<p><strong>Subject: Strengthening of Administration &#8211; Periodic review of Central Government Employees under FR 56(j) and Rule 48 of <a href="https://centralgovernmentnews.com/category/ccs/" target="_blank" rel="noreferrer noopener">CCS</a> (Pension) Rules, 1972</strong></p>



<p>The undersigned is directed to refer to DoP&amp;T’s O.M No.25013/03/2019-Estt.A-IV dated 28.08.2020 and this office O.M. of even No.50 dated 05.08.2019 (copy enclosed) on the above mentioned subject.</p>



<p>All Pr. CCAs/ CCAs/ CAs are requested to undertake the periodic reviews in respect of CCAS (Group ’B’&amp; ‘C’ officials) working under their jurisdiction in terms of DoP&amp;T’s O.M. No.25013/03/2019-Estt.A-IV dated 28.08.2020. Further, it should also be ensured that the prescribed procedure like forming of opinion to retire a Government employee prematurely in public interest is strictly adhered to, and that the decision is not an arbitrary one, and is not based on collateral grounds as per the order of the Hon’ble Supreme Court in case of UOI &amp; Col. J.N. Sinha (1571 SCR (1)791).</p>



<p>All Pr. CCAs/ CCAs/ CAs are requested to furnish a report to this office in the format given below by <strong><em>2nd day of each month</em></strong> :-</p>

<p style="text-align: center;"><span style="text-decoration: underline;">NOTIFICATION</span></p>
<p style="text-align: right;">New Delhi, the 11th August, 2018</p>
<p>G.S.R. 767(E).- In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules further to amend the Fundamental Rules, 1922, namely :-</p>
<p>1. Short title and commencement.- (1)These rules may be called the Fundamental (Second Amendment) Rules, 2018.</p>
<p>(2) They shall come into force on the date of their publication in the Official Gazette.</p>
<p>2. In the Fundamental Rules, 1922, in rule 56, for clause (bb), the following shall be substituted, namely: &#8220;(bb) (i) The age of superannuation in respect of the doctors belonging to &#8211;</p>
<p>(i) Central Health Service;<br />
(ii) Indian Railways Medical Service;<br />
(iii) AYUSH and working under the Ministry of AYUSH;<br />
(iv) Civilian doctors under the Directorate General of Armed Forces Medical Service;<br />
(v) Medical Officers of the Indian Ordnance Factories Health Service;<br />
(vi) Dental Doctors under the Department of Health and Family Welfare;<br />
(vii) Dental doctors under the Ministry of Railways; and<br />
(viii) General Duty Medical Officers, Specialist Grade doctors and Teaching Medical Faculty working in Bhopal Memorial Hospital and Research Centre,</p>
<p>shall be sixty-two years unless they exercise the option of posting to Teaching, Clinical, Patient Care, Implementation of Health programmes, Public Health programmes and functions including advisory and consultancy depending on their expertise and experience, as decided by the competent authority in the concerned Ministry or Department from time to time, in case they desire to continue in their service upto the age of sixty-five years:</p>
<p>Provided that the age of superannuation in respect of the doctors belonging to the General Duty Medical Officers sub-cadre of Central Armed Police Forces and Assam Rifles and Specialist Medical officers of Central Armed Police Forces and Assam Rifles shall be sixty-five years.</p>
<p>(ii) The serving doctors belonging to the services referred to in sub-clause (i) who have either already attained the age of sixty-two years or attaining the age of sixty-two years within six months from the date of publication of these amendment rules in the Official Gazette, may exercise their option in regard to their posting to Teaching, Clinical, Patient Care, Implementation of Health programmes, Public Health programmes and functions including advisory and consultancy as specified in sub-clause (i), within a period of thirty days from the date of the commencement of the Fundamental (Second Amendment) Rules, 2018.</p>
<p>(iii) The serving doctors who fail to exercise the option in regard to their posting to Teaching, Clinical, Patient Care, Implementation of Health programmes, Public Health programmes and functions including advisory and consultancy as specified in sub-clause (i), within the period specified in sub- clause (ii), shall be superannuated form their service on attaining the age of sixty-two years or on expiry of a period of thirty days from the date of the commencement of the Fundamental (Second Amendment) Rules, 2018, whichever is later.&#8221;</p>

<p>Review of performance of Government servants is an ongoing process under Fundamental Rule 56(j) and Rule 48 of Central Civil Services (Pension) Rules, 1972, which provide that the performance of a Government servant on attaining a specified age or qualifying years of service is to be reviewed and he/she can be retired in public interest.The instructions on the procedure to be adopted and various aspects to be kept in view while conducting periodical review under provisions of the said rules have been issued from time to time.</p>
<p>As per available information provided by cadre controlling authorities, performance of a total of 25,082 Group &#8216;A&#8217; and 54,873 Group &#8216;B&#8217; officers has been reviewed up to May 2018; and provisions of Fundamental Rule 56 (j)/ relevant rules were invoked/ recommended against 93 Group &#8216;A&#8217; and 132 Group &#8216;B&#8217; officers out of these.</p>
<p>Confidential Rolls (CRs) / Performance Appraisal Reports (PARs) of IAS officers are written for each financial year or as may be specified by the Government in the form and as per the schedule prescribed in the All India Services (Performance Appraisal Report) Rules, 2007. The appraisal form of IAS officers, inter alia, provides for comments on the overall quality of officers including areas of strength and his attitude towards weaker sections.</p>

										<content:encoded><![CDATA[<p><em>&#8220;Removal of Non-Performing Civil Servants Under Fundamental Rules (FR) 56(j), Rule 48 of Central Civil Services (CCS) (Pension) Rule, 1972&#8221;</em></p>
<h3>Policy for Removal of Non-Performing Civil Servants</h3>
<p>The provisions under Fundamental Rules (FR) 56(j), Rule 48 of Central Civil Services (CCS) (Pension) Rule, 1972 and Rule, 16(3) (Amended) of All India Services (Death-cum-Retirement Benefits) [AIS (DCRB)] Rules, 1958 have laid down the policy of periodic review and premature retirement of non-performing Government servants.</p>
<p>Up to January, 2018, a total of 21,195 Group &#8216;A&#8217; and 47,039 Group &#8216;B&#8217; officers have been reviewed, out of which provisions of FR 56(j) and relevant rules were invoked/recommended against 83 Group &#8216;A&#8217; and 128 Group ‘B’ officers, including 15 officers of All India Services.</p>
<p>This was stated by the Union Minister of State (Independent Charge) of the Ministry of Development of North Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances &amp; Pensions, Atomic Energy and Space, Dr. Jitendra Singh, in written reply to a question in the Rajya Sabha today.</p>
