andaman and Nicobar, and Lakshwadeep Police Force, in addition to the IPS (DANIPS). The Supreme Court&#8217;s final decision, however, will influence future proceedings, including nomination.</p>



<p>The interim judgement was delivered by the Supreme Court in response to a petition filed by the non-governmental organisation National Platform for the Rights of the Disabled. The interim order was issued by a Supreme Court bench consisted of Justices A.M. Khanwilkar and Abhay S. Oka.</p>



<p>Thursday was the deadline for those who passed the civil service exam to apply for the service in which they want to work. The Supreme Court, on the other hand, has given the disabled until April 1 at 4 p.m. to file their applications. The application must be sent in person or by courier to the Secretary-General (UPSC).</p>



<p>Previously, disabled people were barred from joining the police force. In response to a petition, the Supreme Court granted an interim order. In response to the case, the Supreme Court allowed the Centre permission to produce a thorough affidavit. The matter will be heard by the Supreme Court on April 15.</p>



<p>In an earlier order issued in 2021, the Centre exempted all categories of posts in the Indian Police Service and Indian Railway Protection Force, among other services, from the provision of 4 percent reservation in employment for persons with benchmark disabilities, citing the nature of the work involved in these services. The Rights of Persons with Disabilities Act of 2016 specifies a 4% quota for persons with disabilities in government jobs.</p>



<p>In a separate notification, the government exempted all combatant personnel posts in Central Armed Police Forces such as Border Security Force, Central Reserve Police Force, Central Industrial Security Force, Indo-Tibetan Border Police, Sashastra Seema Bal, and Assam Rifles from the provisions of the 2016 Act. Earlier in 2018, the administration exempted all combatant personnel positions in the Armed Forces from the regulation.</p>

<h3 class="wp-block-heading">Subject: Protection of  pay  in  cases  of  deputation  under  Central Staffing Scheme in terms of Rule 7 of Indian Administrative Service ( Pay) Rules, 2016 (<a href="https://centralgovernmentnews.com/7th-pay-commission-latest-news/" target="_blank" rel="noreferrer noopener">7th CPC</a>) and analogous provisions in IPS (Pay) Rules, and IFS (Pay) Rules &#8211; Regarding.</h3>



<p>Sir,</p>



<p>I am directed to refer to queries received from various Ministries/Departments regarding method of pay protection in terms of Rule 7 of IAS (Pay) Rules, 2016 which is as under:-</p>



<p class="has-text-align-center"><strong><a href="https://centralgovernmentnews.com/ips-pay-rules-2016/" target="_blank" rel="noreferrer noopener">IPS (Pay) Rules, 2016</a></strong></p>



<p><em>”If the pay of the officers posted on deputation to the Central Government under Central Staffing Scheme, after fixation of their pay in the revised pay structure, either under these rules or as per the instructions regulating such fixation of pay on the post to which they are appointed on deputation, happens to be lower than the pay they would have been entitled to, had they been in their parent cadre and would have drawn that pay but for the Central deputation, such difference in the pay shall be protected in the form of Personal Pay with effect from the date of notification of Government Resolution in this regard, i.e. 25th July, 2016.</em></p>



<p><em>Further, if the member of Service is promoted in the cadre while on central deputation under Central Staffing Scheme, the difference in the pay that the officer would have drawn had he been in the parent cadre and the amount of pay on his deputation to Centre shall be protected in the form of personal pay with effect from the date of issue of Government Resolution.”</em></p>



<p>Rule 7 of IAS (Pay) Rules, 2016 was subsequently amended vide notification dated 14021/ 1/ 2016-  AIS-11,  dated  12.06.2017  consequent  upon  the amendment of Department of Expenditure Notification No. 1-2/ 2016-IC  dated 16th May, 2017, which inter-alia provide that the aforesaid provision would take effect from 01.01.2016.</p>



<p>2.&nbsp; Pay protection of officers on deputation under Central Staffing Scheme after implementation of IAS (Pay) Rules 2016 has been considered in consultation with Establishment Division of this Department and Department of Expenditure and is elaborated in subsequent</p>



<p><strong>3. Pay Protection of IAS officers who were already on deputation under Central Staffing Scheme on 01.01.2016 or who joined deputation under Central Staffing Scheme on or after 01.01.2016</strong></p>



