<p>Sub: <strong>Leave rules. – Extending the eligibility of half a day LAP to all employees.<br />Ref: Para-539(2) of Indian Railway Establishment Code Volume-I</strong></p>

<p>IRTSA wishes to emphasize the necessity of extension of half day LAP eligibility to all employees and thereupon submit the following facts to your kind perusal:</p>



<p>1) IREC para 539 given below entitles workshop artisan staff to avail half a day LAP. 539 Leave to Workshop staff. – (1) Skilled artisans as also semi-skilled and un-skilled workman will earn leave on average pay, half average pay and commuted leave and leave not due in accordance with these rules.</p>



<p>(2) Workshop staff may be allowed to take leave with pay, if due, or without pay, for periods not less than half a day. For this purpose leave for half a day means authorized absence from duty for over half an hour either during the first period before interval or the second period of any day on which the workshop remains open for both the periods. This concession however, is restricted to six occasions in a year.</p>



<p>2) The purpose of entitling half a day LAP for one category of staff and not entitling for all other staff is not known clearly since the decision was taken in the year 1949 and this rule was not revised for so many years.</p>



<p>3) Half day LAP entitlement might have been given to workshop artisan staff to make them available for work after attending their personal needs in shorter length of time.</p>



<p>4) In present day situation the reasons for allowing half day LAP remains same for all and all non-gazetted employees are required to record their attendance on bio metric method. Reasons like employees coming for duty from faraway places, delay in commuting in city traffic, requirement of attending personal &amp; family needs for an hour, delay due to natural causes like heavy rain, employees returning to HQ in the morning after availing leave or weekend outing, employees required to proceed on leave for emergencies after attending duty for half a day, etc requires half day LAP entitlement for all staff.</p>



<p>5) If half a day LAP entitlement is given to all employees, it will not be necessary for employees to apply full day LAP when they are in need of half a day leave only. It will improve employees’ availability at work. This will improve overall performance of section/shop/depot/office, etc. Cumulatively throughout Indian Railways lakhs of man hours will be available for productive work.</p>



<p>6) Denial of eligibility of half a day LAP to all employees is in violation of Article 14 of the Constitution of India which says that, “The State shall not deny to any person equality before the law or the equal protection of the laws within the territory of India.”</p>



<p>7) Hence it is requested that, entitlement of half a day LAP may be extended to all employees of Indian Railways including Technical Supervisors, which will ensure winwin situation for employees and administration.</p>

<p>Ministry of Labour &amp; Employment has issued each of orders No (i) 1/8(1)/2023-LS-II (ii) 1/8(2)/2023-LS-II_ (iii) No.1/8(3)/2023-LS-II_ (iv) No.1/8(4)/2023-LS-II_ (v) 1/8(5)/2023-LS-II, (vi) 1/8(6)/2023-LS-II (vii) 1/8(7)/2023-LS-II, all are dated 26.09.2023 revising the rates of variable dearness allowance for contract workers engaged in (i) Agriculture (ii) Gypsum Mines, Barytes Mines, Bauxite Mines, Manganese Mines, China Clay Mines, Kyanite Mines, Copper Mines, Clay Mines, Magnesite Mines, White Clay Mines, Stone Mines, Steatite Mines (including the mines producing Soap Stones and Talc), Ochre Mines, Asbestos Mines, Fire Clay Mines, Chromite Mines, Quartzite Mines, Quartz Mines, Silica Mines, Graphite Mines, Felspar Mines, Laterite Mines, Dolomite Mines, Red Oxide Mines, Wolfram Mines Iron Ore Mines, Granite Mines, Rock Phosphate Mines, Hematite Mines, Marble and Calcite Mines, Uranium Mines, Mica Mines, Lignite Mines, Gravel Mines, Slate Mines and Magnetite Mines (iii) Construction or Maintenance of Roads or runways or in Building Operations including Laying Down Underground electric, wireless, Radio, Television, Telephone, Telegraph and Overseas Communication Cables and Similar other Underground cabling work, Electric lines, Water supply lines and Sewerage Pipe Lines (iv) Loading and unloading in (a) Goods sheds, Parcel offices of Railways, (b) Other goods-sheds, godowns, warehouses and other similar employments; (c) Docks and Ports; And (d) Passengers goods and Cargo Carried out at Airports ( Both International and Domestic) (v) Employment of sweeping and cleaning excluding activities prohibited under the Employment of Manual Scavengers and Construction of Dry Latrines (Prohibition) Act, 1993 (vi) Watch and Ward (With and Without arms) and (vii) Stone Mines is sent herewith for information and strict compliance. The rates are applicable w.e.f. 01.10.2023.</p>



