<p>Kind attention is invited to the correspondence cited above on NFIR&#8217;s PNM item No. 12/2016 pending with the Railway Board. Though the subject was discussed with the Railway Board (ED/PC-I) in the special meeting held on 04/06/2019 and Official Side conveyed that the matter was under consideration, unfortunately the issue has not yet been settled.</p>

<p>Federation further desires to convey to the Railway Board that pursuant to Railway Board&#8217;s instructions revising the designations of various erstwhile Group &#8216;D&#8217; Staff (RBE No. 201/2018 dated 27/12/2018), the following categories of staff working in the Railway Hospitals have been excluded from the payment of HPCA/PCA.</p>



<p><strong>1) Hamals, GP 1800 and 2) Peon Assistants, GP 1800 now revised as Hospital Attendant.</strong></p>



<p>In this connection, NFIR desires to state that the staff of above categories working in the Railway Hospitals also undertake various jobs and come into contact with the patients, therefore they should also be covered for payment of Hospital Patient Care Allowance / Patient Care Allowance.</p>



<p>NFIR, therefore, request the Railway Board again to review and issue instructions to the Zonal Railways etc., soon covering all the remaining categories of staff working in the Railway Hospitals for the purpose of payment of Hospital Patient Care Allowance / Patient Care Allowance as has been allowed to the staff of categories working in the Central Government Hospitals.</p>

<p>(a) the steps taken by the Government to implement the Seventh Pay Commission recommendations for physiotherapists regarding cadre restructuring till date; </p>



<p>(b) the duties and responsibilities of physiotherapists employed at Safdarjung hospital, RML hospital, Kalawati Saran hospital, JIPMER and AIIMS; </p>



<p>(c) whether the physiotherapists at the above hospitals are being given Hospital Patient Care Allowance (HPCA); and </p>



<p>(d) if so, the details thereof and if not, the reasons therefor?</p>

<p>STATEMENT REFERRED TO IN REPLY TO LOK SABHA <br />
STARRED QUESTION NO.63* FOR 14TH DECEMBER, 2018</p>



<p>(a) As per decision of the Government on the recommendations of the 7th CPC notified vide Resolution dated 25.07.2016, necessary action on the recommendations of the 7th CPC pertaining to cadre restructuring of physiotherapists have already been taken up for implementation in some of the Central Government hospitals/institution.</p>



<p>(b) The duties and responsibilities of physiotherapists performed in Safdarjung hospital, RML hospital, Kalawati Saran hospital, Jawaharlal Institute of Post Graduate Medical Education and Research (JIPMER), Puducherry and All India Institute of Medical Sciences (AIIMS), New Delhi and six other new AIIMS located at Patna, Jodhpur, Bhubaneswar, Rishikesh, Bhopal, and Raipur broadly include the following:</p>



<ol class="wp-block-list"><li> physiotherapists works with patients who have a range of conditions including Neuro-musculoskeletal, Geriatric, Post-surgical, ICU Patients, Pediatric, Cardiovascular and respiratory. They help to diagnose, assess and treat their physical problems</li><li> treat in and out patients of Orthopedic, Neurological, Medical Surgery, Pediatrics and Gynecological, cardio-thoracic, respiratory &amp; intensive care condition by means of electrotherapy, heat therapy, hydrotherapy, exercise therapy and massage</li><li> provide physiotherapy care including exercise, hot packs, wax bath, short-wave-diathermy, ultrasonic therapy, cervical &amp; lumbar traction, gait training, electrical stimulation &amp; bed-side physiotherapy in ward as prescribed by the medical specialist, etc. </li><li> administer and supervise students and junior physiotherapists and other support workers, who are involved in physical care of patients.</li><li> participation in rehabilitation of patients </li><li> co-ordinate and participate in training programmes related to physiotherapist</li></ol>



<p>(c) &amp; (d) As per the guidelines issued from time to time for grant of Hospital Patient Care Allowance (HPCA), HPCA is admissible to employees belonging to categories of Group ‘C’ and ‘D’ (non-ministerial) whose regular duties involve continuous and routine contacts with patients infected with communicable diseases or those who have to routinely handle, as their primary duty, infected materials, instruments and equipment which can spread infection.</p>