<p>(a) Pay of such officers, as on 01.2016 [or a subsequent date from which they have opted to switch over to the IAS ( Pay) Rules, 2016] will be fixed in the Level of the post held by them on deputation under Central Staffing Scheme on the basis of the pay fixed in their parent cadre. The cell corresponding to the basic pay fixed in the parent cadre will be located in the Level in the Pay Matrix of the post in which the officer is serving on deputation under Central Staffing Scheme and pay shall be fixed at same stage/ equivalent cell. If no such cell is available in the applicable Level of the deputation post, the pay shall be fixed at the immediate lower cell in that Level of the deputation post and the difference in pay will be granted as Personal Pay.</p>



<h3 class="wp-block-heading">Illustration :</h3>



<p>If an officer holding the post in Level 15 in parent cadre and drawing pay of Rs.2,05,100/- goes on deputation under Central Staffing Scheme in Level 14 on 04.05.2017, his pay will be fixed as under :-</p>

<p>(b) However, if an officer currently drawing pay up to Level 13 is appointed on deputation to a post in the equivalent or lower level on deputation &nbsp;under Central Staffing Scheme OR during the continuance of deputation under Central Staffing Scheme gets an upgradation in his parent cadre to a Level higher than pay Level of deputation post up to Level 13 of the Pay Matrix, his pay will be fixed at the same cell and Level in which he is placed in the parent He will also be eligible to draw the CDTA on the pay of Level of the post in parent cadre at the prevailing rates. For the active period of deputation from 1.1.2016 to 30.6.2017 , CDTA will be admissible at the pre-revised rates in pre­ revised pay structure, i.e. as if the ·pay had not been&nbsp; revised w.e.f. 1.1.2016. Provisions of this Department’s OM No.2 / 10/ 2017-Estt(Pay-II) dated 24th April, 2018 shall stand amended to this&nbsp; effect. For the active period of deputation from 1st July, 2017 onwards, CDTA will be admissible as per the guidelines in this Department’s OM No. 2 / 10/2017-Estt(Pay II) dated 24th April, 2018.</p>



<h3 class="wp-block-heading">Illustration :</h3>



<p>(I) If an officer holding the post in Level 13 in parent cadre and drawing pay of 1,26,800/- goes on deputation under Central Staffing Scheme in Level 13 on 22.02.2017, his pay will be fixed as under :-</p>

<p><strong>4. Protection/ Fixation of pay of IAS officers who were on deputation under Central Staffing Scheme on 01.01 .2016 or who joined deputation under Central Staffing Scheme on or after 01.01.2016 and got Proforma promotion in parent cadre :-</strong></p>



<p>(a) In case the officer was on deputation under CSS on 01.2016 or joined thereafter and his junior is promoted to a higher post in his parent cadre on or after 01.01.2016, but was not granted proforma promotion under the ‘Next Below Rule’, there will be no change in the pay fixation already done as per extant rules.</p>



<p>(b) In case an officer on deputation to a post under Central Staffing Scheme gets proforma promotion in his cadre to a post up to Level 13 in the Pay matrix, his pay in the Level of the post will be fixed with reference to the presumptive pay that he would have got had he remained and promoted in the parent cadre of his service in the manner as provided in para 3(b) .</p>



<p>(c) In case an officer on deputation under Central Staffing Scheme gets promoted in his cadre to a higher post in Level l 3A or above in the Pay matrix, his pay in the Level of the post held on deputation under Central Staffing Scheme will be fixed with reference to the presumptive pay of the officer in the parent cadre of his The Cell corresponding to such basic pay fixed in parent cadre will be located in the Level in the Pay Matrix of the post in which the officer is serving on deputation under Central Staffing Scheme, and pay shall be fixed at same stage/ equivalent cell and if no such cell is available in the applicable Level, the pay shall be fixed at the immediate lower cell in that Level of the post and the difference in pay will be granted as Personal&nbsp; Pay. Illustrations may be seen below:-</p>

<p>If an officer holding the post in Level 16 in parent cadre drawing pay of Rs.2,24,400/-, who is on deputation under Central Staffing Scheme in Level 15 and drawing pay Rs. 2,24,100/- + Rs.300/- (Personal pay) gets proforma promotion in Level 17, his pay will be fixed as under :-</p>

<p>5 (a) The officer shall get Dearness Allowance on the said Personal Pay as admissible from time to time. However, no other allowance shall be admissible on this Personal Pay.</p>



<p>(b) The Basic Pay plus Personal &nbsp;Pay, from time to time, &nbsp;shall not exceed Rs. 2,25,000.</p>



<h3 class="wp-block-heading">6. Grant of annual increment to officers on Deputation under Central Staffing Scheme</h3>



