<p><strong>Central government employees waiting for Seventh Pay commission and interim relief</strong></p>
<p><strong>Staff union making up pressure on the Seventh Pay commission</strong></p>
<p><strong> </strong></p>
<p>• Pay commission was formed in February 2014<br />
• Workers waiting for Interim Relief<br />
• Pay commission busy with the necessary process<br />
• Conditions will be applicable from 01 January 2016<br />
• More than 50 Lakh Central government employees will be benefitted</p>
<p>&nbsp;</p>
<p>Even though the Seventh Pay commission was formed by the Manmohan Singh government before the advent of Election for the sake of a Political advantage, this was pleasant news for the Central Government Employees.</p>
<p>&nbsp;</p>
<p>Soon after the formation, the Pay commission has also started meeting the relevant Employee Organisations. Meeting different organisations and obtaining their opinions are still in progress. The Pay commission has also visited various cities for this cause.</p>
<p>&nbsp;</p>
<p>Meeting Employees and Organisations in different cities and understanding their living conditions is the general functional procedure of the Pay commission. It is to be known that the recommendation for House Rent Allowance is also given by the Pay Commission.</p>
<p>&nbsp;</p>
<p>The Sixth Pay commission was released to the Employees in 2006. The recommendations of the Pay commissions are provisioned to be accepted after 10 years. Now the recommendations of the Pay Commission are to be implemented by the government before Janurary 2016.</p>
<p>&nbsp;</p>
<p>Another important point for the Pay commission to work on is the Dearness Allowance which has already crossed 100 percent. It is a common practice that employees are given an Interim relief when the Dearness Allowance crosses 100 percent. This is also to be considered by the Government and the Pay commission.</p>
<p><strong>Sources say that the declaration by the government may be done during or before the budget session. </strong></p>
<p><strong> </strong></p>
<p>The pay commission is also taking a memorandum from the Employee Unions and Organisations. As always, even this time every Employee is looking forward to the Railway Federation, as the Railway Employee Union is believed to be very strong. It is believed that the conditions and directions of the Pay commission are influenced to a very large extent by the Railway union. The defence organisation is also very strong, but they didn’t accept the conditions of the Sixth Pay Commission, and later their pay scale was modified. For this reason, all the Central government employees have fixed their sight on the Railway Union.</p>
<p>&nbsp;</p>
<p>This time, Railways has been divided into two big Employee unions for the sake of Pay. Now, only time can tell how fruitful will this strategy will prove to be.</p>

Sub: <strong>Memorandum of Interim Relief and merger of Dearness allowance.</strong></p>
<p>The National Secretariat of the Confederation of Central Government employees and workers places on record its appreciation over the efforts of the Staff Side, JCM, National Council in preparing and submitting the memorandum to the 7th Central Pay Commission, which has received the widest acceptance and admiration of the Central Government employees. Since the last date for submitting the Department-specific memorandum has been got extended by your efforts uptill 31st July, 2014, the first phase of our endeavour and interaction with the 7th CPC will come to a conclusion in a few days’ time.</p>
<p>I have been directed by the National Secretariat of the Confederation which met on 17th July, 2014 to solicit your kind reference to the memorandum submitted by the Staff Side on behalf of all Federations, Unions, Associations on Interim Relief and merger of Dearness allowance. We are of the view that the Staff Side, in pursuance of the said memorandum, must seek an audience with the Pay Commission immediately to know the course of action the Commission would like to take in the matter. We must also seek an appointment with the honourable Finance Minister thereafter so as to ensure that a decision on our demands is taken by the Government without any further delay. We hope we need not emphasise the fact that the Central Government employees do expect financial benefit on this score as the erosion in the real value of wages as on date is phenomenal.</p>

