<p style="text-align:center">New Delhi, the 29th January, 2019 </p>



<p><strong>G.S.R. 56 (E)</strong>.- Whereas a draft of certain rules further to amend the Minimum Wages (Central) Rules, 1950, among other rules, were published as required by sub-section (1) of section 30 of the Minimum Wages Act, 1948 (11 of 1948), in the Gazette of India, Extraordinary, Part II, Section 3, sub-section (i) vide notification of the Government of  India in the Ministry of  Labour and Employment number  G.S.R.  413(E),dated the 23rd April, 2018, inviting objections and suggestions from all persons likely to be affected thereby, within  a  period  of  three  months,  from  the  date  on  which  copies  of  Official Gazette containing the said notification were made available to the public;</p>



<p>And whereas copies of the said Official Gazette were made available to the general public on the 23rdApril, 2018; </p>



<p>And whereas the objections and suggestions received on the said draft rules from the public have been considered by the Central Government;</p>



<p>Now,  therefore,  in  exercise  of  the  powers  conferred  by  section  30  of  the  said  Act,  the  Central Government hereby makes the following rules further to amend the Minimum Wages (Central) Rules, 1950, namely:-</p>



<ol class="wp-block-list"><li>(1) These rules may be called the Minimum Wages (Central) Amendment Rules, 2019. <br /> (2) They shall come into force on the date of their publication in the Official Gazette.</li><li>In the Minimum Wages (Central) Rules, 1950,- </li></ol>



<p>(a) in rule 21, for sub-rule (4A), the following sub-rule shall be substituted, namely:- </p>



<p>(4A)  Every  employer  shall,  on  or before  the  1st  day  of  February  in  each  year,  upload  unified  annual return  in  Form  III  on  the  web  portal  of  the  Central  Government  in  the  Ministry  of  Labour  and Employment giving information as to the particulars specified in respect of the preceding year:</p>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p>Provided that during inspection, the inspector may require the production of accounts, books, registers and other documents maintained in electronic form or otherwise.</p></blockquote>



<p><em>Explanation</em>.-  For the purposes of this sub-rule, the expression “electronic form”  shall  have the same meaning as assigned to it in clause (r) of section 2 of the Information Technology Act,  2000 (21 of 2000).’; </p>



<p>(b) in Form III, for the word,  figures, brackets and letter “Rule 21(4A)(1)”,  the word, figures, brackets and letter “Rule 21(4A)” shall be substituted. </p>

<strong>NOTIFICATION</strong></p>
<p>G. S .R In exercise of the powers conferred by the proviso to Article 309 of the Constitution and in accordance with DOPT O.M.No. AB.14017/6/2009- Estt.(RR) dated 30.4.2010 and in supersession of the Staff Selection Commission (Group &#8216;D&#8217; posts) Recruitment Rules, 1978; Staff Selection Commission (Examination Work Attendant) Recruitment Rules, 1989 and Staff Selection Commission (Senior Gestetner Operator and Senior Peon) Recruitment Rules, 1996 notified on 31.05.1980, 09.10.1989 and 04.10.1996 respectively, the President hereby makes the following rules regulating the method of recruitment to the post of Multi Tasking Staff<br />
(Group &#8216;C&#8217;) in the Staff Selection Commission, namely :-<br />
1. <strong>Short title and commencement:-</strong>  These rules may be called the Staff Selection Commission Group &#8216;C&#8217;</p>
<p>&#8220;Multi Tasking Staff&#8217; Recruitment Rules, 2017.</p>
<p>They shall come into force from the date of their publication in the Official<br />
Gazette.</p>
<p>2. <strong>Number of Posts, Classification and Scale of pay :-</strong> The number of posts,<br />
its classification and the Pay Level in Pay Matrix attached thereto shall be<br />
as specified in Column 2 to 4 of the Schedule annexed to these rules.</p>
<p>3. <strong>Method of recruitment, age limit and other Qualifications, etc.:-</strong> The<br />
method of recruitment to the said post, age limit, qualification and other<br />
matters relating to thereto shall be as specified in column 5 to 13 of the<br />
said Schedule;</p>
<p><strong>4. Disqualification:- No person,</strong><br />
(a) Who has entered into or contracted a marriage with a person having<br />
a spouse living, or<br />
(b) Who, having a spouse living, has entered into or contracted a<br />
marriage with any person,<br />
shall be eligible for appointment to the said post.<br />
Provided that the Central Government may, if satisfied, that such marriage<br />
is permissible under the personal law applicable to such person and the<br />
other party to the marriage and that there are other grounds for so doing,<br />
exempts any person from the operation of this rule.<br />
<strong>5. Power to relax :-</strong> Where the Central Government is of the opinion that it<br />
is necessary or expedient to do so, it may, by order, and for reasons to be<br />
recorded in writing, relax any of the provisions of these rules with respect<br />
to any class or category of persons.<br />
<strong>6. Saving:-</strong> Nothing in these rules shall affect reservations, relaxations of<br />
age limit and other concessions required to be provided for the Scheduled<br />
Castes, Scheduled Tribes, Other Backward Classes, Ex-Servicemen or any<br />
other special category of persons in accordance with the orders issued by<br />
the Central Government from time to time in this regard.<br />

