<p>Reference is invited to timeline prescribed for processing and payment of pension/family pension, gratuity and other retirement benefits prescribed under CCS (Pension) Rules and issued by DoP&amp;PW and O/o CGA. It has been noticed that payment of retirement benefits is getting delayed in many cases and  errors are also being reported in issuance of PPO.</p>



<p>2. In this regard, it is observed that PAO may receive number of pension/family pension cases where the pension forms are not properly filled and complete, particulars not furnished or authentication of HOO/DDO not given in the space provided, etc. These kinds of cases might have been returned to the concerned office for rectification / omissions which may result to delay in payment of pension/family pension. In this connection, it is advised that common errors noticed by PAO may be compiled and issued as internal guidelines. Accordingly, concerned HOO/DDOs may be advised to ensure due care while submitting pension/family pension cases to PAO so that pensioners/family pensioners get their dues well in time. PAOs may also be advised to fill all the columns of the PPO with due care.</p>



<p>3 It is further advised that, in case, delay is anticipated in payment of pension/ family pension, gratuity to the beneficiary concerned, then sanctioning authority may sanction provisional pension/ family pension/ gratuity to them, as per CCS (Pension) Rules,2021 so as to avoid hardship to the pensioner/family pensioner. In this matter, the provision enunciated under the Rule 65 of CCS (Pension) Rules, 2021 may be taken into account.</p>



<p>4. In view of above, all the Pr. CCAs/ CCAs/ CAs (/Cs) of the respective Ministries/Departments are requested to ensure that pension/family pension cases are processed within the prescribed timelines.</p>

<h3 class="wp-block-heading">SUB: (i) Timelines for completion of various activities in the process of authorisation of pension and gratuity on retirement on superannuation of a Govt. servant.</h3>



<h3 class="wp-block-heading">(ii) Processing of cases for authorization of pension/family pension in respect of a (i) a Govt. servant who is not in a position to submit the pension form on account of any bodily or mental infirmity, and (ii) a Govt. servant who dies after retirement without having submitted the pension forms.</h3>



<p>Govt. of India, Ministry of PPG&amp;P, Deptt. Of P&amp; PW vide their OM No. 11(15)/2022-P&amp;PW (H)-8363 (1) dated 28.10.2022 and OM No. 11(15)/2022-P&amp;PW (H)-8363 (2) dated 28.10.2022 has issued provisions on the subject mentioned above. The following procedure may be adopted for processing of the case regarding timelines for completion of various activities in the process of authorisation of pension and gratuity on retirement on superannuation of a Govt. servant and authorization of pension/family pension in respect of a (1) a Govt. servant who is not in a position to submit the pension form on account of any bodily or mental infirmity, and (11) a Govt. servant who dies after retirement without having submitted the pension forms are summarized as follows:</p>



<h4 class="wp-block-heading">A) Timeline for processing of a pension under CCS (Pension) Rules, 2021</h4>



<p>(i) HOD (Head of Deptt) is required to have a list prepared by 15th day of every month, of all Govt. servants who are due to retire within the next fifteen months of that date.</p>



<p>(ii) Complete details regarding the Govt. accommodation to be obtained from Govt. servants at least one year before retirement and send these details, within 10 days to the Directorate of Estates for issuing a “No demand certificate” in respect of period preceding eight months of the retirement of the Govt. servant. If the Govt. servant is/was not occupation of any residential accommodation, HOO shall issue the “No Demand Certificate” on the basis of a declaration from the Govt. servant in this regard and after verification of the records and no separate “No Demand Certificate” from Directorate of Estates shall be necessary.</p>



<p>(iii) One year before the superannuation, the HOO will verify the service, make good the omission, imperfection or deficiencies in service .book. In order to ensure that the emoluments during last ten months of the service have been correctly shown in service book, the HOO shall verify the correctness of emoluments only the period of twenty four months preceding the date of retirement of a Govt. servant, and not for any period prior to that date. At least, eight months prior to the date of retirement of a Govt. servant, the HOO shall furnish to the retiring Govt, servant a certificate regarding the length of qualifying service and the emoluments/ average emoluments to be reckoned for retirement gratuity and pension and advise the retiring Govt. servant to submit/fill the required pension form. The Govt. servant shall submit the completed forms not later than six months prior to his date of retirement.</p>



<p>(iv) The HOO is required to send the pension forms to the AO within two months from the date of receipt of pension forms from the Govt. servant.</p>



<p>(v) On receipt of pension case the AO shall apply requisite checks and issue the pension payment order (PPO) not later than two months in advance of the date of retirement. In PPO, the AO shall indicate the name of spouse as family pensioner, the name of permanently disabled child/children, dependent parent and disabled siblings.</p>