<p>Hospital Patient Care Allowance (HPCA) is not being given to Physiotherapists in Safdarjung, Dr. RML, Lady Hardinge Medical College and Associated Hospitals and AIIMS, New Delhi and six new AIIMS located at different parts of the country as the physiotherapists working in these hospitals/institutes are Group ‘A’ and ‘B’ category employees. In Kalawati Saran Children Hospital, the physiotherapist are not getting HPCA as these employees are in the pay scale of Group ‘B’ category.</p>



<p>However, JIPMER, Puducherry continues to give Patient Care Allowance to physiotherapists as per the directions of Hon’ble Apex Court. These directions were issued consequent upon re-classification of Group ‘C’ category posts to Group ‘B’ posts based on the replacement scale as there was no change in the duties and responsibilities of the post held by the incumbents.</p>

<p>Kind attention of Railway Board is invited to NFIR&#8217;s PNM agenda item No. 1212016 and the correspondence cited under reference.</p>
<p>In this connection, Railway Board vide letter dated 1310912018 conveyed to the Federation that a Committee had been constituted to find out if any other category of staff working in Railway Hospitals Hlealth Units is eligible for HPCA/PCA and the recommendations of the Committee are being processed for further necessary action. Consequently, NFIR vide its letter dated 1910912018 requested the Railway Board to make available a copy of the recommendations of the Committee to facilitate the Federation to go through the same and make appropriate suggestions. A period of more than three months passed, copy of the Committee&#8217;s report has not been made available to the Federation.</p>
<p>NFIR, therefore, once again requests the Railway Board to please provide a copy of the recommendations of the Committee early for Federation&#8217;s perusal for discussing further, with the Board.</p>

<p>Will the Minister of HEALTH AND FAMILY WELFARE be pleased to state:-</p>
<p>(a) whether his Ministry has finalised draft rules regarding minimum standards for clinical laboratories, framed under Clinical Establishments Act, 2010, if so, the details thereof;</p>
<p>(b) whether his Ministry is aware that presently most of the work of clinical and research laboratories of even prestigious department i.e. ICMR and Central Government Hospitals is performed and supervised by professionally qualified and technically competent BSc, MSc, PhD medical laboratory professional in lab sciences who are not MBBS/MD, if so, the details thereof;</p>
<p>(c) whether the cadre review of medical laboratory staff approved earlier has not been implemented in complete manner so far and most of issues like pay fixation, DPC, MACP, revision of recruitment rules, filling of vacant promotional posts are still pending, if so, the details thereof and the reasons therefor;</p>
<p>(d) whether his Ministry has not issued any order till date regarding grant of Patient Care Allowance/Hospital Patient Care Allowance (PCA/HPCA) to health employees as per the accepted recommendations of Seventh Central Pay Commission and if so, the details thereof and the reasons therefor; and</p>
<p>(e) whether his Ministry has also approved the short term certificate courses/ programmes which are neither formal degree nor diploma in allied health sciences and run under the aegis of Ministry of Skill Development and are very contrary to the core curricula designed by his Ministry in terms of course content and duration of courses etc., if so, the reaction of the Government thereto?</p>
<p><span style="text-decoration: underline;"><strong>ANSWER</strong></span></p>
<p>THE MINISTER OF STATE IN THE MINISTRY OF HEALTH AND FAMILY WELFARE (SMT. ANUPRIYA PATEL)</p>
<p>(a): Yes. The draft notification to amend the Clinical Establishments (Central Government) Rules, 2012 regarding minimum standards of medical diagnostic laboratories is available on the website of Clinical Establishment Act &lt;clinicalestablishments.gov.in&gt;.</p>
<p>(b): As per the information received from ICMR most of the work of clinical and research laboratories is performed and supervised by professionally qualified and technically competent technical staff and Scientists having B.Sc, M.Sc, Ph.D and MBBS, MD qualification.</p>
<p>As far as Central Government hospitals in Delhi viz. Safdarjung Hospital and Lady Hardinge Medical College &amp; Associated Hospitals are concerned, all the diagnostic work is performed and supervised by professionally qualified and technically competent MBBD/MD professionals.</p>
<p>(c): The cadre of the Medical Laboratory Staff of Central Government Hospitals in Delhi namely Safdarjung, Dr. RML and Lady Hardinge Medical College &amp; Associated Hospitals has already been restructured and implemented by giving benefits of 7th Central Pay Commission.</p>
<p>(d): The order containing condition for payment of HPCA/PCA after implementation of Seventh Central Pay Commission has not been issued so far. The matter is under consideration in this Ministry in consultation with Ministry of Finance.</p>
<p>(e): This Ministry has developed a course curricula for short term skill training. The National Skill Qualification Framework (NSQF) level of the skill development curricula is kept lower than the level of Diploma and Degree in core allied health courses developed by this Ministry. A skilled worker will only reach the higher levels after acquiring adequate qualification (either Diploma or Degree) through an accredited institute/university. There are no contradictions in the short term courses as compared to the core curricula developed by the Ministry.</p>

