<p>Sub: <strong>Promotion from Group ‘B&#8217; to Group ‘A’, after CR.</strong></p>
<p>In my previous message dated 19.5.2014, at step No. VII, I had referred to the work relating to promotions of 2,118 officers from Group ‘B’ to Group ‘A’. The Board has since reviewed the work of Committee No. II, Sub-Committee No.1, which is looking after this task, along with the officers from the Ad.II Sections of the CBEC and DG, HRD.</p>
<p>2. After obtaining the tentative consideration zone and the All India seniority list of Superintendents/ Superintendents(P)/ Appraisers from the DG, HRD in December, the Sub-Committee No.1 has obtained around 5000 folders from the various CCAs. Individual folders for each of the eligible officers has been prepared containing the ACRs/APARs for the preceding 5 years. Work is in progress for ensuring that CR/APAR folder is up-to-date which would include availability of vigilance status, integrity certificates, penalty statements (where necessary) availability of part period ACR/APAR, if any, in a particular financial year, completion of action in respect of ‘Below Bench Mark’ cases, No Report/No Review certificates, additional ACRs/APARs in he last mentioned types of cases, etc. Check List has been maintained in respect of each folder. Review of the work revealed that there are 256 dossiers from eight CCAs which are yet to be sent:-</p>

<p>3. Though Member (P&amp;N) has been contacting the above mentioned CCAs, it would be appreciated if the Group ‘B’ Gazetted Officers Associations if these zones take up the matter of ensuring that the missing dossiers are forwarded to the Committee without delay. The Sub-Committee has moved forward with the action for completion of the dossiers and same is expected to be completed shortly. However, it is reiterate that unless the pending dossiers are also received and the same rigorous scrutiny done, we would not be in a position to  move the UPSC for obtaining a date for DPC. All CCAs are, therefore, requested ti bestow personal attention in the matter and‘ the Associations re also requested to coordinate with the administration<br />
in this regard</p>
<p>4. At the level of Ad.II Section in CBEC, necessary action is being taken for de ling with all representations received from individuals as also from Associations. The Ad.II Section will also be providing to the DG, HRD the number of carry forward / backlog vacancies which require to be filled so that the same can be included in the DPC proposal. he Ad.II will send the vetted list of the zone of consideration to the Sub-Committee to enable them to properly identify the dossiers required for the DPC. Once the dossiers are completed and forwarded by the Sub-Committee, the same will have to be completely vetted again before being certified by the appropriate authority in Ad.II and submission to the UPSC through the single window.</p>
<p>5. . I would again emphasise that existence of complete and correct dossiers is necessary before the proposal for DPC can be sent to UPSC. Therefore, I could request all CCAs and Associations to ensure that the action, a required at the zonal level, is expedited. It is evident that delay b even one zone would put in jeopardy the legitimate aspirations rid expectations of the officers of remaining zones. Therefore, I look forward to a coordinated and quick response from you.</p>

<p>It has come to the notice that some local Accounts Offices are not allowing LTC to travel by air from their place of posting (or nearest airport) to a city in the NER to the MCMs who are Non-Gazetted Group &#8216;B&#8217; officers working in Ordnance Factories.</p>
<p>In this connection Government of India, Ministry of Personnel, Public Grievances and Pension, Department of Personnel and Training, Estt(A)Section, New Delhi OM No.31011/4/2007-Estt.(A) dated 14.05.2008 regarding clarification of entitlement of travel air to visit NER and order dated 09.04.2009 alongwith OFB, Kolkata Note : A/I(ID No.01/CR/A/I/Vol.III/658/LTC dated 08.11.2013) regarding classification of the posts of MCM with reference to Grade Pay are forwarded herewith for information and necessary action of all conerned. As OFB Note is specific on a particular post, i.e., <strong>MCM, it is directed to treat MCM posts as Group &#8216;B&#8217; for all purposes including LTC and CGEGIS</strong>.</p>