<p>(vi) The AO shall forward a copy of the PPO duly digitally singed by him to the PDA (Pension disbursing authority) for taking necessary action to disburse the pension to the retired Govt. servant servant on the date on which it becomes due.</p>



<h4 class="wp-block-heading">(B) (a) Processing of cases for authorization of pension/family pension in respect of a (i) a Govt. servant who is not in a position to submit the pension form on account of any bodily or mental infirmity..</h4>



<p>Where the HOO 1s satisfied that the Govt, servant who retires, is not in a position to submit the pension forms on account of any bodily or mental infirmity, he may allow the spouse or in the case absence of spouse, the member of the family eligible to receive family pension on death of a Govt. Servant, to submit Form 4 and Form 6. If there is no member of the family eligible to receive family pension on death of Govt. servant, a member of the family in whose favour a nomination was made by the Govt. servant for payment of gratuity, may be allowed to submit the said form. No commutation of pension is admissible in such cases.</p>



<h4 class="wp-block-heading">B (b) In case for authorization of pension, gratuity and family pension in respect of a Govt. servant, who has died after retirement without submission of pension form is required to be processed in the following manner.</h4>



<p>In order to avoid any hardship to the family of a retired Govt. servant who dies without submitting the pension papers, it has been decided by Deptt. Of P&amp;PW vide their OM No. 11(15)/2022-P&amp;PW (H)-8363 (2) dated 28.02.2022, that following procedure may be adopted for processing of the case for sanction of pension/family pension to his/her family.</p>



<p>(i) The HOO shall allow the spouse or in the case absence of spouse, any other member of the family eligible to receive family pension on death of a Govt. servant, to submit the claim in Form 10 along with Form 4 and an undertaking to the bank in Format 9. If there is no member of the family eligible to receive family pension on death of Govt. servant, a member of the family in whose favour a nomination was made by the Govt. servant for payment of gratuity, shall be allowed to submit Form 6 in place of Form 10 and the said member of the family shall indicate , the details of his or her Bank account in Form 6.</p>



<p>(ii) The HOO shall fill up Form 7 for payment for pension and retirement gratuity in respect of the deceased retired Govt. servant and he shall also make an indication in Form 7 to the effect that the case pertain to a_ retired Govt. servant, who did not submit Form 6 and other documents before his death and if a claim for family pension has been submitted in Form 10, the HOO shall also issue a sanction in Format 13 for authorization of family pension to the eligible member of a family.</p>



<p>iii) The HOO shall send Form4 ,Form7, Form10 or Form 6, as the case may be, Format 9 and Format 13 (if applicable) with a forwarding letter in Format 10 to the Accounts Officer for authorization of pension, retirement gratuity and family pension, if applicable.</p>



<p>(iv) The AO shall authorize the pension ,retirement gratuity and family pension (if applicable) in PPO and he shall also authorize the HOO to make payment of arrears of pension for period from the date following the date of retirement up to the date of death to the member of the family who is authorized to receive family pension. If there is no member of the family eligible to receive family pension, the arrears of pension shall be paid to the member of the family who has been authorize to receive retirement gratuity.</p>



<p>(v) If a family pension has been authorized to a member of the family, the Accounts Officer shall forward a copy of the PPO duly digitally singed by him to the PDA (Pension disbursing authority) along with the undertaking in Format 9 for taking necessary action to disburse the family pension.</p>



<p>In view of the above, all Head of Departments are requested to issue suitable instructions (along with copy of this circular) to all the Head of Office under their administrative control to ensure the compliance of above provisions.</p>

<h3 class="wp-block-heading">Sub: Payment of Provisional Pension and gratuity under Rule 62 of the Central Civil Services (Pension) Rules, 2021 in case of delay in issue of PPO authorizing regular pension &#8211; reg</h3>



<p>The undersigned is directed to say that in accordance with Rule 62 of the Central Civil Services (Pension) Rules, 2021 (Rule 64 of the erstwhile Central Civil Services (Pension) Rules, 1972), the Head of Office is required to sanction a provisional pension/gratuity, in cases where a delay is anticipated in issuing a PPO authorizing regular pension. <strong>Rule 65 of the CCS (Pension) Rules, 2021 further provides that in all cases where pension/ family pension/gratuity (including provisional pension/ family pension/gratuity) has not been sanctioned or is delayed, and it is clearly established that the delay in payment was attributable to administrative reasons or lapses, interest shall be paid on arrears of pension/family pension/gratuity at the rate and in the manner as applicable to General Provident Fund amount.</strong> Every case of delayed payment of pension/family pension/gratuity in respect of employees of a Ministry or Department and the employees of its attached and subordinate offices shall be considered by the Secretary of that Ministry or Department or any other officer authorized by him, and where it is found that the delay in the payment of pension/family pension/ gratuity was caused on account of administrative reasons or lapse, interest shall be required to be paid to the affected pensioner/family pensioner. In such cases, responsibility shall be fixed and disciplinary action shall be taken against the Government servant or servants who are found responsible for the delay on account of administrative lapses.</p>