<p>On grant of annual increment to an officer in parent&nbsp; cadre (upto Level 16) who is on deputation under Central Staffing Scheme, the pay will be fixed increment.ally moving down one cell in the Level of pay in which the officer is serving on deputation under Central Staffing Scheme. Accordingly, &nbsp;the Personal Pay, if any, will be re-computed as the difference in the pay (after increment) that h e would have drawn in the parent cadre and the current pay on deputation under Central Staffing Scheme.</p>



<p>7. The aforementioned &nbsp;instructions &nbsp;are &nbsp;applicable &nbsp;to&nbsp; &nbsp;All&nbsp; &nbsp;India&nbsp; &nbsp;Service officers (i.e. IAS, IPS, IFS) with effect from 01.01.2016.</p>

<p><b>Indian Police Service (Pay) Amendment Rules, 2017</b></p>

<p>G.S.R. 574(E).-In exercise of the powers conferred by sub-section (1) of section 3 of the All India Services Act, 1951 (61 of 1951), the Central Government, hereby makes the following rules to amend the Indian Police Service (Pay) Rules, 2016, namely:-</p>
<p>I. (1) These rules may be called the Indian Police Service (Pay) Amendment Rules, 2017</p>
<p>(2) They shall be deemed to have come into force on the 1&#8243; day of January, 2016.</p>
<p>2. In the Indian Police Service (Pay) Rules. 2016.-</p>
<p>(i) in rule 2, for clause (xi), the following shall be substituted, namely:-</p>
<p>&#8220;(xi) &#8220;Level in the Pay Matrix&#8221; shall mean the Level corresponding to the existing Pay Band and Grade Pay or scale specified in the <b>Pay Matrix in APPENDIX-I</b>&#8220;;</p>
<p>(ii) for rule 7, the following shall be substituted, namely:-</p>
<p>&#8220;7. <b>Pay protection&#8217; to officers on Central deputation.</b>&#8211; If the pay of the officers posted on deputation to the Central Government, after fixation of their pay in the revised pay structure, either under these rules or as per the instructions regulating such fixation of pay of the post to which they are appointed on deputation, happens to be lower than the pay they would have entitled to, had they been in their parent cadre and would have drawn that pay but for the Central deputation, such difference in the pay shall be protected in the form of Personal Pay with effect from the 1st&#8217; January, 2016&#8243;.</p>

										<content:encoded><![CDATA[<p><strong>Government to destroy babus performance appraisal reports</strong></p>
<p>New Delhi: The performance appraisal reports of IAS and IPS officers, who have retired two years ago, will be destroyed by the Centre.</p>
<p>It has asked officers of all India services &#8211; Indian Administrative Service (IAS), Indian Police Service (IPS) and Indian Forest Service (IFoS) &#8211; to make a request to the central government in case they want to have a copy of their performance reports.</p>
<p>Existing norms allow confidential rolls of members of all-India services to be destroyed two years after their death or retirement.</p>
<p>The rules also provide that Confidential Reports (CRs) or Performance Appraisal Reports (PARs) of such bureaucrats can be given to them after the normal period of retention of two years is over from the date of their retirement.</p>
<p>&#8220;Action is accordingly being taken for destroying such CRs/PARs,&#8221; an order issued by the Department of Personnel and Training (DoPT) said.</p>
<p>Officers who wish to obtain their dossiers may send their requests to the Ministry till June 14, 2017, the order said.</p>

										<content:encoded><![CDATA[<p><strong>7th Pay Commission: Pay parity between IAS, non-IAS officers to be examined by the Government</strong></p>
<p>The parliament was informed on the 18th that since the 7th Pay Commission was not able to arrive at a consensus over the issue of pay parity between IAS and non-IAS officers, the matter will now be examined in detail by the department concerned.</p>
<p>In a written reply to Rajya Sabha, Minister of State for Finance Arjun Ram Meghwal said, “7th Pay Commission could not arrive at a consensus on this issue (parity between IAS and non-IAS officers). Therefore, the matter will be examined by the concerned department in detail for further consideration”.</p>
<p>He said employee associations of central government had given a call for strike with effect from July 11, 2016 which has been deferred.</p>
<p>“However, the government is responsive to the concerns of the Employees Association and it would be the endeavour of the government to ensure that the eventuality of a strike does not arise,” the minister said.</p>
<p>The government has decided to implement the recommendations of the 7th Central Pay Commission. The minister said the increase in pay as recommended by the Commission is based on the detailed deliberations keeping in view all relevant factors.</p>
<p>The three-member Seventh Pay Commission was divided over the issue of financial and career-related edge given to IAS officers as against those belonging to the other services.</p>
<p>Presently, the IAS officers get a two-year edge over other services for getting empanelled to come on deputation at the Centre.</p>
<p>A confederation representing thousands of officers of 20 civil services, including Indian Police Service (IPS) have asked the government to give equal pay and job-related opportunities enjoyed by those in IAS.</p>

