<h3 class="wp-block-heading">Sub: Clarification on pay fixation consequent upon the upgradation and merger of the post of Accounts Officer (Pay Level-09) to Sr. Accounts Officer (Pay Level-10)</h3>



<p>This HQrs. AN-VIII section has issued a letter no. AN/VIIN/8210/ RR/SAO/ 2021/p-212 dated 08.08.2023 notifying that in the DAD the posts of Accounts Officer has been upgraded from existing Pay Level-09 to Pay Level-10 and subsequently it has been merged with the post of Senior Accounts Officer.</p>



<p>2. Consequently, the following provisions may please be adhered to while regulating the pay fixation of the affected officers:-</p>



<p>(i) Assumption of higher duties and responsibilities is not involved in the upgradation and merger of Accounts Officer (L-09) with the post of Sr. Accounts Officer (L-10). Therefore, the provisions of Rule 13 of CCS (RP) Rules 2016 and FR 22(I)a(1) are not applicable. i.e. the benefit of notional/ promotional increment is not to be granted.</p>



<p>(ii) The upgradation is not a promotion and no higher responsibilities are involved, therefore. pay is to be fixed as per provision of FR 22(1)a)(2) ie. the officer shall draw as initial pay, the stage of the time-scale (L-10) which is equal to his pay in respect of the old post(L-09) and if there is no such stage, the stage next above his pay in r/o of the old post (L-09) in the upgraded Pay Level-10.</p>



<p>(iii) There is upwards revision of pay scale of the post of Accounts Officer from Pay Level-09 to the post of Sr. Accounts Officer in Pay Level-10. Therefore, FR 22(I)(a)(2),&nbsp;the officer will have an option to be exercised within one month from the date of such appointment, for fixation of his pay in the new post with effect from the date of appointment to the new post or with effect from the date of increment in the old post.</p>



<p>(iv) If the officer chooses to get his pay fixed w.e.f. his date of increment in the old post of Accounts Officer (L-09), as per FR 23, he will retain his old pay until the date on which he has earned his next or any subsequent increment. On the DNI the officer will get his usual increment in the post of Accounts Officer (L-09) and thereafter his pay will be placed in the pay Level-10 (applicable to Sr. Accounts Officer) at the same stage and if there is no such stage the stage next above his pay in Pay Level-09. The option once exercised will be final.</p>



<p>(v) As per FR 23 the holder of a post. the pay of which is changed, shall be treated as if he were transferred to a new post on the new pay. As a consequence of upgradation and merger of Posts of Accounts Officer (L-09) and Sr. Accounts Officer (L-10). the pay of incumbents is changed to L-10 as such they may be treated as if they are transferred to a new post on the new pay. As per FR 22 (1)(a)(2) in cases where pay is fixed at the higher stage, he shall get his next increment on completion of the period when an increment is earned in the time-scale of the new post. Since the qualifying service for earning increments in a post is six months, the officers would be entitled to next increment after six months of qualifying service thereafter they will be granted increment annually.</p>

<p>Extension of Time &#8211; limit for exercise of Option for fixation of pay on Promotion by a period of three (3) months from the date of issue of MoF, DoE, New Delhi OM dated 04/07/2023 i.e. upto 03/09/2023.</p>



<h3 class="wp-block-heading">Message Title: Extension of Time-limit for exercise of Option for fixation of pay on Promotion.</h3>



<p><strong>Message:</strong></p>



<p>As per GoI, MoF, DoE OM No. 4-21/2017-IC/E.III.A dated 04/07/ 2023* read with in conjunction to MoF /DoE, New Delhi OM No.4-21/2017 IC/E-IIIA dated 15/04/2021*, the time limit for exercise/ re-exercise of Option on promotion has been further extended, by a period of three (3) months from the date of issue of MoF, DoE, New Delhi OM dated 04/07/ 2023 i.e. upto 03/09/2023.</p>



