<p>Withdrawal of clarification -I dated 05.09.2011</p>
<p>This Directorate vide F.No.DE-2009-2011/ITO/SCT/Availed Benefits/DIT had issued clarification-I dated 95.09.2011 in respect of awarding the Grace Marks to the result of those SC/ST candidates who have already qualified in the past with relaxed standards so as to enable them to attain the &#8220;OWN MERIT STATUS&#8221;. As this clarification has delegated for promotion as a ITO/ITI to DPCs, many anomalous situations have been reported to have arisen out of various interpretations of application of Grace Marks Policy by various DPCs resulting into grievances and representations.</p>
<p>In view of these facts, this clarification-I dated 05.09.2011 stands withdrawn with immediate effect wiht the approval of CBDT.</p>

<div>The undersigned is directed to refer to this Department’s O.M. No.1/16/96-P&amp;PW(E), dated 2.12.1996 whereby it was clarified that Pensionary benefits will be granted to children of a deceased Government servant/pensioner from void or voidable marriages when their turn comes in accordance with Rule 54(8). It is mentioned in Para 4 of the O.M. that &#8220;It may be noted that they will have no claim whatsoever to receive family pension as long as the legally wedded wife is the recipient of the same.”</div>

<div>2. The matter has been re-examined in consultation with the Ministry of Law and justice(Department of Legal Affairs) and Ministry of Finance (Department of Expenditure). It has been decided that in supersession of Para 4 of the O.M., ibid, dated 2.12.1996, the share of children from illegally wedded wife in the family pension shall be payable to them in the manner given under sub-rule 7 (c) of Rule 54 of CCS (Pension) Rules, 1972, along with the legally wedded wife.</div>
<div></div>
<div>3. It has also been decided that in past cases, no recovery from the previous beneficiary should be made. On receipt of an application from eligible child/children of the deceased Government employee/pensioner born to an ineligible mother, a decision regarding division or otherwise of family pension may be taken by the competent authority after satisfying himself/herself about veracity of facts and entitlement of the applicant (s).</div>

<div>4. As regards pensioners/family pensioners belonging to the Indian Audit and Accounts Departments, these Orders issue after consultation with the Comptroller and Auditor General of India.</div>
<div></div>
<div>5. This issues with the concurrence of Department of Legal Affairs vide their FTS No.3036, dated 17.10.2012.</div>
<div></div>
<div>6. This issues with the concurrence of Ministry of Finance, Department of Expenditure vide their I.D. No.530/E.V/2012, dated 23.11.2012.</div>

