<p>As you are all aware that the Government accommodation can be availed based on the grade pay. That the details of the content are reproduced here for ready reference.</p>



<p><em>The Grade Pay of an officer in his current post in the Government of India will be used to assess his eligibility for Government accommodation.</em></p>



<p>According to SR 317-B-5, the following are the various categories of residences based on the grade pay.</p>

<p>(a) Eligibility of an officer for Government accommodation shall be determined as per the Grade Pay of such officer in his present post held in the Government of India,</p>



<p>(b) Date of priority in respect of lower type accommodation i.e. Type-I to TypeIV shall be the date of joining the service in the Government of India.</p>



<p>(c) The inter-seniority for the higher type accommodation shall be considered on the basis of following principles, namely:</p>

<ul class="wp-block-list">
<li>(i) Firstly the Grade Pay of the Officer;</li>



<li>(ii) Secondly the priority dates within the same Grade-Pay. In this case the priority date shall be the date from which the applicant continuously drawing his existing Grade Pay;</li>



<li>(iii) Where the priority date of two or more officers is the same, the inter-seniority of the officers shall be determined on the basis of the basic pay i.e. the officer who have a higher pay shall be senior in the waiting list;</li>



<li>(iv) Where the priority date and the basic pay of two or more officers are the same, the earlier date of joining in the service of the Government of India shall be the next determining principle of inter-seniority.</li>



<li>(v) where the priority date, basic pay, and the date of joining in the service of the Government of India of two or more officers are the same, the officers retiring earlier may be accorded higher priority over the officer retiring later.</li>
</ul>



<p>(d) The principle of determining the inter-seniority of two or more officers as specified in sub-clause (ii) of clause (c) shall be implemented from the 1st January 2010.</p>



<p>(e) where Type-V and Type VI accommodation has not been classified as Type V-A and type V-B and type-VI-A and type-VI-B respectively, all the officers eligible for type -V shall be grouped together and similarly those eligible for type -VI shall also be grouped together,</p>



<p>(f) in the case of Secretaries to the Government of India and Additional Secretaries to the Government of India, the date of joining in the Government of India at Delhi shall determine their inter-seniority subject to the condition that no junior batch officer of the same service shall get priority over his senior batch officer. Where the date of joining is the same, the date of retirement shall determine their inter-seniority on the principle that the earlier date of joining the Government of India, irrespective of the place of posting and service/batch seniority, shall determine the inter-seniority.</p>



<p>(g) officer entitled for Type-V and above accommodation shall also be eligible to apply for accommodation below entitlement subject to the condition that such accommodation shall not be below type-IV Special accommodation.</p>

<p>It has been decided by the competent authority that allotment of type VII and type VIII house will be made by the Minister of Urban Development keeping in view the functional necessity, criticality/sensitivity of the post held, urgency in requirement of houses by the eligible high dignitaries and such allotments would not entail the imposition of an enhanced rate of license fee upon allottees which are working on very sensitive posts having a lot of responsibility on behalf of the Government. <p>Ministry of Housing and Urban Affairs, vide their OM No.12035/2/2020-Pol-II dated 31.05.2020 has allowed suo-motu retention for the period from 17.03.2020 to for the allottees under the Central Government General Pool Residential Accommodation (<strong>CGGPRA</strong>) Rules 2017. This suo-moto retention has been further extended up to 30.06.2020 by the Ministry of Housing and Urban Affairs vide their OM dated 05.05 2020</p>

<p>2. Keeping in view the above, <strong>Board have decided to allow suo-motu retention of railway accommodation by officers/staff for the period from 17.03.2020 to 30.06.2020</strong>. The suo-motu retention period will be on payment of licence fees as applicable to the allottees under these rules. No damage rent will be charged for this period. These relaxations will be given to such allottees also where she/he has become unauthorized occupant of government accommodation before 17.03.2020. However, in such cases, after the retention period up to 30.06.2020, the damage charges at telescopic rates, as was continuing prior to this period, will be resumed.</p>



<p>3. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.</p>

<p>Sub: <strong>Dispensation of conditions of applying for Government Accommodation and furnishing of ‘No Accommodation Certificate’ for admissibility of House Rent Allowance.</strong></p>



