Sub:-<strong>Treatment of employees selected under LDCE Scheme/GDCE Scheme.</strong></p>
<p>The undersigned is directed to refer to AIRF’s letter No.AIRF/MACP (9), dt. 08/01/2013 on the above subject and to state that on perusal of para 140(i) of IREM Volume-I, it has been observed as under-<br />
1. 75% of the posts in the category of Chargeman ‘B’ in scale Rs.1400-2300 in Mech. &amp; Elec. Eng., Deptts. &amp; in the cadre of Draftsmen in these Departments will be filled by induction of Apprentice Mechanics as under:<br />
(i). 50% plus shortfall, if any, against inter apprentice quota as at (ii) below, from open market through Railway Recruitment Board, and</p>
<p>(ii) 25% from serving employees fulfilling the following qualification:-</p>
<p>(a) Must have passed ITI  Act Apprenticeship in the relevant trade or 10+2 in science stream.</p>
<p>It is evident from the above position of IREM that it prescribes 50% quota in chargeman ‘B’ grade to be filled from open market i.e by direct recruitment and another 25% quota has been earmarked to be filled from amongst serving employees. As such only those employees who have been appointed as chargeman ‘B’ against 50% quota prescribed to be filled from open market can be treated as direct recruits in that grade and the case of employees selected against 25% quota earmarked to be filled from serving employees shall be treated as promotion for MACP purposes.</p>

<div>Ref:  <em><strong>Railway Board’s letter No.PC-V/2009/ACP/2(RBE No.100/2012) dated 12.09.2012</strong></em></div>
<div></div>
<div>As per Railway Board’s letter under reference, while extending benefit of financial upgradation under MACP Scheme, the candidates selected through LDCE/GDCE on a post for which recruitment rules provide for Direct Recruitment, their promotion through above process on the said post are to be treated as Direct Recruitment for the purpose of granting benefit under the said scheme.</div>

<div>As per para 140(i) of the Indian Railway Establishment Manual, Volume-I(Revised Edition 1989), Intermediate Apprentices selected against 25% Intermediate Apprentice Quota(Talented Quota) do fulfill above criteria, as the said para clearly stipulates that 75% of the vacancies in the category of Jr. Engineer in Mechanical, Electrical, Engineering Departments and Draftsmen category of these departments will be filled by induction of Apprentice Mechanics, as such those selected against 25% Intermediate Apprentice Quota(Talented Quota) may also be considered to  have been directly recruited on these posts. They should, therefore, be extended the benefit under MACP Scheme as per para(i) of Railway Board’s letter referred to above.</div>
<div></div>
<div>The Board are, therefore, requested to issue necessary clarification to all the Zonal Railways and Production Units so that the Jr. Engineers selected through LDCE against 25% Intermediate Apprentice Quota(Talented Quota) are granted financial upgradation under MACP Scheme, treating them as Directly Recruited to these posts.</div>

<div>NFIR wishes to invite attention of the Railway Board to yet another anomaly that has been created causing resentment among staff as a result of issuance of letter under reference. In this connection, NFIR furnishes following illustration for rectification and issuing justified instructions: &#8211;</div>
<div></div>
<div>2. ‘A’ has joined as SCP in Traffic Dept in the year 1997. He appeared for the selection to the post of ASM through LDCE against PRQ and got posted as ASM in the year 2000. Another employee ‘B’ has joined as Helper in C &amp; W Cadre in the year 1998. He appeared for the selection to the post of ASM through GDCE against DR quota and got posted as ASM during the year 2002.</div>
<div></div>
<div>‘A’ will be getting his II MACP in the year 2010 to Grade Pay Rs.4200/-</div>
<div>‘B’ will be getting his I MACP in the year 2012 to Grade Pay Rs.4200/-</div>
<div></div>
<div>‘A’ will be getting his III MACP in the year 2020 to Grade Pay Rs.4600/-</div>
<div>‘B’ will be getting his II MACP in the year 2022 to Grade Pay Rs.4600/-</div>
<div></div>
<div>‘A’ will not be getting MACP to Grade Pay Rs.4800/-</div>
<div>But ‘B’ will be getting his III MACP in the year 2032 to Grade Pay Rs.4800.</div>
<div></div>
<div>3. Here an employee entered Railway service later and got selected as ASM later will be getting higher Grade Pay than another employee who entered in Railway service earlier and got selected as ASM earlier. This will constitute a serious anomaly and lead to injustice to the seniors.</div>
<div></div>
<div>Keeping in view the situation as highlighted above which Railway employees will be encountering quite frequently, the NFIR, therefore, urges the Railway Board to issue suitable clarificatory instructions so that Railway employees who happened to be senior do not face unnecessary hardships. A copy of the instructions issued may be endorsed to the NFIR.</div>

<p><span style="text-align: justify;">Ref: </span><strong style="text-align: justify;">Item No. 12,30 &amp; 49 of the record of discussion of 3rd meeting of the Joint Committee on MACP held on 15th March, 2011</strong></p>
<div style="text-align: justify;">During 3rd meeting of the Joint Committee on MACP, held under the Chairmanship of Secretary €, DoP&amp;T on 15th March. 2011, the following decisions have been taken:-</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">“The Staff Side demanded that the employees selected under the LDCE Scheme/GDCE Scheme should be treated as a direct recruit and their earlier promotions and services rendered should be ignored for the purpose of MACPs as was being done in the ACP Scheme. The Official Side informed that the treatment of such cases would generally be same in the MACP as was in the ACP Scheme. Ministry of Railways would be advised to examine the matter accordingly”.</div>

<div style="text-align: justify;">In this connection, it may be pointed out that in terms of Railway Board’s letter No.PC/V/99/1/1/1/  dated 01.10.1999, it was already decided and benefit of ACP would be granted to the candidate selected through LDCE. The relevant portion of the instructions in this regard is cited below:-</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">“If the relevant Recruitment Rules provide for filling-up of vacancies of the Stenographer “D’/Jr. Stenographer by DR, induction of JR. Clerks to the aforesaid grade through LDCE may be treated as DR for the benefit under ACPs…”</div>

<div style="text-align: justify;">The Board are requested to issue necessary clarification on the subject so that the employees selected under LDCE/GDCE Scheme are treated as Direct Recruitment and their promotion be ignored for the purpose of granting benefit under MACP Scheme.</div>
