<h3 class="wp-block-heading"><strong>Subject: Clarification regarding timely payment of GPF final payment to the retiring Government servant &#8211; regarding</strong></h3>



<p>Recently few references regarding interest on delayed payment of GPF to the retired Government have been received for clarification whether interest is payable on GPF after retirement.</p>



<p>2. In this connection, it may be stated that detailed clarifications regarding timely payment of GPF final payment to the retiring Government servant were furnished to all Ministries/Departments vide this Departments’ Office Memorandum No.3/3/2016-P&amp;PW(I) dated 16th January, 2017&nbsp;<strong>(copy enclosed)</strong>.</p>



<p>3. The per Rule 34 of General Provident Fund (Central Service) Rules, 1960 clearly provides that when the amount standing at the credit of a subscriber in the General Provident Fund becomes payable, it shall be the duty of the Accounts Officer to make payment.</p>



<p>4. It is also added the amount deposited in General Provident Fund Account is solely the asset of the individual Government servant. Any disciplinary case pending or penalty imposed against him&nbsp;<strong>does not have any impact</strong>&nbsp;on the disbursement of the GPF amount. As per Rule 11(4) of GPF Rules, in case the GPF balance is not paid on retirement, interest on the GPF balance is required to be paid for the period beyond the date of retirement also.</p>



<p>5. This issues with the approval of competent authority.</p>

<p>Subject:- <strong>Ceiling of Rs. 5 Lakh on subscription to General Provident Fund (Central Services) in a financial year &#8211; instructions regarding.</strong></p>



<p>The undersigned is directed to say that in accordance with the General Provident Fund (Central Services), Rules, 1960, the amount of subscription to the GPF in respect of a subscriber, shall not be less than 6% of the emoluments and not more than total emoluments of the subscriber. Rules 7, 8 &amp; 10 of the General Provident Fund (Central Services) Rules, 1960 were amended vide Notification No. G.S.R. 96 dated 15.06.2022. As per the said Notification dated 15.06.2022, the sum of the monthly subscription by a subscriber under the GPF during a financial year together with the amount of arrear subscriptions deposited in that financial year shall not exceed the threshold limit (at present Rupees Five Lakh) referred to in sub clause (i) of clause (c) of the Explanation below sub rule (2) of the rule 9D of the Income Tax Rules, 1962 [as inserted vide Notification No. G.S.R. 604 (E) dated 31.08.2021 of Ministry of Finance, Department of Revenue (Central Board of Direct Taxes)].</p>



<p>2. Further, instructions have been issued vide this Department’s OM No 3/6/2021-P&amp;PW (F) dated 11.10.2022 for strict implementation of the above amended provisions of the General Provident Fund (Central Services), Rules, 1960.</p>



<p>3. References have been received in this Department seeking advice as to how the GPF subscription is to be regulated in the case of those Government servants in which cases the total subscription of GPF in the current financial year (i.e 2022-23) has already exceeded the limit of Rupees Five Lakh or is likely to exceed this limit even with the minimum subscription of 6% of emoluments prescribed under General Provident Fund (Central Services), Rules, 1960.</p>



<p>4. The amendment Notification limiting the maximum annual GPF subscription was issued on 15.06.2022. A situation of annual total subscription exceeding the limit of Rupees Five Lakh in the current financial year would not have arisen if appropriate steps were taken immediately after the issue of the above amendment notification. However, keeping in view the difficulties being faced by the Ministries/ Departments, the matter has been examined and the following further instructions are issued in this regard:</p>



<ul class="wp-block-list">
<li>(a) In the case of those Government servants, whose GPF subscription during the current financial year (i.e. 2022-23) has already exceeded the threshold limit of Rs. 5 lakhs,<mark style="background-color:#feebb6" class="has-inline-color"> no further deduction of GPF subscription may be made from their salary in the current financial year</mark>. In those cases, <strong>the provision regarding minimum monthly subscription of 6% of the emoluments shall be deemed to have been relaxed.</strong></li>



<li>(b) In the case of those Government servants, whose GPF subscription during the current financial year (i.e. 2022-23) has not yet reached/exceeded the threshold limit of Rs. 5 lakh, further deductions towards GPF subscriptions during the current financial year may be phased out in such a manner that the total subscription during the current financial year does not exceed Rs. 5 lakh. In cases where the total contribution is likely to exceed Rs. 5 lakh even with minimum monthly subscription of 6% of the emoluments, deduction of GPF subscription from the salary may be stopped as soon as the total contribution in the current financial year reaches Rs. 5 lakh. <strong>In such cases also, the provision regarding minimum monthly subscription of 6% of the emoluments shall be deemed to have been relaxed.</strong></li>
</ul>



