<p class="has-text-align-center"><strong>OFFICE MEMORANDUM</strong></p>



<h3 class="wp-block-heading">Subject: Instructions for the purchase of laptops/ notebooks and similar devices for eligible officers &#8211; revised guidelines.</h3>



<p>In supersession to this Ministry’s Office Memorandum bearing&nbsp;No. 08(34)/ 2017-E.II(A) dated 20.02.2018&nbsp;and&nbsp;OM No. 3(6)/2020-E.II(A) dated 27.03.2020, regarding purchase of Note Book/ Laptop by Ministries/ Departments &amp; delegation of powers thereof, it has been decided that laptop, tablet, phablet, notepad, ultra-book, notebook, net-book, mobile or devices of similar categories (referred to as ‘Device’ in this OM) may be issued to eligible officers for discharge of official work. These powers shall be exercised in consultation with the Financial Adviser by the Secretary of Ministry/ Department, duly taking into consideration the functional requirements and budgetary provisions. However, the Secretary, for justifiable reasons, may delegate these powers to any other authority (not below the level of Joint Secretary).&nbsp;<strong>This would, however, be subject to the following conditions:</strong></p>



<p><strong>2. Eligibility:</strong></p>

<p><strong>3. Cost of Device</strong>: The cost of device shall be Rs. 1,00,000/- + taxes. However, for devices with Make-in-India (MII) component of more than 40%, the price ceiling shall be Rs.1,30,000/- + taxes. The above price ceiling is inclusive of cost of standard software*.</p>



<p>*<strong>Standard Software</strong>: Any software (Operating System, Antivirus software or MS-Office&nbsp;etc.) that is essential for the running of device towards discharge of official functions/duties.</p>



<p><strong>4. Purchase Procedures</strong>: As prescribed under GFRs read with procurement guidelines issued by this department. </p>



<p><strong>5. Safety, Security &amp; Maintenance of Device:</strong>&nbsp;The device shall be property of Government upto 4 years from date of purchase. The expenditure to be incurred for the maintenance and upkeep of the device post warranty period is to be borne by the department concerned. However, the officer, who is given the device, shall be personally responsible for safety and security of data/information. The officer concerned will be at liberty to get the device insured at his/her personal cost.</p>



<p><strong>6. Book value of the device</strong>: For the purpose of calculation of the book value, a depreciation of 25% per year (pro-rata basis), on straight line method, be adopted.&nbsp;Illustration to determine the book value of the device is given at&nbsp;<strong>Annexure-A.</strong></p>



<p><strong>7. Retention of device:</strong></p>



<p>(a) Post completion of four years of usage, the officer shall retain the issued device. Concerned Ministry/ Department shall ensure that the data in the device is completely wiped out (data sanitized) before the device is handed over to the officer for retention.</p>



<p>(b) No new device may be sanctioned to an officer who has already been allotted a device, in a Ministry / Department, up to four years except in case of repair which is declared as ‘beyond economical repairs’. In such case, the device shall be retained by the employee without paying any amount and he/she will be eligible for a new device (based on the functional necessity). A BER certificate to this effect shall be obtained from the OEM or its authorized service center or agency/company providing AMC services to the department.</p>



<p><strong>8. Beyond Economical Repair (BER):</strong>&nbsp;When repair cost is considered too high (exceeding 50% of book value of equipment taking depreciation into account). Such cases should be dealt on case-to-case basis and should have concurrence of Financial Advisor of the Department.</p>



<p><strong>9. Conditions at the time of transfer, Superannuation etc.:</strong></p>



<p>(a) In case where, at the time of purchase of device if the residual service of the officer is less than 4 years [or in case the officer is transferred/ deputed to State Govt. and with residual service of less than 4 years] or the officer leaves the Government Service within 4 years of purchase of such device, the officer concerned will have the option of retaining the device by paying the amount equal to book value of the device on such date of relief from Government of India.</p>



<p>(b) Upon transfer/ deputation of the officer to other Ministry/ Department/ Attached/ Sub-ordinate offices of the Government of India or to the State Government in case of Officers of the All-India Services, the officer shall carry the device to his/her new place of posting, this fact should be specifically mentioned in the Last Pay Certificate (LPC) along with copy of the bill.</p>