<p>2. Railways, being Principal Employer are required to ensure that the contractors are complying with the provisions of the Contract Labour (R&amp;A) Act, 1970 and Minimum wages Act, 1948 strictly and arranging prescribed minimum wages to the contract labourers.</p>



<p>3. This issues with the concurrence of the Finance Directorate of Ministry of Railways.</p>

<p>Clarification on &#8220;Regular Employees&#8221; for <strong>GDCE</strong> -prescribed minimum service criteria for serving Railway employee: RBE No. 112/2023, issued October 6, 2023. The Railway Board releases clarification (RBE No. 112/2023) about the eligibility of &#8220;Regular Employees&#8221; in the General Departmental Competitive Examination (GDCE). Some railways questioned the need for a two-year service requirement to participate in the GDCE. The Railway Board confirms that no minimum service condition is currently required for this round of GDCE. Railways that previously imposed the two-year restriction should reconsider and allow rejected personnel more time to apply. The procedure should take around a month to finish.</p>

<h3 class="wp-block-heading">Sub: Clarification on “Regular Employees” for appearing GDCE &#8211; prescribing minimum service conditions for serving Railway employee.</h3>



<p>Ref:  i) East Coast Railway’s letter No. ECoR-HQ/PER dated 20.09.2023.<br />ii) East Coast Railway’s letter No. ECor-HQ/PERS (R) /16/2021(28/20230 dated 03.10.2023.<br />iii) Railway Board’s letter No. E(NG)I/92/ PM2/16 dated 20.08.93(RBE No. 129/93).</p>

<p>Attention is invited to Board’s letter No. Railway Board’s letter No. E(NG)I/PM1/12 dated 20.06.2023 (RBE No. 80/2023) wherein instructions were issued for conducting General Departmental Competitive Examination(GDCE) for filling up of 25% of the Direct Recruitment Quota Vacancies.</p>



<p>One of the Zonal Railways has raised a doubt as to whether 02 years’ minimum service condition is required for serving Railway employees for appearing in GDCE Examination. It has also been observed that different Railways are following different minimum service condition in this round of GDCE.</p>



<p>The issue of prescribing any minimum residency period to become eligible for future GDCEs is still under deliberation in this office. However, on the basis of precedence and practice followed all along by most Railways in terms of the instructions of RBE 129/93, it is clarified that while reiterating that regular employees are eligible, no minimum service condition has now been prescribed for appearing in this round of GDCE examination. Zonal Railways who have already advertised the 02 years service to be eligible for GDCE, are also advised to issue corrigendums to remove the 2 year restriction and re-invite applications giving a reasonable time to the employees who may have been excluded earlier on this account to apply and then scrutinize the same and finalize their list of eligibles.</p>



<p>Zonal Railways may please ensure that this fresh process should be completed in a time bound manner of not later than one month.</p>

<h3 class="wp-block-heading">Sub: Updation of data of Officers/Staff in Biometric Attendance System.</h3>



<p>Attention is invited to Office Order No. 53 of 2023 dated 22.08.2023 wherein it was requested to update the details by login of respective accounts in REIS System. The last date for updating the details was 28.08.2023. However, it has been confirmed by RBCC that around 50% of officials working in Board’s Office have not updated their details in REIS System. This has been viewed seriously by the competent authority.</p>



<p>2. In view of above, all Officers/ Staff working in Board’s Office, who have not updated their details in REIS, may please update their details by login of their respective accounts in REIS (Railway Employee Information System) and fill in all the required details as asked by the system carefully by 15.09.2023, failing which suitable action may be initiated. This exercise is mandatory for all the Officers/ Staff working in Board’s Office. For any assistance/ help regarding updation of data in REIS, RBCC Branch may be contacted.</p>

<h3 class="wp-block-heading">Sub:- Provision of economy meals and affordable packaged drinking water in GS coaches.</h3>



