Sub: <strong>Non-redressal of issues discussed by the Federations &#8211; Grant of regular absorption of staff working in Quasi Administrative Offices/Units in the erstwhile Group &#8216;D&#8217; posts &#8211; reg.</strong></p>
<p>Ref: Federations Joint letters No.II/IB dated 09/05/2016 &amp; I5/05/20I7 to CRB.</p>
<p>Federations have repeatedly been inviting kind attention of the Railway Board at all levels including at the level of Hon&#8217;ble MR, CRB to the DC/JCM item No.27/2006, urging decision for absorption of staff working in the Quasi Administrative Office/Units against erstwhile Group &#8216;D&#8217; vacancies since long.</p>
<p>The subject was also discussed by NFIR and AIRF in full Board meetings held on 07/02/2014, 01/10/2015 and 04/02/2016. Federations are deeply disappointed that though years passed, the issue is still pending unresolved. The Federations Joint communications to the Railway Board Chairman vide letters dated 09/05/2016 and 15/05/2017 have unfortunately not yielded positive result.</p>
<p>The Federations have re-iterated through joint letter dated 09/05/201, the justification for restoration of the earlier policy formulated in the year 1973 &amp; 1977 to facilitate regular absorption of staff working in Quasi Administrative Offices/Units. The Federations had sent another letter dated 15/05/2017 requesting to arrange a meeting at the level of Hon&#8217;ble MR and CRB, unfortunately no meeting has been convened as yet. Federations desire to state that 12 valid points were conveyed to the Railway Board on the legal opinion tendered by the Learned ASG relating in this particular case, but however there has been no positive response yet. Federations once again enclose a copy of 12 points for consideration at the level of Railway Ministry which we feel are sufficient to keep the policy alive. The subject was also highlighted by the Federations during. Standing Committee Meetings held between the Federations and the Railway Board (MS, DG/P etc.) on 7th Feb, 2018, 4th April, 2018 without any positive result which is unfortunate</p>
<p>The Federations also reiterate that the decision of Railway Board vide dated 10/06/1997 was arbitrary as the same was issued without consultations with us which amounts to breach of agreement reached with the Federations during previous periods.</p>
<p>We therefore requests the CRB again to kindly intervene and see that a meeting takes place at your level early to settle this long pending issue besides other issues where agreements have been reached but not implemented so far. Alternatively we suggest a special meeting with Hon&#8217;ble Railway Minister early.</p>

<p>30 AUG 2018</p>
<p>A new wage settlement agreement has been signed for Group C &amp; D category of Port and Dock Workers in Mumbai in the presence of Shri Nitin Gadkari, Union Minister for Shipping, Road Transport &amp; Highways and Water Resources, River Development &amp; Ganga Rejuvenation.</p>
<p>The settlement provides for 10.6% fitment on basic pay plus DA. The lowest grade of workers would get a pay-scale of Rs.20900-43600 and the highest grade worker would get a pay-scale of Rs 36500-88700.</p>
<p>More than 32,000 Port and Dock workers and 1,05,000 Group C&amp;D pensioners across all Major Ports will be benefitted from of this settlement. The Overall financial implication of this settlement for all the Major Ports for serving and pensioners is likely to be about Rs.560 crore per annum.</p>
<p>Speaking on the occasion Shri Gadkari said, &#8220;As per the vision of Prime Minister Shri Narendra Modi, welfare of the people is the chief priority of the Government, and I am glad that Major Ports are becoming drivers of socio-economic change. Major Ports have become pioneers in taking this initiative, being the first to sign the wage settlement for Group C &amp; D employees.&#8221;</p>
<p>The settlement has been signed between six Port and Dock Workers&#8217; Federations and the Port Management under Section 12(3) of Industrial Disputes Act, 1947, before the Regional Labour Commissioner, representing Chief Labour Commissioner. The Settlement would come into force from January 1, 2017 in retrospect. This is a five-year settlement arrived at in the port sector against the ten-year periodicity in many of the major public sector enterprises.</p>

<p>The number of sanctioned posts and number in position of Class-C employees including erstwhile Group D employees in various Ministries/Departments as available in the Brochure on Pay and Allowances of Central Government Civilian Employees 2012-13 as on 1.3.2012, published by Pay Research Unit, Department of Expenditure, Ministry of Finance, is 33,52,380 and 28,06,369 respectively.</p>
<p>The posts sanctioned in Government Departments are required to be filled as and when vacancies arise as per the Recruitment Rules. Instructions have been issued that requisitions for Multi-Tasking Staff (MTS) may be made to the recruiting agency.</p>
<p>This was stated by the Minister of State for Personnel, Public Grievances and Pensions and Minister of State in Prime Minister’s office Dr. Jitendra Singh in a written reply to a question by Shri Ram Tahal Choudhary and Dr. Manoj Rajoria in the Lok Sabha today.</p>

