										<content:encoded><![CDATA[<p><strong>Cabinet approves special package for employment generation and promotion of exports in Textile and Apparel sector</strong><br />
The Union Cabinet under the Chairmanship of Prime Minister Shri Narendra Modi has given approval for a special package for employment generation and promotion of exports in Textile and Apparel sector.</p>
<p>The move comes in the backdrop of the package of reforms announced by the Government for generation of one crore jobs in the textile and apparel industry over next 3 years. The package includes a slew of measures which are labour friendly and would promote employment generation, economies of scale and boost exports. The steps will lead to a cumulative increase of US$ 30 bn. in exports and investment of Rs. 74,000 crores over next 3 years.</p>
<p>The majority of new jobs are likely to go to women since the garment industry employs nearly 70% women workforce. Thus, the package would help in social transformation through women empowerment.</p>
<p><strong>Salient features of the package announced are:</strong></p>
<p><strong>A. Employee Provident Fund Scheme Reforms</strong></p>
<ul>
<li>Govt. of India shall bear the entire 12% of the employers’ contribution of the Employers Provident Fund Scheme for new employees of garment industry for first 3 years who are earning less than Rs. 15,000 per month.</li>
<li>At present, 8.33% of employer’s contribution is already being provided by Government under Pradhan Mantri Rozgar Protsahan Yojana (PMRPY). Ministry of Textiles shall provide additional 3.67% of the employer’s contribution amounting to Rs. 1,170 crores over next 3 years.</li>
<li>EPF shall be made optional for employees earning less than Rs. 15,000 per month</li>
<li>This shall leave more money in the hands of the workers and also promote employment in the formal sector.</li>
</ul>
<p><strong>B. Increasing overtime caps</strong></p>
<ul>
<li>Overtime hours for workers not to exceed 8 hours per week in line with ILO norms.</li>
<li>This shall lead to increased earnings for the workers</li>
</ul>
<p><strong>C. Introduction of fixed term employment</strong></p>
<ul>
<li>Looking to the seasonal nature of the industry, fixed term employment shall be introduced for the garment sector</li>
<li>A fixed term workman will be considered at par with permanent workman in terms of working hours, wages, allowance and other statutory dues.</li>
</ul>
<p><strong>D. Additional incentives under ATUFS</strong></p>
<ul>
<li>The package breaks new ground in moving from input to outcome based incentives by increasing subsidy under Amended-TUFS from 15% to 25% for the garment sector as a boost to employment generation.</li>
<li>A unique feature of the scheme will be to disburse the subsidy only after the expected jobs are created.</li>
</ul>
<p><strong>E. Enhanced duty drawback coverage</strong></p>
<ul>
<li>In a first of its kind move, a new scheme will be introduced to refund the state levies which were not refunded so far.</li>
<li>This move is expected to cost the exchequer Rs 5500 crores but will greatly boost the competitiveness of Indian exports in foreign markets.</li>
<li>Drawback at All Industries Rate to be given for domestic duty paid inputs even when fabrics are imported under Advance Authorization Scheme</li>
</ul>
<p><strong>F. Enhancing scope of Section 80JJAA of Income Tax Act</strong></p>
<ul>
<li>Looking at the seasonal nature of garment industry, the provision of 240 days under Section 80JJAA of Income Tax Act would be relaxed to 150 days for garment industry</li>

<p>Department of Personnel and Training, Govt. of India is organising regular Yoga Training Sessions from 1st April 2015 for the benefit of Central Government Employees and their dependents at Grih kalyan Kendra (GKK), Samaj Sadan as per enclosed list in assoaciation with Morarji Desai National Institute of Yoga, New Delhi. No registration/ training fees will be charged.</p>

<p>DPCs often do not consider such eligible officers who are retiring before the occurrence of the vacancy in the panel year. These undesirable trends negate the very purpose of the above said Office Memorandum No. 22011/4/98-Estt(D) dated October 12, 1998 and it is also against the principle of natural justice.</p>