<p>Ref:-(i) Board’s letter of even no. dated 27.06.2023.<br />(ii) IRCTC’s letter no. Z019/IRCTC /Catg./Policy Instructions/ 02 dated 20.07.2023 &amp; 25.07.2023.</p>



<p>This is in continuation to Board’s instructions issued vide letter referenced above (Ref-i) vide which Zonal Railways/ IRCTC were advised to take necessary action for making provision of economy meals and affordable sealed glass of packaged drinking water at platforms of stations for the passengers of GS coaches. Further, IRCTC, vide letter dated 20.07.2023, has raised few concerns regarding implementation of the scheme. The same have been examined in Board’s office and following is advised:</p>



<p>1. Zonal Railways must ensure earmarking of space at platforms for service counters in terms of Board’s letter dated 27.06.2023 to enable IRCTC to provide seamless service of economy meals, snack/combo meals and affordable packaged drinking water to passengers of GS coaches. The compliance in this regard may be forwarded to this office by <strong>27.07.2023.</strong></p>



<p>2. Any one option of the following rice based economy meals may also be made available from such service counters in addition to the aloo-poori economy meal as per the details below:</p>

<p>Vide above referred letters, details instructions were issued regarding introduction/ implementation of ‘Aadhar Enabled Biometric Attendance System’ (AEBAS) in all the offices of Railways and Aadhar authentication of Railway employees. However, as per feedback received from some of the ZRs/PUs recently, it has been observed that AEBAS has become non-functional due to COVID-19 pandemic and the commencement of the same is underway</p>



<p>2. In this regard, it is mentioned that detailed instructions have already been issued from Board’s office for effective implementation of ‘Aadhar Enabled Biometric Attendance System’ (AEBAS) over Indian Railways vide above referred letters. It is therefore, reiterated to ensure strict implementation of AEBAS in all the offices of the Railways including PUs, attached and subordinate offices and a status report in this regard be furnished to Board’s office immediately thereafter.</p>



<p>3. Further, it is also desired to update and verify the existing Railway employees Aadhar data including those, who are still left out for some reasons, to identify impersonation of employees and weeding out duplication of employees/ ghost employees.</p>



<p>This may be treated as ‘Most Immediate’.</p>

<h3 class="wp-block-heading"><strong>Sub: Fixation of pay on promotion to regular JAG after officiating appointment in JAG(Ad-hoc)</strong></h3>



<p>Consequent to adoption of instructions issued by Department of Personnel &amp; Training (DoP&amp;T) regarding restriction of officiating pay under FR-35 (Rule 1329 of IREC Vol. I) in the context of RS(RP) Rules, 2016 vide Board’s letter No. PC-VII/2017/I/7/5/8 dated 08.08.2019 (RBE 127/2019), certain Railways referred the issue to Board’s Office Stating that few Officers are drawing lesser pay on regular promotion to JAG in comparison to the pay drawn by them during officiating in JAG.</p>



<p>2. Above policy aspect has been examined in consultation with Department of Personnel &amp; Training. It 1s advised that such cases may be dealt as per proviso to Rule 1313(1) of IREC Vol. IL. Proviso to Rule 1313(1) of IREC Vol. II is reproduced under:-</p>



<p>“(b) If the conditions prescribed in clause (a) are not fulfilled, he shall draw as initial pay on the minimum of the time scale.</p>



<p>Provided that, both in cases covered by clause (a) and in cases, other than the cases of re-employment after resignation or removal or dismissal from the public service, covered by clause (b), if he;</p>



<p>(1) has previously held substantively or officiated in —</p>



<ul class="wp-block-list">
<li>(i) the same post, or</li>



<li>(ii) a permanent or temporary post on the same time scale; or</li>



<li>(iii) a permanent post or a temporary post (including a post in a body, incorporated or not, which is wholly or substantially owned or controlled by the Government) on an identical time scale; or</li>
</ul>