<p>5. All Ministries/Departments are requested to bring the above instructions to the notice of the all concerned for strict compliance.</p>

<p>In accordance with General Provident Fund (Central Service) Rules, 1960, the amount of subscription to the GPF in respect of a subscriber, shall not be less than 6% of the emoluments and not more than total emoluments of the subscriber. However, there was no ceiling on the total amount of subscription of a subscriber into his GPF account in a financial year.</p>



<p>2. Rules 7, 8 &amp; 10 of the General Provident Fund (Central Service) Rules, 1960 have been amended vide Notification No. G.S.R. 96 dated 15.06.2022. As per the said Notification dated 15.06.2022, the sum of the monthly subscription by a subscriber under the GPF during a financial years together with the amount of arrear subscriptions deposited in that financial year shall not exceed the threshold limit (at present Rupees Five Lakh) referred to in sub clause (i) of clause (c) of the Explanation below sub rule (2) of the rule 9D of the Income Tax Rules, 1962 [as inserted vide Notification No. G.S.R. 604 (E) dated 31.08.2021 of Ministry of Finance, Department of Revenue (Central Board of Direct Taxes)].</p>



<p>3. <h3 class="wp-block-heading">Subject: Calculation of taxable interest relating to contribution in a provident fund, exceeding specified limit w.e.f F.Y 2021-22 -reg.</h3>



<p>In pursuance of the notification issued by Department of Revenue (CBDT) dated 31st August, 2021, the interest relating to contribution in a provident fund or recognized provided fund, exceeding specified limit of Rs. five lakh in case of employee where GPF is applicable shall be part of taxable income of the subscriber w.ef. Financial year 2021-22 onwards.</p>



<p>2. In view of the aforesaid decision, the respective GPF ledger folio maintained as per CAM-47 &amp; the Annual GPF statement in form CAM-49 respectively with required changes to this effect needs to prepare by PAOs in respective nodal offices in the revised format enclosed with retrospective effect from 01.04.2021 onwards. The same are also made available to ITD for development in PFMS. The necessary amendments in chapter 6 of the Civil Account Manual (CAM) will be issued separately.</p>



<p>3. All the Pr.CCAs/CCAs/CAS(IC) in the Ministries/Departments are required to instruct nodal offices under their control to prepare GPF ledger &amp; Annual statement to be issued to subscribers in the format enclosed.</p>

<h3 class="wp-block-heading">Sub: Payment of Provisional Pension and gratuity under Rule 62 of the Central Civil Services (Pension) Rules, 2021 in case of delay in issue of PPO authorizing regular pension &#8211; reg</h3>



<p>The undersigned is directed to say that in accordance with Rule 62 of the Central Civil Services (Pension) Rules, 2021 (Rule 64 of the erstwhile Central Civil Services (Pension) Rules, 1972), the Head of Office is required to sanction a provisional pension/gratuity, in cases where a delay is anticipated in issuing a PPO authorizing regular pension. <strong>Rule 65 of the CCS (Pension) Rules, 2021 further provides that in all cases where pension/ family pension/gratuity (including provisional pension/ family pension/gratuity) has not been sanctioned or is delayed, and it is clearly established that the delay in payment was attributable to administrative reasons or lapses, interest shall be paid on arrears of pension/family pension/gratuity at the rate and in the manner as applicable to General Provident Fund amount.</strong> Every case of delayed payment of pension/family pension/gratuity in respect of employees of a Ministry or Department and the employees of its attached and subordinate offices shall be considered by the Secretary of that Ministry or Department or any other officer authorized by him, and where it is found that the delay in the payment of pension/family pension/ gratuity was caused on account of administrative reasons or lapse, interest shall be required to be paid to the affected pensioner/family pensioner. In such cases, responsibility shall be fixed and disciplinary action shall be taken against the Government servant or servants who are found responsible for the delay on account of administrative lapses.</p>



<p>2. Although as per Rule 62 of CCS(Pension) Rules, 2021, payment of provisional pension shall not continue beyond the period of six months from the date of retirement of the Government servant, the Rule further provides that the Accounts Officer shall treat the provisional pension as final and issue pension payment order immediately on the expiry of the period of six months, if the final amount of pension and gratuity have not been determined by the Head of Office in consultation with the Accounts Officer within the aforesaid period of six months.</p>



