<p>Subject: <strong>Notice for One day Nationwide Postal Strike on 10/08/2022 by NFPE.</strong></p>



<p>I am directed to inform that a Notice was given by the Postal Joint Council of Action (PJCA) consisting the FNPO, NFPE and AISBCEU to go on one day Nationwide Strike on 10/08/2022. To discuss their charter of demands, a High-level meeting with the representatives of Postal Joint Council of Action (PJCA) consisting the FNPO, NFPE and AISBCEU held on 05.08.2022 and the Minutes of the meeting has been issued on 08.08.2022. After the issue of minutes, the FNPO and AISBCEU have deferred their strike but NFPE stuck to their decision to go on strike on 10th August 2022.</p>



<p>2. In this regard, it is to bring to kind notice that the instructions issued by the Department of Personnel &amp; Training prohibit the Government servants from participating in any form of strike including mass casual leave, go slow etc., or any action that abets any form of strike in violation of Rule 7 of the CCS (Conduct) Rules 1964. Besides, in accordance with the provision to Rule 17 (1) of the <strong><span style="text-decoration: underline;">Fundamental Rules, pay and allowances are not admissible to an employee for his/her absence from duty without any authority</span></strong>. The Supreme Court has also agreed in several judgments that going on strike is a grave misconduct under the Conduct Rules and that misconduct by the Government employees is required to be dealt with in accordance with the law. Any employee going on strike in any form would face the consequences which, besides deduction of wages, may also include appropriate disciplinary action. In this connection, attention is also invited to DOP&amp;T&#8217;s O.M. No. 33012/1(s)/2008-Estt (B) (pt) dated 12th September, 2008.</p>



<p>3. In view of the above, it is requested that aforesaid instructions under Conduct Rules issued by the DOP&amp;T and other regulations upheld by the Hon&#8217;ble Supreme Court may, therefore, be Suitably informed to the Central Government employees working in the Circles. Necessary instructions not to sanction Special Casual Leave or other kind of leave to employees if applied for, during the period of the proposed strike/ dharna/ demonstration and ensure that the willing employees are allowed hindrance &#8211; free entry into the office premises may be issued. Necessary steps may also be taken as per the instructions issued under Contingency Plan vide this office letter No. 08-01/2019-SR dated 03.05.2019 for handling the strike/ dharna/ demonstration situation. The GDS may also invite action in terms of provisions contained in GDS (Service and Conduct), Rules. The staff may also be apprised of the fact that the Department is committed to consider the issues raised by federation within the framework of the existing rules and instructions of the Government of India/Department of Posts.</p>



<p>4. This may please be given wide circulation at all levels. The receipt of this letter may also be acknowledged.</p>

<p class="has-text-align-center"><strong><span style="text-decoration: underline;">CHARTER OF DEMANDS</span></strong></p>



<p>1) To implement the recommendation of Kamalesh Chandra Committee that GDS employees should be granted 2 annual additional increments on completion of 12, 24,36 years of service.</p>



<p>2) To implement one Lakh Rupees annual Health insurance scheme to GDS employees and family members.</p>



<p>3) To implement the recommendation of Kamalesh Chandra Committee to allow accumulation of 180 days leave and to pay cash equalent to the leave at credit at the time of discharge.</p>



<p>4) To permit GDS employees to engage substitutes in emergency leave. and to grant TRCA for such substitute by the Department.</p>



<p>5) To issue ID cards to all GDS employees as ordered vide Directorate No.17-31/2016-GDS Dtd 17.10.2018.</p>



<p>6) To bring to effect Order No.17-1/2017-GDS Dtd 30.05.2017 of DOP Item No. 3(d).ftem No.8(b.c), Item No. 13(b, d) regarding dependents engagement. correctly.</p>



<p>7) While notifying GDS vacancies, the posts is to be filled up on request transfer may be considered first and then only the other vaccancies notified.</p>



<p>8) Non considering rejected GDS compassionate appointment cases by many Circles even after instructions by Directorate. Consider all cases in time bound manner.</p>



<p>9) Severance amount should be paid minimum of Rupees 1,50,000.00 to all GDS who opted for SDBS and discharged or died.</p>



<p>Dear Collegues,</p>



<p>Kamalesh Chandra committee recommendations are brought to effect from 2018 July. Even on lapse of 32 months, the Department of Post has not come forward to settle the legitimate demands, by implementing very important recommendations.</p>



<p>Though several discussions were conducted with the Department by the NUGDS and the Federation, no progress is seen. Peaceful discussions did not give any fruitful result which has lead us to move with agitation programmes. It is decided to conduct one day’s opposition Dharna in front of all Circle offices all over India on 24.03.2021.</p>



<p>All Circles are requested to make the programme a grand success. Detailed instructions connected with the programme will be given shortly.</p>

<p><strong>Request for relaxation in compassionate appointment &#8211; Deaths due to COVID-19</strong></p>

<p>Sub: <strong>Deaths due to COVID-19 : Request for relaxation in compassionate appointment &#8211; reg</strong></p>