<p><strong>10. Instructions for Ministries/ Departments:</strong></p>



<p>(a) For the officials who are currently holding laptops, notebooks or similar devices in accordance with the provisions of O.M. dt. 27.09.2016, O.M. dt. 20.02.2018 &amp; O.M. dated 27.03.2020, the terms &amp; conditions for retention of the device shall now be governed as per Para 7 of this OM and in case of transfer/ deputation/ superannuation of the officer provisions of Para 9 above shall be applicable.</p>



<p>(b) The applicability of the provisions of this order to the officers of Armed Forces/ Para-Military Forces, officers of MoD &amp; other similar establishments dealing with sensitive data would be subject to restrictions imposed by the concerned departments/ organizations duly taking into consideration the security of information. In all such cases the security of the information shall be the responsibility of the concerned department.</p>



<p>11. This OM is applicable to all officers of Ministries /Departments of Government of India (including attached and subordinate offices). However, the following categories are outside the purview of these instructions:</p>



<p>(a) Minister and their personal staff (outsiders whose appointment is co-terminus to the term of Minister).<br />(b) Public Sector Undertaking &amp; Government Companies<br />(c) State Governments<br />(d) Autonomous Bodies<br />(e) Consultants engaged by Ministries/Departments</p>



<p>12. This is issued with the approval of Finance Secretary &amp; Secretary (Expenditure).</p>

<p><strong>Example</strong><br />An eligible officer is issued a device (including standard software) costing Rs. 1,00,000/- plus applicable taxes and levies. Calculation of Depreciation, book value of the device (including software) is as below:</p>



<p><strong>Formula:</strong><br /><strong>Percentage of depreciation = (100/48) X No. of months elapsed or completed from&nbsp;</strong><strong>the date of purchase of the device.</strong></p>

<p>The undersigned is directed to refer to Board’s letter of even no. dated 05.08.2021 on the aforesaid subject and to say that the competent authority has noted, from the data furnished by CCAs on compassionate appointment cases, that data is not up to date. Therefore, the compassionate appointments data furnished by CCAs needs to be updated.</p>



<p>2. It is further requested to confirm if arrangements are in place in the zone, in relation to the procedure for compassionate appointments, in compliance with DoPT’s O.M. dated 23.08.2021.</p>

<h3 class="wp-block-heading">Subject: Revised rates of Dearness Allowance to the employees of Central Government and Central Autonomous Bodies continuing to draw their pay in the pre-revised pay scale/Grade Pay as per 5th Central Pay Commission from 01.07.2021.</h3>



<p>The undersigned is directed to refer to this Department&#8217;s O.M. No. 1/3(2)/2008-E.II(B) dated 13th August, 2021 on the subject mentioned above and to say that the rate of Dearness Allowance in respect of employees of Central Government and Central Autonomous Bodies, who are continuing to draw their pay In the pre-revised pay scale/Grade Pay as per 5th Central Pay Commission, shall be enhanced from the existing rate of <strong>356% to 368%</strong> of the Basic Pay with effect from <strong>1st July 2021</strong>.</p>

<p>3. The contents of this Office Memorandum may also be brought to the notice of all organisations under the administrative control of the Ministries/Departments which have adopted the Central Government scales of pay.</p>

<p><strong>Subject: Grant of Non-Productivity Linked Bonus (ad-hoc bonus) to Central Government Employees for the year 2019-20</strong></p>



<p>The undersigned is directed to convey the sanction of the President to the grant of Non-Productivity Linked Bonus (Ad-hoc Bonus) equivalent to <strong>30 days</strong> emoluments for the accounting year 2019-20 to the Central Government employees in Group ‘C’ and all non-gazetted employees in Group ‘B’, who are not covered by any Productivity Linked Bonus Scheme. The calculation ceiling for payment of ad-hoc <strong><a href="https://centralgovernmentnews.com/category/bonus/" target="_blank" rel="noreferrer noopener">Bonus</a></strong> under these orders shall be monthly emoluments of Rs.7000/-, as revised w.e.f 01/04/2014 vide OM No.7/4/2014-E.III(A), dated 29th August, 2016. The payment of ad-hoc Bonus under these orders will also be admissible to the eligible employees of Central Para Military Forces and Armed Forces. The orders will be deemed to be extended to the employees of Union Territory Administration which follow the Central Government pattern of emoluments and are not covered by any other bonus or ex-gratia scheme.</p>