<div>I take this opportunity to bring to your kind notice that, while Government of India have appointed 7th Central Pay Commission for the Central Government Employees to make recommendations in regard to revision of wages and other allowances, merger of Dearness Allowance with Pay and payment of Interim Relief have neither been considered by the government itself nor included in the Terms of Reference(ToR)</div>
<div>of the VII CPC.</div>
<div></div>
<div>It may be recalled that the two issues, viz. Merger of Dearness Allowance with Pay and Interim Relief have been the subject matter with the government at the time when the Staff Side was called upon to present their views while finalizing the ToR of the VII CPC by the Secretary(PersonneI, DoP&amp;T), in his capacity as Chairman, Standing Committee, National CounciI(JCM). Although, the Staff Side pleaded for the specific reference of the above two issues to the VII CPC, the final version of the ToR, as approved by the government, did not find place for our views.</div>
<div></div>
<div>It would not be out of context to mention here that the methodology adopted for compensating the erosion in the real value of wage on account of price hike refiected in the rate of Dearness Allowance paid to Government Employees. The merger of DA to partially compensate the erosion in the real wages was done in pursuance of the report of Gadgil Committee in the post 2“ Pay Commission. This has, thereafter, been continued in the successive Central Pay Commissions also, wherein up to 50% of DA has been merged with the Pay when Dearness compensation exceeded 50%.</div>
<div></div>
<div>Dearness compensation has already reached 100% as on 01.01.2014, and it is further likely to exceed w.e.f. 01.07.2014, therefore, it would be grossly justified that, at least 50% DA be merged with Pay to compensate the erosion of the real value of the wages immediately.</div>
<div></div>
<div>The 7th CPC, appointed by the Government of India, has though started its functioning, nevertheless its report is expected to be available not earlier than 1 and 1/2 years time and because of uncontrolled skyrocketing price hike of essential commodities in the market, the real value of the wages is eroding the greatest extent, which is in no way being compensated even by sanction of Dearness Allowance/Dearness Relief.</div>
<div></div>
<div>It would, therefore, be imperative that, at least 25% of the Basic Pay of Central Government Employees, but not less than Rs.2000 should be sanctioned as “lnterim Relief” with immediate effect to compensate the sharp erosion in the real value of the wages.</div>
<div></div>
<div>We request your early intervention in the matter so as to provide necessary relief to the Central Government Employees.</div>

<div><strong>NATIONAL FEDERATION OF INDIAN RAILWAYMEN (N.F.I.R.)</strong></div>
<div>NFIR is one of the major Federations in the railways functioning for the cause of rail workforce (serving &amp; retired) and equally for the growth of Nation as well Railways since the last over six decades.</div>
<div></div>
<div>NFIR is one of the major constituents of the Joint Consultative Machinery (JCM). M. Raghavaiah, General Sccrctary/NFIR, is also the Leader of Staff Side/JCM.</div>

<div><strong>INDIAN RAILWAYS</strong></div>
<div>Indian Railways is a unique and complex transportation system under the control of Central Government, serving the needs of people since the last more than 160 years. Indian Railways handle over 19,000 regular trains (Freight &amp; Passenger) per day besides about 3000 special trains a day during various seasons. Its route kilometerage is 65,187.</div>
<div></div>
<div>During the year 2012-13, Indian Railways moved more than 1010 Metric Tonnes of freight traffic and joined as fourth member of the select Billion Tonne Club of USA, China and Russia. The operating ratio has been around 90% barring the 3 years period between 2005-06 &amp; 2008. The Indian Railways incur losses as a result of fulfilling the social service obligations. The approximate loss on this account is around Rupees Twenty Thousand Crores per annum.</div>

