<h3 class="has-text-align-center wp-block-heading"><strong>REVISED CHARTER OF DEMANDS</strong></h3>



<p class="has-text-align-center"><strong>(Submitted for approval of the National Executive Committee meeting to be held on 26-09-2020)</strong></p>



<p>1. Scrap New Contributory Pension Scheme (NPS). Restore old defined benefit Pension Scheme (OPS) to all employees. Guarantee 50% of the last pay drawn as minimum pension.</p>



<p>2. (a) Scrap the draconian FR 56(j) and Rule 48 of CCS (Pension) Rules 1972. Stop terrorizing and victimizing employees.</p>



<p>(b) Withdraw the attack against the recognised status of Associations and Federations.</p>



<p>(c) Withdraw the anti-worker Wage/Labour codes and other anti-labour reforms.</p>



<p>(d) Stop attack on trade union rights.</p>



<p>3. (a) <a href="https://centralgovernmentnews.com/freezing-of-dearness-allowance-to-central-government-employees-and-dearness-relief-to-central-government-pensioners-at-current-rates-till-july-2021/" target="_blank" rel="noreferrer noopener">Withdraw the orders freezing the DA and DR of employees and Pensioners</a> and impounding of arrears till 30.0-.2021.</p>



<p>(b) Implement five year wage revision and Pension revision to Central Government employees and Pensioners. Appoint 8th Central Pay Commission and revise the Pay, Allowances and Pensionary benefits of Central Government employees and Pensioners with effect from 01-01-2021.</p>



<p>(c) Honour the assurance given by Group of Ministers (GoM) to NJCA leaders on 30-06-2016. Increase minimum pay and fitment formula recommended by 7th CPC. Grant HRA arrears from 01-01-2016.</p>



<p>(d) Withdraw “Very Good” bench mark for MACP, grant promotional heirachy and date of effect of <a href="https://centralgovernmentnews.com/latest-macp-orders-from-dopt/" target="_blank" rel="noreferrer noopener">MACP </a>from 01-01-2006.</p>

<p>4. Stop ban on creation of new posts. Fill up all seven lakhs vacant posts in Central Government departments in time bound manner. Scrap National Recruitment Agency and introduce Department wise recruitment and Regional recruitment for Group B and C posts. Stop re-engaging retire personnel in Central Govt. services.</p>



<p>5. Stop Corporatisation and privatisation of Railways, Defence and Postal Departments. Withdraw closure/ merger orders of Govt. of India Printing Presses and Postal Stores depots/ Postal Stamp depots. Stop proposed move to close down salt department. Stop outsourcing and closure of Govt. establishments.</p>

<p>(b) Regularise all casual and contract workers including those joined service on or after 01-09-1993.</p>



<p>7. Settle all Covid-9 related issues pertaining to Central Govt. employees and Pensioners on top priority basis. Treat the period of absence during lock down as duty. Grant full wages to casual, part-time, contingent contract workers during the lockdown period.</p>



<p>8. Grant equal pay for equal work for all. Remove disparity in pay scales between Central Secretariat staff and similarly placed staff working in field units of various departments.</p>



<p>9. Implement 7th CPC wage revision and pension revision to remaining Autonomous body employees and pensioners. Ensure payment of full arrears without further delay. Grant Bonus to Autonomous body employees pending from 2016-17 onwards.</p>



<p>10. Remove arbitrary 5% ceiling imposed on compassionate appointments. Grant appointment in all eligible cases.</p>



<p>11. Grant five time-bound promotions to Group B &amp; C employees. Complete cadre review in all departments in a time bound manner.</p>



<p>12. Ensure prompt functioning of various negotiating forums under the JCM Scheme at all levels.</p>

<p><strong>Subject: Proposed Protest by Government Employees from March 15, 2019 to March 30, 2019 to protest against National Pension Scheme (NPS) and to demand hike in Minimum pay and fitment factor under 7th Central Pay Commission &#8211; Instructions under CCS (Conduct Rules), 1964 &#8211; Regarding.</strong></p>