<p>2. The benefit will be admissible subject to the following terms and conditions:-</p>



<h4 class="wp-block-heading"><a href="https://centralgovernmentnews.com/78-days-bonus-for-non-gazetted-railway-employees-payment-of-productivity-linked-bonus-2019-20/" target="_blank" rel="noreferrer noopener">78 days Bonus for non-gazetted Railway employees &#8211; Payment of Productivity Linked Bonus 2019-20</a></h4>



<ul class="wp-block-list"><li>Only those employees who were in service as on 31.3.2020 and have rendered at least six months of continuous service during the year 2019-20 will be eligible for payment under these orders. Pro-rata payment will be admissible to the eligible employees for period of continuous service during the year from six months to a full year, the eligibility period being taken in terms of number of months of service (rounded off to the nearest number of months);</li><li>The quantum of Non-PLB (ad-hoc bonus) will be worked out on the basis of average emoluments/calculation ceiling whichever is lower. To calculate Non-PLB (Ad-hoc bonus) for one day, the average emoluments in a year will be divided by 30.4 (average number of days in a month). This will, thereafter, be multiplied by the number of days of bonus granted. To illustrate, taking the calculation ceiling of monthly emoluments of Rs. 7000 (where actual average emoluments exceed. Rs.7000), Non-PLB (Ad-hoc Bonus) for thirty days would work out to Rs. 7000×30/30.4=Rs.6907.89 (rounded off to Rs.6908/-).</li><li>The casual labour who have worked in offices following a 6 days week for at least 240 days for each year for 3 years or more (206 days in each year for 3 years or more in the case of offices observing 5 day week), will be eligible for this Non-PLB (Ad-hoc Bonus) Payment. The amount of Non-PLB (ad-hoc bonus) payable will be (Rs.1200×30/30.4 i.e.Rs.1184.21 (rounded off to Rs.1184/-). In cases where the actual emoluments fall below Rs.1200/- p.m., the amount will be calculated on actual monthly emoluments.</li><li>All payments under these orders will be rounded off to the nearest rupee.</li><li>Various points regarding regulation of Ad-hoc/Non-PLB Bonus are given in the Annexure.</li></ul>



<p>3. The expenditure on this account will be debitable to the respective Heads to which the pay and allowances of these employees are debited.</p>



<p>4. The expenditure to be incurred on account of Non-PLB (Ad-hoc Bonus) is to be met from within the sanctioned budget provision of concerned Ministries/ Departments for the current year.</p>

<p>Subject:  <strong>Expenditure Management &#8211; Further Economy Measures</strong></p>



<p>With a view to improving the quality of public expenditure, containing non-developmental expenditure and ensuring availability of adequate resources for meeting the needs of critical priority schemes, Ministry of Finance, has from time to time issued instructions on Expenditure Management. In the context of the present fiscal situation and the consequent pressure on Government resources, there is a need for further economy and rationalization of non-priority expenditure, while protecting and preserving priority expenditure. With this objective, the following economy instructions will come into force with immediate effect.</p>



<p><strong>1. ADMINISTRATIVE EXPENDITURE :</strong></p>



<p>All Ministries/ Departments including Attached Offices/ Subordinate Offices and Autonomous Bodies shall observe the following instructions for curtailing Administrative Expenditure.</p>



<p>a.) No printing/publishing of books, publications, documents, etc. will be done on imported paper, except where printing is done abroad by Indian Missions, etc.<br />b.) Expenditure on functions such as celebrations of Foundation Day, etc. should be discouraged or if felt necessary be appropriately curtailed. In any case, travel for such functions and provision of bags or mementoes should be avoided.<br />c.) Consultancy Assignments – All Ministries/Departments may carry out a review of the individual Consultants appointed in their respective Ministries /Departments in consonance with the provisions of GFR and reduce the number of Consultants to the minimum requirement. Due economy may be observed while determining the fees of the Consultants and care may be taken that such fees are not disproportionate to the quality and quantity of work to be carried out by the Consultants.</p>

