<h3 class="wp-block-heading">Subject: Review of Modified Flexible Complementing Scheme (MFCS) &#8211; reg.</h3>



<p>The undersigned is directed to refer to this <strong>Department OM of even number dated 16.4.2020</strong> (copy enclosed) followed by <strong>reminder dated 06.07.2020</strong> on the above-mentioned subject conveying therein the following recommendations made by Committee of Secretaries (CoS), in its meeting held on 20th February 2020, while considering the proposal of review of Modified Flexible Complementing Scheme (MFCS):</p>



<ul class="wp-block-list"><li>Ministries/ Departments may carefully rework the Output Indicators so as to simplify and streamline them. Qualitative dimensions may also be captured so that excellence of a Scientist is brought out and only the deserving Scientists get promoted.</li><li>Ministries/ Departments may ensure that all promotions under MFCS are held timely so that the issue of granting retrospective promotion does not arise.</li><li>Number of posts required at HAG/ HAG+ level may be worked out individually at the Ministry/ Department level looking at the organizational structure and their specific requirements. Cadre review exercise may accordingly be undertaken.</li></ul>



<p>2. A response in this regard is still awaited. It is, therefore, requested that Action Taken Report on the recommendations made by CoS, may kindly be provided to this Department at the earliest.</p>

<p>Subject: &#8211; <strong>Review of Modified Flexible Complementing Scheme (MFCS) &#8211; reg.</strong></p>



<p>As the Scientific Ministries / Departments are aware a Committee under former Secretary, Department of Bio-Technology, Prof. K. Vijay Raghavan, was constituted to review the Modified Flexible Complimentary Scheme (MFCS). A proposal based on the recommendations of this Committee was considered by the Committee of Secretaries (CoS), constituted to frame comprehensive and uniform guidelines relating to promotion of scientists In Scientific Ministries and Departments, in its meeting held on 20th February 2020.</p>



<p>2. The CoS has inter-alia recommended as under:</p>



<ul class="wp-block-list"><li>Ministries / Departments may carefully rework the Output Indicators so as to simplify and streamline them. 										<content:encoded><![CDATA[<p><strong>Pay Anomaly in respect of Maj Generals and Lt Generals promoted before 01/01/2016</strong></p>
<p>1. Consequent upon implementation of 7th Pay Commission Orders, Maj Generals promoted after 01/01/2016 are drawing more pay than the officers in the same Corps, who were promoted as Maj Generals prior to 01/01/2016. Hence stepping up of pay of Maj Generals promoted prior to 01/01/2016 has been carried out, at par with the pay from the date of promotion of Maj General of that Corps, promoted after 01/01/2016 based on seniority list received from ADGPS . Subsequent increments have been granted thereafter and the pay also revised on promotion to the rank of Lt General, wherever applicable.</p>
<p>2 (a) Consequent upon implementation of 7th Pay Commission Orders, Lt Generals (HAG) promoted after 01/01/2016 are drawing more pay than the Lt Generals (HAG), in same Corps, promoted before 01/01/2016. The case are under examination for stepping up of pay of Lt Generals (HAG) promoted before 01/01/2016, at par with pay from the date of promotion of Lt Generals (HAG), in that Corps, promoted after 01/01/2016.</p>
<p>2 (b) (i) Pay revision in Approx 31 such cases is under progress and will be found adjusted in 09/2017 Pay Account.</p>
<p>2 (b) (ii) In 36 cases of Lt General drawing pay in HAG &amp; HAG(+) scale are under examination and those cases not covered under the provisions of SRO 12 (E) dated 03.05.17 regarding stepping up of Pay, will be taken to CGDA office and IHQ of MoD (Army) / Ministry of Defence for clarification.</p>
<p>2(b) (iii) In 19 cases, where General officers are holding appointment of Army Commanders as on 01/01/2016 drawing maximum pay of Rs.2,25,000/- will not involve any stepping up of pay since there is no pay anomaly.</p>

The details of batch of the officers belonging to the Indian Administrative Service who have been posted at the Centre in various grades of PB-3, PB-4 and HAG was last circulated in this Department OM of even number dated 14-9-2017.</p>

<p>2. The details of the IAS officers who have been subsequently posted in the Centre in various grades as well as the date of posting of the first officer belonging to the batch is annexed. Necessary action may be taken for grant of higher scale for the officers belonging to batches of Organized Group &#8216;A&#8217; Services that are senior by two years or more and have not so far been promoted to that particular grade in accordance with the provisions of this Department&#8217;s OM No.AB.14017/64/2008-Estt.(RR) dated 24.4.2009.</p>

The case are under examination for stepping up of pay of Lt Generals (HAG) promoted before 01/01/2016, at par with pay from the date of promotion of Lt Generals (HAG), in that Corps, promoted after 01/01/2016.</p>
<p>2 (b)(i) Pay revision in Approx 31 such cases is under progress and will be found adjusted in 09/2017 Pay Account.</p>
<p>2 (b) (ii) In 36 cases of Lt General drawing pay in HAG &amp; HAG(+) scale are under examination and those cases not covered under the provisions of SRO 12 (E) dated 03.05.17 regarding stepping up of Pay, will be taken to CGDA office and IHQ of MoD (Army) / Ministry of Defence for clarification.</p>
<p>2(b) (iii) In 19 cases, where General officers are holding appointment of Army Commanders as on 01/01/2016 drawing maximum pay of Rs.2,25,000/- will not involve any stepping up of pay since there is no pay anomaly.</p>

<p>Subject: <strong>Proposal for grant of Apex Scale to Director General (DG) level officers at the Centre on Seniority basis instead of post specific basis.</strong></p>
<p>Sir,</p>
<p>I am directed to say that the Ministry of Home Affairs in consultation with this Department proposes to amend Part &#8216;C&#8217; and Part &#8216;D&#8217; of Schedule II of IPS (Pay) Rules, 2016 as under:</p>
<p>(i) In the Part C of Schedule -II of the IPS (Pay) Rules, 2016 (hereinafter referred to as the said rules), at Serial Nos. 1,2,3,4,5,6,7,8,9,11,13,14,17,19 under column (4), for the entry relating to the posts of Director (IB), Director (SVPNPA), DG (BSF), DG(CRPF), DG (ITBP), DG (CISF), DG (BPR &amp;D), DG (NSG), DG (RPF), DG (SSB), DG (Civil Defence Home Guard and Fire Services), DG (HRC) and DG (NIA), the following entries shall be substituted , namely:</p>
<blockquote><p><strong>&#8221; Apex or HAG+ pay scale as decided by the Appointment Committee of the Cabinet&#8221;.</strong></p></blockquote>
<p>(ii) In the Part (D) of Schedule -II of the IPS (Pay) Rules, 2016 (hereinafter referred to as the said rules) column (2) of the table for the entry relating to the post of Special Secretary to the Government of India, the following entries shall be substituted, namely:</p>
<blockquote><p><strong>&#8221; Apex of HAG + pay scale as decided by the Appointment Committee of the Cabinet&#8221;.</strong></p></blockquote>
<p>2. The amended Rules shall deemed to have come into force w.e.f. 21st July 2016.</p>
<p>3. You are requested to furnish comments on the proposed amendments latest by 5th October 2017, falling which it will be presumed that the State Government has no comments to offer.</p>