<p>3. In view of the provisions of Rule 62 of CCS (Pension) Rules, 2021 (earlier Rule 64 of CCS (Pension) Rules, 1972), the Accounts Officer has to treat the provisional pension as final and issue pension payment order immediately on the expiry of the period of six months provided in the Rule, if the final amount of pension and gratuity have not been determined by the Head of Office in consultation with the Accounts Officer within the said period. Therefore, there should not be a situation where regular pension is not authorized by the Accounts Officer to a retired Government servant on expiry of the period of six months.</p>



<p>4. All Ministries/Departments and their Account Officers are advised to strictly comply with the provisions of Rule 62 of the CCS (Pension) Rules, 2021. It is further emphasized that pension should not be discontinued under any circumstances, if, for any reason, PPO for regular pension could not be issued by the Accounts Officer till the expiry of the aforesaid period of six months.</p>

<p>Please refer MoF Department of Revenue(CBDT)’s notification No.95/2021/File No. 370142/36/2021-TPL dated 31-08-2021(Copy enclosed) regarding deduction of Income Tax on interest of GPF subscription over Rs. 5 Lakhs during the financial year 2021-22.</p>



<p><strong>2. The provisions of notification and action there of:</strong></p>



<ul class="wp-block-list"><li>(i) Exercising the powers conferred by the first proviso to clause(11) of section 10 and first proviso to clause(12) of section 10 read with section 295 of the Income-Tax Act, 1961(43 of 1961), the CBDT has inserted a <strong>Rule 9D namely Income-tax (25th Amendment) Rule 2021</strong> after Rule 9C of Income-tax Rule 1962 which stipulates Calculation of taxable interest relating to contribution in a provident fund or recognized provided fund, exceeding specified limit of Rs. 5 Lakhs.,</li><li>(ii) The interest earned on contribution above Rs. 5 Lakhs during FY 2021-22 should be treated as income from other sources for the FY 2021-22(AY 2022-23) and income tax should be deducted from salary paid during the FY 2021-22 itself. Same should be reflected in Form-16 of Fy 2021-22(AY 2022-23) accordingly.</li><li>(iii) <strong>Action on the part of DDO &amp; Fund manager:</strong> Deduction of tax will be done by DDO in consultation with fund manager and where Fund manager and DDO are separate bodies the Fund manager will calculate the interest earned on contribution as per ibid rules and inform the DDO for adjustment of tax deduction from the salary of concerned individual</li></ul>



<p>The CBDT notification mentioned above may be implemented wef 01 April 2022.</p>

<p><strong>Subject: Maintenance of General Provident Fund Accounts by the Ministries/ Departments-&nbsp;</strong><strong>reg.</strong></p>



<p>A reference is invited to the provisions of General Provident Fund (Central Services) Rules, 1960 and Chapter 6 of the Civil Accounts Manual outlining the procedure for the maintenance of GPF Account of subscribers by the Ministries/Departments. In order to ensure proper maintenance of GPF Accounts and expeditious disposal of withdrawal/final payment cases provisions of Civil Accounts Manual and the instructions issued by the Government from lime to time in this regards need to be strictly adhered to in order to prevent irregularities/ discrepancies in maintenance of GPF Accounts of subscribers and delay in disposal of final payment cases. These have also been reported during the course of Special Audit on GPF conducted by Audit Wing of the office of CGA.</p>



<p>2.&nbsp;<strong>Following checks are to be carried out by all PAOs:</strong>&nbsp;Check if there is any discrepancy in carry forwarding of closing balance to Opening Balance of the next financial year of the subscriber’s GPF account.</p>



<p>(i) Delay in final payment cases on retirement/death of a subscriber.<br />(ii) Difference between GPF broadsheet and figures as per compilation sheet.<br />(iii) Missing Debit/Credit of GPF subscription<br />(iv) Improper maintenance of GPF ledger<br />(v) Check discrepancies in Transfer-in and Transfer – out cases<br />(vi) Check discrepancies in GPF final payment cases</p>



<p>(3) Improper maintenance of GPF accounts is a serious matter and affects the balances in the GPF Accounts of the subscribers which could lead to less/ over payments to some subscribers.</p>



<p>(4) It is necessary that each transaction relating to GPF viz subscriptions’ refunds advance/withdrawal., credit of interest. transfer of GPF Accounts &amp; settlement on final payment cases by the field offices are attended to in a timely and an efficient manner.</p>