<p>Accordingly, Officers who have been promoted or granted financial upgradation on or after 01.01.2016 and <em><strong>desire to exercise/ re-exercise option for pay fixation from DNI may opt within three months from the date of issue of MoD, New Delhi OM dated 04/07/2023 i.e. by 3rd Sept 2023</strong></em>. Officers to publish Part II Orders and forward it through HRMS 2.0 along with option Form which can be downloaded from the website</p>



<p class="has-text-align-center"><strong>#The Last date of exercising option shall be 3rd Sept 2023.</strong></p>



<p>**Further, the ‘Option Calculator’ provided by office of the PCDA(O), Pune may please be referred to, for further necessary guidance while exercising your Option.</p>

<p>References from Zonal Railways and NFIR have been received in Board’s office seeking clarifications regarding reckoning of 30% pay element for fixation of pay of such Running Staff who have been selected to the Stationary Post i.e non-running post upon promotion through General Selection.</p>



<ol class="wp-block-list" start="2">
<li>The matter has been examined in consultation with Establishment and Finance Directorate(s) of Railway Board. It is advised that in absence of specific orders from the Board to this effect, the benefit of reckoning of 30% pay element for the purpose of fixation of pay of running staff on their promotion/appointment to the posts filled through General Section is not admissible. Further, the General Selection is voluntary in nature and the concerned staff are aware of the mode of fixation of pay on promotion/appointment to a post under General Selection. Hence in such cases, pay fixation has to be effected without taking into account the ‘pay element’.</li>



<li>This issues with the concurrence of the Finance Directorate of the Ministry of Railways.</li>

<p>Will the Minister of Finance be pleased to refer to the answer to Unstarred Question 731 given in the Rajya Sabha on 13th December, 2022 and state:</p>



<p>(a) the details of the merit, on the basis of which references received from Ministries/Departments regarding the option for re-fixation of pay after time limit provided vide O.M. dated 15/04/2021, are being considered by the Ministry;</p>



<p>(b) the reasons as to why Government is not relaxing limitation period once again, to provide one time option to re-exercise the option for fixation of pay to Central Government employees when Government is aware that everyone was directly or indirectly affected by the second wave of COVID-19 pandemic; and</p>



<p>(c) by when, Government will issue orders in view of the above?</p>

<p>(a) to (c): Department of Expenditure issued O.M. dated 28.11.2019 clarifying admissibility of conditions for pay fixation from the date of promotion or date of next increment within a period of one month. The employees were allowed to revise option for pay fixation for a period of one month from the date of O.M. dated 28.11.2019. Another opportunity for exercising option was allowed vide O.M. dated 15.04.2021 on the basis of feedback from Ministries/Departments that employees could not exercise option for pay fixation due to circumstances which prevented them from exercising their options or which were beyond their control. Thereafter, the proposals for allowing another opportunity to exercise option for pay fixation are considered on case to case basis on merit taking into account the facts and circumstances which prevented the employees from exercising the option for pay fixation within the permissible period due to non-accessibility of information available on public domain or circumstances which prevented them from exercising options.</p>

<p>Subject:- <strong>Methodology of fixation of pay on promotion to SO(A/c) AAO on account of passing SAS Part-II / Appendix-II Examinations which involves Special Allowance.</strong></p>



<p>The undersigned is directed to refer to this Ministry/ Department&#8217;s Letter No. 27023(41)/74-EG-I dated 03.01.1975 and Defence Account Department/ Ministry of Finance (Defence)&#8217;s Letter No.11323/ Accts/AN dated 20.02.1972 regarding incentives for passing SAS Examination as Special Pay wherein it was stipulated that the <strong><span style="text-decoration: underline;">Special Pay would be taken into account for Fixation of Pay on promotion</span></strong> under the relevant orders issued by the Government in this regard. Pursuant to recommendation of Fifth Central Pay Commission, as per DOPT vide OM No. 4/4/97-Estt(Pay-ll) dated 22.4.1998, the Special Pay henceforth termed as Special Allowance and would be granted hithertofore subject to same conditions as are stipulated in FR 9(25).</p>