<p>2. Although as per Rule 62 of CCS(Pension) Rules, 2021, payment of provisional pension shall not continue beyond the period of six months from the date of retirement of the Government servant, the Rule further provides that the Accounts Officer shall treat the provisional pension as final and issue pension payment order immediately on the expiry of the period of six months, if the final amount of pension and gratuity have not been determined by the Head of Office in consultation with the Accounts Officer within the aforesaid period of six months.</p>



<p>3. In view of the provisions of Rule 62 of CCS (Pension) Rules, 2021 (earlier Rule 64 of CCS (Pension) Rules, 1972), the Accounts Officer has to treat the provisional pension as final and issue pension payment order immediately on the expiry of the period of six months provided in the Rule, if the final amount of pension and gratuity have not been determined by the Head of Office in consultation with the Accounts Officer within the said period. Therefore, there should not be a situation where regular pension is not authorized by the Accounts Officer to a retired Government servant on expiry of the period of six months.</p>



<p>4. All Ministries/Departments and their Account Officers are advised to strictly comply with the provisions of Rule 62 of the CCS (Pension) Rules, 2021. It is further emphasized that pension should not be discontinued under any circumstances, if, for any reason, PPO for regular pension could not be issued by the Accounts Officer till the expiry of the aforesaid period of six months.</p>

<h3 class="wp-block-heading">Subject:- Rationalization of financial transactions &#8211; reg.</h3>



<p>Madam/Sir,</p>



<p>With reference to the subject cited above, it is stated that as per the existing procedure, the payment towards Gratuity, Commutation money, Leave Encashment, Employees Welfare Scheme, DLIS, Provident Fund, Advance/ withdrawal from Provident Fund etc. are being made to the concerned employee through the respective Vidyalayas/ units. It was observed that there is a requirement to rationalise these financial transactions mainly due to the following reasons:-</p>



<ul class="wp-block-list"><li>(i) As per the existing procedure, aforesaid payments are done through concerned units, which some time causes delay in receipt of amount by the employees.</li><li>(ii) In the existing procedure, these transactions are recorded in the books of the concerned KVs/units as well as in the books of the Regional Offices. In the new procedure, since the payments would not be required to be entered in the books of accounts of K’Vs, it will decrease the work load significantly at Vidyalaya level. Further, Maintenance of cash book and subsidiary records would be easier because good number of transactions would not be required to be entered in Cash Book of KV.</li><li>(iii) Since the amount towards aforesaid payments would not be received by the Vidyalaya, possibilities of mis-classification of entries/ utilization of funds for other purpose would not be there.</li><li>(iv) Accumulation of liabilities can be avoided as the payment released even in the month of March would not form part of liabilities.</li><li>(v) The commutation of pension 1s effective from the date of receipt of the commutation money by the pensioner. The new procedure will reduce the grievances from the pensioner to this extent.</li><li>(vi) Utilization of funds/grants would be optimal as no funds would be available in transit (KV level) at the close of financial year.</li><li>(vii) in the existing procedure, the payment relating to GPF/CPF withdrawal is released through the concerned KV/unit which some time causes delay in receipt of amount by the employee concerned. Late receipts of amount cause loss of interest to the employees. In the new procedure, the payment would be made directly to the employee concerned. Hence, question of loss of interest would not be there.</li></ul>



<p>In view of the above, the existing procedure relating to these financial transactions was reviewed and further discussed in detail during the Virtual DC conference on financial matters, held on 22.10.2021. Now, it has been decided that <strong>all Regional Offices/ KVS (HQ) shall make the aforesaid payments except Gratuity directly to the employee/retired employee/ nominee concerned without routing these transactions through the respective Vidyalaya/ RO Unit / Cash Section of KVS (HQ) w.ef 01.12.2021 on trial basis.</strong></p>



<p>In this regard detailed guidelines are given in&nbsp;<strong>Annexure-I.</strong>&nbsp;All the Deputy Commissioners are requested to go through the guidelines carefully and ensure the compliance without fail.</p>

