<p class="has-text-align-center"><strong>Option for fixation of pay on Promotion</strong></p>



<p>Extension of Time &#8211; limit for exercise of Option for fixation of pay on Promotion by a period of three (3) months from the date of issue of MoF, DoE, New Delhi OM dated 04/07/2023 i.e. upto 03/09/2023.</p>



<h3 class="wp-block-heading">Message Title: Extension of Time-limit for exercise of Option for fixation of pay on Promotion.</h3>



<p><strong>Message:</strong></p>



<p>As per GoI, MoF, DoE OM No. 4-21/2017-IC/E.III.A dated 04/07/ 2023* read with in conjunction to MoF /DoE, New Delhi OM No.4-21/2017 IC/E-IIIA dated 15/04/2021*, the time limit for exercise/ re-exercise of Option on promotion has been further extended, by a period of three (3) months from the date of issue of MoF, DoE, New Delhi OM dated 04/07/ 2023 i.e. upto 03/09/2023.</p>



<p>Accordingly, Officers who have been promoted or granted financial upgradation on or after 01.01.2016 and <em><strong>desire to exercise/ re-exercise option for pay fixation from DNI may opt within three months from the date of issue of MoD, New Delhi OM dated 04/07/2023 i.e. by 3rd Sept 2023</strong></em>. Officers to publish Part II Orders and forward it through HRMS 2.0 along with option Form which can be downloaded from the website</p>



<p class="has-text-align-center"><strong>#The Last date of exercising option shall be 3rd Sept 2023.</strong></p>



<p>**Further, the ‘Option Calculator’ provided by office of the PCDA(O), Pune may please be referred to, for further necessary guidance while exercising your Option.</p>

<p><strong>Note</strong>: The provisions of re-exercising Option under the said OM is only for fixation of pay on promotion from the DNI in the lower grade and should not to be construed for switching over of pay to the revised pay structure in 7th CPC.</p>

<p>References from Zonal Railways and NFIR have been received in Board’s office seeking clarifications regarding reckoning of 30% pay element for fixation of pay of such Running Staff who have been selected to the Stationary Post i.e non-running post upon promotion through General Selection.</p>



<ol class="wp-block-list" start="2">
<li>The matter has been examined in consultation with Establishment and Finance Directorate(s) of Railway Board. It is advised that in absence of specific orders from the Board to this effect, the benefit of reckoning of 30% pay element for the purpose of fixation of pay of running staff on their promotion/appointment to the posts filled through General Section is not admissible. Further, the General Selection is voluntary in nature and the concerned staff are aware of the mode of fixation of pay on promotion/appointment to a post under General Selection. Hence in such cases, pay fixation has to be effected without taking into account the ‘pay element’.</li>



<li>This issues with the concurrence of the Finance Directorate of the Ministry of Railways.</li>

<h3 class="wp-block-heading">Subject: Grant of Non-Functional Scale to Section Officers of CSS &#8211; Clarification on fixation of pay &#8211; regarding.</h3>



<p>The undersigned is directed to draw attention to this Department’s OMs of even number dated 01.04.2014 and 21.04.2014 governing grant of NFS to Section Officers of CSS and fixation of pay thereon.</p>



<p>2. It has been brought to the notice of this Department that in a few cases, actual benefit of pay on grant of NFS to Section Officers, who were appointed against SO SL 2015 from CSSS on the basis of the results of Section Officers/ Stenos (Gr.B/Gr.I) LDCE 2015 have allegedly been allowed w.e.f. 01.07.2019. The matter has been examined in consultation with Estt.(Pay) Division, DoPT. It is reiterated that in terms of FR 17(1), Section Officers of CSS cadre appointed to the aforesaid grade from CSSS cadre i.e. PS (Adhoc/regular), were not holding the post of Section Officer as on the date of grant of NFS i.e. 01.07.2019, but were officers of CSSS holding post of PA/PS (Adhoc). Hence, the actual financial benefit is not admissible to them from 01.07 2019 but is admissible only from the date of their assumption of the charge of the post of Section Officer on regular basis.</p>



