OFFICE MEMORANDUM

Attention is invited to this office OM No. CPAO/IT & Tech/ Gallantry Award/26/2020-21/06 dated 12.05.2021 wherein it was stated that all the Pension disbursing banks are required to ensure that Income Tax at source is not be deducted from pension in respect of Gallantry Awardees, as per the Provisions of Section 10 clause 18(i) of the IT Act, CBDT Notification dated 24th November, 2000.

2. It is observed that the banks are not complying with the instructions as this office has been receiving grievances regarding deduction of income tax from pension of Gallantry Awardees.
3. In view of the above, Heads of CPPCs/ GBDs of all Authorized banks are requested to follow the instructions issued by the Income Tax department, on the subject, without fail.

This issues with the approval of the Chief Controller (Pensions).

Subject:- Streamlining of the procedure for payment of monetary allowance attached to gallantry award/Police Medal to the retired personnel of Central Armed Police Forces (CAPFs) and Gallantry Allowance attached with Asadharan Suraksha Seva Praman Patra (ASSPP) to the retired officers of Cabinet Secretariat.

Gallantry Awards are conferred by the government of India to the officers and personnels of the Police forces/Central Armed Police Forces (CAPFs) as per the GOI notification No. 3-Pers and 4-Pers dated 01.03.1951 (as amended from time to time). The awards carry a monetary allowance at specified rates.

2. At present, the monetary allowance to pensioners/family pensioners is being paid by the respective Pay & Accounts Officer through a bill duly supported by a pre-receipt received from the awardees. As a result of the current system, Gallantry award winners are facing many practical difficulties in claiming their due amount.

3. Accordingly, the issue of improving the procedure for payment of Monetary Allowances, linked these awards, to pensioners was pending since long, now, consequent upon approval by the Finance Secretary & Secretary (Expenditure) for making payment of Monetary Allowances attached to Gallantry awards/Police Medals to retired personnel from the Pension grant these payments have now become a part of pension and shall be made along with Pension through the Central Pension Accounting Office (CPAO).

4, To process the payment of the Monetary Allowances attached with the Gallantry Awards, technical up gradation is required to be carried out by the Bhavishya, PFMS and NIC (CPAO) teams. Post the upgradation of these modules, the standard operating procedure for processing of fresh and revision pension cases will be shared by CPAO with all accounting unit and the CPAO will start receiving cases w.e.f. 20 July, 2022

Subject: Streamlining of the procedure for payment of monetary allowance attached to Gallantry award/Police Medal to the retired personnel of Central Armed Police Forces (CAPFs) and Gallantry Allowance attached with Asadharan Suraksha Seva Praman Patra (ASSPP) to the retired officers of Cabinet Secretariat.

The undersigned is directed to say that, at present. monetary allowances attached to Gallantry Awards/Police Medals are disbursed to the retired personnel of Central Armed Police Forces (CAPFs) in accordance with the orders issued by Ministry of Home Affairs. Gallantry Allowance of Rs.6000/- per month is disbursed to the awardees of Asadharan Suraksha Seva Praman Patra (ASSPP) under Cabinet Secretariat in recognition for their significant operational contribution, in accordance with the orders issued by the Cabinet Secretariat. This award is equivalent to the President’s Police Medal for Gallantry. The Gallantry Allowance is payable to the awardee till his life and, on his death, to his/her spouse.

2. Ministry of Home Affairs and Cabinet Secretariat have intimated that the awardees of the Gallantry Allowance have been facing certain difficulties in claiming and receiving the amount of allowance under the present system. With a view to streamline the procedure for payment of monetary allowance attached to Gallantry awards/police Medal to the retired personnel of Central Armed Police Forces (CAPFs) and Gallantry Allowance to the officers of Cabinet Secretariat who are awarded Asadharan Suraksha Seva Praman Patra (ASSPP), Ministry of Home Affairs, Cabinet Secretariat and office of Controller General of Accounts have recommended that these allowances may be disbursed to the concerned retired personnel and their families along with their monthly pension/family pension in the same manner as in the case of Fixed Medical Allowance payable to the pensioners/family pensioners.

Monetary Allowance for Widows of Gallantry Awards Recipients

3. It has, accordingly, been decided that payment of monetary allowances to the recipients of aforesaid Gallantry Awards under Ministry of Home Affairs and Cabinet Secretariat may be made along with their monthly pension or family pension, as the case may be. In the case of existing pensioners/family pensioners in receipt of monetary allowance attached to the Gallantry Award, the respective pension sanctioning authorities will issue an amendment to the Pension Payment Order for authorisation of payment of the said allowance, by following the usual procedure and send the same to the Pension Disbursing Authorities without waiting for any application/request from pensioner/family pensioner. In the case of future retirees, the case for grant of the monetary allowance will be processed along with the pension case and an entry regarding entitlement of the allowance will be made in the Pension Payment Order. Office of Controller General of Accounts (CGA) shall make necessary changes in the format of the Pension Payment Order accordingly.

4. Department of Pension & Pensioners’ welfare will make required functionalities in ‘Bhavishya’ (the Online Pension Sanction & Tracking System) to capture the details of Gallantry awardees for online transmission to Pension Module of PFMS for generating the PPO/e-PPO accordingly. The Pension Disbursement Authority shall make the payment of the allowances attached with the Gallantry Awards along with monthly pension based on the authorisation in the Pension Payment Order.