<p>Subject: <strong>Calculation of Gratuity and Cash payment in lieu of leave for the employees of CPSEs following IDA pattern (2017, 2007, 1997, 1992 and 1987 pay scales) retired on or after 01.10.2020 and up to 30.06.2021 &#8211; reg.</strong></p>



<p>The undersigned is directed to refer to this Department’s OM No. 02/0039/2014- DPE(WC) dated 19.11.2020, in regard to payment of Dearness Allowance (DA) during the freezing period from 01.10.2020 up to 30.06.2021 and to say that in terms thereof the rate of DA during the said period will continued to be paid at the rates applicable w.e.f. 01.07.2020.</p>



<p>2. In view of the above order calculation of Gratuity and Cash payment in lieu of leave for CPSE employees IDA pattern who retired on or after 01 October, 2020 and up to 30.06.2021 have been made as per the above order.</p>



<p>3. Keeping in view that gratuity and cash payment in lieu of leave are one-time retirement benefits admissible to employees on retirement, the matter has been considered sympathetically. It has been decided that in respect of CPSE employees (IDA pattern) who retired on or after 01 .10.2021 and up to 30.06.2021, the amount of DA to be taken into account for calculation of gratuity and cash payment in lieu of leave will be deemed to be as per the notional DA rates indicated in the annexure(s) to the OPE OMs dated 02.08.2021 and 03 .08 .2021 for different pay revision. The notional DA rates for calculation purpose are given below for different pay scales.</p>

<p>Lately, GoI, MoF, New Delhi letter, No. 1(5)/E.V/2020 dated 07/09/2021 regarding <a href="https://centralgovernmentnews.com/central-government-employees-leave-encashment-and-gratuity-for-pensioners-who-retired-between-january-2020-and-june-2021/"><strong>Central Govt employees retired during the period from January 2020 to June 2021- calculation of Gratuity and Cash payment in lieu of Leave</strong> </a>&#8211; regarding’, is doing rounds in the environment, however, the same has not been received in this office through proper permissible channel of official communication till date. There have been several enquiries from Army Officers &amp; Army Authorities on this account, through various modes &amp; various channels of communication. MoD, New Delhi order on the above subject, has not been received. As and when MoD orders are received, necessary action will be taken by the O/o the PCDA (O), Pune. This has been put up for kind information of Indian Army Officers to avoid queries in this matter along with the attached anxiety.</p>

<p class="has-text-align-right">New Delhi, the 23rd September, 2021</p>



<p><strong>G.S.R. 658(E)</strong>. In exercise of the powers conferred by the proviso to article 309 and clause (5) of article 148 of the Constitution and after consultation with the Comptroller and Auditor-General of India in relation to persons serving in the Indian Audit and Accounts Department, the President hereby makes the following rules, namely:-</p>



<h2 class="has-text-align-center wp-block-heading">CHAPTER I</h2>



<p><strong>1. Short title and commencement.-&nbsp;</strong>(1) These rules may be called the Central Civil Services (Payment of Gratuity under National Pension System) Rules, 2021.</p>



<p>(2) They shall come into force on the date of their publication in the Official Gazette.</p>



<p><strong>2. Application.-</strong>&nbsp;Save as otherwise provided in these rules, these rules shall apply to the Government servants including civilian Government servants in the Defence Services, appointed substantively to civil services and posts in connection with the affairs of the Union on or after the 1st day of January 2004, and to whom the Central Civil Services (Implementation of National Pension System) Rules, 2021 apply :</p>



<p>Provided that in the case of a Government servant who dies during service or is boarded out on account of disablement or retires on invalidation and who had exercised option under rule 10 of the Central Civil Services (Implementation of National Pension System) Rules, 2021 for availing benefits under the Central Civil Services (Pension) Rules, 1972 or the Central Civil Services (Extraordinary Pension) Rules, 1939, payment of gratuity shall be made in accordance with the said rules.</p>



<p><strong>3. Definitions.</strong> &#8211; In these rules, unless the context otherwise requires, &#8211;</p>