<p>3. Ministries/ Departments/ offices concerned are requested to review all such cases where actual pay benefits upon grant of NFS to Section Officers appointed against SO SL 2015 from CSSS on the basis of the results of Section Officers/ Stenos (Gr.B/Gr.I) LOGE 2015 have been granted from 01.07.2019 and take immediate corrective action, if they are not in consonance with the existing instructions dated 01.04.2014 and 21.04.2014, under intimation to this Department.</p>

<p><strong>Sub: Fixation of pay on grant of benefit under Modified Assured Career Progression Scheme (MACPS) &#8211; Extension of the benefit of entry level pay provided in Board’s letter dated 12-10-2018 (RBE No. 158/2018)</strong><br /><br />Reference is invited to para 4 of Annexure to Board’s letter dated 10-6-2009 (RBE No.101/2009) regarding regulation of fixation of pay at the time of regular promotion in the same or higher Grade Pay as granted under MACPS. Now DOP&amp;T vide their OM.35034/3/2015 -Estt.(D) dated 08-9-2020 (copy enclosed) has issued revised guidelines for fixation of pay of the employees who have been granted regular promotion after grant of financial up gradation under ACP/MACPS. These instructions shall apply mutatis-mutandis on the Railways also.</p>

<p>Ref: NFIR’s letter No.1/2/Part IV dated 13.11.2018.</p>



<p>Please refer to NFIR’s letter quoted above requesting Board to give 90 days’ time for exercise of option for fixation of pay on DNI instead of ‘one month’ period as circulated vide Board’s letter RBE No. 142/2018 dated 20.09.2018 from the date of issue of these orders on the ground that these orders have not been circulated by the Zonal Railways and the Divisions to field units with the result that the staff are unable to exercise option in time.</p>



<p>With respect to above, it is stated that generai instruciions relating to revised pay structure which are applicable to all central government employees issued by Ministry of Finance (MoF) are adopted in Railways in mutatis mutandis manner. The letter under question was also uploaded on Board’s website on date itself and also circulated amongst all concerned including Zonal Railways/Production Units, Board’s branches, Members of the Staff Council, NFIR, AIRF and other, staff associations. Federation may appreciate that MoF’s circulars/orders already remains in circulation before adopted in Railways, as such Railway employees have even more time to go through such circulars/orders in comparison to other central government employees. Further, no Railway has made any reference bringing on record delayed circulation in this regard.</p>



<p>In view of the above, unilateral deviation from MoF’s stipulation is not feasible.</p>