<ol class="wp-block-list" start="2"><li>It has been observed that due to no further instructions/guidelines has been issued by this Department or DOPT with regard to the treatment of Special Allowance on fixation of pay on promotion to next higher post prior to 7th CPC regime, different accounts cadres has been following the practice of taking into Special Allowance for fixation of pay on promotion, in previous CPC regime (5th and 6th CPC and in switching over to 7th CPC regime) as per MOF/ DOE/ DAD&#8217;s earlier instruction issued in 3rd CPC vide letters dated 03.01.1975 &amp; 20.02.1975, as stated above.</li><li>Since 7th CPC did not recommend Dearness Allowance on Qualification Pay/Special Allowance, the grant of DA, HRA etc. on Special Allowance/Qualification Pay granted to Account Cadres is not admissible. The practice of adding of Special Allowance (on passing SAS Examination) in the basic pay and fixing the pay at the next higher cell would mean treating this Allowance as pay for all purposes which would not only dilute the very principle of fixed monetary benefit instead it would lead to an additional increment. This is also not in consonance with the recommendation of at para 8.9.45 of 7th CPC that Dearness Allowance is not admissible on the Qualification Pay/ Special Allowance.</li><li>In view of above, it has been decided to adopt the following instructions/guidelines, with prospective effect, for treatment of Special Allowance on passing SAS Examination on promotion to next higher post:</li></ol>



<ul class="wp-block-list"><li>(i) the element of Special Allowance granted on passing SAS Examination may be treated as standalone element i.e. Special Allowance of Rs. 360 for 1st year and Rs. 630 from 2nd year onwards.</li><li>(ii) Dearness Allowance and other allowances on Special Allowance will not be admissible.</li><li>(iii) Special Allowance will be admissible till the government servant is not promoted to the next higher post/grade on passing SAS Examination.</li><li>(iv) On promotion to next higher post after passing SAS examination, the element of Special Allowance shall not be taken into account for fixation of pay on promotion to the next higher post.</li><li>(v) On such promotion, the pay of such GS will be fixed as per Rule 13 of CCS(RP) Rules 2016.</li></ul>

<h3 class="wp-block-heading">Subject: Fixation of Pay on promotion/NFS of PSs of CSSS on or after 1.1.2016, who have already availed pay fixation and increment under MACP &#8211; clarification regarding.</h3>



<p>The undersigned is directed to refer to this Department OM No.10/3/2004-CS. II (Pt.)(A) dated 18.4.2012 vide which Private Secretaries of CSSS who have already been granted increment and Grade Pay of Rs.5400 in the <strong>PB-2</strong> of Rs. 9300-34800 under MACPS, have been allowed the benefit of one increment @3% when placed in Non-functional pay scale in <strong>PB-3</strong> of Rs.15600-39100+GP Rs. 5400. After implementation of 7th CPC recommendations, the MACP guidelines have been amended vide OM No.35034/3/2008-Estt.(D) Vol.III dated 04.7.2017 modifying para-4 of the earlier MACP guidelines dated 19.5.2009. The OM dated 4.7.2017 inter alia states that .. “<em>…. benefit of pay fixation available at the time of regular promotion shall also be allowed at the time of financial upgradation under the Scheme. Therefore, the pay shall be raised by 3% of the total pay in the pay band and the grade pay drawn before such upgradation. <strong>There shall, however, be no further Fixation of pay at the time of regular promotion/ Grant of Non-functional Scale, if it is in the same grade pay as granted under MACPS. However, at the time of actual promotion/grant of Non functional Scale</strong>, if it happens to be in a post carrying higher grade pay than what is available under MACPS, no pay fixation would be available and only difference of grade pay would be made available. </em></p>