<p>Reference is invited to Govt. of India, Ministry of Finance, Department of Expenditure Office Memorandum No. 2/5/2017-E.IIB dated 05.03.2019 (copy attached) wherein the Ministry has dispensed with the condition of applying for Government Accommodation and furnishing of ‘<strong>No Accommodation Certificate</strong>’ by Central Government employees to become eligible for <a rel="noreferrer noopener" aria-label="HRA (opens in a new tab)" href="https://centralgovernmentnews.com/category/hra/" target="_blank">HRA</a>, in respect of General Pool Residential Accommodation (GPRA) controlled by Directorate of Estate, Ministry of Housing and Urban Affairs. It has been further stipulated in the ibid Office Memorandum that Ministries/Departments having their separate pool of residential accommodation for their employees other than GPRA, have been suggested to adopt these provision, wherever feasible.</p>

<p>Accordingly, comments from PCDA/ CDA/ Estate Officers were called for and the matter was under consideration at this office. Now, in terms of rules contained in Allotment of DAD Pool Residential Accommodation Rules, 2019, it has been decided with the approval of Competent Authority that the provision of Govt. of India, Ministry of Finance, Department of Expenditure Office Memorandum No. 2/5/2017-E.IIB dated 05.03.2019 shall be applied to DAD Pool Residential Accommodations except Reserved or Appointment accommodation at various stations pan India with retrospective effect ie. w.e.f. 05.03.2019, the date of issue of ibid orders.</p>



<p>PCDA/ CDA/ Estate Officers are therefore requested to apply the ibid Office Memorandum dated 05.03.2019 on DAD Pool Residential Accommodations except Reserved or Appointment accommodation and dispense with the conditions of applying for Government Accommodation and furnishing of ‘<strong>No Accommodation Certificate</strong>’ for admissibility of House Rent Allowance w.e.f. 05.03.2019.</p>

 Whether the Government has any proposal for retention of the Government
 accommodation by the Central Government servants after retirement, on 
payment of suitable rent, at least till the lifetime of the Central 
Government servant, especially in cases related to medical and education
 of children;</p>



<p>(b) If so, the details thereof; and</p>



<p>(c) If not, the reasons therefor?</p>

<p>(b) Does not arise in view of reply to (a) above.</p>



<p>(c)
 As per Rule 40(1)(ii) of Central Government General Pool Residential 
Accommodation (CGGPRA) Rules, 2017, on retirement, a central Government 
employee who is an allottee of General Pool Residential Accommodation 
(GPRA), can retain Government Accommodation for six months on payment of
 normal license fee. </p>

<p>Subject: <strong>Dispensation of conditions of applying for Government Accommodation and furnishing of &#8216;No Accommodation Certificate&#8217; for admissibility of House Rent Allowance.</strong></p>



<p>Several references are being received in this Department to review the condition of applying for Government Accommodation and fumishing of &#8216;No Accommodation Certificate&#8217; for admissibility of House Rent Allowance as contained in Para 4(a) of this Department&#8217;s. a,M, No, 2(37)-E.lI(B)/64 dated 27.11.1965 read with Para 1 (1) of a,M, No, 11011/1/E.II(B)/75 dated 25.02.1977.</p>



<p>The matter has been examined in this Department and in supersession of Para 4(a) of this Department&#8217;s O,M, No, 2(37)-E,II(B)/64 dated 27.11.1965 read with Para 1.(1) of O.M. No, 11011/1/E, II(B)/75  dated 25.02,1977 and to simplify the procedure relating to grant of House Rent Allowance to Central Government employees, the President, in consultation with Ministry .of Housing and Urban Affairs and the Staff Side of the National Council (J,C.M,), is pleased to decide that the conditions of applying for Government Accommodation and furnishing of &#8216;No Accommodation Certificate&#8217; by Central Government employees to become eligible for House Rent Allowance, are  dispensed with for all places, in respect of General Pool Residential Accommodation(GPRA) controlled  by Directorate of Estates.</p>



<p>3, Ministries/Departrnents having their separate pool of residential accommodation for their employees other than GPRA, may adopt these provisions, wherever feasible.</p>



<p>4, These orders shall be effective from the date of issue of the orders.</p>



<p>5, In so far as the persons serving in the Indian Audit and Accounts Department are concerned, these orders issue in consultation with the Comptroller &amp; Auditor General of India.</p>

<p>Sub:<strong> Grant of additional HRA to CAPF personnel on their transfer to non-family locations in the event of their vacation of Government accommodation retained by them after 3 years.</strong></p>