<p>Subject: – <strong>Inclusion of eligible officers who are due to retire before the likely date of vacancies, in the panel for promotion-Regarding</strong></p>
<p>The undersigned is directed to invite reference to the Department of Personnel and Training Office Memorandum No. 22011/4/98-Estt(D) dated October 12, 1998 regarding consideration of retired employees who were within the zone of consideration in the relevant year(s) but are not actually in service when the DPC is being held. The said OM provides as follows:-</p>
<p>“…….There is no specific bar in the aforesaid Office Memorandum dated April 10, 1989 or any other related instructions of the Department of Personnel and Training for consideration of retired employees, while preparing year-wise panel(s), who were within the zone of consideration in the relevant year(s). According to legal opinion also it would not be in order if eligible employees, who were within the zone of consideration for the relevant year(s) but are not actually in service when the DPC is being held, are not considered while preparing year-wise zone of consideration/panel and, consequently, their juniors are considered (in their places), who would not have been in the zone of consideration if the DPC(s) had been held in time. This is considered imperative to identify the correct zone of consideration for relevant Year(s). Names of the retired officials may also be included in the panel(s). Such retired officials would, however, have no justify for actual promotion. The DPC(s) may, if need be, prepare extended panel(s) following the principles prescribed in the Department of Personnel and  Training Office Memorandum No.22011/8/87-Estt.(D) dated April 9, 1996.”</p>
<p>Appointment Committee of Cabinet has observed that DPCs often do not consider such eligible officers who are retiring before the occurrence of the vacancy in the panel year. These undesirable trends negate the very purpose of the above said Office Memorandum No. 22011/4/98-Estt(D) dated October 12, 1998 and it is also against the principle of natural justice.</p>
<p>3. All the Ministries/Departments are therefore advised to ensure strict compliance of the instructions of the Department of Personnel &amp; Training issued vide this Department’s OM No. 22011/4/98-Estt(D) dated October 12, 1998.</p>
<p>4. These instructions may please be brought out to the notice of all concerned including attached and subordinate offices.</p>

<p style="text-align: right;">New Delhi,18 Sept4 2014</p>
<p><strong>Shri Shiva Gopal Mishra,</strong> General Secretary, All India Railwaymen’s Federation said that inspite of the continuous negotiation with the Government of India &amp; Railway Ministry, the genuine pending demands of the Ratiwaymen has not so far been resolved &amp; lying as unattended.</p>
<p>Shri. Mishra further said that the 36 points charter of demands was discussed in the Central Council Meeting of AIRF on 3-4 July 2014 at and also on Working committee Meeting of AIRF held on 25-26 Aug, 2014 at Nanital, where the serious concern over the 36 point Charter of demand were engaged the attention of all members. The major demands are as regards- Scrapping New Pension Scheme, Filing up of the lakh of the Vacancies in Railways, Stop privatization &amp; contractization in Railways, Removal of the ceiling limit of Rs. 3500/- for calculation of the Productivity Linked Bonus, Removal of anomalies of VI CPC, Merger of Dearness Allowances, Interim Relief not yet granted although, the demand were raised in JCM forum, Redressai of pending problems of Running staff, stop Anti labour amendment in the various labour laws such as I.D Act. Factory Act, and Apprentice Act etc, Employment of ward of Railway employees.  Exemption limit on Income Tax be raised to Rs. 5 Lakh, Provision of basic amentias to the women workers at their work place etc,</p>
<p>Shri Mishra further mentioned that there is great resentment amongst the Railway Workers on the account of the unattended charter of demands in general and FDI, PPP in particular. The FDI, will definitely not be beneficial to the Indian Railway system and the Government decision is aimed to divide the activities of Railway into two different mode of functioning and hand it over to Multi National Private Companies through this dis-investmeflt &amp; Privatization.</p>
<p>The Anti labour attitude of the Railway Ministry &amp; Govt. of India has compelled us to organize a countrywide “<strong>Jan Jagran Abhiyan</strong>” from<strong> 3rd to 18 Sept, 2014</strong> in all over Indian Railway by AIRF affiliates and on <strong>19th Sept, 2014</strong> the countrywide “<strong>All India Protest Day”</strong> wifl be organized in front of All the Administrative Officers of Zonal Railway, workshop, Production units, station etc,. if the genuine demands of the Railwaymen are not addressed properly by the Govt of India and Railway Ministry, the Railway employee will be compelled to March for indefinite Strike as done in the past in year of 1974 for which Govt. of India / Railway Ministry will be responsible.</p>
