<p>￼Subject: <strong>Central Civil Services (Leave Travel Concession) Rules, 1988- Clarification regarding eligibility of Home Town Concession- Frequently Asked Questions.</strong></p>
<p>The undersigned is directed to say that this Department receives a number of references from Government servants/ various Ministries/Departments seeking clarifications regarding the eligibility of Government employees in respect of Home Town LTC. The point of doubts raised and their clarifications are as under :-</p>

<p><em>S.No. / Query / Clarification</em><br />
1. <strong>Whether the employees whose Headquarters/ Place of posting and Home Town are same, are eligible for Home Town LTC?</strong></p>
<p>No. Government employees whose headquarters/place of posting and Home Town are one and the same are not eligible for Home Town LTC.</p>
<p>2. <strong>Whether the employees who are not eligible for Home Town LTC may avail the Special Concession scheme of conversion of Home Town LTC to travel to North East Region, allowed by DoPT’s 31011/3/2014-Estt.A-IV 26.09.2014?</strong></p>
<p>No. Employees whose Home Town &amp; Headquarters are same are not eligible for Home town LTC and hence, the question of conversion of Home Town LTC to travel to these places under special concession scheme does not arise.</p>
<p>3. <strong>Whether the employees residing in cities / towns outside Delhi which fall under other states of National Capital Region (NCR) are eligible for Home Town Concession?</strong></p>
<p>Yes, Cities/Towns which outside Delhi and fall in other states of NCR are not to be treated as Delhi Headquarters. Hence, the Government employees whose headquarters are Delhi and reside in cities/towns outside Delhi falling in other states of NCR, are eligible for Jammu &amp; Kashmir &amp; Andaman &amp; Nicobar Islands as eligible for Home Town Concession.</p>

<p><strong>FREQUENTLY ASKED QUESTIONS ON ADMINISTRATIVE TRIBUNALS</strong></p>
<p><strong>Q.1 What is the objective behind setting up of Central Administrative Tribunal?</strong><br />
<strong>Ans.</strong> To provide in-expensive and speedy relief to Central Government Employees in respect of their grievances related to service matters.</p>
<p><strong>Q.2 What are the jurisdiction of a Central Administrative Tribunal?</strong><br />
<strong>Ans.</strong> CAT adjudicates disputes with respect to recruitment and conditions of service of persons appointed to public services and posts in connection with the affairs of the Union or other local authorities with the territory of India or under the control of Government of India and for matters connected therewith or incidental thereto.</p>
<p><strong>Q.3 What are the qualifications for appointment as Chairman and other Members of the Tribunal?</strong><br />
<strong>Ans.</strong> A person shall not be qualified for appointment as the Chairman unless he is, or has been, a Judge of a High Court.</p>
<p>Provided that a person appointed as Vice-Chairman before the commencement of this Act shall be qualified for appointed as Chairman if such person has held the office of the Vice-Chairman at least for a period of two years.</p>
<p>(2) A person shall not e qualified for appointment :-</p>
<p>(a) as an Administrative Member, unless he has held for at least tow years the post of Secretary to the Government of India or any other post under the Central or State government and carrying the scale of pay which is not less than that of a Secretary to the Government of India for at least two years or held a post of Additional Secretary to the Government of India for at least five years or any other post under the Central or State Government carrying the scale of pay which is not less than that of Additional Secretary to the Government of India at least for a period of five years :</p>
<p>Provided that the officers belonging to All India Services who were or are on Central deputation to a lower post shall be deemed to have held the post of Secretary or Additional Secretary, as the case may be, from the date such officers were granted proforma promotion or actual promotion whichever is earlier to the level of Secretary or Additional Secretary, as the case may be, and the period spent on Central deputation after such date shall count for qualifying service for the purpose of this clause:</p>
<p>(b) as a Judicial Member, unless he is or qualified to be Judge of a High Court or he has for at least two years held the post of a Secretary to the Government of India in the Department of Legal Affairs or the Legislative Department including Member-Secretary, Law Commission of India or held a post Additional secretary to the Government of India in the Department of Legal Affairs and Legislative at least for a period of five years.</p>
<p><strong>Q.5 Where are the benches of Central Administrative Tribunals located?</strong><br />
<strong>Ans.</strong> There are 17 Benches of the Tribunal, located throughout the country wherever the seat of a High Court  located, with 33 Division Benches. In addition, circuit sittings are held at Nagpur, Goa, Aurangabad, Jammu, Shimla, Indore, Gwalior, Bilaspur, Ranchi, Pondicherry, Gangtok, Port Blair, Shillong, Agartala, Kohima, lmphal, Itanagar, Aizwal and Nainital.</p>
<p><strong>Q.6 what are the limitations of admitting an application?</strong><br />
<strong>Ans.</strong> As per Section 21 of the Administrative Tribunal Act. 1985 (1) A Tribunal shall not admit an application :-</p>
<p>(a) In a case where a final order such as is mentioned in clause (a) of sub-(2) of section 20 has been made in connection with the grievance unless the application is made, within one year from the date on which such final order has been made:</p>
<p>(b) In a e where an appeal or representation such as e mentioned in clause (b) of sub-section (2) of section 20 has been made and a period of six months had expired thereafter without such final order having been made within one year from the dale of expiry of the said period of six months.</p>
<p>(2) Notwithstanding anything contained in sub-section (1), where &#8211;<br />
(a) the grievance in respect of which an application is made had arisen by reason of any order made at any time during the period of three years immediately preceding the date on whdi the jurisdiction, powers and authority of the Tribunal becomes exercisable under this Act in respect of the mater to which such order relates; and</p>
<p>(b) no proceedings for the readressal of such grievance had been commenced before the said date before any High Court,</p>
<p>the application shall be entertained by the Tribunal if it is made within the period referred to in clause (a), or. as the case may be. clause (b), of sub section (1) or within a period of six months from the said date. whichever period expires later.</p>
<p>3. Notwithstanding anything contained in sub-section (1) or sub-section(2). an application may be admitted after the period of one year specified in clause (a) or clause (b) of sub-section (1) or, as the case may be, the period of six months specified in sub-section (2), ¡f the applicant satisfies the Tribunal that he had sufficient cause for not making the application within such period.</p>