<p>Sub:- <b>Revision of the rates of Hospital Patient Care Allowance (HPCA) and Patient Care Allowance (PCA) to Railway employees working in Railway Hospitals and Health Units/Clinics-regarding.</b></p>
<p>Hospital Patient Care Allowance (HPCA)/Patient Care Allowance (PCA) was introduced on the Railways in terms of Board’s letter No.E(P&amp;A)II-98/HW-6, dt. 09.01.2008 (RBE No.1/2008). Subsequently, on implementation of 6th CPC recommendations, the rates of HPCA/PCA have been revised vide Board’s letter No.E(P&amp;A)II-2013/AL-3, dt. 20.02.2013 (RBE No.15/2013) and dt. 14.07.2014 (RBE No.74/2014).</p>
<p>2. Consequent upon the decision taken by the Government of India on the recommendations of the 7th CPC, the President is pleased to decide that Hospital Patient Care Allowance (HPCA)/Patient Care Allowance (PCA) shall be admissible only to existing eligible Group &#8216;C&#8217; and &#8216;D&#8217; (Non-Ministerial) Railway employees as per R1H3 of the newly proposed Risk and Hardship Matrix ( Rs.4100 for level 8 and below and Rs.5300 for level 9 and above).</p>
<p>3. The revised rates of HPCA/PCA shall be admissible with effect from the 1st of July, 2017.</p>
<p>4. The other terms and conditions regarding admissibility of HPCA/PCA as contained in Board’s letter dt. 09.01.2008 (RBE No.1/2008) and subsequent letters in this regard will remain in force.</p>
<p>5. These orders would be subject to any modification after issue of instructions by the Nodal Ministry i.e. Ministry of Health &amp; Family Welfare.</p>
<p>6. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.</p>

<p>On perusal of the report of EDs Committee constituted to examine the feasibility for payment of Hospital Patient Care Allowance/Patient Care Allowance (PCA) to the Kitchen Staff working in the Railway Hospitals/Health Units, the Federation finds that the following vital points have been ignored by the Committee while finalizing its recommendations:</p>
<p>• Railway Board vide letter No. E(P&amp;A) II-98/HW-6 dated 09/01/2008 issued orders for payment of Hospital Patient Care Allowance (HPCA). Patient Care Allowance (PCA) to the Group ‘C’ &amp; ‘D’ staff working in Railway Hospitals/Health Units/Clinics with effect from 01/01/2008 pursuant to the directives issued by the Ministry of Health &amp; Family Welfare vide OM No. Z. 28015/24/2001-H dated 4th February 2004 duly removing ambiguity in this regard.</p>
<p>• The Principal Bench/CAT, New Delhi vide order dated 21st February 2014, while deciding OA No. 974/2013, has also relied on Railway Board’s circular dated 09/01/2008 and directed to pay HPCA/PCA to the Kitchen Staff working in the Railway Hospitals/Health Units/Clinics i.e. form 01/01/2008.</p>
<p>• Railway Board have issued orders granting HPCA/PCA to a few more categories such as Physiotherapist, Pharmacist working in the Railway Hospitals/Health Units/Clinics and these staff have been paid the HPCA/PCA w.e.f. 01/01/2008.</p>
<p>The Kithchen staff working in the Northern Railway Central Hospital are disappointed consequent upon issuance of unjustified order by the Railway Board for payment of HPCA/PCA from prospective date i.e. 02/06/2016 instead from 01/01/2008. A copy of representation dated 08/11/2016 received by the Federation from the Kitchen Staff of Northern Railway, Central Hospital is enclosed for reference as the representationists have been rightly demanding payment of HPCA/PCA from 01/01/2008.</p>
<p>NFIR, therefore, requests the Railway Board to re-consider the matter and issue instructions for allowing payment of HPCA/PCA to all Kitchen Staff working in Railway Hospitals/Health Units/Clinics w.e.f. 01/01/2008.</p>
<p>The issue will be discussed in NFIR&#8217;s PNM meeting to be held with the Railway Board on 22nd/23rd December 2016.</p>