<p>2. The issue of pay fixation and grant of increment to PSs of CSSS as per OM dated 18.4.2012 in the light of the revised guidelines issued vide OM dated 4.7.2017 has been examined in consultation with Establishment Division, DOPT and Dept. of Expenditure and it is clarified that the dispensation of pay fixation to PSs of CSSS as available under OM No.10/3/2004-CS.1l (Pt.)(A) dated 18.4.2012 shall not be available w.e.f. 1.1.2016 in view of the amendments made in the MACPS guidelines vide OM No.35034/3/2008-Estt.(D) Vol.II dated 04.7.2017. Accordingly, pay fixation and grant of increment on promotion/NFS on or after 1.1.2016 to PSs of CSSS, who have already availed pay fixation and increment under MACP, shall be regulated as per the guidelines vide OM No.35034/3/2008-Estt.(D) Vol. I dated 04.7.2017 and the provisions of OM dated 18.4.2012 of this Division shall not be applicable.</p>



<p>3. If any benefits based on this Division’s OM dated 18.4.2012 have been extended to any PS of CSSS on or after 1.1.2016, the same shall be reviewed based on the guidelines dated 4.7.2017 and recoveries, if any due, shall be made accordingly.</p>

<p><strong>Date of next increment under Rule 10 of the CCS RP Rules, 2016 &#8211; DoE</strong></p>



<p>The undersigned is directed to invite the attention to <strong>Rule 10 of the CCS (RP) Rules, 2016</strong> which provides for the entitlement of employees for drawal of <strong>annual increment</strong> either on 1st January or 1st July depending on the date of appointment, promotion or grant of financial upgrdation. The Sub-Rule (2) thereof provides that increment in respect of an employee appointed or promoted or granted financial up-gradation including up-gradation under <strong>Modified Assured Carrier Progression Scheme (MACPS)</strong> during the period between the 2nd day of January and 1st day of July (both inclusive) shall be granted on 1st day of January and the increment in respect of an employee appointed or promoted or granted financial up-gradation under <strong>MACPS </strong>during the period between the 2nd day of July and 1st day of January (both inclusive) shall be granted on 1st day of July.</p>

<p>2. A number of references were received in the Ministry of Finance seeking clarifications regarding drawal of next increment by the employees promoted on 1st July, 2016. On consideration of the matter, Department of Expenditure vide it’s Office Memorandum of even number dated 31.07.2018 has clarified that in case an employee is promoted or granted financial up-gradation including up-gradation under the <strong>MACP scheme </strong>on 1st January or 1st July, where the pay is fixed in the Level applicable to the post on which promotion is made in accordance with the <strong>Rule 13 of the CCS (RP) Rules, 2016</strong>, the first increment in the Level applicable to the post on which promotion is made shall accrue on the following 1st July or 1st January, as the case may be, provided a period of 6 months qualifying service is strictly fulfilled. The next increment thereafter shall, however, accrue only after completion of one year.</p>



<p>3. Consequent upon issue of Office Memorandum dated 31.07.2018 different Ministries/ Departments have sought clarification on applicability of DOE’s O.M dated 31.07.2018 keeping in view the provisions of <strong>Rule 10 of CCS (RP) Rules 2016 , Rule 22(I)(a)(1) of Fundamental Rules &amp; provisions of Stepping up of pay</strong>. The issues on which various Ministries/Departments have sought clarifications and decisions thereon are brought in the succeeding paragraphs.</p>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p><strong>Issue No. 1</strong>: Whether after promotion on 1st July and fixation of pay with two increments the date of next increment will be 1st January or 1st July</p></blockquote>



<p>4. During the regime of <strong>6th CPC</strong>, when the annual increment was admissible uniformly on 1st July every year, employees completing 6 months and above in the revised pay structure as on 1st July were eligible for grant of increment. In the <strong>7th CPC</strong> regime there are two dates of increments 1st January and 1st July. Keeping in view the spirit of 6th CPC, O.M dated 31.07.2018 was issued providing for accrual of next increment on 1st July/1st January in respect of employees getting promotion on 1st January/1st July provided 6 months qualifying service is strictly fulfilled.</p>