<p>The matter regarding issue of Uniforms and liveries to MTS recruited posts 6th CPC through Staff Selection Commission was referred to Ministry for clarification.</p>
<p>2. DoP&amp;T has since confirmed that Uniforms/Liveries and washing allowance to newly recruited MTS , post 6th CPC may be allowed as is being admitted to erstwhile Group ‘D’ posts of peon, daftary, jamadar, Junior Gestetner Operator, Farash, Chowkidar, Safaiwala, Mali etc. which have been designated as MTS in Group ‘C’ post 6th CPC.</p>
<p>Further , it should be ensured that the Uniforms/Liveries are being admitted to those expected to wear respective uniforms while on duty.</p>

<p>3. The issue of seniority of merged MTS Grae (erstwhile Group &#8216;D&#8217; post) has been examined in consultation with UPSC. The post(s) in the erstwhile Group &#8216;D&#8217; for the purpose of determination of seniority, can be grouped into five different categories as under :</p>

The determination of seniority of merged grade will be regulated as per following guidelines:</div>
<div></div>
<div>I. As on 29.08.2008, holders of posts in Category-I will be enbloc senior to the holder of posts in Category-</p>
<p>II, similarly holder of the posts in Category-II will be senior to holder of the posts in Category-III and so on.</p></div>
<div></div>
<div>II. While merging the different grade(s), the inter se seniority in a post which existed as on 29.08.2008 is to be maintained.</div>
<div></div>
<div>III. Within same category, where different stand alone posts have been merged, inter se seniority will be determined based on length of continuous officiation in the post.</div>
<div></div>
<div>IV. Only the regular service in the grade is to be counted for determination of service and ad-hoc service, if any, is to be ignored.</div>
<div></div>
<div>V. Seniority is to be determined based on the substantive post held by the employee irrespective of the fact that such employee has been allowed financial upgradation to the next higher grade under ACP Scheme or any other scheme.</div>
<div></div>
<div>VI. In case of employees who joined a erstwhile Group ‘D’ post either by promotion or direct recruitment between 01.01.2006 to 29.08.2008, inter-se seniority will be determined as per guidelines laid down in this</div>
<div>Department’s O.M. of even number dated 13.09.2012.</div>

<div>Sub:- <strong>Revision of designations of erstwhile Group ‘D’ staff.</strong></div>

<div>While recommending upgradation of all existing Group &#8216;D’ employees to Group &#8216;C’in Grade Pay Rs. 1800 (equivalent to Group ‘C’ scale of R. 2750-4400), 6th CPC in para 3.7.9 of its report has provided that job description of the Group &#8216;D&#8217; posts shall be so upgraded and placed in Group &#8216;C’, and revised and re-defined with emphasis on multi skilling so that a single employee is able to perform various jobs. Further, DOP&amp;T in their OM dated 30-04-2010 has suggested that single designation may be adopted for posts whose duties are similar in nature. While indicating that designation of Multi-Tasking Staff may be adopted for some common categories of posts (designation and indicative list of duties issued by DOP&amp;T vide their letter ibid is enclosed as Annexure-I.</div>

<div>Since, all the pre-revised scale of Group ‘D’ staff (Rs.2550-3200, 2610-3540 &amp; 2650-4000) has been merged and placed in a single revised pay structure PB-I, Grade Pay Rs.1800 (corresponding to pre-revised scale of Rs.2750-4400, revised designations for these staff on Railway are to be issued in consonance with the recommendations of 6 CPC.</div>

<div>Federations are requested to please convey their views on the above proposal regarding grouping/broad-banding of erstwhile Group &#8216;D’ staff and revision of their designation keeping in view of above facts in the format enclosed alongwith as Annexure-II.</div>

<div>References are being received from various controllers seeking clarification whether the candidates who have appeared in the subject examination are required to attempt the typewriting test in the same language as they have opted for the written examination.</div>

<div>In this regards it is clarified that typing test is an independent test to be conducted internally by PCsDA/CsDA for candidates serving under their jurisdiction. As such separate language option can be exercised by the candidates for typing test irrespective of the language opted for the written test.</div>