<p>(4) All the Pr.CCAs/CCAs/CAs(IC) are requested to ensure strict compliance to procedural guidelines/instructions laid down in Civil Accounts Manual in this regard. A check-list of activities for proper maintenance of the GPF Accounts 1s enclosed with this OM as Annexure-A.</p>



<p>(6) It may also be ensured that Nominations as per Rule 5 of GPF (CS) Rules,1960 are obtained and accepted by the Head of Office concerned. A review in this regard be conducted and the matter taken up with the concerned Head of Office to obtain the same.</p>

<h3 class="wp-block-heading"><strong>Check List for maintaining GPF Account:</strong></h3>



<p>1. Maintain all records pertaining to GPF viz. Broad Sheet, ledger, Classified/consolidated Abstract &amp; PBR as per laid down procedure in prescribed form. HoOs/DDOs may be asked to ensure that GPF details are maintained in manual PBR.</p>



<p>2. Review of Individual ledgers and investigation of missing credit/debits and adjustment thereof.</p>



<p>3. Proper checking of accounting for the subscriptions received through challan, the head of account; Check for any duplicity of the credits to avoid any overpayments.</p>



<p>4. Verification of interest calculation</p>



<p>5. Figures of debit and credit in GPF Broad sheet should tally with the Accounts, any mismatch to be tracked out with reasons and necessary adjustments effected in case of misclassification as per procedure.</p>



<p>6. Timely settlement of final payment cases on retirement. It may be ensured that GPF Accounts are properly settled and closed.</p>



<p>7. Dormant Account to be investigated and closed after proper scrutiny within a reasonable period to avoid the chances of any ambiguity in the subscriber’s GPF account.</p>



<p>8. Verification of all the particulars mentioned in Annual statement with the GPF ledger before issue.</p>



<p>9. To ensure the overall total booking made under GPF Head should tally with credit side inclusive of credit received through salary or challan, transfer in amount and interest accrued on the same Details of advance/withdrawal of GPF, amount of transfer out and amount of final payment made to this account</p>



<p>10.Month-wise total credits of subscribers needs to be tallied with schedules attached to salary bills/challans and posted in the Broadsheet subscriber wise.</p>



<p>11.In case of any mismatch in the figures posting in the accounts to be checked to track the discrepancies for rectification.</p>



<p>12. No entry is to be posted in account without the supporting instrument (Challan/Debit voucher/Cr. Schedules/salary bill).</p>



<p>13.Any transfer entry needs to be prepared with reasons and correct corresponding contra entry elected after verification of the related instruments.</p>



<p>14.Review of Transfer-in &amp; Transfer-out cases. Every account should be thoroughly checked before making transfer out and in of GPF balance.</p>



<p>15.Details of GPF accounts without having nominations to be track out and the matter may take up with Head of Office to obtain the nomination by GPF Subscribers as per Para 6.2 of the CAM.</p>



<p>16.Reconciliation of closing balance of GPF with the opening balance of current financial voce for the Previous Financial year.</p>



<p>17.The work relating to GPF should be processed through the GPF module of PFMS by PAO, where PFMS is implemented, and check each entry properly.</p>



<p>18. The year-end total booking under head of GPF account should be tallied in credit side with total GPF credit received through salary or Challan, transfer in amount and amount credited as interest and debit should tally with total advance/withdrawal of GPF, amount of final GPF payment and amount of transfer out of GPF cases.</p>

<h3 class="has-text-align-center wp-block-heading"><strong><span style="text-decoration: underline;">FOREWORD</span></strong></h3>



<p>Department of Pension and Pensioners Welfare has been leveraging technology year after year, to make the system seamless and more and more convenient for the elderly Pensioners, while taking other steps for bringing about changes in pension policy towards providing a life of dignity for them and their dependents. Some of the major initiatives/support measures taken in this regard include providing Doorstep Service for submission of Digital Life Certificate through Postal Department besides the facility to submit life certificate online through Jeevan Pramaan Portal. This is considered to be a step towards making the Pensioners “Atamnirbhar” as the DLC can now be given from the comfort of one’s home also.</p>



