<h3 class="wp-block-heading">Subject:- Rationalizing the process of granting approval of Central Government for sanctioning ex-India Study Leave by the State Cadre in respect of IAS officers in terms of Regulation 3(3) of AIS (Study Leave) Regulations, 1960.</h3>

<p>Sir / Madam,</p>



<p> I am directed to refer to the subject mentioned above and to state that the Central Government examines the proposal of ex-India Study Leave of IAS officers in terms of Regulation 3(3) of AIS (Study Leave) Regulations, 1960.</p>



<p>2. In this context, it is felt necessary that a holistic appreciation of impact of such long study leave on the overall cadre management both at the State as well as the Central Government level is needed before a well informed decision is taken both by the State while recommending and for DoPT to provide its approval.</p>



<p>3. With this objective, it is felt necessary that while recommending ex- India Study leave in respect of IAS officers, the requests of study leave/ex-India Leave/Extension to study leave may be considered in the light of availability of sufficient number of IAS officers in the Cadre and for Central Deputation against the prescribed norms of CDR (which is 40% of SDP). This would ensure that the functioning of the State Governments as well as Central Government is not affected due to shortage of officers.</p>



<p>4. Accordingly, it is requested that while recommending the proposals of ex-India Study Leave, the State Governments should submit the following&nbsp;<strong>along-with the Study Leave proposal:</strong></p>



<ul class="wp-block-list">
<li>(a) the details of officers sponsored for Central Deputation during the previous year and the current year against the prescribed norms of Central Deputation Reserve (CDR) @ 40% of Senior Duty Posts (SDPs);</li>



<li>(b) the details of IAS officers who are on Study leave within India and outside India vis-à-vis Leave Reserve;</li>



<li>(c) the details of IAS officers who have returned from the Study leave during the last two years and the posting(s) given to them according to the practical knowledge and experience acquired during Study Leave.</li>
</ul>

<p>Sub: <strong>Circulation of Revised Check-List for forwarding the disciplinary proceedings proposals / cases to Department of Personnel &amp; Training against IAS Officers under Single Window System prescribed vide OM No.142/16/2013-AVD &#8211; I dated 10th February 2014 &#8211; reg.</strong></p>



<p>Sir/ Madam,</p>



<p>The Department of Personnel &amp; Training (<strong>DoPT</strong>) deals with the disciplinary matters of the officers of the Indian Administrative Services (<strong>IAS</strong>), being their cadre controlling department. It receives the proposals for disciplinary proceedings against the IAS officers working in connection with the affairs of the State, from the State Government; and against the IAS officers working under various Ministries/ Departments in the Central Government, from the Central Ministries/ Departments of the Government of India; under the All India Services (Discipline &amp; Appeal) Rules, 1969 and All India Services (Death-cum-Retirement Benefits) Rules, 1958. Besides, it is also entrusted with dealing with the Appeals/ Memorials and Revision/ Review under the said Rules.</p>



<h2 class="has-text-align-center wp-block-heading">IAS Officers under Single Window System</h2>