<p><strong>2. CREATION OF POSTS :</strong></p>



<p>a.) There will be a ban on creation of new posts, except with the approval of Department of Expenditure, in Ministries/Departments, Attached Offices, Subordinate Offices, Statutory Bodies and Autonomous Bodies.<br />b.) This ban will cover all creation of posts under powers which have been delegated to any organization regardless of the source of such authority or power.<br />c.) If any posts have been created after 01.07.2020 under delegated powers or authority, without approval of Department of Expenditure and have not yet been filled, then such posts shall not be filled. If it is deemed absolutely essential to fill them, proposals may be sent for approval of Department of Expenditure.<br />3. Secretaries of the Ministries/ Departments, being the Chief Accounting Authorities as per Rule 70 of GFR, shall be fully charged with the responsibility of ensuring compliance of the above instructions. Financial Advisers shall assist respective Departments in securing compliance with these measures.</p>

<p>Kind attention is invited to the Order No. 40-3/2020-DM-I (A) dated 15th April, 2020 whereby the Ministry of Home Affairs have issued consolidated revised guidelines on the measures to be taken by the Ministries / Departments of Government of India, State/UT Governments and State / UT Authorities for containment of <a href="https://centralgovernmentnews.com/tag/covid-19/" target="_blank" rel="noreferrer noopener">COVID-19</a> in the country.</p>



<p>2. Vide para 3 read of the said order, the Ministry of Home Affairs have, inter-alia, allowed select additional permitted activities as enumerated in para 5 to 20 of the said order. As per para 18 (ii), all Ministries / Departments under Government of India to function with effect from 20th April, 2020. The para 18 is reproduced below &#8211;</p>



<p>18. Offices of the Government of India, its Autonomous / Subordinate offices will remain open, as mentioned below: </p>



<ul class="wp-block-list"><li>Defence, Central Armed Police Forces, Health and Family Welfare, Disaster management and Early Warning Agencies (IMD, INCOIS, SASE and National Centre of Seismology, CWC), National Infomatics Centre (NIC), Food Corporation of India (FCI), NCC, Nehru Yuva Kendras (NYKs) and Customs to function without any restriction.</li><li>Other Ministries and Departments, and offices under their control, are to function with <strong>100%</strong> attendance of Deputy Secretary and levels above that. Remaining officers and staff to attend upto <strong>33%</strong> as per requirement.</li></ul>



<p>4. The undersigned has been directed to convey that the above guidelines of the Ministry of Home Affairs, Government of India be scrupulously followed.</p>

<p>Subject:- <strong>Rate of Dearness Allowance applicable w.e.f. 01.07.2019 to the employees of Central Government and Central Autonomous Bodies continuing to draw their pay in the pre revised pay scale / Grade Pay as per 6th Central Pay Commission</strong></p>



<p>The undersigned is directed to refer to this Department’s O.M. o. 1/3(1)/2008-E.II(B) dated 8th March, 2019 revising the rate of Dearness Allowance (DA) w.e.f. 01.01.2019 in respect of employees of Central Government and Central Autonomous Bodies continuing to draw their pay in the pre-revised pay scale/Grade Pay as per <strong>6th Central Pay Commission</strong>.</p>



<p>2. The rate of DA admissible to above categories of employees of Central Government and Central Autonomous Bodies shall be enhanced from the existing <strong>154% to 164% w.e.f. 01.07.2019</strong>.</p>

<p>3. The provisions contained in paras 3, 4 and 5 of this Ministry’s O.M.No.1(3)/2008-E.ll(B) dated 29th August, 2008 shall continue to be applicable while regulating Dearness Allowance under these orders.</p>



<p>4. The contents of this Office Memorandum may also be brought to the notice of all organisations under the administrative control of the Ministries / Departments which have adopted the Central Government scales of pay.</p>