<div>This Representation is submitted by ‘Bharat Pensioners Sarnaj’ on behalf of Pensioners born on 1/1/1946, 1/1/1938 and on 1/1/1928 to seek restoration of all the Central Pay Commission benefits in terms of pay revisions and pensionary benefits.</div>
<div></div>
<p>&nbsp;</p>
<div>2. While modifying the then existing provision of FR 56(a) that every government servant shall retire from service on the afternoon of the last day of the month in which he attains the age of fifty eight years, it was provided on the 7th February, 1975 in Rule 56 (a) that a government servant whose date of birth is the first of a month shall retire from service on the afternoon of the last day of the preceding month on attaining the age of sixty years.</div>
<div></div>
<div>3. The proviso added by the Ministry of Finance singled orn the 1.1.1946/1938/1928-born pensioners, which deprived of the full Pay Commission benefits, which were granted to the rest of the pensioners, thus the application of the rule becoming bereft of the universality and uniformity maintained so far in keeping with upholding of a fundamental rule, It is a general principle that framing or amending of any statutory rule should be common to all retirees without exception and there should not be any discrimination.</div>
<div></div>
<div>4. It will be seen that the basic rule already stands relaxed by the Government itself consequent on its acceptance of the Third Central Pay Commission’s recommendation, by which all the government servants including those born on 1st of every month other than January, benefited, by way of extensions in their services besides the Sixth CPC Pay &amp; Pension revision benifits, barring the 1st January-born governnent servants. While this initial relaxation has benefited the employees born on, 2nd of January and onwards and even 1st of every month other than January (which virtually means all the remaining 364 days of the year), as in their case their retirement as per the basic rule on the preceding day happened in the same year (post-2005), the relaxation was no applied in the case of the 1st January-born employees probably on ground that their retirement took place in the previous month and year(Pre-2006).</div>
<div></div>
<div>5. Actually, the relaxation of FR 56 should have been made in an equitable manner by treating the application of the basic rule, which stands amended, in consequential for the 1st January born employees also.</div>
<div></div>
<div>6. In response to a representation from a similarly affected 1/1/46-born pensioner, the Department of Expenditure seems to have made a stock observation that for any such revision, a line has to be drawn and wherever the line is drawn, there will be persons who retired on a previous day and would lose the benefits of pay revision, We strongly feel that this analogy may not hold good in flatters of pay &amp; pension revisions consequent on the recommendation of Pay Commissions, since this happens not routinely but once in ten years as a measure of updating the pay &amp; pensions, etc according to new economic conditions in the country and these recommendations encompass all government servants and there cannot be any exception by application of any extant rules, which are meant for only routine purposes.</div>
<div></div>
<div>7. Further, in regard to 1/1/46-born retirees it may be stated that they retired on the afternoon of the last day of the preceding month, i.e. 31/12/2005 consequent on a decision taken based on the Third CPC recommendation. This clubbed then with the other retirees who retired notionally on 31/12/2005. There is absolute need to provide an enabling provision, by adding another suitable provision under FR.56 (a), so that this category of pensioners, who have been left out for no fault of theirs — in fact it sounds as if they have been penalised for wrong-doing — can also avail the said benefits.</div>
<div></div>
<div>8. Thus there are several alternatives to remove the hardship being faced by the above-referred pensioners.</div>
<div></div>
<div>First, addition of second Proviso to FR.56 as prayed for in the Paragraph 7 and second is suitable amendment to the Government Resolution dated 29/8/2008, the third is to retire the 1 st January pensioners also on the 31st of the same month and the fourth is to grant 1st January born pensioners also to avail like the rest of the pensioners all the Pay Commission benefits, extension of services etc. by following the same principle as applied to Senior pensioners for grant of enhanced pension on attainment of 80 years, 85 years, etc. The best recourse will always be the removal altogether of the first proviso under this amended FR.</div>
<div></div>
<div>9. It will also be noticed that there is no proportionate reduction in enhanced pension for the particular month in which a pensioner attains the 81st/85th birthday irrespective of the date, ie. 1st day of the month or any other day of the month, he is paid full enhanced pension. In other words, there is no proportionate reduction for the part of the month during which the pensioner is below 80 years since the benefit has been made available for the whole month.</div>
<div></div>
<div>10. It is time to think of appropriate Administrative reforms to remove all such anomalous situation by the Govt. so that things can be put straight. They shall not view like yet another representation or grievance, but they need to take it as an improvement over the system that is prevailing. Such a right spirit will facilitate added repute to the HR based Administration of date. I think still many capable and positive oriented functionaries exist at top layer and hence the system keeps on and on in spite of all odd factors.</div>
<div></div>
<div>11. May I, therefore, request for a deep examination of the several issues raised here in above, with a view to finding a satisfactory and just solution to the hardship being faced by the pensioners referred to above?</div>

<div>Subject: <strong>Rates of Dearness Allowance applicable w.e.f. 1.7.2012 to the employees of Central Government and Central Autonomous Bodies continuing to draw their pay in the pre-revised scale as per 5th CPC.</strong></div>

<div>The undersigned is directed to refer to this Department&#8217;s O.M. of even No. dated 20th April, 2012 revising the Dearness Allowance w.e.f. 1.1.2012 in respect of employees of Central Government and Central Autonomous Bodies who continue to draw their pay and allowances in the pre-revised scales of pay as per 5th Central Pay Commission.</div>

<div>2. The rates of Dearness Allowance admissible to the above categories of employees of Central Government and Central Autonomous bodies shall be enhanced from the existing rate of 139% to 151% w.e.f. 1.7.2012. All other conditions as laid down in the O.M. of even number dated 3rd October, 2008 will continue to apply.</div>

<div>3. The contents of this Office Memorandum may also be brought to the notice of the organizations under the administrative control of the Ministries/Departments which have adopted the Central Government scales of pay.</div>