<ol class="wp-block-list" start="2"><li>It is the responsibility of the Disciplinary Authorities concerned to lead the departmental proceedings to their logical conclusion. Inordinate and inexplicable delay in conclusion of the disciplinary proceedings vitiates the proceedings and sometimes leads to litigations. This delay is mainly attributed to the documentary and procedural deficiencies and a lot of time is consumed in avoidable protracted correspondence with the State Government or the Ministry/ Department concerned, for furnishing requisite documents/ case-records or fulfilling the procedural deficiencies.</li><li>Accordingly, a proforma check list was prescribed vide this Department&#8217;s OM No.142/16/2013 -AVD.l dated 10th February 2014 for referring disciplinary proceedings proposals/cases against IAS officers to Department of Personnel &amp; Training under Single Window System. However, pursuant to OM No. 39011/08/2016 &#8211; Estt. (B) dated 28th December 2018 and to align with the requirements prescribed for submission of cases to UPSC for referring the disciplinary cases to <a href="https://centralgovernmentnews.com/tag/upsc/" target="_blank" rel="noreferrer noopener">UPSC</a>, it has been felt necessary to revise the checklists for submission of disciplinary proceedings proposals/ cases to DaRT for onward reference to UPSC for its statutory advice.</li><li>Therefore, it has now been decided to prescribe new checklists as per enclosed Appendices I &amp; II in supersession of the checklists prescribed vide the Appendices to this Department&#8217;s OM No.142/16/201 3-AVD.l dated 10th February 2014.</li><li>Submission of a disciplinary cases against an IAS officer and requisite case records will be checked against these new checklists through the single window system in DoPT. Appendix I to be followed hereafter; has 4 different checklists catering to 4 different situations (as described in the following table) in which a proposal of disciplinary proceeding against an IAS officer is to be submitted to DOPT by the concerned State Government / Central Ministry /Department. Appendix II contains list of documents and folders which need to be submitted while submitting the disciplinary case through Single Window System. Another Appendix III has been enclosed which contains the Model letters for forwarding the proposals to Government of India, for each of the 4 situations of Appendix I.</li><li>Therefore, it is requested to submit the proposals of disciplinary cases against IAS officers to DoPT as per the appropriate Appendix that may be applicable in light of the situation for the case at hand with following details to ensure proper submission of proposals by various State Governments /Ministries/ Departments as per the requirement of UPSC.</li></ol>

<ol class="wp-block-list" start="7"><li>Further, it is also expected that the complete reference is received in this Department at least six months (180 days) prior to the retirement of the charged officer for complete examination of the proposal. Wherever the time of submission of case to this Department is less than six months (<strong>180 days</strong>) from the date of retirement of the officer, cogent reasons justifying late submission of case to this Department are also required to be submitted.</li><li>The operation of <a href="https://centralgovernmentnews.com/tag/single-window-system/" target="_blank" rel="noreferrer noopener">Single Window System</a> requires the representatives of the State Government/ Ministries/ Departments of the Government of India seek prior appointment from concerned Under Secretary. During the appointed time, complete verification/ scrutiny of documents will be done and only such cases which are reckoned and found complete in all respects shall be accepted for processing. Cases found deficient vis-a-vis the mandated check-list will be returned therewith, and the case would not be deemed to have been received until it is received in complete form as per the check-list.</li><li>The State Governments/ Ministries/ Departments of Government of India will be required to depute an officer not below the rank of the Under Secretary with his/her official seal and who is well conversant with the case to submit the records of the disciplinary case as per the check-list, in this Department. In the DoPT, Under Secretary (AVD-l.B), Room No.268B, North Block (through Gate No.4, Tele No. 011-2309-2298) will receive the Disciplinary cases referred to by the State Government and Under Secretary (AVD-l.C.l), Room No.270, North Block (through Gate No.4, Tele No.: 011-23092957) will receive the disciplinary cases referred to by the Ministries/Departments in Central Government from 11.00 a.m. to 1.00 p.m. and 2.30 to 4.00 p.m. on all working days.<br /><br />Also check: &nbsp;<strong><a href="https://centralgovernmentnews.com/launch-of-epratiniyukti-a-single-window-online-deputation-module-for-receipt-and-processing-of-deputation-applications-cadre-clearance-of-irs-cce-officers/" target="_blank" rel="noreferrer noopener">Launch of ePratiniyukti – a single window, online Deputation Module for receipt and processing of deputation applications / Cadre Clearance of IRS (C&amp;CE) Officers</a></strong><br /></li><li>Finally, Rule 6(1) (b)(ii) of AIS(DCRB) Rules,1958 stipulate time-limit for instituting disciplinary proceedings against a pensioner. Therefore, a proposal where time available for Disciplinary Authority for according sanction under said Rule is less than six months from the date of submission of the proposal to DoPT by Ministry/Department/State, the proposal will not be accepted on same day. In such case, DoPT would be afforded a time-limit of up to five working days to analyse the proposal before accepting or returning in case there is requirement of any information/clarification /document.</li><li>It is requested that the above instructions are strictly followed with immediate effect while submitting the proposals of disciplinary proceedings against IAS officers, with a view to streamline and expedite the processing.</li></ol>