<p>(2) is appointed subject to the fulfillment of eligibility conditions us prescribed in the relevant recruitment rules to a tenure post on a time scale identical with that of another tenure post which he has previously held on regular basis; then the initial pay shall not, except in cases of reversion to parent cadre, governed by proviso (1) (iii) be less than the pay, other than special pay,personal pay or any other emoluments which may be classed us pay by the President under Rule 1303 (iii)- RIT (FR-9 (21) (a) (iii)) which he drew on the last occasion, and he shall count the period during which he drew that pay on a regular basis on such last and any previous occasions for increment in the stage of the time scale equivalent to that pay. If, however, the pay last drawn by the Railway servant in a temporary post had been inflated by the grant of premature increments, the pay which he would have drawn but for the grant of these increments shall, unless otherwise ordered by the authority competent to create the new post, be taken for the purposes of this proviso to be the pay which he last drew in the temporary post which he had held on a regular basis. The service rendered in a post referred to in proviso (1) (iii) shall, on reversion to the parent cadre, count towards initial<br />fixation of pay, to the extent and subject to the conditions indicated below; ”</p>

<p>1313. (FR-22) (I) —The initial pay of a railway servant who is appointed to a post on a time scale ofpay is regulated as follows:–</p>



<p>(a) (1)</p>



<p>“1313(F.R.22) (1) The initial pay of a railway servant who is appointed to a post ona time scale of pay ts regulated as follows :-</p>



<p>(a)(1) where a Railway servant holding a post, other than a tenure post. in a substantive or temporary or officiating is promoted of appointed in a substantive, temporary of officiating capacity, as the case may be, subject to the fulfillment of the eligibility conditions as prescribed in the relevant Recruitment Rules, to another post carrying duties and responsibilities of greater Importance than those attaching to the post held by him. his initial pay in the time-scale shall be fixed by giving one increment in the level from which the Railway servant is promoted and he or she shall be placed at a cell equal to the figure so arrived at in the level of the post to which promoted or appointed and if no such cell is available in the level to which promoted or appointed, he shall be placed in the next higher cell in that level.</p>



<p>Save in cases of appointment on deputation to an ex-cadre post or to a post on ad-hoc basis or on direct recruitment basis, the Railway servant shall have the option, to be exercised within one month from the date of promotion or appointment or as the case may be. to have the pay fixed under this rule from the date of such promotion or appointment or to have the pay fixed initially at the next higher cell in the level of post to which he or she is promoted on regular basis and subsequently, on the date of accrual of next increment in the level of the post from which Railway servant is promoted, shall be re-fixed and two-Increments his pay (one accrued on account of annual increments and second accrued on account of promotion) shall be granted in the level from which the Railway Servant is promoted and he or she shall be placed, at a cell equal to the figure so arrived, in the level of the post to which he or she is promoted; and if no such cell is available in the level to which he or she is promoted, he or she shall be placed at the next higher cell in that level.</p>



<p>In cases where an officer has retired as ad-hoc before being regularized to that post and later on has been assessed during the process of regularization and found fit by the competent authority along with his or her juniors, who are still in service and are eligible to avail of the option facility from a date on which the retired employee was still in service. the same option facility shall also be extended to the retired employee, to be exercised within three months from the date when his or her junior became eligible to avail of option facility and in cases where such retired employee was himself the junior most. he or she may exercise the option facility within three months from the date when his or her immediate senior become eligible to avail of option facility:</p>



<p>Provided that where a Railway servant is, immediately before his promotion or appointment on regular basis to a higher post, drawing pay at the maximum of the lower post, his initial pay in the level of the higher post shall be fixed at the cell equal to the figure so arrived at in the level of the post to which promoted or appointed by increasing his pay in respect of the lower post held by him on regular basis by an amount equal to the last increment in the level of the lower post and if no such cell is available in the level to which he is promoted or appointed, he shall be placed at the next higher cell in that level.”</p>

<p>(2) When the appointment to the new post does not involve such assumption of duties and responsibilities or greater importance, he shall draw as initial pay, the stage of the time scale which is equal to his pay in respect of the old post held by him on regular basis, or, if there 1s no such stage, the stage next above his pay In respect of the old post held by him on regular basis. </p>



<p>Provided that where the minimum pay of the time scale of the new post is higher than his pay in respect of the post held by him regularly, he shall draw the minimum as the initial pay; Provided further that in a case where pay is fixed at the same stage, he shall continue to draw that pay until such time as he would have received an increment in the time scale of the old post; in cases where pay is fixed at the higher stage, he shall get his next increment on completion of the period when an increment is earned in the time scale of the new post.</p>