<p>5. The instructions contained in the O.M. dated 31.07.2018 are self-explanatory in respect of the cases of promotion/ financial up-gradation falling on 1st July or Pt January. These instructions provide that in case of promotion/financial up-gradation on 1st July and 1st January and getting fixation of pay in the Level applicable to the post in which promotion is made in accordance with Rule 13 of the CCS (RP) Rules 2016, the first increment in the level in which promotion is made shall accrue on the following 1st January or 1st July, as the case may be, provided a period of 6 months’ qualifying service is fulfilled.</p>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p><strong>Issue No.2:</strong> Accrual of next increment in case of regular promotion /financial up-gradation of an employee on any date other than the date of annual increment and option for pay fixation is exercised under FR 22(I)(a)(1).</p></blockquote>



<p>6. The opportunity to exercise of option for pay fixation under FR 22(I)(a)(1) is available to employees in case of promotion/financial up-gradation. Therefore, the Central Government Employee promoted on regular basis/granted financial up-gradation on any date other than the date of his/her annual increment in lower grade and exercises the option under FR 22(I)(a)(1) read with Department of Personnel &amp; Training’s OM No.13/02/2017-Estt.(Pay-I) dated 27.07.2017 for fixation of pay from the date of accrual of next increment in the scale of pay in lower grade, he may be allowed the 1st increment in promotional grade on 1st January/ 1st July as the case may be after completion of 6 months’ qualifying service after such fixation on 1st July/1st January (i.e., the date of increment in lower grade) on the analogy of Department of Expenditure’s OM dated 31.07.2018. The next increment, thereafter, shall however, accrue only after completion of one year.</p>



<p>7. Since there is material change, it has also been approved that the employees who have been regularly promoted or granted financial up-gradation on or after 01.01.2016 and desire to exercise/re-exercise option for pay fixation under FR22(I)(a)(1) shall be given an opportunity to exercise or re-exercise of the option there under. Such an <strong>option shall be exercised within one month of issue of this O.M.</strong></p>



<p>8. These instructions will be applicable with effect from 01.01.2016.</p>



<p>9. In so far as persons serving in the Indian Audit and Accounts Department are concerned, these orders issue after consultation with the Comptroller and Auditor General of India.</p>

<p>Please refer to Board’s letter of even no. dated 31.07-2017 forwarding therewith a copy of Ministry of Personnel, Public Grievances and pensions, Department of Personnel &amp; Training&#8217;s (MoPPG&amp;P/DoPT)0M No.13/02/2017-Estt.(Pay) I dated 27.07.2017 regarding guidelines on availability of option for fixation of pay on promotion from the Date of Next Increment (DNI) in the lower and method of fixation of pay from DNI, if opted for, in context of CCS(RP) Rules, 2016 for adoption of the same in Railways with respect to RS(RP) Rules, 2016.</p>
<p>2. Now Ministry of personnel, Public Grievances and Pensions, Department of personnel &amp; Training vide their 0M No.13/02/2017-Estt.(Pay-I) dated 28.08.2018 has clarified various aspects of their earlier 0M. The clarifications issued by DoP&amp;T shall be applicable mutatis mutandis in Railways with respect to RS(RP) Rules, 2016.</p>
<p>3. The &#8216;one month&#8217; period mentioned in the aforesaid 0M of DoP&amp;T dated 28.08.2018 under clarification to point of doubt at Sl No.2 shall be month from the date of issue of these instructions.</p>