<div><strong>RAILWAY EMPLOYEES&#8217; ROLE:</strong></div>
<div>The railway employees perform duties for ensuring uninterrupted flow of services. They Work at over 7000 railway stations. Most work places do not have access to facilities and basic amenities for their living. The employees are compelled to work under the open sky and inclement weather conditions. They face hazards associated with the job environment, remoteness. inhospitable terrain etc.,</div>
<div></div>
<div>Although, railway employees are part of Central Government Employees, their nature of work, duties and responsibilities are uncommon and not comparable with any other system/industry. The staff who maintain railway tracks, rolling stock, signal/telecom network, train operations, trains planning, punctuality, safety are skillful and devoted to the system but however, these factors have not been given due weighage by successive Pay Commissions. The running staff i.e. Loco Pilots, Asst. Loco Pilots, Guards. operating staff, station masters, controllers etc.. perform their jobs facing many odds. They are expected lo perform duties even beyond the prescribed duty hours.</div>
<div></div>
<div>We may incidentally cite para 2.3 of the report of the Chairman, High Level Safety Review Committee headed by Dr.Anil Kakodkar submitted to the Railway Ministry. According tlo the said report the number of railway employees killed in the course of performing duties has been higher as can be seen from the following figures (period 2007—08 to 2011)</div>

<div>The nature of work, duties, responsibilities of railway staff justify grant of better pay structtire and other benefits treating the Railway Workforce as unique and not comparable with other Central Government employees. We shall explain the facts through our memorandum for consideration of Hon’ble 7th CPC.</div>
<div></div>
<div><strong>NFIR‘s MEMORANDAM AND EVIDENCE:</strong></div>
<div>As the NFIR is one of the major constituents of the JCM, our memorandum will be drafted and finalized after the submission of memorandum by JCM (Staff Side). In view of this, we request that we may be given time to submit our memorandum by 31st July, 20l4.</div>
<div></div>
<div>As the Hon’ble Pay Commission is aware that 1.3 million staff belonging to hundreds of caegories are working in the railways, we request that the Federation be given more slots in phases to facilitate us to explain the case of every important category cogently.</div>
<div></div>
<div><strong>SATISFACTION LEVEL OF 6th CPC REPORT:</strong></div>
<div>We may submit that the 6th  report, more particularly the concept of Grade Pay and Pay Band had generated many anomalies. This led to dis-satisfaction among different categories of railway employees. These anomalies are yet to be rectified by the Government. The proposals of Railway Ministry on 6th CPC issues are pending with Finance Ministry. MACPS aberrations have also been very large in number. Our efforts at the level of Railway Ministry as well Ministry of Personnel/MoF have not yielded positive result.</div>
<div></div>
<div>We hope that the Seventh Central Pay Commission would look into these issues in a realistic manner for mitigating the injustice caused to staff.</div>
<div></div>
<div><strong>DEARNESS ALLOWANCE — IT’s MERGER WITH PAY:</strong></div>
<div>Honhle Pay Commission may kindly appreciate that the Dearness Allowance (D.A.) has become 100% of pay w.e.f. 01/01/2014. This scenario was never anticipated by the 6th CPC. It may however be appreciated that in the past, the Government had merged DA with pay when it crossed 50% (In the year 2004). We are expecting 6% DA w.e.f. July 1, 2014, thus the DA% would be 106% of pay in July, 2014.</div>
<div></div>
<div>We therefore, request the Hon’ble Pay Commission to kindly consider this aspect for sending interim report to the Government recommending merger.</div>
<div></div>
<div><strong>CONCLUDING:</strong></div>
<div>NFIR assures its co-operation to the Pay Commission by way providing facts and material &amp; equally hopes that this Pay Commission would render justice to the Railway employees.</div>

<div>While enclosing copy of Federation’s letter No. 1/5(A) dated 27/09/2013, NFIR desires to bring to your kind notice, the following facts for consideration.</div>
<div></div>
<div>2. In the Standing Committee meeting held under the chairmanship of the Secretary DoP&amp;T, on 7th May 2014, the agenda item pertaining to merger of D.A. with pay was discussed by the JCM/Staff Side representatives. There has, however, been no positive response from the Official Side on the issue probably the VII CPC has started working on the terms of reference.</div>
<div></div>
<div>3. Now that the D.A. has become 100% of pay w.e.f. 01/01/2014 and another instalment of D.A. @ 6% of pay is likely to be granted by the Government w.e.f. 01/07/2014 as per the figures of Consumer Price Index, continuing D.A., without merger, is highly unjustified. In the past i.e. during the year 2004, the Government of India had merged 50% DA with pay for all purposes. Similar decision has, unfortunately, not been taken by the previous Government.</div>
<div></div>
<div>4. Seventh Central Pay Commission has already sent communications to JCM constituent organisations etc.. to submit Memorandums. At this juncture, it would be proper to convey to the Chairman, 7th CPC to consider the JCM (Staff Side) demand for merger of DA with pay with retrospective effect and send interim report to the Government for consideration.</div>