<p>The undersigned is directed to refer to this Department’s O.M. No. 1/3(2)/2008-E.II(B) dated 8th March, 2019 revising the rate of Dearness Allowance (DA) w.e.f. 01.01.2019 in respect of employees of Central Government and Central Autonomous Bodies continuing to draw their pay in the pre-revised pay scales <strong>as per 5th Central Pay Commission</strong>.</p>



<p>2. The rate of DA admissible to above categories of employees of Central Government and Central, Autonomous Bodies shall be enhanced from the existing 295% to 312% w.e.f. 01.07.2019.</p>

<p>3. The provisions contained in paras 3, 4 and 5 of this Ministry’s O.M.No.1(13)/97-E.II(B) dated 3rd October, 1997 shall continue to be applicable while regulating Dearness Allowance under these orders.</p>



<p>4. The contents of this Office Memorandum may also be brought to the notice of all organisations under the administrative control of the Ministries / Departments which have adopted the Central Government scales of pay.</p>

<p>Subject: <strong>Switch over form petrol and diesel vehicles to electrical vehicles for hired vehicles in Secretariats/Attached officer of Ministries and Department of Government of India located in Delhi</strong></p>



<p>Keeping in view the policy thrust of the Government that by 2030 30% of the total vehicle flect in the country will be electrical for the reason of its being environmental friendly cost effective and substitute for fossil fuels Ministries/Departments are encouraged to switch over to electrical mobility from petrol and diesel cars in respect of vehicles taken on lease/hire for official purpose.</p>



<p>Accordingly, all the Ministries/ Departments may aim at replacing the petrol and diesel cars hired by Ministries/ Department in their Secretariats and attached officers (located in Delhi) through contractors by electric cars for mobility in Delhi. In cases where existing contracts for hiring of petrol/ diesel vehicles have come to an and, Ministry/ Departments may Consider fresh contract for hiring electric vehicles.</p>



<p>To facilitate Ministry/ Departments a framework of the draft agreement which the Ministry/ Departments may adopt for entering into contract for lease/ hiring of electric vehicles is annexed. Ministry/ Departments are at liberty to amend the conditions of the agreement as per the type of lease/ hiring (Wet or Dry) entered into with the service provide.</p>

<p>Subject: <em><strong>Reimbursement of rent to Government servants during their temporary stay (upto a maximum period of six months) in State Bhavans/Guest Houses/Departmental Guest Houses run by Central Government/State Governments/Autonomous Organizations etc.</strong></em></p>
<p>Several references are being received in this Department seeking clarification regarding applicability of instructions contained in this Department&#8217;s O.M. No.2(25)/2004-E.II(B) dated 15.12.2011 to Central Government officials on their stay in State Bhavans/Guest Houses and also in cases where Central Government officials stay in Department Guest Houses.</p>
<p>2. The matter has been considered in this Department. In supersession of the instructions contained in aforesaid O.M. Dated 15.12.2011, it has been decided that the officials on their posting to the Centre and the Central Government Officials on their transfer/posting to a new station, necessitating chages of residence if they temproarily stay in State Bhavans/Guest Houses/Departmental Guest Houses run by Central Government / State Government/Autonomous Organizations etc., may be reimbursed the amount of rent paid subject to fullfillment of the following conditions:</p>
<blockquote><p>(a) The official has applided for accommodation of his entitlement, but has not been alloted residential accommodation by the Government</p>
<p>(b) The concerned Guest House should be located at the place of posting of the official.</p>
<p>(c) The official must have stayed in State Bhavans/Guest Houses/Departmental Guest Houses run by Central Government / State Government/Autonomous Organizations etc.and submit rent receipt in support of payment of rent.</p>
<p>(d) Reimbursement of rent shall be admissible up to a maximum period of six months.</p>
<p>(e) No House Rent Allowance (HRA) shall be admissible during this period.</p></blockquote>
<p>3. These orders shall be effective from the dated of issue.</p>
<p>4. In so far the persons serving in the India Audit and Accounts Department are concerned, these orders issue in consultation with the Comptroller and Auditor General of India.</p>