<p>On appointment on regular basis to such a new post, other than to an ex-cadre post on deputation, the Railway servant shall have the option, to be exercised within one month from the date of such appointment, for fixation of his pay in the new post with effect from the date of appointment to the new post or with effect from the date of increment in the old post.</p>



<p>(3) When appointment to the new post is made on his own request under (Rule 227 (a) (2)-RI (FR-15A) (2)) and the maximum pay in the time scale of that post is lower than his pay in respect of the old post held regularly, he shall draw that maximum as his initial pay.</p>



<p>(b) If the conditions prescribed in clause (a) are not fulfilled, he shall draw as initial pay on the minimum of the time scale.</p>



<p>Provided that. both in cases covered by clause (a) and in cases. other than the cases of re-employment after resignation or removal or dismissal from the public service. covered by clause (b), if he;</p>



<p>(1) has previously held substantively or officiated in —</p>



<p>(i) the same post, or</p>



<p>(ii) a permanent or temporary post on the same time scale: or</p>



<p>(iii) a permanent post or a temporary post (including a post in a body, incorporated or not, which is wholly or substantially owned or controlled by the Government) on an identical time scale; or</p>



<p>(2) is appointed subject to the fulfillment of eligibility conditions as prescribed in the relevant recruitment rules to a tenure post on a time scale identical with that of another tenure post which he has previously held on regular basis; then the initial pay shall not. except in cases of reversion to parent cadre, governed by proviso (1) (ill) be less than the pay, other than special pay, personal pay or any other emoluments which may be classed as pay by the President under Rule 1303 (il1) &#8211; RIT (FR-9 (21) (a) (11)) which he drew on the last occasion, and he shall count the period during which he drew that pay on a regular basis on such last and any previous occasions for increment in the stage of the time scale equivalent to that pay. If, however, the pay last drawn by the Railway servant in a temporary post had been inflated by the grant of premature increments. the pay which he would have drawn but for the grant of these increments shall, unless otherwise ordered by the authority competent to create the new post, be taken for the purposes of this proviso to be the pay which he last drew in the temporary post which he had held on a regular basis. The service rendered in a post referred to in proviso (1) (iii) shall, on reversion to the parent cadre, count towards initial fixation of pay, to the extent and subject to the conditions indicated below: </p>



<ul class="wp-block-list">
<li>(a) The Railway servant should have been approved for appointment to the particular grade or post in which the previous service is to be counted;</li>



<li>(b) All his seniors, except those regarded as unfit for such appointment, were serving in posts carrying the scale of pay in which benefit is to be allowed or in the higher posts, whether in the Department itself or elsewhere and at least one junior was holding a post in that Department carrying the scale of pay in which the benefit is to be allowed; and</li>



<li>(c) The service will count from the date his junior is promoted on a regular basis and the benefit will be limited to the period the railway servant would have held the post in his parent cadre had he not been appointed to the ex-cadre post.</li>
</ul>



<p class="has-text-align-center"><strong>Railway Board’s Orders</strong></p>



<p>(1) These rules will not apply to ad-hoc promotions from Group ‘B’ to Group ‘A’ and ad-hoc promotions within Group *A’ for which separate orders issued by Railway Board will good.</p>



<p>(2) Duties and responsibilities of greater importance for the purpose of Rule 1313(FR-22):</p>



<p>(i) For the purpose of fixation of substantive pay (including presumptive pay) a junior scale post shall be deemed to carry duties and responsibilities of greater importance than those attached to Class I] post (including the post of an Assistant Accounts Officer).</p>



<p>(This takes effect from 2nd July. 1959)</p>



<p>(ii) Appointments of the following classes shall be deemed to involve the assumption of duties and responsibilities of greater importance-</p>



<ul class="wp-block-list">
<li>(a) appointment to the Assistant Officer’s grade or Lower Gazetted Service from a non- gazetted post;</li>



<li>(b) appointment to the District Grade from an Assistant Officer’s or lower grade post;</li>



<li>(c) appointment to junior administrative post from the District or Lower grade;</li>



<li>(d) appointment to a senior or inter-administrative post from a junior administrative post or from a lower grade;</li>



<li>(e) appointment to a senior administrative post from an intermediate administrative post;</li>



<li>(f) appointment to a senior administrative post in the erstwhile scale of Rs.1800-2250 from a senior administrative post in the scale of Rs. 1800-2200 (RS).</li>
</ul>