<p>Over the past few years, this Department has also taken a number of decisions to liberalize and simplify the rules and procedures to make the life of our honored pensioners and their dependents simpler and dignified. Rules have been relaxed for divorced daughters to receive Family Pension and now a daughter is entitled to receive the Family Pension even if the divorce has not finally taken place but the divorce petition had been filed by her during the lifetime of her deceased parent employee/ pensioner. Earlier Rule provided for payment of Family Pension to a divorced daughter only if the divorce had taken place during the lifetime of deceased parent pensioner or his spouse. The new Rule not only brings ease to the life of pension receiving individuals but also ensures respectable and equitable rights for the divorced daughters in society. Rule 64 of CCS (Pension) Rules, 1972, was relaxed in order to ensure immediate provisional sanction of pensionary benefits amid the unprecedented situation of <a href="https://centralgovernmentnews.com/tag/covid-19/" target="_blank" rel="noreferrer noopener">COVID-19</a>, wherever an employee is likely to retire before finalization of his dues or is unable to submit the pension claim form. . The Government has very recently made amendment of income criteria for grant of family pension to children/siblings suffering from a mental or physical disability.</p>



<p>While the DOPPW has been striving to bring about, from time to time, necessary changes, it is all the more important to keep the pensioners aware of various developments in the pension administration system. Keeping this in view the Department has now decided to bring about Booklet titled “Know Your Retirement Benefits”, which I am sure, will be helpful in creating awareness amongst pensioners. It will also serve as a guide for officers and dealing staff dealing with pension-related matters in Ministries/ Department/ Organisation.</p>



<p>I am happy and proud to release this Booklet of Department of Pension and Pensioners Welfare which will be a help in determining the retirement benefits entitlements of Pensioners and their dependents.</p>

G.O.Ms.No.386, Finance (Allowances) Department, dated 02.11.2020.<br />4. From the Government of India, Ministry of Finance, Department of Economic Affairs (Budget Division), New Delhi, Resolution No.F.No.5(2)-B(PD)/2020, dated: 06.01.2021.</p>



<p>ORDER:</p>



<p>In the Government Order first, to third read above, orders were issued regarding fixation of the rate of interest on the accumulation at the credit of the subscribers of G.P.F.(TN) during the financial year 2020-2021 as detailed below:</p>



<p>S.No .1.<br /><strong>Quarter: I</strong><br />Period: 01-04-2020 to 30-06-2020<br /><strong>Rate of Interest: 7.1%</strong></p>



<p>S.No .2.<br /><strong>Quarter: II</strong><br />Period: 01-07-2020 to 30-09-2020<br /><strong>Rate of Interest: 7.1%</strong></p>



<p>S.No .3.<br /><strong>Quarter: III</strong><br />Period: 01-10-2020 to 31-12-2020<br /><strong>Rate of Interest: 7.1%</strong></p>



<p>2. The Government of India, in its resolution fourth read above, announced that during the year 2020-2021, accumulation at the credit of subscribers to the General Provident Fund and other similar funds shall carry interest at the rate of 7.1% (Seven points one percent) with effect from 1st January 2021 to 31st March 2021.</p>



<p>3. The Government now directs that the rate of interest on the accumulation at the credit of the subscribers to General Provident Fund <a href="https://centralgovernmentnews.com/tag/GPF/" target="_blank" rel="noreferrer noopener">GPF</a> (Tamil Nadu) shall carry interest at the rate of 7.1% (Seven points one percent) with effect from 1st January 2021 to 31st March 2021.</p>



<p>4. The rate of interest on belated final payment of Provident Fund accumulation remaining unpaid for more than three months of its becoming payable shall be at the same rates as ordered in para-3 above.</p>

<p>Subject: <strong>Issuance of Annual Statement of General Provident Fund Account-reg</strong></p>



<p>As per Rule 39 of GPF Rules 1960 an annual statement of GPF is to be provided to the subscriber at the end of Financial Year.</p>



<ol class="wp-block-list" start="2"><li>The Annual Statement of <strong><a href="https://centralgovernmentnews.com/tag/GPF/">GPF</a></strong> is to be maintained in Form 49 of CAM, which includes details of missing credit/debit and also provides for acknowledging the receipt of the statement. Immediate action should be taken by Pay and Accounts Office in case any variation in the GPF annual statement is reported. The statement is to be dispatched, invariably, to the subscribers latest by the 31st of July every year as per para 6.9.2 of CAM.</li><li>Despite the laid down guidelines/ provisions on the matter, DoP&amp;PW has been receiving grievances from retired government servants regarding missing credits and delayed GPF settlement on their retirement, vide their OM No. No.3/7/2020- P&amp;PW (Desk-F) E.6574 dated 17.07.2020.</li><li>All the Pr. CCAs/CCAs/ CAs(IC) are , therefore, requested to ensure that codal provisions of GPF prescribed under GPF(CS)Rules 1960 and CAM are scrupulously complied with and annual signed statement of GPF is, invariably, issued to all the GPF subscribers.</li></ol>