<p>Subject:<em><strong> Availability of option for fixation of pay on promotion from the Date of Next Increment (DNI) in the lower post and method of fixation of pay from DNI, if opted for, in respect of Army Pay Rules 2017, Air Force Pay Rules 2017 and Navy Pay Regulations 2017 in respect of Officers and JCOs/OR equivalent.</strong></em></p>
<p>Reference is invited to Special Army Instructions (SAI-2008), Special Air Force Instructions (SAFI-2008), Special Navy Instructions (SNI-2008) dated 11.10.2008 and Army Pay Rules 2017, Air Force Pay Rules 2017 and Navy Pay Regulations 2017 dated 3.5.2017 in respect of Officers and JCOs/OR equivalent.</p>
<p>2. In 6th CPC regime pay fixation on promotion in respect of Defence Services Personnel was governed by provisions contained in SAI-2008, SAFI-2008 and SNI-2008. These provisions regulates pay fixation on promotion, wherein an Officer has an option to get his pay fixed in the higher post either from the date of his promotion or from the date of next increment. Similarly, consequent upon implementation of ih CPC, the pay fixation on promotion from the date of promotion is regulated by Rule 12 of the Army Pay Rules 2017, Air Force Pay Rules 2017 and Navy Pay Regulations 2017 dated 3.5.2017 in respect of Officers and JCOs/OR equivalent. This methodology of fixation of pay on promotion to a post carrying duties and responsibilities of greater importance, of a Defence Services Personnel in case he opts for pay fixation from the Date of Next Increment (DNI) has been considered in this Department.</p>
<p>3. After due consideration in this matter, the following is decided as follows:</p>
<p>(i) A Defence Personnel, who is promoted or upgraded from one rank to another, subject to the fulfilment of the eligibility conditions as prescribed in the relevant Recruitment Rules, to another post carrying duties or responsibilities of greater importance than those attaching to the post held by him/her. Such, Defence Personnel may opt to have his/her pay fixed from the Date of his/her<br />
Next Increment (either 1st July or 1st January, as the case may be) accruing in the Level of the post from which he/she is promoted, except in cases of appointment on deputation basis to an ex-cadre post or on direct recruitment basis or appointment/promotion on ad-hoc basis, as applicable in the Defence Services.</p>
<p>(ii) In case, consequent upon his/her promotion, the Defence Personnel opts to have his/her pay fixed from the date of his/her next increment (either 1st July or 1st January, as the case may be) in the Level of the post from which Defence Personnel is promoted, then, from the date of promotion till his/her  DNI, the Defence Personnel shall be placed at the next higher cell in the level of the post to which he/she is promoted.</p>

<p>(iii) Subsequently, on DNI in the level of the post to which Defence Personnel is promoted, his/her Pay will be re-fixed and two increments (one accrued on account of annual increment and the second accrued on account of promotion) may be granted in the Level from which the Defence Personnel is promoted and he/she shall be placed, at a Cell equal to the figure so arrived, in the Level of the post to which he/she is promoted; and if no such Cell is available in the Level to which he/she is promoted, he/she shall be placed at the next higher Cell in that Level.</p>

<p>(iv) In such cases where Defence Personnel opts to have his/her pay fixed from the date of his/her next increment in the Level of the post from which he/she is promoted, the next increment as well as Date of Next Increment (DNI) will be regulated accordingly.</p>

<li>It is further reiterated that in order to enable the officials to exercise the option within the time limit prescribed, the option clause for pay fixation on promotion with effect from date of promotion/ON I shall invariably be incorporated in the promotion/appointment order, as per applicability, so that there are no cases of delay in exercising the options due to administrative lapse.</li>
<li>This issues with the concurrence of Ministry of Finance vide their 1D No. 4-23/2017-IC/E.III (A) dated 22.3.2018.</li>

<p>Cases of promotion taking place in the pre-revised pay structure between 1.1.2006 and the date of notification of CCS (RP) Rules, 2008 and the subsequent merger of the pre-revised pay scales of the promotional and the feeder posts in a common Grade – Fixation of Pay – Regarding</p>