<div>NFIR, therefore, requests you to kindly consider our request and see that the Government makes reference to 7th CPC to consider DA merger with pay and to send its interim report to the Government for favourable consideration.</div>

<div>On the invitation of the Seventh Central Pay Commission for having Preliminary Interaction with All India Railwaymen’s Federation(AIRF), a delegation of the AIRF, comprising of Com. Shiva Gopal Mishra, General Secretary AIRF, Com. Rakhal Das Gupta, Working President AIRF, Com. Ch. Sankara Rao, Asstt. General Secretary AIRF and Com. J.R. Bhosale, Treasurer AIRF, met today, i.e. 28th May, 2014, the Seventh Central Pay Commission(Hon’ble Justice Shri Ashok Kumar Mathur, Chairman, Shri Vivek Rae, Member, Dr. Rathin Roy, Member and Ms Meena Agarwal, Secretary, Seventh Central Pay Commission) in Hotel Janpath(Camp Office of the VII CPC), New Delhi.</div>
<div></div>
<div><strong>The following points were raised by the AIRF before the VII CPC:-  </strong></div>
<div><strong><br />

<div><strong>(i) Extension and improvement in Railway Services </strong></div>
<div><strong>(ii) Safety &amp; Training </strong></div>
<div><strong>(iii) Wages, Dearness Allowance and Other Allowances </strong></div>
<div><strong>(iv) Living Wage </strong></div>
<div><span style="color: #ff0000;"><strong>(v) Interim Relief </strong></span></div>
<div><span style="color: #ff0000;"><strong>(vi) Merger of Dearness Allowance</strong> </span></div>
<div></div>
<div>It was asserted by the AIRF that the Railwaymen are Industrial Workers and are governed by the Industrial Disputes Act, Factories Act and Hours of Employment Regulations etc.</div>
<div></div>
<div>It was stressed by the AIRF that, out of 7,000 railway stations, over 6,000 are road side stations where staff are bereft of all civic facilities like housing, electricity, drinking water, sanitation, medical facilities etc., and the education of their children suffers.</div>
<div></div>
<div>Indian Railways run 19,000 trains daily and additional train services are being introduced without developing</div>
<div>infrastructure and adding manpower, rather manpower is being reduced day-by-day. In spite of all impediments, there has been tremendous improvement in carrying goods traffic and passenger services.</div>
<div></div>
<div>AIRF further stressed that, the Railwaymen are working round-the-clock in all weathers and arduous conditions, even sacrificing their lives to keep the lifeline of the nation(Indian Railways) in operation. On the one hand it used to be said that we(the Railwaymen), are the second line of defence, on the other, when the issue of Wage Structure and Allowances comes, the Railwaymen always get raw-deal, saying, they are “Common Categories”. Quoting examples of the Running Staff, Technician, Technical Supervisor, Operating &amp; Commercial Staff, AIRF asked, where we are common? The VII CPC agreed that they would definitely look into these aspects while deciding wages and allowances of the Railwaymen.</div>
<div></div>
<div>It was impressed upon to the Seventh Central Pay Commission that AIRF would lead broad categories/ departments’ representation to VII CPC during oral evidence.</div>
<div></div>
<div>It was also stressed that the Seventh Central Pay Commission should consider the matter of granting Interim Relief as well as merger of Dearness Allowance with the Pay.</div>
<div></div>
<div>The Members of the Pay Commission, mainly the Chairman himself, interacted with AIRF’s representatives. The Pay Commission gave patient hearing and assured that they could understand the complexity and gravity of the Railway Industry, devotion and dutifulness of the Railwaymen and would try to administer justice to the Railwaymen by way of their recommendations.</div>
<div></div>
<div>Thereafter, representatives of the Staff Side, National Council (JCM), lead by Com. Shiva Gopal Mishra, Secretary, Staff Side, National Council(JCM), along with Com. Rakhal Das Gupta, Com. Ch. Sankara Rao and Com. J.R. Bhosale, Members, Standing Committee, NC/JCM/AIRF, held discussions with the VII CPC.</div>
<div></div>
<div>The issues of Fixation of Wages, allowances and the matters of Anomalies of VI CPC, Scrapping of New Pension Scheme, Promotional Policy, General Grade Structure along with the demands of Interim Relief and Merger of Dearness Allowance with the Pay were raised by the Staff Side, NC/JCM. Apart from AIRF representatives, in the delegation, Coms. M. Raghavaiah, Guman Singh, S.N. Pathak, S.K. Vyas, Sri Kumar, K.K.N. Kutty and B.C. Sharma were also present on the occasion.</div>
<div></div>
<div>The Chairman, VII CPC, on persistent demand of the Staff Side, NC/JCM, suggested that the Staff Side can submit separate Memorandum on Interim Relief and Merger of Dearness Allowance, so that VII CPC can seek necessary advice from the Government, as to how to deal with these issues since there has been no specific reference in the matter from the Government to VII CPC on these subjects.</div>
<div></div>
<div>It was decided that detailed memorandum on behalf of Staff Side, National Council(JCM) should be submitted by 30th June 2014, and all the departments, like Railways and others should submit their memorandum by 15th July, 2014.</div>
<div></div>