<p>It has been brought to the notice of the Government that a forum by the nomenclature of National Joint Council of Action (NJCA) has decided to organize protest from March 15, 2019 to March 30, 2019 to protest against National Pension Scheme (<a href="https://centralgovernmentnews.com/category/nps/" target="_blank" rel="noreferrer noopener" aria-label="NPS (opens in a new tab)">NPS</a>) and to demand hike in Minimum pay and fitment factor under 7th Central Pay Commission</p>



<p>The instructions issued by the Department of Personnel and Training prohibit the Government servants from participating in any form of strike/protest including mass casual leave, go slow etc. or any action that abet any form of strike/protest in violation of Rule 7 of the CCS (Conduct) Rules, 1964. Besides, in accordance with the proviso to Rule 17(I) of the Fundamental Rules, pay and allowances is not admissible to an employee for his absence from duty without any authority. As to the concomitant rights of an Association after it is formed, they cannot be different from the rights which can be claimed by the individual members of which the Association is composed. It follows that the right to form an Association does not include any guaranteed right to strike/protest.</p>



<p>There is no statutory provision empowering the employees to go on strike. The Supreme Court has also agreed in several judgements that going on a strike/performing any sort of protest is a grave misconduct under the Conduct Rules and that misconduct by the Government employees is required to be dealt with in accordance with law. Any employee going on strike/protest in any form would face the consequences which, besides deduction of wages, may also include appropriate disciplinary action. Kind attention of all employees of this Department is also drawn to this Department’s O.M. No.33012/1/(S)/2008 Estt.(B) dated 12.9.2008, on the subject for strict compliance (enclosed as Annexure-A).</p>



<p>All officers are requested that the above instructions may be brought to the notice of the employees working under their control. All officers are also requested not to sanction Casual Leave or any other kind of leave to the officers and employees, if applied for, during the period of proposed Dharna/demonstration, and ensure that the willing employees are allowed hindrance free entry into the office premises.</p>



<p>In case employees go on protest anytime during the period 15.03.2019 to 30.03.2019, all Divisional Heads are requested to forward a report indicating the number and details of employees, who are absent from duty during the period of said protest, i.e. from 15.03.2019 to 30.03.2019.</p>

<p>Sub: <em><strong>Long pending prominent issues of the Central Government Employees</strong></em></p>



<p>You may kindly recall that, aggrieved by  retrograde recommendations of the VII CPC in general and particularly  related to Minimum Wage and Fitment Formula as also on the issue of  Restoration of Defined Old Pension Scheme for the Central Government  Employees, the Central Government Employees, including Railwaymen, had  decided to go on &#8220;<strong>Indefinite Strike</strong>&#8221; w.e.f. 11th July, 2016 since 06:00  hrs., in the morning. With a view to resolve these important issues  amicably, a meeting was convened by your goodself on 30th June, 2016,  wherein Hon&#8217;ble Finance Minister, Hon&#8217;ble Minister for Railways and  Hon&#8217;ble Minister of State for Railways, were also present.</p>



<p>After detailed deliberations, the 
representatives of the Central Government Employees(NC/JCM) were assured
 that, the Union Government would favourably consider their demand of 
improvement in Minimum Wage and Fitment Formula, recommended by the VII 
CPC. It was also assured to look into the demand of Scrapping 
Contributory NPS in respect of the Central Government Employees and 
restoration of Defined Old Pension Scheme.</p>



<p>The representatives of the <a href="https://centralgovernmentnews.com/" target="_blank" rel="noreferrer noopener" aria-label="Central Government Employees (opens in a new tab)">Central Government Employees</a> were made to understand in the said meeting that,  the Government would take decision in regard to above demands within a  timeframe of four months by constituting committees for the purpose. On  the assurance of the Group of Ministers, the proposed &#8220;<strong>Indefinite  Strike</strong>&#8221; was deferred by the NC/JCM.</p>