<ul class="wp-block-list"><li>(1) (a) ‘Accounts Officer’ means an officer, whatever his official designation, of a Ministry or Department functioning under the scheme of departmentalisation of accounts, who, inter-alia is responsible for receipts, payments, Internal Audit and accounting functions of an office or Department or Ministry of the Central Government or Union territory and includes officers subordinate to the Accountant General who is entrusted with the function of maintaining the accounts or part of accounts of the Central Government or Union territory;</li><li>(b) ‘allottee’ means a Government servant to whom Government accommodation has been allotted on payment of license fee or otherwise ;</li><li>(c) ‘average emoluments’ means average emoluments as determined in accordance with rule 7;</li><li>(d) ‘Emoluments’ means emoluments referred to in rule 6;</li><li>(e) ‘Form’ means a Form appended to these rules ;</li><li>(f) ‘Government’ means the Central Government ;</li><li>(g) ‘Government dues’ means dues referred to in sub-rule (3) of rule 45;</li><li>(h) ‘gratuity’ includes retirement gratuity and death gratuity payable under these rules;</li><li>(i) ‘Minor’ means a person who has not completed the age of eighteen years ;</li><li>(j) ‘Qualifying service’ means the service rendered while on duty or otherwise which shall be taken into account</li><li>for the purpose of payment of gratuity admissible under these rules;</li><li>(k) ‘Service Book’ includes service roll, if any.</li></ul>



<p>(2) Words and expressions used herein and not defined but defined in the Fundamental Rules, 1922 or the Central Civil Services ( Implementation of National Pension System) Rules, 2021 shall have the meanings as respectively assigned to them in those rules.</p>



<h2 class="has-text-align-center wp-block-heading">CHAPTER II<br />GENERAL CONDITIONS</h2>



<p><strong>4. Regulation of claims to gratuity. &#8211; </strong>(1) Any claim to gratuity shall be regulated by the provisions of these rules in force at the time when a Government servant retires or is retired or is discharged or is allowed to resign from service or dies, as the case may be.</p>



<p>(2) The day on which a Government servant retires or is retired or is discharged or is allowed to resign from service, as the case may be, shall be treated as his last working day and the date of death of a Government servant shall also be treated as a working day.</p>



<p><strong>5. Right of President to withhold gratuity.-</strong>&nbsp;(1) The President reserves to himself the right of withholding gratuity, either in full or in part, and of ordering recovery from gratuity of the whole or part of any pecuniary loss caused to the Government, if, in any departmental or judicial proceedings instituted while the Government servant was in service, the retired Government servant is found guilty of grave misconduct or negligence :</p>



<p>Provided that the Union Public Service Commission shall be consulted before any final orders are passed by the President under this rule:</p>



<p>(2) (a) The departmental proceedings referred to in sub-rule (1), shall, after the retirement of the Government servant, be deemed to be proceedings under this rule and shall be continued and concluded by the authority by which they were commenced in the same manner as if the Government servant had continued in service :</p>



<p>Provided that in all cases where the departmental proceedings are instituted by an authority subordinate to the President, that authority shall submit a report recording its findings to the President.</p>



<p>(b) No gratuity shall be payable to the Government servant until the conclusion of the departmental or judicial proceedings referred to in sub-rule (1) and issue of final orders thereon.</p>



<p>(3) The President may at any time, either on his own motion or otherwise call for the records of any inquiry and revise any order made under these rules and may confirm, modify or set aside the order, or remit the case to an authority directing such authority to make such further enquiry as it may consider proper in the circumstances of the case, or pass such other order as he may deem fit :</p>



<p class="has-text-align-center"><strong><a href="https://centralgovernmentnews.com/central-government-employees-leave-encashment-and-gratuity-for-pensioners-who-retired-between-january-2020-and-june-2021/" target="_blank" rel="noreferrer noopener">Central Government employees Leave Encashment and Gratuity for pensioners who retired between January 2020 and June 2021</a></strong></p>



<p>Provided that no order enhancing the amount of gratuity to be withheld or withdrawn, shall be made.</p>



<p>(4) The President may at any time, either on his own motion or otherwise review any order passed under these rules, where extenuating or special circumstances exist to warrant such review or when any new material or evidence which could not be produced or was not available at the time of passing of the order under review and which has the effect of changing the nature of the case, has come, or has been brought, to his notice :</p>



<p>Provided that no order enhancing the amount of gratuity to be withheld or withdrawn, shall be made.</p>



<p>(5) For the purpose of this rule, &#8211;</p>



<p>(a) departmental proceedings shall be deemed to be instituted on the date on which the statement of charges is issued to the Government servant or pensioner, or if the Government servant has been placed under suspension from an earlier date, on such date; and</p>



<p>(b) judicial proceedings shall be deemed to be instituted &#8211;</p>



<p>(i) in the case of criminal proceedings, on the date on which the complaint or report of a police officer, of which the Magistrate takes cognizance, is made, and</p>



<p>(ii) in the case of civil proceedings, on the date the plaint is presented in the court.</p>



<h2 class="has-text-align-center wp-block-heading">CHAPTER III<br />EMOLUMENTS AND AVERAGE EMOLUMENTS</h2>