<p>(3) A temporary post on a certain rate of pay (fixed or time-scale) which is converted into a permanent post on a different rate of pay is not the same post as the permanent post even though the duties remain the same.</p>



<ul class="wp-block-list">
<li>II. The President may specify posts outside the ordinary line of service the holder of which may, notwithstanding the provisions of this rule and subject to such conditions as the President may prescribe, be given officiating promotion in the cadre of the service which the authority competent to order promotion may decide, and may thereupon be granted the same pay whether with or without any special pay attached to such posts as they would have received if still in the ordinary line.</li>



<li>III. For the purpose of this rule, the appointment shall not be deemed to involve the assumption of duties and responsibilities or greater importance if the post to which it is made is on the same scale of pay as the post, other than a tenure post, which the railway servant holds on a regular basis at the time of his promotion or appointment or on a scale of pay identical therewith.</li>



<li>IV. Notwithstanding anything contained in this rule. where a railway servant holding an ex-cadre post is promoted or appointed regularly to a post in his cadre, his pay in the cadre post will be fixed only with reference to his presumptive pay in the cadre post which he would have held but for his holding any ex-cadre post outside the ordinary line of service by virtue of which he becomes eligible for such promotion or appointment.</li>

<p>Attention is invited to Board’s letter of even number dated 14.11.2022 (RBE No. 151/2022), wherein mentioning instructions issued vide RBE No. 89/1989, it had been clarified that Level-I employees (erstwhile Group ‘D’), who are now classified as Group ‘C, are also eligible for the selection to the post of Publicity Inspector in Level-5.</p>



<p>One of the Zonal Railways has raised doubt as to whether the upper age limit along with relaxation for SC/ST employees as indicated vide RBE No. 131/97 still holds good or otherwise. The matter has been examined, and it is clarified that upper age limit of eligible employees for selection to the post of Publicity Inspector in tevel-5 is 40 years which is relaxable by 5 years in the case of SC/ST employees as provided in RBE No. 131/97, which still holds good.</p>



<p>This disposes off Eastern Railway’s letter No. E.839/T-HQ/CPRO/ promotion/ NM/Pt.II dt.04.05.2023.</p>

<h3 class="wp-block-heading">Sub: Treating the period of Earned Leave/ training for computation of minimum requisite period of 90 days for writing the APAR.</h3>



<p>As per the existing instructions, the Reporting, Reviewing and Accepting Authorities are required to have at least 90 days experience of supervising the work and conduct of a subordinate officer to record their assessment in his APAR. As per present practice, while computing the period of 90 days, the leave/ training period of even a day or two is taken into account and deducted from the total period spent on the post.</p>



<p>2. This issue has been considered by the Board and it has now been decided that where the officer reported upon or the Reporting/ Reviewing/ Accepting officer has been on leave/training, etc. for a period of more than 15 days at a time during the period of the APAR, the total period spent on leave/training may be deducted from the total period spent on the post, for purposes of computing the minimum requisite period of 90 days for writing the entries in the APAR. However, where such period of leave/ training is 15 days or less at a time, the same will not be taken into account while computing the minimum requisite period of 90 days for writing the APAR.</p>



<p>3. The above guidelines will be applicable from the reporting period 2022-23 onwards. The APARs already written need not be amended/re-written on the basis of new guidelines mentioned above.</p>



<p>4. This should be brought into the notice of all concerned.</p>

<h3 class="wp-block-heading">Sub: Relaxation in air travel (both ways) for the officers working in Station Development Directorate of Railway Board.</h3>



<p>It has been decided with the approval of Board (Member Finance) to delegate the powers for sanction of air travel for Station Development Directorate of Board’s office as under:</p>



<p>1. For the Financial Year 2023-24, an allotment of Rs. 5 Lakhs towards air travel of officials (DDs/ JDs/ Directors/EDs) of Station Development Directorate i.e. including ED/ SD-I and ED/SD-II is to be earmarked.</p>



<p>2. The tour programme should be approved by PED/GS which will not require Finance concurrence.</p>



<p>3. At the time of approval, lowest airfare should be taken.</p>



<p>4. Station Development Directorate should keep accountal of the ceiling limit and it should not be breached.</p>



<p>5. Other instructions contained in Board’s letter No. F(E)I/2021/ AL-28/47 dated. </p>