<div align="justify">Subject: &#8211; <strong>Grant of Non-Productivity Linked Bonus (ad-hoc bonus) to Central Government Employees for the year 2011-12.</strong></div>
<div align="justify"></div>
<div align="justify">The undersigned is directed to convey the sanction of the President to the grant of Non-Productivity Linked Bonus (Ad-hoc Bonus) equivalent to 30 days emoluments for the accounting year 2011-12 to the Central Government employees in Groups &#8216;C&#8217; and ‘D’ and all non-gazetted employees in Group ‘B’, who are not covered by any Productivity Linked Bonus Scheme. The calculation ceiling for payment of ad-hoc Bonus under these orders shall continue to be monthly emoluments of Rs 3500/-, as hitherto. The payment of ad-hoc Bonus under these orders will also be admissible to the eligible employees of Central Para Military Forces and Armed Forces. The orders will be deemed to be extended to the employees of Union Territory Administration which follow the Central Government pattern of emoluments and are not covered by any other bonus or ex-gratia scheme.</div>
<p><a name="more"></a><strong>2. The benefit will be admissible subject to the following terms and conditions:</strong></p>
<div align="justify">(i) Only those employees who were in service as on 31.3.2012 and have rendered at least six months of continuous service during the year 2011-12 will be eligible for payment under these orders. Pro-rata payment will be admissible to the eligible employees for period of continuous service during the year from six months to a full year, the eligibility period being taken in terms of number of months of service (rounded off to the nearest number of months).</div>
<div align="justify"></div>
<div align="justify">(ii) The quantum of Non-PLB (ad-hoc bonus) will be worked out on the basis of average emoluments / calculation ceiling whichever is lower. To calculate Non-PLB (Ad-hoc bonus) for one day, the average emoluments in a year will be divided by 30.4 (average number of days in a month). This will thereafter be multiplied by the number of days of bonus granted. To illustrate, taking the calculation ceiling of monthly emoluments of Rs.3500 (where actual average emoluments exceed Rs.3500), Non-PLB (Ad-hoc Bonus) for thirty days would work out to Rs. 3500&#215;30/30.4=Rs.3453.95 (rounded off to Rs 3454/-).</div>
<div align="justify"></div>
<div align="justify">(iii) The casual labour who have worked in offices following a 6 days week for at least 240 days for each year for 3 years or more (206 days in each year for 3 years or more in the case of offices observing 5 days week), will be eligible for this Non-PLB (Ad-hoc Bonus) Payment. The amount of Non-PLB (ad-hoc bonus) payable will be (Rs.1200&#215;30/30.4 i.e.Rs.1184.21 (rounded off to Rs.1184/-). In cases where the actual emoluments fall below Rs.1200/- p.m., the amount will be calculated on actual monthly emoluments.</div>
<div align="justify"></div>
<div align="justify">(iv) All payments under these orders will be rounded off to the nearest rupee</div>
<div align="justify"></div>
<div align="justify">(v) The clarificatory orders issued vide this Ministry’s OM No.F.14 (10)—E.Coord/88 dated 4.10.1988, as amended from time to time, would hold good.</div>
<div align="justify"></div>
<div align="justify">3. The expenditure on this account will be debitable to the respective Heads to which the pay and allowances of these employees are debited.</div>
<div align="justify"></div>
<div align="justify">4. The expenditure incurred on account of Non-PLB (Ad-hoc Bonus) is to be met from within the sanctioned budget provision of concerned Ministries/Departments for the current year.</div>
<div align="justify"></div>
<div align="justify">5. In so far as the persons serving in the Indian Audit and Accounts Department are concerned, these orders are issued in consultation with the Comptroller and Auditor General of India.</div>

<div>The undersigned is directed to refer to this Ministry’s Office Memorandum No.1(1)/2012-E-II (B) dated 3rd April, 2012 on the subject mentioned aboe and to say that the President is pleased to decide that the Dearness Allowance payable to Central Government employees shall be enhanced from the existing rate of <strong>65% to 72% with effect from 1st July, 2012.</strong></div>

<p>&nbsp;</p>
<div>2. The provisions contained in paras 3, 4 and 5 of this Ministry’s O.M. No.1(3)/2008-E-II(B) dated 29th August. 2008 shall continue to be applicable while regulating Dearness Allowance under these orders.</div>
<div></div>
<div>3. The additional installment of Dearness Allowance payable under these orders shall be paid in cash to all Central Government employees.</div>
<div></div>
<div>4. These orders shall also apply to the civilian employees paid from the Defence Services Estimates and the expenditure will be chargeable to the relevant head of the Defence Services Estimates. In regard to Armed Forces personnel and Railway employees, separate orders will be issued by the Ministry of Defence and Ministry of Railways, respectively.</div>