<p>All IAS officers have been asked to submit details of their assets by next month and warned that the failure to do so would lead to a denial of vigilance clearances needed for promotions and foreign postings.</p>
<p>The Department of Personnel and Training (DoPT) has written to all Central government departments, states and union territories asking them to ensure submission of Immovable Property Returns (IPRs) by IAS officers working with them by January 31, 2018.</p>
<p>&#8220;In view of the DoPTs instructions dated April 4, 2011, it is reiterated that failure to ensure timely submission of IPR would result in denial of vigilance clearance,&#8221; Establishment Officer and Additional Secretary P K Tripathi said in the recent missive.</p>
<p>According to the 2011 instructions, officers who did not submit their IPR as on January 1, 2018, on time would be denied vigilance clearances and will not be considered for promotions and empanelment for senior-level posts in the government of India.</p>
<p>&#8220;Those who do not submit property details on time will not be considered for any posts of the Central government including foreign postings,&#8221; a senior DoPT official said.</p>
<p>An online module has been designed for the purpose of filing of the IPR. Officers have the option of uploading the hard copy of the IPR by January 31 in the online module, the December 22 letter said.</p>
<p>There are 5,004 Indian Administrative Service (IAS) officers working across the country, according to the DoPTs latest data.</p>

<p>The undersigned is directed to refer to this Department&#8217;s OM of even number dated 14.02.2014 on the subject mentioned above and to say that consequent upon the approval and circulation of Cadre Allocation Policy for All India Services &#8211; IAS / IPS / IFoS vide OM No. 13013/2/2016-AIS.I dated 05.09.2017, the policy for change of cadre of Indian Administrative Service Officers appointed against vacancies reserved for Physically Handicapped (PH) category issued vide this Department&#8217;s OM of even number dated 14.02.2014 will now be treated as superseded w.e.f. Civil Services Examination &#8211; 2017.</p>
<p>2. Further, proposals of cadre change of Indian Administrative Service Officers appointed against vacancies reserved for Physically Handicapped (PH) category on the basis of Civil Service Examination upto 2016 will continue to be considered as per policy circulated vide this Department&#8217;s OM of even number dated 14.02.2014.</p>

<p>New Delhi: The government has decided to fix six-month deadline for completion of corruption enquiries against IAS and IPS officers among others.</p>
<p>The Department of Personnel and Training (DoPT) has finalised draft rules to put a time limit for each stage of the enquiries to ensure expeditious disposal of corruption cases.</p>
<p>&#8220;The Inquiring Authority should conclude the inquiry and submit his report within a period of six months,&#8221; the draft rules said.</p>
<p>However, this period can be extended for a further period of six months after recording reasons of the Inquiring Authority in this regard, it said.</p>
<p>At present, there are no rules that define time limit for conducting corruption enquiries.</p>
<p>As per the government proposal, officers will get copy of articles of charges from the disciplinary authority and they should give their response mandatorily within 15 days.</p>
<p>In cases, where a disciplinary authority decides to consult Union Public Service Commission (UPSC) in the matter involving a delinquent officer, its advice need to be shared with such charged employee.</p>
<p>The UPSC conducts civil service examination to select officers for various services including Indian Administrative Service (IAS) and Indian Police Service (IPS) and it is consulted by authorities concerned before acting against a civil servant.</p>
<p>The government servant will be given 15 days to submit his representation on receipt of such advice from the Commission.</p>
<p>All ministries have been asked to share their comments on the proposed changes in the rules, which if comes into force will be applicable to IAS, IFS and IPS officers and those belonging to other civil services.</p>