<p>The National Mazdoor Conference has urged the Chairman of the newly formed 7th Pay Commission recommend that 20% interim relief be given to all Central and State Government employees.</p>
<p>As per Newspapers report that the National Mazdoor Conference has also strongly demanded that these recommendations be submitted to the new government that is likely to form at the Centre.</p>
<p>The NMC President, Subhash Shastri said in a letter to 7th Pay Commission that along with the State and Central Government employees, the interim relief of 20% of basic pay be also extended to pensioners too and that these demands be recommended as soon as the Election Commission’s restrictions (Model Code of conduct Rules) end.</p>
<p>Shastri emphasised that whenever the recommendation of the commission are submitted to the Central government, the Commission should extend these recommendations to the state governments in general and Jammu and Kashmir in particular.</p>
<p>In addition to these, the National Mazdoor Conference has also demanded on its previous demands for raising the retirement age to 62 and of 50% DA merger.</p>
<p>Last week, the Confederation had released its draft reply to the 7th Central Pay Commission questionnaire. The Secretary General said that a final decision in this regard will be made at the Staff Side National Council Meeting.</p>
<p>Leading federations are going to proclaim their replies in the near future. Employees all over the country are eagerly waiting to see these, especially the opinions and queries of federations like AIRF, and NFIR.</p>
<p>Meanwhile, the 7th Pay Commission has sent a circular to all the federations to submit their replies as memorandum on or before June 30. The Commission has sought the cooperation of all the federations since it has to submit a complete report to the Government within 18 months.</p>
<p>The Federations have advised their affiliate unions to hurry with their opinions, demands and their views on the implementation of 7th CPC. Attention is now being channelized to draft suggestions and demands that include all thoughts and views.</p>
<p>The 7th Pay Commission too is particular about gathering opinion and feedback from all Ministers/Departments and the general public for drafting its recommendations.</p>