										<content:encoded><![CDATA[<p>Seeking to check IAS dominance, a confederation representing thousands of IPS, IRS officers among 20 civil services, has sought fair representation on an empowered committee that will examine the 7th Central Pay Commission recommendations.</p>
<p>In a memorandum submitted to Cabinet Secretary P K Sinha and Expenditure Secretary Ratan Watal recently, it demanded that the representation of any one service should be restricted to 25 per cent of the total strength of the committee.</p>
<p>The Union Cabinet had on January 13 given its approval for setting up an empowered committee of Secretaries under the Cabinet Secretary to process the recommendations of the pay panel.</p>
<p>The move assumes significance as various civil services have been raising their voice against career benefits enjoyed by officers of the Indian Administrative Service (IAS) and Indian Foreign Service ( IFS).</p>
<p>The Confederation of Civil Services Association (COCSA) has highlighted the “apprehensions” shared by a “majority” of officers and requested for a fair representation to other services on committee, limiting the representation of any one service to 25 per cent of the total strength, said senior IRS officer Jayant Misra, its convener.</p>
<p>The COCSA had in December forwarded a memorandum and sought an appointment with the Cabinet Secretary to explain to him the “concern” of these officers.</p>
<p>“We are still waiting for an opportunity to meet the Cabinet Secretary. We have submitted fresh Memoranda dated January 19, 2016 to the Cabinet Secretary and also to the Expenditure Secretary, reiterating our demand that equitable representation be given to various services in all the bodies or committees etc. looking into or implementing recommendations of the 7th CPC, so that there is no domination by any particular service,” he said.</p>
<p>Amid a bitter war of words among services, the confederation maintained “that officers from various services continue to maintain excellent interpersonal relations and serve the Government with full devotion”.</p>
<p>“Cohesion and camaraderie among various civil services are essential pre-requisites for good governance and efficient public service delivery.</p>
<p>“The onus of strengthening these attributes lies on the officers of these services, but somewhat more on the officers who control the service conditions of the services, particularly when they are expected to render absolutely objective and neutral advice to the competent authorities, even if it may be perceived as disadvantageous to their own service,” the memorandum said, citing its concern.</p>
<p>In the present context, strong evidence was presented before the Pay Commission regarding unfair, unjustified and exclusive edge to two services, the confederation said.</p>
<p>“Our arguments were accepted and favourable recommendations were made by the Commission in a majority voice, and the final decision will be taken by the Cabinet in due course,” it said referring to the report submitted by the pay panel in November last year.</p>
<p>Two factors, however, raised concerns among thousands of officers whether the recommendations of the Commission will ever be taken to logical conclusion.</p>
<p>“First, the dissenting notes of one member of the Pay Commission in violation of the time-honoured principle of ‘nemo judex in causa sua’ (No one can be a judge in his own cause), and second, the very meagre level of compliance of the PMO’s instructions of reducing the huge inter-service gap in empanelment to the Joint Secretary level by December 2015.</p>
<p>“When instructions from even the highest office of the country are not being complied, one cannot blame the affected officers if they get hugely disappointed and agitated, and approach the service associations for espousing their cause,” said the COCSA, that comprises 20 services including IPS, Indian Revenue Service, Indian Forest Service, Indian Audit and Accounts Service and Federation of Railway Officers Association (representing nine railway services).</p>

<blockquote><p>(a): Recruitment to IAS, IPS, IRS, IFS etc. is done through the Civil Services Examination (CSE) conducted by Union Public Service Commission (UPSC) every year within the parameter of CSE Rules notified by the Central Government. With a view to ensure that extremely talented personnel are recruited to the above services, the Central Government keeps on reviewing the scheme/pattern of the examination etc. from time to time. Recently with the same objective the Central Government has approved some changes in the Civil Services (Main) Examination, 2013.</p>
<p>(b): The UPSC discharges its duties as mandated by the Constitution of India. The examinations are conducted as per Rules notified by Government and merit is the only criteria for selecting the candidates. As such, there is no scope for external influence while recruiting civil servants for various services, viz, IAS, IPS, IFS, IRS, etc.</p>
<p>(c): There is no such proposal</p></blockquote>