<p>No. F.6/2016 SCA(I) The Seventh Central Pay Commission (Commission) was set up by the Government of India vide Resolution No. 1/1/2013-E.III (A), dated the 28th February, 2014. The Terms of Reference of the Commission also includes the Officers and Employees of the Supreme Court. The period for submission of report by the Commission was extended upto 31st December, 2015 vide Resolution No. 1/1/2013 E.III(A), dated the 8th September, 2015. The Commission, on 19th November, 2015, submitted its Report on the matters covered in its Terms of Reference as specified in the aforesaid Resolution dated the 28th February, 2014.</p>
<p>2.The Chief Justice of India, after consideration, has decided to accept the recommendations of the Commission in respect of the Officers and Employees of the Supreme Court in the manner as specified hereinafter.</p>
<p>3.The Chief Justice of India has accepted the Commission&#8217;s recommendations on Minimum Pay, Fitment Factor, Index of Rationalisation, Pay Matrix and general recommendations on pay without any material alteration in respect of Officers and Employees of the Supreme Court.</p>
<p>4. (1) The Pay Matrix, in replacement of the Pay Bands and Grade Pays as in force immediately prior to the notification of this Resolution, shall be as specified in Annexure I in respect of Officers and Employees of the<br />
Supreme Court.</p>
<p>(2) With regard to fixation of pay of the Officers and Employees of the Supreme Court in the new Pay Matrix as on 1st day of January, 2016, the existing pay (Pay in Pay Band plus Grade Pay) in the pre revised structure as on 31st day of December, 2015 shall be multiplied by a factor of 2.57. The figure so arrived at is to be located in the Level corresponding to employee’s Pay Band and Grade Pay or Pay Scale in the new Pay Matrix. If a Cell identical with the figure so arrived at is available in the appropriate Level, that Cell shall be the revised pay; otherwise the next higher cell in that Level shall be the revised pay of the employee.</p>
<p>(3) After fixation of pay in the appropriate Level as specified in sub-paragraph (2) above, the subsequent increments in the Level shall be at the immediate next Cell in the Level.</p>
<p>5.There shall be two dates for grant of increment namely, 1st January and 1st July of every year, instead of existing date of 1st July; provided that an employee shall be entitled to only one annual increment on either one of these two dates depending on the date of appointment, promotion or grant of financial upgradation.</p>
<p>6. The Commission&#8217;s recommendations and Chief Justice of India’s decision thereon with regard to revised pay structure for Officers and Employees of the Supreme Court as specified at Annexure I and the consequent pay fixation therein as specified at Annexure II shall be effective from the 1st day of January, 2016. The arrears on this account shall be paid during the financial year 2016 to 2017.</p>
<p>7. The recommendations on Allowances (except Dearness Allowance) having been referred by the Government to a Committee which will submit its report within a period of four months, till a final decision on Allowances is taken based on the recommendations of the said Committee, all Allowances will continue to be paid to Supreme Court Officers and Employees at existing rates in existing pay structure, as if the pay had not been revised with effect from 1st day of January, 2016.</p>
<p>8. The recommendations of the Commission relating to interest bearing Advances as well as interest free Advances have been accepted with the exception that interest free Advances for Medical Treatment, Travelling Allowance for family of deceased, Travelling Allowance on tour or transfer and Leave Travel Concession shall be retained.</p>
<p>9. The recommendations of the Commission for increase in rates of monthly contribution towards Central Government Employees Group Insurance Scheme (CGEGIS) for various categories of employees having not been accepted, the existing rates of monthly contribution shall continue.</p>
<p>10. As requisite sanction for upgradation has been received and upgraded scale have already been implemented, the list of cases of upgradation of pay scales of posts recommended by Seventh Central Pay Commission in which no action is required is specified at Annexure III.</p>
<p>11. The Chief Justice of India has approved for setting up of an Anomalies Committee by the Registry to examine individual, post-specific and cadre-specific anomalies arising out of implementation of the recommendations of the Commission.</p>
<p>12. The Chief Justice of India wishes to place on record their appreciation of the work done by the Commission.</p>