<div>The Union Cabinet approved the Finance Ministry’s proposal on terms of reference of the 7th CPC.  We have placed the full text of the same on our website.  None of the suggestions made by the Staff Side was accepted by the Government.</div>
<div></div>
<div>However, our concern over the date of effect seems to have been taken note of.  The terms of reference has left the effective date of its recommendations to be decided by the Commission itself.  A united stand backed up by struggles will enable us to clinch this demand in our favour.  Undoubtedly it has been our endeavours and the two days strike action that has compelled the Government to have a rethinking on their earlier stand of Decennial (Ten years} wage revision for Central Government employees and the date of effect as 1/1/2016</div>

<div>Unlike on the earlier occasion, the Government has not decided to grant Interim Relief and merger of Dearness allowance.  Nor has it asked the Commission to consider and make appropriate recommendation in this regard specifically.  As pointed out in our earlier communication, inclusion of a labour representative in the Commission being not an idea the UPA Government cherishes, for it is diametrically opposite to its economic policies and ideology, they have stuck to the position of sandwiching the Honourable Judge with bureaucrats.  In the light of the agreement penned by Com. Mahadeviah, the General Secretary of the recognised GDS union with the Postal Board to the effect that a separate one man committee will look into the service conditions of the Grameen Dak Sewaks, it is not surprising that the Government chose to ignore our demand to cover them within the ambit of the 7th CPC.   Our demands for parity between the past and present pensioners and scrapping of the new pension scheme also stand rejected.</div>
<div></div>
<div>As you are aware, the 6th CPC (and the earlier Commissions also) had refused to entertain the demand for removal of anomalies despite Government referring the same to the Commission specifically.  Therefore, the omnibus clause in the terms of reference requiring the Commission to submit interim reports may not be of any help to us to raise the anomalies before the 7th CPC.</div>
<div></div>
<div>At the conclusion of the meeting held on 24/10/2013 by Secretary, DoPT, with the staff side on terms of reference of the 7th CPC, it was agreed that the Government will consider our suggestion in the matter and will convene another meeting with the presence of Secretary (Expenditure) to iron out the differences, if any, and explore the possibilities of an agreement in the matter. But no such meeting was convened and no attempt was made by the official side to arrive at an agreed Terms of Reference.</div>

<div>We must now react to the arbitrary and unilateral decision of the Government.  We appeal all the State Secretaries, District Secretaries and Branch Secretaries of the affiliated organisations and the State/District COCs to immediately send the following Savingram to the Prime Minister.</div>

<div>While the National Convention scheduled to be held at Nagpur will chalk out detailed and phased programmes of action, we call upon our State Committees and Affiliated Unions to organise massive demonstration in front of all offices and important centres on 7th  March, 2014 (Friday) or any other immediate convenient date. Kindly instruct all the Branches to mobilise their members so that the demonstration has the participation of cent per cent of the membership of the concerned branch.  The State Units and affiliated Unions may issue pamphlets and posters and ensure its wide circulation throughout the country.</div>

<div>As already declared by the National Secretariat of the Confederation, we shall have to go for an indefinite strike action immediately after the General Election if our demands are to be settled.</div>

<p>NEW DELHI: The Union Cabinet on Friday raised dearness allowance to 100% from 90%, benefiting 50 lakh employees and 30 lakh pensioners.</p>
<p>The government has also cleared the way for merger of 50% DA with basic pay by approving it among the terms of reference of the 7th Pay Commission. An official said now the commission can suggest the merger in its interim report.</p>
<p>He added that 50% DA merger with basic pay will roughly increase the gross salaries of central government employees by around 30%.</p>
<p>The Cabinet approved the proposal to release an additional installment of DA and dearness relief (DR) to pensioners with effect from January 1, 2014, in cash, but not before the disbursement of the salary for the month of March 2014 at the rate of 10% increase over the existing rate of 90%, said an official statement.</p>
<p>Central government employees as well as pensioners are entitled for DA/DR at the rate of 100 per cent of the basic with effect from January 1, 2014, it said.</p>
<p>The government has estimated that the combined impact on exchequer on account of both DA and DR would be Rs 11,074.80 crore every year.</p>