<p>You may kindly appreciate that, 
substantially long time has already elapsed and the Federations of the 
Railways and other Central Government Employees, who had participated in
 the said meeting, have still been awaiting the positive outcome of the 
discussions held and assurances given by the Group of Ministers therein.</p>



<p>There is, therefore, serious  discontentment brewing among the Central Government Employees, including  the Railwaymen, and it is quite difficult to further contain the same  any longer. There is, therefore, tremendous pressure to revoke the  decision of the &#8220;Indefinite Strike&#8221; of the<strong> Central Government Employees</strong>  due to non-settlement of the said issues.</p>



<p>It would, therefore, be largely fair and
 conducive for harmonious relations of the Central Government Employees 
with the Central Government, that, at least the following two major 
issues be settled without any further delay:-</p>



<p><strong>(i) Restoration of Defined Old Pension  Scheme for all Central Government Employees, irrespective of their date  of appointment, which was available for the Central Government Employees  appointed before 01.01.2004.</strong></p>



<p><strong>(ii) Improvement in Minimum Wage and Fitment Formula.</strong></p>



<p>I earnestly hope that, your goodself 
will take these issues with all seriousness for resolving the same

<p>As you are aware that the <a href="https://centralgovernmentnews.com/" target="_blank"><strong>Central Government employees</strong></a> are in quite anguish as agitating various issues since 1st January 2016 after submission of report of the 7th CPC. In the Standing Committee, JCM Staff Side have raised many issues which are still unresolved, the National Council is not taking place since more than a decade, the Standing Committee also not called since one year. The various Government employees are agitated and are demonstrating on the Charter of Demands submitted to you as well as Group of Ministers, headed by Hon&#8217;ble Home Minister on 30th June 2016.</p>
<blockquote><p><strong>Main issues of increasing Minimum Wage, Fitment Formula as well as announcing Guaranteed Pension at par with the Old Pension Scheme are creating lots of anguish in the mind of the Central Government Employees.</strong></p></blockquote>
<p>The JCM Staff Side feels that the Government have no priority for redressal of the grievances of Central Government employees which is a very serious trend and machinery of the JCM have become defunct.</p>
<p>We hope being the Chairman of National Council&nbsp;&#8211; JCM, you should immediately call a meeting of JCM and issue necessary instructions to Secretary DOPT and other Secretaries of other departments of Government of India to co-operate with the Staff Side and have regular meetings of National Council / Departmental Council JCM meetings as prescribed as per scheduled.</p>

										<content:encoded><![CDATA[<h3>Revision of Minimum Pay and Fitment formula due to increased revenue collections of the Central Government</h3>
<p>Comrades,</p>
<p>Today none of the 7th CPC related demands of Central Government Employees are settled. The assurance given by the Group of Ministers to the NJCA leaders regarding increase in Minimum Pay and Fitment formula is in paper even after a lapse of 20 months. Now the Finance Minister has replied in Parliament that &#8220;no change in Minimum Pay and Fitment formula is at present under consideration&#8221;.</p>
<p>To avert the 11th July CG employees strike the Hon&#8217;ble Prime Minster had instructed the group of Hon&#8217;ble Ministers including Shri Rajnath Singhji, Hon&#8217;ble Home Minister, Shri Suresh Prabhuji , Hon&#8217;ble Railway Minister and Shri Arun Jaitelyji , Hon&#8217;ble Finance Minister to hold discussions with the Staff Side (JCM) on 30th June 2016 and the Shri Arun Jaitelyji , Hon&#8217;ble Finance Minister had published a written assurances in the Government website on 6th July 2016 leading to deferment of the strike .</p>
<p><strong style="color: #c60;">Pay Commission Objective</strong>: It is the endeavour of every pay commission to ensure that the pay and allowances of employees should be ‘fair and reasonable&#8217;. The pay structure should also motivate the employees to reasonable levels of performance in the tasks assigned to them, so that the general public derive the benefit of their service as intended.</p>
<p style="color: #c60;"><strong>Our demand of revision of Minimum Pay and Fitment formula is quite justified.</strong></p>
<p>Comparison of earlier wage hike we can observe that the fitment factor of 2.57 times is the lowest comparing to other pay commissions. If we make a study of earlier pay commission.</p>