in the multiple of Rs. 10, as specific to an employee, it has been very 
clearly brought out therein, drawing upon the illustration given by the 
7th Pay Commission in para 5.1.37 of its Report . that a difference of 
at least 3%, the rate of annual increment in the 6th CPC structure, was 
essential for counting of two stages. Therefore, for the purpose of 
considering bunching, two Pays drawn in a Pay Band with a particular 
Grade Pay, which are separated by 3% of the lower pay; are to be taken 
into account, as explained in the illustration given in para 9(i) of 
this order.</td></tr><tr><td>2.</td><td>Whether the pay at Cell 1 of any Level may be taken as first stage.</td><td>Bunching is to be considered with reference to the consecutive stages of
 pay drawn in the pay structure obtaining prior to 1.1.2016, as 
explained in these orders and as such a reference to Cell 1. which is in
 the revised pay structure, is not relevant.</td></tr><tr></tr><tr><td>3.</td><td>Whether all .pay stages lower than the entry pay in the 6th CPC pay structure the purpose of bunching.</td><td>This point has been amply clarified in the aforesaid OM dated 3.8.2017.&nbsp;
 As mentioned in para 8(iv) thereof , all pay stages lower than the 
Entry Pay in the 6th CPC pay structure as indicated in the Pay Matrix 
contained in 7th CPC Report are not to be taken into account for 
determining the extent of bunching.</td></tr><tr><td>4.</td><td>Whether benefit of bunching should be given only where previous and 
current pay stages of the officers (specific to each employee) are 
getting bunched and placed at the same Level in the 7th CPC matrix 
without any comparison to any other officer’s pay as per para 5 and 
8(iii) of this Department’s OM dated 3.8.2017 which stipulates that a 
difference of 3% to be reckoned for determination of consecutive pay 
stages, specific to each employee.</td><td>The position clarified in these orders covers this poi nt. As explained 
in the illustration. the pre-revised pay of Rs.46,100 and Rs.47,490 are 
considered two stages of pay, as these are separated by 3% and these 
could be drawn by any two officers.</td></tr><tr><td>5.</td><td>Whether benefit of bunching is to be given to a senior officer with 
reference to the pay of his junior officer who is drawing less pay with 
the difference of 3% to the senior officer and now his pay got fixed in 
the same Level as that of the senior officer.</td><td>The issue of bunching is not a matter of pay drawn by a Senior Officer 
vis-a-vis a Junior Officer. As explained in these orders, bunching 
happens as in the illustration given in these orders and as such this is
 not related to the issue of seniority.</td></tr><tr><td>6.</td><td>Whether the benefit of bunching is also required to be given to a senior
 officer where his junior’s pay has got fixed in the same Cell as that 
of the senior due to the benefit of bunching of pay given to the junior</td></tr><tr><td>7.</td><td>Whether the benefit of bunching may be extended on account of bunching 
of two stages of pre-revised pay of a Government servant alone.</td><td>It is not clear how two stages drawn by a single Government servant are 
relevant for pay fixation on 1.1.2016, as only the pay drawn on 
31.12.2015 is to be taken into account for pay fixation on 1.1.2016</td></tr><tr></tr><tr><td>8.</td><td>Whether the benefit of bunching may be extended only on direct pay 
fixation where the pay of two officers in the pre-revised pay with a 
difference of 3% get fixed at the same stage in the revised pay 
structure (7th CPC) or also on further bunching with next higher pay 
stage due to grant of additional increment to an officer for bunching on
 initial/direct pay fixation.</td><td>As explained in the illustration contained in para 9(ii) of these orders, no such benefit is admissible in such cas</td></tr></tbody></table>

<p>Subject: <strong>Fixation of pay on promotion to a post carrying higher duties and responsibilities but carrying the same grade pay &#8211; reg.</strong></p>
<p>Madam/Sir,</p>
<p>I am directed to say that the matter related to a clarification on pay fixation under FR 22(1)(a)(I) on re-designation/promotion to a post carrying higher duties and responsibilities but carrying the same pay scale has been examined in the Board in consultation with Department of Expenditure. Department of Expenditure has advised that &#8211;</p>
<p>&#8220;in case the issue is for pay fixation on movement from the post of Office Superintendent (OS) to Administrative Officer (AO) taking place on dates prior to merger of the posts of OS with AO on 01.01.2006, the pay fixation may be considered in the light of Department of Expenditure OM No.169/2/2000-IC dated 24.11.2000&#8221;.</p>
<p>2. It is advised to take necessary action in the matter in terms of provisions contained in Department of Expenditure OM No.169/2/2000-IC dated 24.11.2000. A copy of Department of Expenditure O.M. dated 24.11.2000 is enclosed.</p>

<p>** On grant of NFU w.e.f.08.03.2018, pay of the employees shall notionally be fixed in Level-10 at Rs.80000, thereafter the pay in Level-11 will be fixed at 80,900 in Level-11. The provisions of FR 22 (I)(a)(i) ie.Rule 1313(I)(a)(i) of IREC Vol.II would continue to be applicable on grant of NFU.</p>
<p>** In respect of Accounts Department Officiers, similar procedure may be followed for fixation of Pay on grant of Non functional Upgradation from Level-9 to Level-10 in respect of officials officiating in Sr.Scale (Level-11) prior to grant of NFU.</p>
<p>*** If the employee in this illustrations is drawing more pay than that computed due to fixation at Rs.80900, the higher pay of that employee in such circumstances shall be protected as “Personal Pay” till the date it is adjusted by the next increment.</p>