<p>Subject: Cases of promotion taking place in the pre-revised pay structure between 1.12006 and the date of notification of CCS(RP) Rules ,2008 and the subsequent merger of the pre-revised pay scales of the promotional and the feeder posts in a common Grade- fixation of Regarding.</p>
<p>The undersigned is directed to Say that consequent upon coming into force of the CCS(RP) Rules, 2008, which were notified on 298.2008 but are effective from 1.1.2006, fixation of pay on promotion on or after 1.1,2006 is carried out as per Rule 13 thereof. This Rule is invoked only in cases of promotion frotn one Grade pay to another in the revised pay structure.</p>
<p>2. In terms of Section I of Part-A of the First Schedule of the CCS(RP) Rules, 2008, which provides for revised pay structure in the form of applicable pay Bands and Grades pay corresponding to various pre-revised pay Scales, certain pre-revised pay Scales have been merged in a common Grade pay in the revised pay structure w.e.f. 1.1.2006, In view of this, the posts in those pre-revised pay scales which have been merged in a common Grade pay w.e.f. 1,1.2006, are normally required to be merged even if these posts constituted feeder and promotional grades in the pre-revised pay structure.</p>
<p>3. However, in cases where such merger of feeder and promotional posts in the wake of their come to lie in the Same grade pay has not taken place due to administrative reasons and the posts continue to retain their promotional and feeder character as per the relevant Recruitment Rules, this Ministry issued instructions vide OM 10/2/2011-E.III A dated 7.1.2013 providing for fixation of pay on promotion in such cases under Rule 13 of CCS (RP) Rules, 2008 subject to the conditions laid down therein.</p>
<p>4. Now, instances have been brought to the notice of this Ministry where the feeder and promotional posts have been merged in view of the merger of the pre- revised pay scales applicable to the erstwhile feeder and promotional posts in a common grade/post after the promulgation of CCS(RP) Rules), 2008, due to which the character of posts being promotional and feeder grades as existing during the period from 1.12006 to the date of notification of CCS(RP) Rules, 2008 stood rescinded with retrospective effect from 1.12006 and, consequently, a question has been raised as to whether Rule 13 of CCS(RP) Rules, 2008 may apply for fixation of pay on promotion taking place during the period between 1.1.2006 and the date of notification of the said Rules, when the fixation of pay was actually done as applicable in the event Of promotion in the pre-revised Structure.</p>
<p>5. The matter has been considered in the light of the provisions contained in the OM No. 20020/4/2010-Estt.D dt.13.9.2012 issued by the Department of Personnel &amp; Training, which has been issued in the context of the posts/grades merged in pursuance Of the recommendations of the 6th Central pay Commission. This OM provides, inter-alia, that the Status of a government servant as on 29.8.2008 including those who have earned promotion between 1.12006 and 29.09.2008 will be protected as appointment/promotions are made as per the provisions of the recruitment rules applicable to the post/grade.</p>
<p>6. Accordingly, it has been decided that in cases where promotion took place in the pre-revised pay structure during the period between 1.12006 and the date of notification of CCS(RP) Rules, 2008 when the pre-revised and revised pay scales were different and the posts carried the character of feeder and promotional grades, pay fixation on such promotion Shall be allowed under Rule 13 of the CCS(RP) Rules, 2008, subject to the following conditions:-</p>
<blockquote><p>(i) The promotion had taken place between 1.1.2006 and the date of notification Of CCS(RP) Rules, 2008 as per the Recruitment Rules then<br />
in vogue, which clearly provided for such posts being promotional grade for the feeder grade from where the promotion took place and where the posts were subsequently merged in a single post/grade consequent upon promulgation of the CCS(RP) Rules, 2008.</p>
<p>(ii) FR. 22 (r) I), which was applicable for fixation Of pay on promotion before promulgation of CCS(RP) Rules, 2008, was invoked for fixation<br />
of pay in these cases in the pre-revised structure during the period between 1.1.2006 and the date of notification of the CCS(RP) Rules 2008.</p>
<p>(iii) The concerned employees had opted to come over to the revised pay structure from a date occurring prior to the date Of notification of CCS(RP) Rules, 2008.</p>
<p>(iv) The concerned Recruitment Rules have been amended subsequently to provide for merger of these grades into a single grade/post.</p></blockquote>
<p>7. This order applies only in case of promotions carried out in the pre-revised structure durirg 1.1.2006 and the date of notification of CCS(RP) Rules, 2008. Thus, the benefit of Rule 13 of CCS(RP) Rules, 2008 would not apply in Cases of appointment to the post which was in the higher pay scale in the pre-revised pay structure, where such appointment is made after the date of notification of CCS(RP) Rules, 2008.</p>
<p>8. In its application to the employees serving under the Indian Audit and Accounts Department, this order issues with the concurrence Of the office Of CMG.</p>
