<p class="has-text-align-center"><strong>ORDER</strong></p>



<p class="has-text-align-right">New Delhi, the 3rdApril, 2020</p>



<p><strong>S.O. 1245(E).-</strong> In exercise of the powers conferred by section 96 of the Jammu and Kashmir Reorganisation Act, 2019 (34 of 2019), and of all other powers enabling it in that behalf, the Central Government hereby makes the following Order in respect of the Union territory of Jammu and Kashmir, namely:-</p>



<p>1. (1)This Order may be called the Jammu and Kashmir Reorganisation (Adaptation of State Laws) Second Order, 2020.</p>



<p>(2) It shall come into force with immediate effect.</p>



<p>2. The General Clauses Act, 1897 applies for the interpretation of this Order as it applies for the interpretation of laws in force in the territory of India.</p>



<p>3.With immediate effect, the Act mentioned in the Schedule to this Order shall, until repealed or amended by a competent Legislature or other competent authority, have effect, subject to the adaptations and modifications directed by the Schedule to this Order.</p>

<p class="has-text-align-center">1. <strong>THE JAMMU AND KASHMIR CIVIL SERVICES (DECENTRALIZATION AND RECRUITMENT) ACT</strong></p>



<p class="has-text-align-center"><strong>(Act No.XVI of 2010)</strong></p>



<p><strong>Section 3A</strong>.-</p>



<p>(i) In sub-section (1): &#8211;</p>



<p>(a) omit &#8220;deemed to be&#8221; and &#8220;carrying a pay scale of not more than Level-4 (25500)&#8221;, and</p>



<p>(ii) in sub-section (2) :-</p>



<p>(a) omit &#8220;deemed to be&#8221;; and<br />(b) in clause (a), for ―have served&#8221; substitute &#8220;shall have served</p>



<p>&#8220;<strong>Section 5A</strong>.- for &#8220;a post carrying a pay scale of not more than Level-4 (25500)&#8221; substitute &#8220;any post&#8221;</p>



<p><strong>Section 8</strong>.- before clause (ii), add:-</p>



<p>“(i) is a domicile of Union territory of Jammu and Kashmir”</p>

										<content:encoded><![CDATA[<p><strong>Government plans to abolish posts vacant for 5 years</strong></p>
<p>The government is planning to abolish all posts which have been vacant for more than five years, and has directed all ministries and department to submit a comprehensive report on the matter.</p>
<p>In an office memorandum, the Finance Ministry said it had asked all ministries and departments to submit an action-taken report regarding abolition of posts vacant for more than five years.</p>
<p>Some departments and ministries have responded but some, instead of providing a comprehensive report, have submitted the requisite information in piecemeal manner, it said.</p>
<p>Therefore, financial advisors and joint secretaries (administration) of all ministries/ departments are requested to identify the posts which are vacant for more than five years and submit a comprehensive report on abolition of such posts in main ministry and their respective subordinate organisations at the earliest, the office memorandum, dated January 16, 2018, said.</p>
<p>Following this, the Ministry of Home Affairs has directed all its additional secretaries, joint secretaries, chiefs of paramilitary forces and other attached organisations to submit comprehensive reports, a home ministry official told PTI.</p>
<p>According to a preliminary estimate, there are several thousand central government posts which are lying vacant for five or more years, the official said.</p>

<p>The Government posts are to be filled in accordance with the recruitment rules. Wherever recruitment rules provide reemployment as a mode of recruitment or in cases of exigencies of work, retired Government servants are reappointed on contractual basis for a specific period.</p>
<p>The Central Civil Services (Fixation of Pay of re-employed Pensioners) orders, 1986 as amended from time to time govern the pay fixation of re-employed pensioners including the persons re-employed on contract basis, unless the contract provides otherwise. The interests of serving employees with regard to promotions/financial upgradations to higher post are taken care of by the respective service rules/regulations applicable to them.</p>
<p>This was stated by the Union Minister of State (Independent Charge) for Development of North Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances, Pensions, Atomic Energy and Space Dr. Jitendra Singh in a written reply to a question by Shri M.P.Veerendra Kumar in the Rajya Sabha today.</p>