Q. &nbsp;Whether &nbsp;the &nbsp;services &nbsp;of &nbsp;other &nbsp;Air &nbsp;lines &nbsp;can &nbsp;be &nbsp;availed &nbsp;during &nbsp;TA/DA&amp;LTC, &nbsp;where &nbsp;the stations are not connected by Air India.</div>

Ans. For travel to stations not connected by Air India the officials may travel by Air India to the point closest to their eventual destination, beyond which they may utilize the services of another airlines.</div>

Ans: Yes, however reimbursement of fare should be restricted to the fare admissible for travel between &nbsp;his &nbsp;headquarters &nbsp;station &nbsp;to &nbsp;any &nbsp;place &nbsp;in &nbsp;India/home &nbsp;town &nbsp;or &nbsp;actual &nbsp;expenditure, whichever is less.</div>

<div style="text-align: justify;">
Ans: No, Government servant under suspension cannot avail of LTC as he/she cannot get any leave including casual leave during the period of suspension; however his family is entitled to LTC.</div>

Q. What is the entitlement of fresh recruits?</div>
<div style="text-align: justify;">
Ans: Fresh recruits of Central government may be allowed to travel to their home town with their families on three occasions in a block of four years and to any place in India on the fourth occasion. This facility shall be available to the Government officers only for the first two blocks of four years applicable after joining the Government for the first time. The blocks of 4 years shall apply with reference to the initial date of joining the Government even though the employee changes the job within Government subsequently. The existing blocks will remain the same but the entitlements of the new recruit will be different in the first eight years of service.</div>

Q. Whether a Government servant appointed before 23-09-2008 but not completed first eight years of service is eligible for four LTC as mentioned in VI CPC?</div>
<div style="text-align: justify;">
Ans: The Government servant who have not completed 8 years of service as on 01-09-2008 are entitled for this concession as per their entitlement. There is no change in block years.</div>
<div style="text-align: justify;">

Q. &nbsp;Home &nbsp;town &nbsp;of &nbsp;an &nbsp;employee &nbsp;is &nbsp;connected &nbsp;by &nbsp;train &nbsp;but &nbsp;is &nbsp;not &nbsp;directly &nbsp;connected &nbsp;by Rajdhani/Shatabdi Express trains. In such a case, can the employee be entitled to travel partly by Rajdhani/Shatabdi Express trains and partly by other trains?</div>
<div style="text-align: justify;">
Ans: Yes, If the journey is actually performed by Rajdhani/Shatabdi trains up to an en route railway station by direct shortest route and thereafter the journey is completed in a train other than Rajdhani/Shatabdi trains, fare for both the types of trains by the entitled class would be admissible for the respective portion of journey.</div>

Q. If the originating and terminating points fall on the routes of Rajdhani/shatabdi express trains &nbsp;but &nbsp;these &nbsp;trains &nbsp;do &nbsp;not &nbsp;halt &nbsp;at &nbsp;these &nbsp;stations, &nbsp;can &nbsp;an &nbsp;employee &nbsp;travel &nbsp;by Rajdhani/Shatabdi Express?</div>
<div style="text-align: justify;">
Ans: The employee can travel by Rajdhani/Shatabdi Express up to the nearest en route station which should not be beyond the destination i.e., Home town or the declare place of visit.</div>

If a &nbsp;Government employee/his family member is entitled to concessional train fare such as senior &nbsp;citizen, &nbsp;student &nbsp;concession, &nbsp;children, &nbsp;etc., &nbsp;whether &nbsp;in &nbsp;case &nbsp;of &nbsp;air &nbsp;travel, &nbsp;the reimbursement would be restricted to such concessional fare by train in entitled class?</div>
<div style="text-align: justify;">
Ans: If full air fare has been charged by the airlines and paid by the Government servant, the reimbursement &nbsp;would &nbsp;be &nbsp;restricted &nbsp;to &nbsp;the &nbsp;full &nbsp;train &nbsp;fare &nbsp;in &nbsp;entitled &nbsp;class &nbsp;including Rajdhani/shatabdi.</div>

Q. &nbsp; If &nbsp;a &nbsp;Government &nbsp;servant &nbsp;drawing &nbsp;grade &nbsp;pay &nbsp;Rs. &nbsp;10,000 &nbsp;and &nbsp;above &nbsp;can &nbsp;claim &nbsp;for reimbursement of Air travel by executive class on LTC?</div>
<div style="text-align: justify;">
Ans: No, reimbursement of the expenses on air travel while availing of LTC will be restricted to the cost of travel by the economy class, irrespective of entitlement.</div>

Q. Whether DA is admissible on Sunday, holiday, casual leave and RH to Government Servant on temporary duty at out station?</div>
<div style="text-align: justify;">
Ans: 1. Government servant availing &nbsp;CL or RH while on tour is not entitled to draw DA.</div>
<div style="text-align: justify;">
&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;2. DA is not admissible for any day whether sunday or holiday unless the officer is actually and &nbsp;not merely constructively in camp.</div>