<p>G.S.R &#8211; In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Lal Bahadur Shastri National Academy of Administration (Establishment Group &#8216;C&#8217; and &#8216;D&#8217; Posts) Recruitment Rules, 2000, in so far as they relate to the posts of Physical Training Instructor, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the posts of Physical Training Instructor, namely:-</p>
<p>1. Short title and commencement.- (1) These rules may be called the Ministry of Personnel, Public Grievances and Pensions, Department of Personnel and Training, Lal Bahadur Shastri National Academy of Administration, Mussoorie (Physical Training Instructor) Recruitment Rules, 2015.</p>
<p>(2) They shall come into force on the date of their publication in the Official Gazette.<br />
2. Number of posts, classification, pay band and grade payor pay scale.- The number of the post, their classification and the pay band and grade payor pay scale attached thereto shall be as specified in columns (2) to (4) of the said Schedule.</p>
<p>3. Method of recruitment, age-limit, qualifications, etc.- The method of recruitment, age-limit, qualifications and other matters relating to the said posts shall be as specified in columns (5) to (13) of the said Schedule.</p>
<p>4. Disqualifications.- No person,-</p>
<blockquote><p>(a) who has entered into or contracted a marriage with a person having a spouse living; or</p>
<p>(b) who having a spouse living, has entered into or contracted a marriage with any person,</p></blockquote>
<p>shall be eligible for appointment to the said posts:</p>
<p>Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.</p>
<p>5. Power to relax.- Where the Central Government is of the opinion that it is necessary or expedient so to do, for reasons to be recorded in writing, in consultation with Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.</p>
<p>6. Saving.- Nothing in these rules shall affect reservation, relaxation of age-limit, and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Class, the Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.</p>

<p>G.S.R. 776(E) —In exercise of the powers conferred by sub-section (1) read with clause (k) and clause (l) of subsection (2) of section 59 read with section 44 and section 45 of the Lokpal and Lokayuktas Act, 2013 (1 of 2014), the Central Government hereby makes the following rules further to amend the Public Servants (Furnishing of Information and Annual Return of Assets and Liabilities and the Limits for Exemption of Assets in Filing Returns) Rules, 2014, namely:-</p>
<p>1. (1) These rules may be called the Public Servants (Furnishing of Information and Annual Return of Assets and Liabilities and the Limits for Exemption of Assets in Filing Returns) Third Amendment Rules, 2015.</p>
<p>(2) They shall come into force on the date of their publication in the Official Gazette.</p>
<p>2. In the Public Servants (Furnishing of Information and Annual Return of Assets and Liabilities and the Limits for Exemption of Assets in Filing Returns) Rules, 2014, in rule 3, in sub-rule (2),-</p>
<blockquote><p>
(a) in the first proviso, for the words and figures &#8220;on or before the 15th day of October, 2015&#8221;, the words and figures &#8220;on or before the 15th day of April, 2016&#8221; shall be substituted;</p>
<p>(b) in the second proviso, for the words and figures &#8220;on or before the 15th day of October, 2015&#8221;, the words and figures &#8220;on or before the 15th day of April, 2016&#8221; shall be substituted.</p></blockquote>