<p>The undersigned is directed to say that a proposal for grant of HRA of Old Station/Selected Place of Residence, in addition to the HRA admissible at the new place of posting, to CAPF personnel on their-transfer to non-family locations, vjz. North Eastern Region, Sikkim, Andaman &amp; Nicobar Islands, Lakshadweep Islands, State of Jarnmu &amp; Kashrnir and Left Wing Extremist (LWE) areas, in the event of their vacation of Government accommodation retained by them after 3 years, as per Ministry of Housing &amp; Urban Affairs OM No. 12035/4/2015-Pol.II dated 14.11.2017 and 01.08.2018, till they remain posted in such non-family stations, was examined in this Ministry in consultation with Ministry of Finance (Department of Expenditure), and it has agreed to:- </p>



<p>(i) allow HRA, on vacation of the Government accommodation by families of CAPF personnel after 3 years retention period, who are posted in non-family stations/locations (as defined by M/o Housing &amp; Urban Affairs in their OM dated 01/08/2018) , in addition to the HRA admissible at the new place of posting.</p>



<p>(ii) relax the mandatory provision of keeping families of CAPF personnel at last place of posting for allowing I-IRA at the rate of Selected Place of Residence.</p>



<p>This issues with the approval of Ministry of Finance (Department of Expenditure), vide their ID No.28/2/2018-E.II(B) dated 18.01.2019 and as vetted by Integrated Finance Division of this Ministry vide their Dy No.3437419 dated 22.01.2019. </p>

<p>Subject: <strong>Clarification regarding the term &#8216;Non-Family Station&#8217; in respect of concessional retention given under Rule 43 of CGGPRA Rules, 2017.</strong></p>
<p>In continuation to the OM. of even Number dated 10.4.2018 vide which the concessional retention of General Pool Residential Accommodation at the last place of posting by Central Government Civilian Employees, Centrally Armed Paramilitary Forces employees and officers of All India Services on their posting to a Non-family stations was extended up to 30.06.2021 on payment of normal rate of licence fee, it is further clarified that the term &#8216;Non Family station&#8217; includes:</p>
<blockquote><p>(i) North Eastern Region, Sikkim, Andaman &amp; Nicobar Islands and Lakshadweep, State of Jammu &amp; Kashmir</p>
<p>(ii) Left Wing Extremist (LWE) areas, as declared by Ministry of Home Affairs from time to time.</p></blockquote>
<p>2. All the other terms and conditions of OM dated 10.4.2018 will remain unchanged.</p>

<p>Subject: <strong>Filling up the post of Financial Adviser in National Company Law Tribunal (NCLT) under the , Ministry of Corporate Affairs</strong>.</p>
<p>&nbsp;</p>
<p>This is regarding filling up the post of Financial Adviser in NCLT under the Ministry of Corporate Affairs on deputation basis.</p>
<p>2. Officers of the rank of Deputy Secretary/Director level from any Organized Finance &amp; Accounts Service of the Government of India or equivalent level, eligible for appointment under Central Staffing Scheme are eligible for the post. The period of deputation is 4/5 years at Deputy Secretary/Director level respectively.</p>
<p>3. The post may be circulated amongst officers eligible to be appointed at Deputy Secretary/Director or equivalent levels in the Government of India on priority basis. Names of willing and eligible officers who can be spared by the Ministries/Departments may be forwarded to this Department along with cadre clearance, vigilance clearance, detailed bio-data in the enclosed proforma and CR Dossiers for the last five years. For officers working in the cadre, it may also be ensured that the &#8216;Cooling off, after a previous stint on deputation, if any, is completed and the officer is eligible for appointment on Central Deputation as per extant instructions.</p>
<p>4. The Post is a Non-Central Staffing Scheme post to be filled up through the Civil Services Board (CSB) procedure. It may be noted that no &#8216;Mandatory Posting Certificate&#8217; for allotment/retention of Government accommodation would be issued by this office to the officer appointed on the above referred post. However, those officers who have served and are currently serving on Central Staffing Scheme post in Delhi for at least four years and require to retain Government accommodation, would be issued a certificate to the effect that the officer concerned has served for at least four years in CSS post and he/she needs to retain Government accommodation for his/her tenure on non-CCS post.</p>
<p>5. It is requested that the application(s) of the eligible candidate(s) may please be forwarded so as to reach this Department within one month from the date of issue of this circular.</p>