<p>The financial position of the Central Government is very good. Even the GDP (Gross Domestic Product) has shown increase in last few years which is around 7% , the Indian economy is fastest growing and placed 7th in the world ( which is at 2,250.987 billions of $ ), comparing to wages paid in the world our wages are at lower level. The Government fiscal budget deficit equal to 3.50 percent of the country&#8217;s Gross Domestic Product in 2016. Compared to 2008 where the fiscal deficit was at 7.8%, but today the fiscal deficit is contained at 3.5%. This is also a healthy sign of the economic status of the Central Government financial status, the budget fiscal deficit is always below 4%.</p>
<p>Direct tax collections in 2017-18 at Rs 9.95 lakh crore, exceeded the revised budgetary target of Rs 9.8 lakh crore. Also, 6.84 crore income tax returns filed in the year against 5.43 crore in the previous year signalling a rise of 26% . A net of 99.5 lakh new assesses were added to the tax net.</p>
<p>Net collection from corporate tax went up 17.1 per cent while that from personal income tax rose 18.9%.</p>
<p>The revenue collection from Goods and Services Tax (GST) exceeded Rs 1 lakh crore in April 2018, GST revenue collected in April 2018 came at Rs 1,03,458 crore.</p>
<p>With the improved economic climate, introduction of e-way bill and improved GST compliance, GST collections would continue to show a positive trend.</p>
<p>The wage bill of the Central Government on in its employees is less than 10% or 3.4% of the GDP, which is less compared to various countries world wide .</p>
<p>Vacancy of the Central Government is about 15% , more than 4 lakhs vacancies are existing in the Central Government the work load is being carried out by the existing employees. The Government being a model employer should pay for its employees and motivate them to work more for implementation of its policies.</p>
<p>Hence due to the improved revenue earning of the Central Government, as assured to the staff side JCM by the Group of Ministers in respect of increase of Minimum Pay and Fitment formula, the Central Government should increase the Minimum Pay and Fitment formula.</p>

<p><b>7th Pay Commission Employees unions to meet today on minimum pay hike</b></p>

<p>Central government employees unions leaders will meet today to discuss their demand of minimum pay hike.It will be the meeting of the Standing Committee Members of Staff Side, National Council JCM over the demand of hiking minimum pay beyond the 7th Pay Commission recommendation.</p>
<p>National Council (staff Side) Joint Consultative Machinery (JCM) is an umbrella organisation of various Central Government employees’ unions, including Railways, post and telegraph and Income Tax.</p>
<p>In wake of DoPT letter letter, Shiva Gopal Mishra, Secretary National council (staff Side), Joint Consultative Machinery has called for the meeting to give proper reply to the Department of Personnel and Training (DoPT).</p>
<p>DoPT letter dated October 30, addressed to Shiv Gopal Mishra, Secretary, Staff Side, National Council JCM stating that the demand for increase in minimum Pay and fitment formula do not appear to be treated as an anomaly, therefore, these do not come under the purview of National Anomaly Committee (NAC).</p>
<p>However, National Anomaly Committee (NAC) has been formed in September, 2016 to look into pay anomalies arising out of the implementation of the 7th Pay Commission’s recommendations and the government had said the NAC would discuss any pay hike agenda.</p>
<p>Earlier, Finance Minister Arun Jaitley had promised with central government employees unions’ leaders in Home Minister Rajnath Singh’s house on June 30, 2016 for hiking Pay and fitment formula through the appoint of a High Level Committee, when the unions had threatened to carry out an indefinite strike on July 11, 2016.</p>
<p>The High Level Committee has not yet been constituted, while the Cabinet cleared the 7th Pay Commission recommendations on June 29, 2016.</p>
<p>Shiva Gopal Mishra Secretary National council (staff Side) JCM is also planning to meet PM Modi to raise the minimum pay hike issue before him.</p>
<p>Accordingly, he said, “We have faith in Prime Minister’s office, we have faith in PM Modi. We are sure that in order to maintain good industrial relations in the country, PM Modi will find an alternate solution.”</p>
<p>Media reports already stated that minimum pay and fitment factor beyond 7th Pay Commission recommendation was under consideration of the Central government and NAC was likely to recommend minimum pay hike to Rs 21,000 from existing Rs 18,000 and fitment factor to 3.00 times from existing 2.57 times, but DoPT letter now says minimum pay and fitment factor doesn’t come under the purview of the NAC.</p>
<p>The Unions have been demanding minimum pay Rs. 26,000 instead of Rs 18,000 with 3.68 fitment factor.</p>