<p>6<strong>. Emoluments.- </strong>(1) The expression ‘emoluments’ for the purpose of determining the amount of gratuity payable under these rules shall include the basic pay as defined in rule 9 (21) (a) (i) of the Fundamental Rules, 1922, which a Government servant was receiving immediately before his retirement or on the date of his death and shall also include non-practicing allowance granted to the medical officer in lieu of private practice.</p>



<p><strong>Explanation. </strong>&#8211; For the purposes of this sub-rule, stagnation increment shall be treated as emoluments for calculation of gratuity.</p>



<p>(2) Where a Government servant immediately before his retirement or death while in service had been absent from duty or was on leave for which leave salary is payable or having been suspended had been reinstated without forfeiture of service, the emoluments which he would have drawn had he not been absent from duty or suspended shall be the emoluments for the purposes of this rule:</p>



<p>Provided that any increase in pay [ other than the increment referred to in sub-rule (5)] which is not actually drawn shall not form the part of his emoluments.</p>



<p>(3) Where a Government servant immediately before his retirement or death while in service had proceeded on leave for which leave salary is payable after having held a higher appointment whether in an officiating or temporary capacity, the benefit of emoluments drawn in such higher appointment shall be given only if it is certified that the Government servant would have continued to hold the higher appointment but for his proceeding on leave.</p>



<p>(4) Where a Government servant immediately before his retirement or death while in service had been absent from duty on extraordinary leave or had been under suspension, the period whereof does not count as service, the emoluments which he drew immediately before proceeding on such leave or being placed under suspension shall be the emoluments for the purposes of this rule.</p>



<p>(5) Where a Government servant immediately before his retirement or death while in service, was on earned leave, and earned an increment which was not withheld, such increment though not actually drawn, shall form part of his emoluments :</p>



<p>Provided that the increment was earned during the currency of the earned leave not exceeding one hundred and twenty days, or during the first one hundred and twenty days of earned leave where such leave was for more than one hundred and twenty days.</p>



<p>(6) Pay drawn by a Government servant while on deputation to another Central Government Department and to the Armed Forces of India shall be treated as emoluments.</p>



<p>(7) Pay drawn by a Government servant while on foreign service shall not be treated as emoluments, and the pay which he would have drawn under the Government had he not been on foreign service shall alone be treated as emoluments.</p>



<p>(8) Where a pensioner who is re-employed in Government service and whose pay on re-employment has been reduced by an amount not exceeding his monthly pension, the element of monthly pension by which his pay is reduced shall be treated as emoluments.</p>



<p><strong>7. Average emoluments.-</strong> (1) Average emoluments shall be determined with reference to the emoluments drawn by a Government servant during the last ten months of his service.</p>



<p>(2) Where during the last ten months of his service, a Government servant had been absent from duty on leave for which leave salary is payable or having been suspended had been reinstated without forfeiture of service, the emoluments which he would have drawn had he not been absent from duty or suspended shall be taken into account for determining the average emoluments :</p>



<p>Provided that any increase in pay [ other than the increment referred to in sub-rule (4)] which is not actually drawn shall not form the part of his emoluments.</p>



<p>(3) Where during the last ten months of his service, a Government servant had been absent from duty on extraordinary leave, or had been under suspension the period whereof does not count as service, the aforesaid period of leave or suspension shall be disregarded in the calculation of the average emoluments and equal period before the ten months shall be included and in order that the fractions of a month, when added, worked out to one full month, a month for this purpose shall be reckoned as consisting of thirty days.</p>



<p>(4) Where a Government servant who was on earned leave during the last ten months of his service and earned an increment, which was not withheld, such increment though not actually drawn shall be included in the average emoluments :</p>



<p>Provided that the increment was earned during the currency of the earned leave not exceeding one hundred and twenty days or during the first one hundred and twenty days of earned leave where such leave was for more than one hundred and twenty days</p>



<h2 class="has-text-align-center wp-block-heading">CHAPTER IV<br />QUALIFYING SERVICE</h2>



<p>8. Commencement of qualifying service. &#8211; Subject to the provisions of these rules, qualifying service of a Government servant shall commence from the date he takes charge of the post to which he is first appointed either substantively or in an officiating or temporary capacity :</p>



<p>Provided that officiating or temporary service is followed without interruption by substantive appointment in the same or another service or post.</p>

<h3 class="wp-block-heading">Subject: Timely payment of retirement benefits to the retiring employees</h3>



