Sub: Dispensation of conditions of applying for Government Accommodation and furnishing of ‘No Accommodation Certificate’ for admissibility of House Rent Allowance.

Reference is invited to Govt. of India, Ministry of Finance, Department of Expenditure Office Memorandum No. 2/5/2017-E.IIB dated 05.03.2019 (copy attached) wherein the Ministry has dispensed with the condition of applying for Government Accommodation and furnishing of ‘No Accommodation Certificate’ by Central Government employees to become eligible for HRA, in respect of General Pool Residential Accommodation (GPRA) controlled by Directorate of Estate, Ministry of Housing and Urban Affairs. It has been further stipulated in the ibid Office Memorandum that Ministries/Departments having their separate pool of residential accommodation for their employees other than GPRA, have been suggested to adopt these provision, wherever feasible.

Accordingly, comments from PCDA/ CDA/ Estate Officers were called for and the matter was under consideration at this office. Now, in terms of rules contained in Allotment of DAD Pool Residential Accommodation Rules, 2019, it has been decided with the approval of Competent Authority that the provision of Govt. of India, Ministry of Finance, Department of Expenditure Office Memorandum No. 2/5/2017-E.IIB dated 05.03.2019 shall be applied to DAD Pool Residential Accommodations except Reserved or Appointment accommodation at various stations pan India with retrospective effect ie. w.e.f. 05.03.2019, the date of issue of ibid orders.

PCDA/ CDA/ Estate Officers are therefore requested to apply the ibid Office Memorandum dated 05.03.2019 on DAD Pool Residential Accommodations except Reserved or Appointment accommodation and dispense with the conditions of applying for Government Accommodation and furnishing of ‘No Accommodation Certificate’ for admissibility of House Rent Allowance w.e.f. 05.03.2019.

Sub: Grant of additional HRA to CAPF personnel on their transfer to non-family locations in the event of their vacation of Government accommodation retained by them after 3 years.

The undersigned is directed to say that a proposal for grant of HRA of Old Station/Selected Place of Residence, in addition to the HRA admissible at the new place of posting, to CAPF personnel on their-transfer to non-family locations, vjz. North Eastern Region, Sikkim, Andaman & Nicobar Islands, Lakshadweep Islands, State of Jarnmu & Kashrnir and Left Wing Extremist (LWE) areas, in the event of their vacation of Government accommodation retained by them after 3 years, as per Ministry of Housing & Urban Affairs OM No. 12035/4/2015-Pol.II dated 14.11.2017 and 01.08.2018, till they remain posted in such non-family stations, was examined in this Ministry in consultation with Ministry of Finance (Department of Expenditure), and it has agreed to:-

(i) allow HRA, on vacation of the Government accommodation by families of CAPF personnel after 3 years retention period, who are posted in non-family stations/locations (as defined by M/o Housing & Urban Affairs in their OM dated 01/08/2018) , in addition to the HRA admissible at the new place of posting.

(ii) relax the mandatory provision of keeping families of CAPF personnel at last place of posting for allowing I-IRA at the rate of Selected Place of Residence.

This issues with the approval of Ministry of Finance (Department of Expenditure), vide their ID No.28/2/2018-E.II(B) dated 18.01.2019 and as vetted by Integrated Finance Division of this Ministry vide their Dy No.3437419 dated 22.01.2019.

1. Ministry in their ID has stated that the committee on Allowances headed by the Finance Secretary and Secretary (Expenditure) has desired that the information relating to occupancy of Govt. Accommodation and the officers/officials HRA (not allotted Govt. accommodation) may be obtained.

Subject: Guidelines on regularization/ allotment of alternate general pool residential accommodation in the name of the eligible spouse / ward of the allottee in the event of death/retirement/transfer of the allottee.

