<p>Subject:- <strong>Clarification on physical presence of witnesses at the time of acceptance of deceased claim case.</strong></p>



<p>Sir/Madam,</p>



<p>Kindly refer to the SB Order No. 31/2020, issued vide this office letter of even number dated 28.08.2020 on the settlement of deceased claim cases. This office has been receiving various representations from nominee / claimant that post offices are insisting for <strong>physical presence of two witnesses</strong> at the time of acceptance of deceased claim case.</p>



<p>This issue has been examined in detail and accordingly, I am directed to clarify that the physical presence of witnesses is not required, if self attested photocopy of ID/Address proof of witnesses <strong>containing signature of the witness concerned</strong> are produced along with other claim documents.</p>



<p>ID and Address proof of witnesses may be taken as prescribed in KYC master circular issued vide SB Order 14/2012 and GSPR-2018. A list is enclosed for ready reference.</p>

<p>Sub: <strong>Reservation for Persons with Disabilities-revised forms for Disability Certificates.</strong></p>
<p>The undersigned is directed to refer to this Department&#8217;s O.M. No. 36035/3/2004-Estt.(Res) dated 29.12.2005 circulating consolidated instructions relating to Reservation for the Persons with Disabilities.</p>
<p>2. Ministry of Social Justice and Empowerment vide their Notification No. G.S.R. 2 (E) dated 30.12.2009 has issued rules to amend the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Rules, 1996. Rules 3 to 6 (Chapter II) Of the said Notification dated 30.12.2009 have prescribed various Forms of Disability Certificate.</p>
<p>3.    Keeping in view the amended Rules for Disability Certificates issued by the Ministry of Social Justice and Empowerment vide Notification dated 30.12.2009, paras 9, 10 and 11 of this Department&#8217;s O.M. No. 36035/3/2004-Est(Res) dated 29.12.2005 relating to issue of Disability Certificate stands withdrawn.</p>
<p>4.    All the Ministries/Departments are now requested to comply with the instructions contained in Rules 3 to 6 of Chapter II relating to Disability Certificate as per Ministry of Social Justice and Empowerment&#8217;s Notification No. G.S.R. 2 (E) dated 30 ,12.2009 (copy enclosed for ready reference).</p>
<p>5.    All the Ministries/Department are also requested to bring the above instructions to the notice of all k pointing authorities under their control.</p>

										<content:encoded><![CDATA[<p><strong>Nomination Facility under CGHS for Claiming Medical Reimbursement in Event of Death of Principal CGHS Cardholder</p>
<p></strong> The Ministry of Health &amp; Family Welfare has simplified the procedure by providing an option to the principal CGHS cardholder beneficiary to nominate a person to claim reimbursement of medical expenses in the event of his/her unfortunate death.</p>
<p>The nomination facility shall be subject to certain conditions which include &#8211; the nomination facility shall be available only to the CGHS pensioner card holders; beneficiaries who wish to exercise this option shall submit their declaration of nomination in the prescribed ‘Nomination Form’ duly filled up and complete in all respect, to the CMO In-charge of the CGHS Wellness Centre where the beneficiary is enrolled; the nomination shall be treated as valid only if the same has been entered in the CGHS database; only one person shall be allowed to be nominated as the original nominee or first nominee, and another person can also be nominated as ‘alternate nominee or second nominee’ who can claim reimbursement in case of unfortunate death of the first nominee; the principal CGHS cardholder beneficiary can nominate any natural or juristic person as his/her nominee for this purpose, whether related or unrelated to him/her; this option can be exercised at any time during the lifetime of the beneficiary. However, this option can be exercised only twice in the lifetime of the pensioner card holder; and in case, no option has been exercised during the life time of the CGHS pensioner beneficiary, the existing CGHS provision for claiming reimbursement of medical expenses, requiring submission of Affidavit by the claimant and NOCs from other legal heirs shall continue to apply.</p>

<p>The undersigned is directed to state that as present separate Nomination Form are being filled for various benefits. With a view to simplifying the procedure, the Department of Pension &amp;PW proposes to introduce Common Nomination Form 1 for making nomination for the following benefits:</p>
<p>1. Gratuity under CCS (Pension) Rules, 1972<br />
2. General Provident Fund (Civil Services) Rules, 1960<br />
3. Amount under Employees Group Insurance Scheme, 1980</p>
<p>2. It is also proposed to use Common Nomination Form 2 for making nomination under</p>
<p>1. CCS (Commutation of Pension) Rules, 1981<br />
2. Payment of Arrears of Pension (Nomination) Rules, 1983</p>
<p>3. Comments are invited from all concerned, including pensioners and pensioners&#8217; associations on the use of these Forms in place of the existing Forms. Any suggestions for making the proposed Forms more simple, user-friendly and compatible with the amended provisions of the Rules are also welcome.</p>