<p>The undersigned is directed to say that timelines have been prescribed under the CCS (Pension) Rules, 1972 for each activity involved in the processing of a pension case and for payment of pension and gratuity to a retiring Government servant. As per this timeline, the process of verification of service and other preparatory work should be<br />undertaken one year before a Government servant is due to retire on superannuation, the Government servant should submit the forms six months before retirement, the Head of Office should send the pension case to the PAO four months before retirement and the PAO should issue PPO and send it to CPAO one month before retirement. The CPAO is required to issue the Special Seal Authority within 21 days, thereafter.</p>



<p>2. Instructions have been issued vide this Department’s OM No 1/27/2011- P &amp;PW (E) dated 01.08.2017 for handing over the copy of pensioner PPO to him/her at the time of retirement along with other retirement dues. The Rules also provide for sanction of provisional pension in cases where a Government servant is likely to retire before finalization of his pension and gratuity.</p>



<p>3. “BHAVISHYA’, the online Pension Sanction &amp; Payment Tracking System, facilitates online tracking of pension sanction and payment process by the individual as well as the administrative authorities and keeps the retiring employees informed of the progress of pension sanction process through SMS/E-Mail. The system is, therefore, very useful for ensuring timely payment of pensionary benefits to the retiring Government servant.</p>



<p>4. In spite of the timelines prescribed in the rules/ instructions and simplification/ streamlining of the procedures through <a href="https://centralgovernmentnews.com/bhavishya-pension-sanction-payment-tracking-system/" target="_blank" rel="noreferrer noopener">BHAVISHYA</a>, issue of the PPO and payment of retirement benefits continue to be delayed in a large number of cases. A significant percentage of the grievances registered on the CPENGRAMS relate to non-payment of retirement dues for several months after retirement. Delay in settlement of retirement dues also leads to avoidable litigation. In a number of cases, the courts have directed payment of interest for the delayed period to the affected pensioners, besides making adverse comments on the functioning of the administration.</p>



<p>5. In order to ensure timely payment of retirement dues in all cases, it has been decided that the progress of the pension cases should be regularly monitored by the Heads of the organizations and the Heads of Departments. An effective monitoring mechanism is required to be established in every office/ Department to review the progress of processing of the pension cases. The information available from the BHAVISHYA software may be utilized for this purpose.</p>



<p>6. Farewell programs are often organized in the offices on the occasion of retirement of employees. This is one of the most appropriate occasions that can be utilized to review the progress of the pension cases and to sensitize the concerned staff about the importance of timely payment of retirement dues. Accordingly, in every farewell function, Heads of organizations/ Departments/ offices may review the progress of pension cases of all the employees of that organization/ Department/ office, who are due for retirement in the next six months. Wherever the processing of any pension case is found to be behind schedule, proactive action must be taken to ensure that all retirement dues are paid on time to the retiring Government servant.</p>



<p>7. A half-yearly statement may be submitted by each Department/ organization/ office to the Secretary of the administrative Ministry/ Department indicating the particulars of the Government servants in whose case issue of PPO was delayed by more than two months after retirement on superannuation. The statement may also contain the reasons for the delay in issuing the PPO and remedial action taken to avoid such delays in future.</p>

<h3 class="has-text-align-center wp-block-heading"><strong><span style="text-decoration: underline;">FOREWORD</span></strong></h3>



<p>Department of Pension and Pensioners Welfare has been leveraging technology year after year, to make the system seamless and more and more convenient for the elderly Pensioners, while taking other steps for bringing about changes in pension policy towards providing a life of dignity for them and their dependents. Some of the major initiatives/support measures taken in this regard include providing Doorstep Service for submission of Digital Life Certificate through Postal Department besides the facility to submit life certificate online through Jeevan Pramaan Portal. This is considered to be a step towards making the Pensioners “Atamnirbhar” as the DLC can now be given from the comfort of one’s home also.</p>



<p>Over the past few years, this Department has also taken a number of decisions to liberalize and simplify the rules and procedures to make the life of our honored pensioners and their dependents simpler and dignified. Rules have been relaxed for divorced daughters to receive Family Pension and now a daughter is entitled to receive the Family Pension even if the divorce has not finally taken place but the divorce petition had been filed by her during the lifetime of her deceased parent employee/ pensioner. Earlier Rule provided for payment of Family Pension to a divorced daughter only if the divorce had taken place during the lifetime of deceased parent pensioner or his spouse. The new Rule not only brings ease to the life of pension receiving individuals but also ensures respectable and equitable rights for the divorced daughters in society. Rule 64 of CCS (Pension) Rules, 1972, was relaxed in order to ensure immediate provisional sanction of pensionary benefits amid the unprecedented situation of <a href="https://centralgovernmentnews.com/tag/covid-19/" target="_blank" rel="noreferrer noopener">COVID-19</a>, wherever an employee is likely to retire before finalization of his dues or is unable to submit the pension claim form. . The Government has very recently made amendment of income criteria for grant of family pension to children/siblings suffering from a mental or physical disability.</p>