<p>Dear Sir/Madam</p>
<p>Please refer to my D.O. letter no.4(8)/2008-EO(PR) dated 21.4.2015 making online filing of PAR mandatory for the year 2014-15 onwards. As on date, 6975 number of PARs have been generated online for the year 2015-16. However, it is noted that still 1037 PARs are pending at the self-appraisal stage and 2905 PARs are pending at the stage of reporting authorities i.e. Reporting / Reviewing / Accepting authority (State-wise break-up is enclosed).</p>
<p>2. As per Rule 5(1) of AIS (PAR) Rules, 2007, if a performance appraisal report for a financial year is not recorded by 31st of December of the year in which the financial year ended, no remarks may be recorded thereafter and the officer may be assessed on the basis of the overall record and self assessment for the year, if he has submitted his self-assessment on time</p>
<p>3. In View of the rule position stated above, the window for SPARROW would get closed automatically on the midnight of 31.12.2016, and PARs at whatever stage in the system would also close and be treated as final, I may, therefore, request you to issue necessary instructions to the concerned designed authorities for expediting the PARs, which are yet to be recorded by the reporting / reviewing/ accepting authorities, so that all comments are recorded before 31.12.16.</p>

<p>The undersigned is directed to refer to this Department&#8217;s OM No. 21/04/2016-CS.I (P) dated 15.06.2016 on the subject mentioned above.</p>
<p>2. Consequent upon the acceptance of recommendations of Seventh Central Pay Commission by the Government of India, the pay of the Assistant Secretaries is required to be fixed as per the IAS (Pay) Rules, 2016. Ministries/ Departments concerned are accordingly requested to fix the pay of the Assistant Secretaries as per the IAS(Pay) Rules, 2016.</p>
<p>3. In so far as payment of arrears of revised pay from 01.01.2016, is concerned, it is clarified that the payment of arrears to such Assistant Secretaries for their tenure in the Central Secretariat will be made by the union Ministries/Department concerned where they are presently posted on Central Deputation. Arrears for the period prior to the appointment as Assistant Secretary will be paid by the respective State Governments.</p>

<p>Subject: <strong>The All India Services (PAR) Rule, 2007- annual health check-up of IAS Officers.</strong></p>
<p>Sir,<br />
I am directed to invite your attention to this Department&#8217;s letter of even number dated the 16th February, 2015 on the above mentioned subject, wherein it was requested to continue the arrangements for annual health check-up of IAS officers for subsequent year which was initially started in your hospital vide this Departments letter No. 11059/18/2002- AIS-III dated 11 th January, 2008. It is again requested that the arrangement mentioned therein may be continued for the year 2016 and subsequent years also, unless revised by this Department.</p>
<p>2. It is further informed that Ministry of Health &amp; Family Welfare has approved the revised rates i.e. Rs. 2000/- for men and Rs. 2200/- for women may also be allowed to be reimbursed in respect of AIS Officers as is being reimbursed in case of Group &#8216;A&#8217; officers of CCS.</p>
<p>3. The Chief Medical Superintendents of the approved Government and private hospitals are therefore, requested to kindly ensure that the system works smoothly and the individual officer does not face any inconvenience. All the prescribed tests may please be conducted on a single day and the report provided to the officers concerned on the next day.</p>

<p>New Delhi: The Central Secretariat Service (CSS) is demding for a status equivalent with the IAS officers (Indian Administrative Service officers).</p>
<p>A team of CSS officers met Dr Jitendra Singh, Minister of State for Personnel, seeking a new pay package, perks and promotion.</p>
<p>The Central Secretariat Service (CSS) is one of the earliest organized services in the country. The origin of the service can be traced back to the year 1919.</p>
<p>The CSS Officers at the middle and lower management levels of the administrative machinery are responsible for assisting in the formulation and monitoring implementation of policies concerning subjects, which are the main responsibility of the central government.</p>
<p>There are around 2,200 CSS officers in the Government starting from Under Secretaries to Additional Secretaries.</p>