<p>Ref: Railway Board&#8217;s letter No. E(P&amp;A)II-98/HW-6 Vol.III dated 02/06/2016.</p>
<p>We the following staff working the Kitchen of Northern Railway Central Hospital are thankful to the Railway Board for issuing orders for payment of Hospital Patient Care Allowance/Patient Care Allowance vide Railway Board&#8217;s orders dated 02/06/2016, pursuant to the demand raised vide NFIR&#8217;s PNM Item No. 12/2016. We are however, constrained to bring to your kind notice that our case has not been dealt with on merit and the payment of HPCA/PCA has been made w.e.f. 02/06/2016 only which is not justified.</p>
<p><strong>In this connection, we place below following facts for the kind consideration and passing further orders in this case:</strong></p>
<p>• That pursuant to the directives issued by the Ministry of Health &amp; Family Welfare, Railway Board vide letter No. E(P&amp;A)II-98/HW-6 dated 09/01/2008 issued order for payment of HPCA/PCA to the categories of Group &#8216;C&#8217; &amp; &#8216;D&#8217; staff working in the Railway Hospitals and Health Units/Clinics w.e.f 01/01/2008.</p>
<p>• Subsequently, some more categories of staff working in Railway Hospitals/Health Units/Clinics like Physiotherapist, Pharmacist etc., were added by the Railway Board who have also been paid HPCA/PCA w.e.f 01/01/2008.</p>
<p>• We are disappointed to note that in our case justice has not been awarded because payment of HPCA/PCA has been ordered only with effect from 02/02/2016, though our categories have been included vide Board&#8217;s order dated 02/06/2016.</p>
<p>The points mentioned above clearly established that the orders issued vide Board&#8217;s letter dated 02/06/2016 are discriminatory and do not impart justice to us.</p>
<p>We, therefore, request your kind honour to kindly consider our case for payment of Hospital Patient Care Allowance/Patient Care Allowance (HPCA/PCA) to us w.e.f. 01/01/2008, similar to other categories of staff receiving the Allowance since 01/01/2008 and remove discrimination.</p>

<p>Hospital Patient Care Allowance / Patient Care Allowance was introduced on the Railways in terms Board’s letter No.E(P&amp;A)II-98/HW-6 dated 09.01.2008. Further, the rates of HPCA/PCA were revised as per Board’s letter No. E(P&amp;A)I-2013/AL-3 dated 20.02.2013. Dental Hygienists and Physiotherapists/Occupational Therapists were also made eligible for HPCA/PCA vide Board’s letters E(P&amp;A)II-98/HW-6 Vol. Ill dated 31.07.2015 on the terms and conditions mentioned therein.</p>
<p>2. Consequent to the directions made by the Hon ‘ble CAT/Delhi in its order dt. 16.7.2015 in OA No. 974/2013, an expert committee was constituted to find out whether the duties &amp; responsibilities of the applicants involve continuous &amp; routine contacts with communicable diseases &amp; handling infected materials, instruments, which can spread infection &amp; thereafter would take final decision regarding their entitlement to HPCA/PCA/Risk Allowance. The applicants in this case were kitchen staff working in the Northern Railway Central Hospital, New Delhi. The recognized Federations have also been demanding for the admissibility of HPCA/PCA to the Kitchen Staff.</p>
<p>3. The expert committee has submitted its recommendations and it has been considered by the Board and accordingly it has been decided to include the following category of Kitchen Staff in the list of eligible categories of Group ‘C’ and ‘D’ (non-ministerial) for the grant of HPCA/PCA w.e.f. the date of issue of this letter:</p>
<blockquote><p>(i) Masalchis &amp; Cookmates :<br />
(ii) Cooks where no separate Masalchi/Cookmates is provided and the cooks are required to clean the utensils or serve food where bearers are not provided.</p></blockquote>
<p>4. Other terms and conditions would remain the same as per Board’s letter no. E(P&amp;A)II-98/HW-6 dated 09.0 l.2008 and Board’s letter No. E(P&amp;A)II-2013/AL-3 dated 20.02.2013.</p>
<p>5. This issues with the concurrence of Finance Directorate of the Ministry of Railways.</p>

