Clarification regarding Maternity Leave Incentive Scheme</p>

<p>In a section of media, there have been some reports about Maternity Leave Incentive Scheme. In this regard, the Ministry of Labour &amp; Employment has clarified the following:-</p>
<p><strong>Background- </strong></p>
<blockquote><p>(i) The Maternity Benefit Act, 1961 applies to establishments employing 10 or more than 10 persons in Factories, Mines, Plantation, Shops &amp; Establishments and other entities. The main purpose of this Act is to regulate the employment of women in certain establishments for certain period before and after child birth and to provide maternity benefit and certain other benefits. The Act was amended through the Maternity Benefit (Amendment) Act, 2017 which, inter alia, has increased the paid maternity leave to women employees from 12 weeks to 26 weeks.</p>
<p>(ii) While the implementation of the provision is good in Public Sector, there are reports that it is not good in Private Sector and in contract jobs. There is also a wide perception that private entities are not encouraging women employees because if they are employed, they may have to provide maternity benefit to them, particularly 26 weeks of paid holiday. In addition, the Ministry of Labour Employment is also getting complaints from various quarters that when the employers come to know that their women employee is in the family way or applies for maternity leave, the contracts are terminated on some flimsy grounds. There have been several representations before the Labour Ministry on how the extended maternity leave has become a deterrent for female employees who are asked to quit or retrenched on flimsy grounds before they go on maternity leave.</p>
<p>(iii) Therefore, the Ministry of Labour &amp; Employment is working on an incentive scheme wherein 7 weeks&#8217; wages would be reimbursed to employers who employ women workers with wage ceiling upto Rs. 15000/- and provide the maternity benefit of 26 weeks paid leave, subject to certain conditions. It is estimated that approximately an amount of Rs. 400 crores would be the financial implication for Government of India, Ministry of Labour &amp; Employment for implementing the proposed incentive scheme.</p></blockquote>
<p><strong>Major Impact: </strong></p>
<p>The proposed Scheme, if approved and implemented shall ensure the women in this country an equal access to employment and other approved benefits alongwith adequate safety and secure environment. Also, the women shall continue to bear the major share of household work as well as child care. The work places will be more and more responsive to the family needs of the working women.</p>
<p><strong>Current Stage of the Proposal: </strong></p>
<p>There are some media reports that this Scheme has been approved/notified. However, it is clarified that Ministry of Labour &amp; Employment is in the process of obtaining necessary budgetary grant and approvals of Competent Authorities. The reports that it will be funded from Labour Welfare Cess, is also incorrect, as no such cess exists under this Ministry.</p>

<p>Pursuant to the presentation made by the GM/NWR to full Board on 06.03.2018, recommendations of the Committee have been considered by the Board (ME,MT,MS,FC,CRB) Following key recommendations have been approved by CRB.</p>
<p>1.  At the time of exercising option for fixation of pay the employee shall be provided with two options for calculation of pay so that he is able to pick up the best. As the employee would be exercising the option in a more informed manner, a wider window be provided to them, if they seek to change the option, and Master Circular for the pay fixation should be suitably amended.</p>
<p>2. Zonal Railways can consider providing accommodation (not leased) strictly for family of field level staff at a nodal station generally within 50-100 kms of the way side station where he or she is posted. The Zonal Railway may chose the nodal station on their own where they want to operate this scheme as per feasibility and allot vacant quarters at the nodal stations on the first come fist serve basis. If required some of the way side station quarters can be converted into transit camp or dormitories at the discretions of Zonal Railways. This would alleviate a major concern of out field staff who face problems on this account. GM’s may take necessary action based on the above.</p>
<p>3. It would be better to provide resting facility with toilets at manned level crossings for use by the trackmen and other field staff. This facility can be a temporary structure made up of porta cabins and be provided within the sanctioned budget of the Zonal Railways.</p>
<p>4. All other items which are apparently of general nature may be taken up as a pilot project by GM/NWR for which he is being fully authorized. The result of the pilot project be sent to Board for further action.</p>
<p>Concerned Directorates will issue necessary detailed instructions in respect of items at 1,2 &amp; 3 above in particular and other items listed in the Annexure wherever necessary.</p>
<p>This issues with the concurrence of Associate Finance of Transformation Cell.</p>

<p>With due regards, it is submitted that all the 03 recognized federations have already reflected their views and recommended to extend the existing incentive scheme (incentive bonus) for examiners deputed for quality control at par with the maintenance workers in Ord &amp; Ord Equipment Factories.</p>
<p>It is learnt that all the Ord &amp; Ord Equipment Factories have also submitted the necessary inputs to the OFB in response to OFB letter No.754/PER/POLICY(PT), Dated 23.11.2015, 02.12.2015 &amp; 17.12.2015 on the subject matter. Since then, the beneficiaries (examiners) are eagerly waiting for the compliance of the recommendations.</p>
<p>In such circumstances, you are requested to take appropriate action expeditiously so that the examiners may get the incentive bonus at par with the maintenance workers without further delay.</p>

<div>With due regards, your attention is invited to meeting held with your good self and BPMS reps on 12.12.2013 wherein one of the issues was raised regarding grant of incentive bonus to Examiners of Quality Control in Ordnance &amp; Ordnance Equipment Factories and you had assured to do the needful.</div>
<div></div>
<div>This letter is to bring to your kind notice that vide OFB letter No. 108/POLICY/TS/QCS, Dated 12.09.2012 addressed to Sr GM /GM of all Ord Fys, the then DGOF &amp; Chairman OFB had reflected his concerns over the ‘Quality Management System in Ordnance Factories’ which needs improvement to enhance User’s confidence in our products.</div>
<div></div>
<div>In this regard, this federation vide letter no. BPMS / OFB / 72(7/3/R), dated 19.09.2012 urged the then DGOF &amp; Chairman, OFB to give some incentive to Examiners at least on par with Maintenance workers to motivate the Examiners, to contribute their knowledge, experience cent percent to the organization.</div>
<div>This federation has been grateful to the OFB on considering the above in correct perspective and for inviting the comments from Sr GMs/GMs of all Ordnance Factories whether Examiners may be provided some incentives. It is learnt that almost all Sr GMs/GMs have recognized the role of Examiners and recommended to grant incentive to Examiners at least on par with Maintenance workers. Since then the matter is pending in OFB.</div>

<div>Therefore, you are requested to take necessary action on priority to give Incentive Bonus to Examiners of QC at least on par with Maintenance Workers to boost the morale of Examiners and remove their apathetic attitude.</div>