<p>While the DOPPW has been striving to bring about, from time to time, necessary changes, it is all the more important to keep the pensioners aware of various developments in the pension administration system. Keeping this in view the Department has now decided to bring about Booklet titled “Know Your Retirement Benefits”, which I am sure, will be helpful in creating awareness amongst pensioners. It will also serve as a guide for officers and dealing staff dealing with pension-related matters in Ministries/ Department/ Organisation.</p>



<p>I am happy and proud to release this Booklet of Department of Pension and Pensioners Welfare which will be a help in determining the retirement benefits entitlements of Pensioners and their dependents.</p>

<h3 class="wp-block-heading"><em>Sub: Computation of gratuity and leave encashment in the case of persons retired/ to be retired after 1.1.2020 Consequent upon the denial of DA/DR</em></h3>



<p>We invite your kind attention to the orders in F. No. 1/1/2020-E II (B) dated 23.04.2020 wherein the decision of the Government to deny the <strong><a href="https://centralgovernmentnews.com/category/dearness-allowance/" target="_blank" rel="noreferrer noopener">dearness allowance</a></strong> <strong><a href="https://centralgovernmentnews.com/category/dearness-relief/" target="_blank" rel="noreferrer noopener">dearness relief</a></strong> to the employees and pensioners respectively has been conveyed. We had written two letters in the matter on 23rd April 2020 and on 26th May 2020. The undersigned had taken up the issue also with the Cabinet Secretary. when he assured of an informal discussion in the matter with the Staff Side. However. no talks have taken place thereafter. It is not for the first time that the Government is by pausing the National Council. Staff Side. On the last occasion. when the National Council met. we had pointed out the inordinate delay in convening the meetings. We are constrained to believe that the Government wanted the negotiating body to have a burial. I am however duty bound to convey the growing resentment of the employees over this unprecedented decision. As the Government has decided to deny the dearness relief to the pensioners. the pensioner community is in great financial stress as many of them are compelled to spend exorbitant amount for the treatment of <a href="https://centralgovernmentnews.com/tag/Covid-19/" target="_blank" rel="noreferrer noopener">Covid</a>.</p>



<p>It has been brought to our notice that the <a href="https://centralgovernmentnews.com/freezing-of-dearness-allowance-to-central-government-employees-and-dearness-relief-to-central-government-pensioners-at-current-rates-till-july-2021/" target="_blank" rel="noreferrer noopener">denial of DA and freezing</a> the same forced 18 months from 1.01.2020 to 1.07.2021 has created a piquant situation for the lower level administrative functionaries to correctly compute the retirement benefits in the case of those civil servants who are retiring after the date of issue of the above cited O.M. The definition of “emoluments” for the purpose of computing the gratuity as also the leave salary (of the accumulated leave) includes Dearness allowance as admissible and not as paid or payable to the Government servant. Without exception. every administrative Department has computed the entitlement on this account only with reference to the Basic pay Dearness allowance paid or received by the concerned individual i.e 17%, Either 21% w.e.f 1-1-2020 or figure increase in percentage are not taken into account while calculating gratuity and leave salary. Since the order of the Finance Ministry clearly stipulates that the Dearness Allowance admissible to the Government servants would be restored on 1.07.2021. the computation of Gratuity and leave salary without taking into account the DA as admissible to the individual Government servant is incorrect. Annexed to this letter is an example as to how the individual loses out if the present faulty, computation procedure is followed It could be seen from the given example, the concerned Government servant will lose a staggering sum of <strong>Rs. 57116</strong> because of this faulty computation.</p>



<p>The Government is required to pass the orders as and when the DA has become due, Freezing it for certain period of time or denying it altogether for a specified duration are altogether different issues. Our objection to the adopted policy has already been conveyed to the Government. The faulty computation of Gratuity and Leave salary is not even intended by the order issued by the Government on 23rd April, 2020.</p>

<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p>(i) Orders are issued as and when the Dearness allowance has to be revised on the basis of the cost of living index;<br />(ii) Direct the administering Ministries to compute the emoluments of persons who are to retire during the period of freezing, taking the correct amount of DA as admissible to receive and not what has been paid to him for computing gratuity and leave salary<br />(iii) The orders revising the rate of DA DR are to be issued in April, 2020, before September, 2020 and again in April, 2021.</p></blockquote>