<p>G.S.R. &#8212; In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Company Law Board (Group IV posts) Recruitment Rules, 1999, in so far as they relate to the post of Section Officer, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the Group &#8216;B&#8217; post — Section Officer in the Company Law Board, Ministry of Corporate Affairs, namely:-</p>
<p>2. Short title and commencement.&#8211; (1) These Rules may be called the Company Law Board (Group &#8216;B&#8217; Post — Section Officer) Recruitment Rules, 2013.</p>
<p>(2) They shall come into force on the date of their publication in the Official Gazette.</p>
<p>2. Number of posts, classification and Pay Band and Grade Pay .&#8211; The number of posts, their classification and Pay Band and Grade Pay attached thereto shall be as specified in column (2) to (4) of the Schedule annexed to these rules.</p>
<p>3. Method of recruitment, age limit and other qualifications .&#8211; The method of recruitment to the said post, age limit, qualifications and other matters relating thereto shall be as specified in column (5) to (13) of the aforesaid Schedule.</p>
<p>4. Disqualification &#8211; No person —<br />
(a) who, has entered into or contracted a marriage with a person having spouse living; or<br />
(b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said posts :</p>
<p>Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.</p>
<p>5. Power to relax &#8212; Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing , and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.</p>
<p>6. Saving .&#8211; Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, Scheduled Tribes, Ex- servicemen and other special categories of persons, in accordance with the orders issued by the Central Government from time to time in this regard.</p>

<p>3. The Departmental Assistant in Pay Band 2 — Rs. 9300-34800 plus Grade Pay of Rs. 4200/- with five years&#8217; regular service in the grade shall also be considered along with outsiders and In case he is selected for appointment to the post, the same will be treated as having been filled by promotion.</p>
<p>Note- 1. The period of deputation including the period of deputation in another ex-cadre post held immediately preceding this appointment in the same, or some other organization/ department of the Central Government shall ordinarily not exceed three years. The maximum age limit for appointment by deputation shall be not exceeding 56 years as on the closing date of receipt of applications.</p>
<p>Note 2: For the purpose of appointment on deputation, the service rendered on a regular basis by an officer prior to 1st January, 2006 (the date from which the revised pay structure based on the Sixth Central Pay Commission recommendation has been extended), shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the Pay Commission except where there has been merger of more than one pre-revised scales of pay into one grade with a common Grade Pay or Pay Scale and where this benefit will extend only for the post (s) for which that Grade Pay or Pay Scale is the normal replacement grade without any up- gradation.</td>

Subject: <strong>Model Recruitment Rules for the various categories of Group ‘A’ and Group ‘B’ posts in the Library Discipline.</strong></p>
<p>The Model RRs for the various categories of Group ‘A’ and Group ‘B’ posts in the Library Discipline issued in this Department OM No. AB-14017/43/1991-Estt.(RR) dated 22.2.1993 have been reviewed in the light of 6th CPC recommendations on revision of pay scales, instructions issued by this Department, etc. Accordingly, the revised Model Recruitment Rules for the same are enclosed as Annexure to this Office Memorandum.</p>
<p>2. Ministries / Departments may review the existing rules and notify the revised rules conforming to the Model Recruitment Rules. These may also be forwarded to all autonomous / statutory bodies for adoption. The Ministry of Home Affairs is also requested to forward these Model RRs to the UT Administrations for appropriate action.</p>

<p>Attention is invited to this Department’s O.M. of even number dated 25th February, 2013 on the subject cited above vide which all the cadre unit were requested to initiate advance action for completion of ACRs/APARS in respect of all the candidates who have appeared in LDCE 2009, 2010 and 2011 conducted by UPSC during December, 2012 so that result may be declared in a compressed time schedule.</p>
<p>2. All the cadre units were also requested to send a statement of ACRs/APARs grading for the period 2004 -2011 (1.4.2004 to 31.3.2011) in respect of all the candidates who have appeared in the examination from respective cadre units by 31st March,2013.</p>
<p>3. It is once again re-iterated that the deadline for completion of ACRs/APARs and submitting the statement to DOPT i.e. 31st March, 2013 may strictly be followed so as to avoid any delay in sending the ACRs/APARs of the successful candidates to UPSC immediately once the result of written part is declared.</p>