<p>Hospital Patient Care Allowance/Patient Care Allowance was introducedon the Railways in terms of Railway Board’s letter no. E(P&amp;A)II-98/HW-6 dt. 09.01.2008. As per paragraph 2 (a) (ii), of the letter dt. 9-1-2008 Pharmacists were also made eligiblle for grant of HPCA/PCA subject to fulfilment of the conditions of admissibility except exclusive store Pharmacists who were not involved in dispensing of medicines. Both the recognised Federations, namely AIRF and NFIR have raised the issue in the forum of PNM stating that there is no particular designation of Store Pharmacists in the Indian Railways. The matter has been considered in consultation with the Health Directorate of Railway Board and it has decided to remove the exception made for exclusive Store Pharmacists in paragraph2(a)(ii) in Railway Board’s letter no. E(P&amp;A)II-98/HW-6 dt. 09.01.2008. Pharmacists will be entiled for payment of Hospital Patient Care Allowance / Patient Care Allowance. This would have effect from 01.01.2008 as mentioned in Railway Board’s letter no.E(P&amp;A)II-98/HW-6 dt,09.01.2008.</p>
<p>3. Other terms and conditions would remain the same as per Board’s letter no. E(P&amp;A)II-98/HW-6 dt. 09.01.2008 and Board’s letter No. E(P&amp;A)II-2013/AL-3 dt.20.02.2013</p>

<p>Ministry of Railways (Railway Board) have decided to constitute a Committee for Hospital Patient Care Allowance (HPCA)/Patient Care Allowance (PCA)-2015.</p>

<p>Ministry of Railways (Railway Board) have decided to constitute a Committee for Hospital Patient Care Allowance (HPCA)/Patient Care Allowance (PCA)-2015 consisting of the following:-</p>
<p>i) Executive Director/Health (G), Railway Board                : Convenor<br />
ii) Executive Director/Finance (Estt), Railway Board         : Member<br />
iii) Executive Director/Pay Commission-I, Railway Board : Member<br />
2. The Terms of reference of the Committee will be as under:-</p>
<blockquote class="tr_bq"><p>i) To find out whether the duties and responsibilities of kitchen staff including Cooks, Asstt. Cooks and Mates working in Railway Hospitals/Health Units involve continuous and routine contacts with communicable diseases and handling infected materials, instruments, which can spread infection and thereafter would take final decision ·regarding their entitlement to Hospital Patient Care Allowance(HPCA)/Patient Care Allowance(PCA)/Risk Allowance; and</p>

<p>3. The Committee should submit its report within a period of two months from the date of its constitution.</p>
<p>4. The Headquarter of the Committee will be at New Delhi.</p>
<p>5. The Health Directorate of Railway Board will be the Nodal Directorate for functioning of the Committee.</p>

<div>Subject :<strong> Doubling of existing rate of Payment of Hospital Patient Care Allowances / Patient Care Allowances to eligible Group &#8216;C&#8217; and &#8216;D&#8217;  (Non-Ministerial) employees working in Hospitals  Dispensaries and Organizations w.e.f.1.9.2008.</strong></div>

<div>The undersigned is directed to convey the approval of the Union Cabinet for doubling the existing rate of payment of HPCA / PCA to all eligible Group &#8216;C&#8217; and &#8216;D&#8217; employees working in Hospitals, Dispensaries and Organizations in the Central Government from the period w.e.f. 1.9.2008. The amount of HPCA/PCA would be automatically raised by 25% every time the Dearness Allowance on the revised pay structure goes up by 50%. This is subject to the following terms and conditions :-</div>
<div></div>
<div>(i) HPCA/PCA may be admissible in case the individual proceeds on leave/training for less than one calender month.</div>
<div></div>
<div>(ii) HPCA / PCA may not be admissible in case the individual proceeds on leave/training for more than one calender month.</div>
<div></div>
<div>(iii) HPCA / PCA should not be admissible in case of unauthorized leave.</div>
<div></div>
<div>This issues with the approval of Department of Personnel and training vide their D.O. No.21012/01/2010-Estt.(AL) dated 18th October, 2012 and U.O. of even number dated 11th December, 2012.</div>