Vide instructions of this Directorate O.M. of even number dated 18.2.2014, guidelines on regularization / allotment of alternate general pool residential accommodation in the name of the eligible spouse / ward of the allottee in the event of death/retirement/transfer of the allottee were issued. On review of the said guidelines, it is found that the issue related to regularization of general pool residential accommodation in the name of eligible spouse/ward of allottee, who owns a house at the place of posting or his / her family owns a house at the place of posting, but his /her policy is covered by allotment of that house has not been inadvertently incorporated in the OM dated 18.2.2014.

2. Therefore, paragraph 2(iv)(f)(i) of the said guidelines is modified and shall be read as below instead of existing entries in the OM dated 18.2.2014:

“Where the allottee or any member of his / her family owns a house at the place of posting where regularization is being sought. However, either one type below accommodation or same accommodation may be regularized in the name of ward / spouse only in case his / her date of priority was covered on the date of retirement of the retiring allottee or on the date of death of the deceased allottee, irrespective of the fact that they are house-owner at the place of their posting subject to the condition that the licence fee is charged on house owing allottees of general pool residential accommodation as per the guidelines from time to time; and.”

Sub: Extension of the period of retention of Railway accommodation at the previous place of posting in favour of officers/staff posted to ECR & NWR.

Ref: Board’s letter No.E(G)2009 QR-1-2 dated 07.05.2014.

The issue of permitting the Railway Officers/Staff posted in the ECR and NWR to retain Railway quarters at their previous places of posting has been considered by the Board.

2. In exercise of its powers to make reasonable relaxations in public interest for a class/group of employees, in all or any of the existing provisions regarding house allotment/retention, the Board have decided that permission for retention of Railway accommodation at the previous place of posting in favour of officers/staff posted to LCR and NWR be granted up to 31.12.2015 in supersession of Board’s earlier instructions dated 07.05.2014.

3. This issues with the concurrence of Finance Directorate of the Ministry of Railways.

Sub: Guidelines for discretionary out of turn allotments of general pool residential accommodation in Delhi — allotment of ground floor residential accommodation to the applicants with disabilities under discretionary quota on medical grounds.

The undersigned is directed to refer to Department of Personnel and Training OM. No.36O35/3/2013.Es(Res) dated 31.3.2014 and to say that it has been decided by the competent authority that preferably ground floor accommodation will be allotted to the applicants with disabilities under the discretionary allotments on out of turn basis on medical grounds as per the extant guidelines of the Directorate of Estates issued vide O.M.No.12035/2/97Pol(pt) dated 17.11.1997.

OFFICE MEMORANDUM

Subject: Retention of General Pool Residential Accommodation by Central Government Civilian Employees and Officers of All India Services posted to State of Jammu & Kashmir – extension upto 30.6.2015.

Reference is invited to this Directorate O.M .No.12035 / 2/ 90-Pol.lI(Pt.II) dated 15.9.1993 and subsequent instructions dated 26.7.1999, 25.5.2002, 31.10.2005, 5.6.2003 and 3.6.2011 regarding retention of General Pool Residential Accommodation at the last place of posting by Central Government Civilian Employees and Officers of All India Services on posting to the State of Jammu & Kashmir. The existing orders on the subject are valid up to 30.6.2014 and further extension beyond 30.6.2014 has been considered by the competent authority. It has now been decided to further extend allowing retention of General Pool Residential Accommodation at the last place of posting by Central Government Civilian Employees and Officers of All India Services on their posting to State of Jammu Kashmir for a period of one year, i.e. up to 30.06.2015.

2. Since the retention/ allotment of alternate Govt. accommodation is allowed for bonafide use of the dependent family of the transferred government servant, he/ she will furnish a certificate on 1st July and st January of every year, stating that his/her dependent family members are actually residing in the Government accommodation at the last place of posting. Such a certificate will also have to be furnished at the time of seeking retention. In case no such certificate is received by 31st January and 31st  July every year respectively, this Directorate will be constrained to cancel the allotment of the residence in question.

3. The request for retention of entitled type of accommodation should be received within a period of one month from the date of relinquishing of charge at the last place of posting so that further necessary action could be initiated by the Directorate of Estates in Time.