<div dir="ltr" style="text-align: left;">During the last 2 – 3 months both print and electronic media are continuously reporting that increase in 7th CPC Minimum Pay and Fitment Factor is under serious consideration of the Govt. and National Anomaly Committee will give its recommendation to Govt. and orders for increased Minimum Pay and Fitment Formula will be given effect from April 2018. We are reproducing below a letter from Govt. dated 30.10.2017 addressed to Secretary, Staff Side , National Council JCM stating that the demand for increase in Minimum Pay and Fitment Formula will not come under the purview of National Anomaly Committee. Further Govt. has not yet constituted the HIGH LEVEL COMMITTEE for increasing Minimum Pay and Fitment Formula as assured by the Group of Ministers including Home Minister Sri Rajnath Singh, Finance Minister Shri Arun Jaitley on 30.06.2016. The so-called Senior Officers Committee has also not discussed this agenda even though staff Side has repeatedly demanded discussion and settlement as per the assurance given by Senior Cabinet Ministers. Now 17 months are over. 32 lakhs Central Govt. Employees and 33 lakhs Pensioners are being continuously betrayed by the NDA Govt.</div>

<p>There are various reports in the news media, print media &amp; social media regarding the hike in the minimum wage of Central Government employees from the existing Rs 18,000/-  to Rs 21,000/- and fitment formula from 2.57 to 3.00, which shall be implemented from 1st January 2018. The same shall be announced in the National Anomaly Committee due on 9th of October.</p>

<p>Comrades,</p>
<p>We cannot confirm this news, comrades we should concentrate on struggle path as the Confederation has given the series of programs , I hope the Government will implement the hike in minimum wage for CG employees and revise the fitment formula also from the existing 2.57 to 3.00 even though the Staff side JCM has demanded Rs 26,000/ as minimum wage and fitment formula of 3.56 , this hike should be from 1/1/2016 not 1/1/2018 as per media reports.</p>
<p>&nbsp;</p>
<p>In fact the Central Government has to take the political decisions on the wage hike , in fact the group of ministers of the Central Government have agreed to raise the minimum wage for CG employees on 30th June 2016 . I hope the commitment of the union minsters shall be honoured now.</p>
<p>&nbsp;</p>
<p>Secondly the economy of the country which was going very well during past three years has showed down ward trend in last one year as the GDP which was at 9.1 in 2015-16 has reduced to 5.7 in 2017-18 .The economic activity has to take place, it is also observed during the past one year, in spite of economic recessions, the Government revenue collection has increased considerably. To improve the economic activity of the country and increase the GDP the Central Government should spend its funds which is available with them .</p>
<p>&nbsp;</p>
<p>If the Central Government increases the minimum wage and fitment formula for its employees, the Central Government employees gets back 40% of the wage increase through the Income Tax and GST . So hardly a Government servant is left out with 60% wage hike , here also he spends the amount credited to him , as such an economic activity is induced in the public which will help to create more demand and employment activity.</p>

<p>I hope the Central Government takes a political decisions on increase of minimum wage hike and fitment formula for more than one crore employees which will also benefit the public and the CG employees.</p>
