<p>Subject: <strong>Representation of Stenographers Grade &#8216;D&#8217; of Stenographer Grade &#8216;C&#8217; &amp; &#8216;D&#8217; Examination, 2010 for relaxation in the approved service and subsequently granting NFSG of GP Rs.4200/-</strong></p>
<p>The undersigned is directed to say that this Department has received several representations from the cadre units as well as from the concerned Stenographers Grade &#8216;D&#8217; of 2010 batch wherein they have requested to consider their approved service counted from 01.07.2011 instead of 01.07.2012 so that they may get the benefit of NFSG w.e.f 01.07.2016 and appear at the LDCE 2017 of PA Grade to be held in July 2017.</p>
<p>2. The said matter has been examined in this Division in consultation with Establishment Division of this Department and Department of Legal Affairs but the same could not be agreed to.</p>
<p>3. In view of the above, all the cadre units of CSSS are requested to convey the above decision to the concerned accordingly. The cadre units are also advised to follow the existing CSSS Rules/Regulations and other instructions in force while dealing with matters pertaining to above.</p>

<p>Sub: <strong>Promotion from GP Rs.1800 (Level-1) to GP Rs.1900 (Level-2) against 16-2/3% quota &#8211; Minimum eligibility Condition of service for selection.</strong></p>
<p>As the Railways are aware, in terms of Board&#8217;s letter No.E(NG)1-96/CFP/27 dated 10.10.2000, 16-2/3% of the Posts in the lowest grade of Commercial Clerks, Ticket Collectors, Trains Clerks, Offices Clerks and other categories of Clerks like stores clerks, etc. are filled by promotion of Matriculate erstwhile Group &#8216;D&#8217; employees with a minimum of two years service in the concerned seniority units entirely on merit on the basis of a competitive examination.</p>
<p>2. A question has now arisen as to whether any relaxation in two years of service condition is to be given to SC/ST candidates to appear in the selection for promotion from GP Rs.1800 (Level-1) to GP Rs.1900 (Level-2) against 16-2/3% quota being filled up on the basis of merit.</p>
<p>3. Accordingly, it is clarified that SC/ST employees in GP Rs.1800 (Level-1) will be eligible for consideration in the selection for promotion to GP Rs.1900 (Level-2) and above against 16-2/3% promotion quota, only on completion of two years regular service in the concerned seniority unit.</p>

<p>Sub: <strong>Reckoning GP 4200/- PB-2 as entry grade pay for granting financial upgradation under MACPS to the Pharmacist category &#8211; reg.</strong></p>
<p>Ref: (i) NFIR&#8217;s letter No. IV/MACPS/09/Part 10 dated 30/08/2016 and<br />
22/12/2016.</p>
<p>(ii) Railway Board&#8217;s reply vide No. PC-V/2011/M/NFIR dated<br />
24/01/2017<br />
Federation does not agree with the view taken by the Railway Board by misinterpretation of the contents of DoP&amp;T&#8217;s OM dated 4th Feb 1992. In this connection, Federation once again cites below the facts which have been ignored by the Board while considering the demand:</p>
<ul>
<li>It is true that vide para 2 of the said OM, while the DoP&amp;T has laid down criteria for assessing the suitability of the incumbents of the posts due to revision of pay scales/upgradation, at the same time in sub-para 2 of the same OM, it has been clarified that  where the upgradation involves replacement scale without higher responsibilities or higher qualification but with higher eligibility of service, in such situation suitability may not be assessed.</li>
<li>It has been further clarified that those who fulfill the criteria of qualifying service, should be appointed to the upgraded post from the date on which they complete the qualifying service.</li>
<li>The condition stipulated in sub-para 2 of DoP&amp;T&#8217;s OM dated 4th Feb 1992 has been fulfilled by the Pharmacists who though recruited in GP 2800 have been appointed to GP 4200 (6th CPC) on completion of 2 years service in GP 2800/- (PB-1).</li>
</ul>
<p>The plea taken by the Railway Board that the said OM of DoP&amp;T is applicable for assessing the suitability of the incumbents, is therefore, misconceived, illogical and unjustified. On the other hand, the case of Pharmacists for granting MACP benefit is required to be dealt applying the provisions contained in the DoP&amp;T&#8217;s OM dated 4th Feb,1992.</p>
<p>NFIR, therefore, requests the Railway instructions to the Zones etc., allowing MACP endorsed to the Federation.</p>

Federation desires to invite kind attention of the General Manager to the instructions issued by the Railway Board vide letter No. 2002lAC-IV37l8 dated lTllI/2004 and No. 2002/AC-II(CC)/37/8 dated 16/11/2006, re-organizing the staffing pattern of EDP Centres &#8220;as information Technology Cadre&#8221; classifying the posts as JE(IT), SSE (IT) etc.,<br />
Federation has come across with a notification issued by the FA &amp; CAO/MAS vide letter No. P(S)/135/XV/SRIPC/HqrsA/oI. I dated 2210412016 for filling up of two posts of JE (IT) &#8211; ex cadre on TVC Division of Southern Railway and inviting applications from the willing staff of all departments. NFIR encloses a copy of the said notification with its enclosures for ready reference.</p>
<p>Federation is disappointed to note that a period of over 12 years have passed, the Southern Railway Administration does not appear to have taken action to form IT cadre for</p>
<p>granting benefit of promotion to the staff. While the action of Southern Railway Administration is in violation of extant instructions of the Railway Board, the same is disadvantageous to the staff whose promotional opportunities are adversely affected due to wrong classification of the , post ofJE (IT) as ex-cadre.</p>
<p>NFIR, therefore, requests the General Manager kindly intervene and see that the posts of JE (IT) on TVC Division of Southern Railway are filled up strictly according to the instructions issued by the Railway Board duly treating the same as cadre posts and not as ex-cadre. Action taken in the matter mav be advised to the Federation.</p>

<p>8.17.6 The periodicity of reimbursement is restricted to once in three years. No demands have been received regarding this allowance.</p>
<p><strong>Analysis and Recommendations</strong></p>
<p>8.17.7 <em><strong>The Commission is of the view that the present rates are adequate However, the ceiling shall further increase by 25 percent each time DA increases by 50 percent</strong></em></p>