<div>5. In so far as the persons serving in the Indian Audit and Accounts Department are concerned, these orders issue in consultation with the Comptroller and Auditor General of India.</div>

<p>Subject- <strong>Clarification on the admissibility of House Rent Allowance (HRA) during the Child Care Leave (CCL) &#8211; Reg.</strong></p>
<p>The undersigned is directed to refer to Para 6(a)(i) of this Ministry’s O.M.No.2(37)-E.II(B)/64 dated 27.11.1965, as amended from time to time, on regulation of House Rent Allowance during Leave which stipulates that a Government servant is entitled to draw HRA&#8230;..during total leave of all kinds not exceeding 180 days and the first 180 days of the leave if the actual duration of leave exceeds that period, but does not  include terminal leave, &#8230;.. It has also been stipulated, thereunder, that drawal of the allowance (HRA) during the period of leave in excess of first 180 day availed of on grounds other than medical grounds mentioned in sub-para (ii), shall be subject to furnishing of the certificate prescribed in Para 8(d) of the O.M. ibid.</p>
<p>2. This Ministry has been receiving representations from the female employees that certain Central Government Ministries / Department / Establishments are not allowing HRA during the Child Care Leave (CCL), especially when taken in continuation of Maternity Leave of 180 days. The reason for their reluctance may be the fact that CCL has been first introduced on the recommendations of the 6th Central Pay Commission, though the Department of Personnel &amp; Training (DoPT), vide their O.M .No 13018/1/2010-Estt.(Leave) dated 07.09.2010 inter-alia, reiterated that the leave (CCL) is to be treated like Earned Leave and sanctioned as such.</p>
<p>3. It is, therefore, clarified that the ‘total leave of all kinds’ as referred to in Para 6(a) of this Ministry’s OM dated 27.1.65 ibid, will include Child Care Leave for regulating grant of HRA during leave, subject to fulfiment of all other conditions stipulated thereuder, from time to time. It is also clarified that drawal of HRA during leave (including CCL) in excess of first 180 days, if otherwise admissible, shall be subject to furnishing of the certificate prescribed in Para 8(d).</p>
<p>4. These orders take effect from 01.09.2008. HRA during CCL, if not paid to women employees who are entitled to it as per this clarification, may be reconsidered, if so requested by the concerned employee.</p>

										<content:encoded><![CDATA[<p>CHILD CARE LEAVE : DOPT and  FINMIN ORDERS</p>
<p>Introduction of child care leave in respect of Central Government employees as per recommeded in the sixth Central Pay Commission, women employees having minor children may be granted CCL by an authority competent to grant leave for a maximum period of 730 days during their enitre service for taking care of up to two children, whether for rearing or to look after any of their needs like examination, scikness etc. Hence Earned Leave availed specifically for this purpose only should be converted. Child Care Leave shall not be admissible if the child is eighteen years of age or older.</p>
<p>On recommendations of sixth pay commission, the CCL was announced to help women employees to take better care of their children and family. But the privilege backfired to several central government departments being like a hill with applications from women employees for CCL. After consideration of all the views, Dopt declared, &#8216;CCL can be availed only if the employee concerned has no Earned Leave in her account. Those who have already taken the CCL will either have to return to office or part with their accumulated with Earned Leave&#8217;.</p>
<p>In further, Dopt orders said that &#8220;CCL cannot be demanded as a matter of right. Under no circumstances can any employee proceed on CCL without prior proper approval of the leave by the leave sanctioning authority. The leave is to be treated like the Earned Leave and sanctioned as such. Consequently, Saturdays, Sundays, Gazetted holidays etc. falling during the period of leave would also count for CCL, as in the case of Earned Leave. CCL can be availed only if the employee concerned has no Earned Leave at her credit.</p>
<p>and also instrcuted as &#8220;CCL may not be granted in more than 3 spells in a calendar year. CCL may not be granted for less than 15 days. CCL should not ordinarily be granted during the probation period except in case of certain extreme situations where the leave sanctioning authority is fully satisfied about the need of Child Care Leave to the probationer. It may also be ensured that the period for which this leave is sanctioned during probation is minimal.</p>