<p>Sub: <strong>Submission of Form 14 by the spouse to the pension disbursing bank after the death of the pensioner &#8211; instructions reg.</strong></p>
<p>The undersigned is directed to draw attention to the requirement of applying for family pension in Form 14 as given in rule 81 (2) (A) (ii) of the CCS (Pension) Rules, 1972.</p>
<p>2. This Department has been receiving representations from various quarters to do away with the condition of applying for family pension in Form 14 as it is causing inconvenience to widows, who find it difficult and embarrassing to present themselves before two Gazetted Officers/persons of repute for attestation of Form 14.</p>
<p>3. Before commencement of family pension, personal identification details of the spouse such as specimen signature, personal mark of identification and left hand thumb impression, proof of age/date of birth of spouse and an undertaking from him/her for recovery of excess payment are to be obtained by the bank. Form 14 serves as a standard processing sheet, which defines and delineates the exact requirement of information to be given to the pension disbursing Bank. It was apprehended that in the absence of this standard, the widows may be asked to submit any relevant or irrelevant information by the bank. This could also lead to delay in commencement of the family pension.</p>
<p>4. The matter has been examined and it has been agreed that in case the pensioner and spouse are holding a joint account, the possibility of claim for family pension from someone else does not arise. Therefore, in such cases, there is no requirement of Form 14. The spouse may inform the Bank of death of the pensioner and request the bank for commencement of family pension, through a simple letter. He/she may enclose a copy of death certificate of pensioner, PPO, proof of his/her own age/date of birth and an undertaking for recovery of excess payment. In other cases, i.e., where the pension is not being credited to the joint bank accountbank accountbank account of the pensioner and his/her spouse, Form 14 will be continued to be obtained by the banks.  However, the condition of attestation of Form 14 has been done away with and witnessing by two persons has been considered as sufficient.</p>
<p>5. For all future cases, Head of Office will forward to the PAO, along with similar details for the pensioner, the specimen signature, personal mark of identification, left hand thumb impression, the proof of age/date of birth and an undertaking from the spouse regarding recovery of excess payment. After the death of the pensioner, the spouse of the deceased pensioner will be required to provide only death certificate to the paying bank, who will identify the spouse based on the information given in the PPO and its own &#8220;Know Your Customer&#8221; procedures. Where the pensioner and his/her spouse do not have a joint account, Form 14 will be required as in para 4 above.</p>
<p>6. This issues with the concurrence of Department of Expenditure, vide their ID No. 601/E.V/2013, dated 13.09.2013.</p>

<p>New Delhi: Taking the first step towards launch of online provident fund (PF) transfer claim facilities, the Employees&#8217; Provident Fund Organisation (EPFO) on Thursday unveiled the revised transfer claim form for the purpose.</p>
<p>The launch of full-fledged service of online transfer of provident fund transfer claims would take more than a month, said K K Jalan, the retirement fund body&#8217;s central provident fund commissioner.</p>
<p>The revised transfer claim form, which could be used online as well as manually, was unveiled by Labour and Employment Minister Sis Ram Ola.</p>
<p>According to Mr Jalan, the full-fledged service of online transfer of PF accounts on changing jobs would be possible only after employers&#8217; have digital signatures for the purpose.</p>
<p>This is estimated to cost around Rs. 700 for an employer. At present, EPFO is supposed to settle a transfer of PF claim in 30 days period as per its citizen charter.</p>
<p>Through online settlement of claims, the body envisages to do it in three days.</p>
<p>On this occasion, the Minister said the expectation of EPFO beneficiaries for a timely settlement of claims is a justified one.</p>
<p>During 2012-13, 107.62 lakh claims were settled, out of which 88 per cent of claims were processed within the prescribed 30 days as per the body&#8217;s citizen charter. EPFO is expecting 1.2 crore claims in the current fiscal year.</p>
<p>The Labour Minister directed that all efforts should be made to not only settle the claims within the time, but also to reduce the time taken in settlement of claims.</p>
<p>The revised form will be called &#8216;Transfer Claim Form&#8217; instead of Form 13 for easy comprehension by beneficiaries. The form can be presented after verification, either through the present employer or the previous employer.</p>
<p>Earlier, the form could be submitted after verification only through the present employer.</p>
<p>&#8220;It can be submitted online as well as in physical form. The facility of online submission of this form will be given shortly after process of collecting the digital signature of the employer is completed,&#8221; an EPFO statement said.</p>
<p>The facility to file physical form shall continue to cater to the needs of working class who do not have Internet access. Employees will be allowed to submit their applications online, if their employer is having registered digital signature, it said.</p>
<p>Under the new system of claim settlement, every beneficiary will be informed through SMS and e-mail about the stage of process of the claim to make the entire process transparent and accountable.</p>
<p>Initially, the facility of online transfer of PF account would be available for the employees of establishments whose account is managed by EPFO and not for the firms having private PF trusts who are managing their workers&#8217; funds and accounts, Mr Jalan said.</p>
<p>EPFO is in the process of setting up a central clearance house, which will enable subscribers to apply online for withdrawal claim settlements and transfer of funds.</p>
<p>The biggest problem faced by subscribers is with regard to transferring their accounts on change of job. This central clearance facility will expedite the process, a union leader said.</p>
<p>However, the retirement fund body&#8217;s ambitious plans to provide permanent account numbers to all subscribers to avoid filing for PF transfer claims in the event of changing jobs will be possible only next year.</p>