<p>My Federation repeatedly requesting the Department to follow Ministry of Health instructions while opening and operating the offices during <strong><a href="https://centralgovernmentnews.com/tag/covid-19/" target="_blank" rel="noreferrer noopener">COVID -19</a></strong> pandemic. It is the most unfortunate that no circles are following the MOH advisories. This failure to follow advisories resulted in infection of a few Officials of the department. Out of which one is succumbed.</p>



<p>In the instant case one of our officials namely Abdul Haasan had attended duty at Kolkatta Foreign post on 30/3/2020 and 01/04/2020. He was admitted in RG Kar Medical College and Hospital Kolkatta on 14/04/2020 with high fever and breathing problem. In the course of treatment as inpatient, our official Abul Haasan expired on 18/04/2020. According to our information dead body of our staff, was not handed over to the family, it was buried by the State Government authorities. Subsequently, Abul Haasan family members have been sent to quarantine by the state government authorities. This is the most unfortunate, in this connection circle unions both FNPO &amp; NFPE jointly met CPMG and submitted a detailed letter requesting protection to the staff from COVID-19 infection. It is also requested to observe MOH advisory on the subject during the course of employment during the period of this pandemic. The Circle unions have also requested the CPMG to cause compassionate appointments to the family member of the demised official by relaxing the prevailing rules.</p>



<p>Further to submit that the undersigned appraised off the details of the case to Member (P) on 20.04.2020 via whats app and the Member (P) has conveyed the deepest condolences.</p>



<p>This incident of death is in the course of the employment exposing to the deadly Virus. This death is most unfortunate and resulted due to extraordinary conditions. The official is succumbed while rendering the essential service in view of this my federation requests the Chairman Postal Services Board kindly take up the issue with DOP&amp;T to cause relaxation to, in extending the benefit of Compassionate appointments to the deceased family members, wherein the death due to COVID-19. In other words the norms for <a href="https://centralgovernmentnews.com/tag/compassionate-grounds/" target="_blank" rel="noreferrer noopener">compassionate appointments</a> may not be observed for the cases of death due to the pandemic.</p>

<p>Sub: <strong>Non Implementation of GDS Committee Report</strong></p>
<p>GDS committee report, containing favorable recommendations to the bill paid GDS employees was submitted to the Government in November 2016. A discussion on the report was held before the unions and the Department on March 2017. The officers of the postal services board had promised after discussion that the recommendations would be implemented within 6 months which was taken by the union. with gratitude. But though 17 months have elapsed, there is no move from the Department to implement the recommendations which we note painfully. We are not in a position to explain delay before the employee. VII th CPC report relating to about 1 crore central government employees and pensioners was implemented with the 8 months of the submission to the Government. There is no justification for the abnormal delay for the non implementation of GDS committee report, relating to 240000 GDS employees of the postal department alone.</p>
<p>In the above circumstances, we are constrained to move on serious agitation programmes against the attitude of the Government including non attending of PLI/RPLI, and SB/RD business. Along with this, we are preparing for conducting nation wide strike in the month of May 2018. Statuary notice for the strike will be given in the appropriate time.</p>

I am directed to refer to Maharashtra Circle&#8217;s letter no. STA/MACPs/Bench Mark/2017 dated &amp; 12.2.2017 on the subject cited above and to say that &#8216;Promotion&#8217; and &#8216;Modified Assured Career Progression Scheme&#8217; (MACP) are two different matters. The first involves higher duties &amp; responsibilities while latter don&#8217;t.</p>
<p>&nbsp;</p>
<p>2.For MACP, DOP&amp;T has issued instruction vide OM No. 35034/3/2015-Estt(D) dated 28.09.2016, accordingly to which the prescribed benchmark would be &#8216;Very Good&#8217; for all posts and it will come into effect from 25.07.2016. The communication DOP&amp;T has already been circulated by Estt. Division of the Directorate vide letter no. 7-8/2016-PCC dated 5.10.2016 (Copy enclosed)</p>
<p>&nbsp;</p>
<p>3.For promotion, Personnel Division vide letter no. 20-24/2016-SPB-II dated 13.02.2017 has clarified to follow instructions contained DOPT&#8217;s OM No. 35034/7/97-Estt(D) dated 8.02.2002 until further clarification is issued by DOPT or Department of Posts.</p>

NFPE &amp; FNPO DECIDED TO GO ON NATIONWIDE INDEFINITE STRIKE IF THE DEMAND FOR INCLUSION OF GRAMIN DAK SEVAKS UNDER THE PURVIEW OF 7TH CENTRAL PAY COMMISSION IS NOT ACCEPTED BY THE GOVERNMENT. THE MAIN DEMANDS OF THE STRIKE WILL BE</p>
<p>(1) Inclusion of Gramin Dak Sevaks under the purview of 7th CPC</p>
<p>(2) Regularisation of Casual, Part-time, Contingent Employees and Revision of their wages with effect from 01.01.2006 (as per 6th CPC wage revision) &amp; Grant of DA</p>
<p>(3) Merger of 50% DA with pay for all employees including GDS</p>
<p>The above decision was taken in the Central JCA Meeting held on 19.10.2013 at New Delhi under the Chairmanship of Shri. T. N. Rahate, President, FNPO.</p>