5. The payment of the allowances attached with the above-mentioned Gallantry Awards shall be debited to the head “Pensions & other Retirement Benefits”.

6. There will be no change in the other terms and conditions for payment of monetary allowances attached to Gallantry Awards/Police Medals to the retired personnel of Central Armed Police Forces (CAPFs) and the Gallantry Allowance to the awardees of Asadharan Suraksha Seva Praman Patra (ASSPP) under Cabinet Secretariat and the same will continue to be regulated in accordance with the orders issued by Ministry of Home Affairs and the Cabinet Secretariat, respectively from time to time.

Sub: Payment of enhanced Monetary Allowance attached to pre and post independence Gallantry Awards.

Ref: This office Circular No. 9 dated 10/06/2011 and Circular No. 30 dated 22/12/2017.
The rates of Monetary Allowance attached to pre and post independence Gallantary Awards have been revised by the Govt w.e.f. 30/03/2011 and 01/08/2017 and the same have been issued to all the Pension Disbursing Agencies (PDAs) vide this office Circular No. 9 dated 10/06/2011 and Circular No. 30 dated 22/12/2017 respectively. These circulars are also available on this office web site www.pcdapension.nic.in.

However, complaints from various agencies as well as the pensioners/family pensioners & Pensioners’ Associations are being received at various levels including Ministry of Defence (MoD) stating that PDAs are not making payment of enhanced rate of Monetary Allowance attached to pre and post independence Gallantry Awards.

On examining the cases, it has been noticed that monetary allowance of Gallantry award has neither been revised as per this office Circular No. 9 dated 10/06/2011 nor Circular No. 30 dated 22/12/2017. Non-revision of monetary allowance of Gallantry Awards by the PDAs has resulted in huge arrears. Non-payment of dues to the pensioners/family pensioners as well as accumulation of such cases has been viewed seriously by the MoD. The MoD has further directed to ensure that such incidents do not recur.

Therefore, PDAs are requested to review all cases of monetary allowance attached to pre and post independence Gallantry Awards and ensure that revision as per circulars mentioned above has been carried out by them and payment is being made at correct rates. The Pension Disbursing Agencies are also requested to submit detailed status report on payment of correct rate of Monetary Allowance attached to pre and post independence Gallantry Awardees.

Details of Gallantry awardees extracted from pension payment scrolls for the month of January, 2018 received from the Banks in respect of whom monetary allowances are still awaiting for revision in terms of the above circulars is being forwarded separately to each CPPC for immediate revision of the same and to ensure credit the payments along with arrears in pensioners/family pensioners Bank Account. PDAs other than Banks are requested to review all cases of Gallantry awardees and confirm to this office that payment is being made as per the above quoted circulars.

Consequent upon issue of letters bearing No. 7(62)/20014-D (AG) dated 4th Dec, 2017 by Govt. of India, Ministry of Defence(reproduced as Annexure ‘A’ and ‘B’ respectively to this circular), the rates of Pre- Independence Gallantry Awards and Post-Independence Gallantry Awards have been revised w.e.f. 01st August, 2017.

2. The revised rate of monetary allowance attached with Gallantry Awards may please be paid to all recipients at revised rate, irrespective of rank and income.

3. The terms and condition for payment of monetary allowance on the authority of Pension Payment Order (PPO) notified by this office in above categories of cases is stated in brief in following Paras

i. The allowance will be admissible to the recipient of the award and on his death to his widow lawfully married by a valid ceremony. The widow will continue to receive the allowance until her death. Ordinarily, the widow who was first married shall receive the allowance, but with the special sanction of the Government, the allowance may be divided equally between the lawfully married widows of recipients.

ii. When the award has been made posthumously to a bachelor, the monetary allowance shall be paid to his father or mother, and in case the posthumous awardee was a widower, the allowance shall be paid to his son below 18 years or unmarried daughter as the case may be.

iii. Each bar to the decoration will carry the same amount of monetary allowance as admissible to the original award.

iv. The monthly monetary allowance will be paid in respect of all gallantry awards received by an individual.

v. The monetary allowance will not be taken into account for computing dearness relief.

It is requested that a copy of these orders / instructions may be provided to all Paying Branches/ Treasuries under your jurisdiction for making payment of the monetary allowance at the enhanced rate.

Recipients of the gallantry awards are entitled to the monetary allowance as per the letter of 1972 of Ministry of Defence (MoD), superseded by letter in 1995 of the MoD, which have been revised from time to time. As per the existing condition for grant of monetary allowance, the allowance shall be admissible to the recipient of the award and on his death to his widow lawfully married by a valid ceremony. The widow will continue to receive the allowance until her re-marriage or death. The payment of the allowance will, however, be continued to a widow who re-marries the late husband’s brother and lives a communal life with the living heir eligible for family pension.

Representations were received from various quarters to remove the condition of the widow’s remarriage with the late husband’s brother for continuation of the monetary allowance.

This issue was considered by the Government of India and it has now been decided to remove the condition of the widow’s remarriage with the late husband’s brother for continuation of the monetary allowance vide MoD letter dated November 16, 2017.

The revised condition for grant of monetary allowance for recipients of gallantry awards is as under:

The allowance shall be admissible to the recipient of the award and on his death to his widow lawfully married by a valid ceremony. The widow will continue to receive the allowance until her death.
