<p>Sub: <strong>General Budget 2020 &#8211; NFIR&#8217;s proposals for consideration and inclusion in the Budget proposals to be presented before the Parliament &#8211; reg.</strong></p>



<p>NFIR requests the Hon&#8217;ble Prime Minister of India, to kindly consider the following proposals for inclusion in the ensuing Union Budget 2020 to be presented before the Parliament during Budget presentation in February 2020 :</p>



<ol class="wp-block-list"><li>Pension/ Earnings of Senior Citizens may be exempted from Income Tax upto Rupees 15 lakhs per annum.</li><li>Additional quantum of pension may be allowed to the pensioners on attainment of 70 years age instead of 80 years as at present with further increase to those who attain 80 and 85 years age.</li><li>Restoration of commuted value of pension be done on completion of 10 years instead of 15 years.</li><li>The <a rel="noreferrer noopener" aria-label="Single Female Government Employees (opens in a new tab)" href="https://centralgovernmentnews.com/provision-for-granting-special-casual-leave-for-the-woman-employees-working-in-the-central-government-organizations/" target="_blank">Single Female Government Employees</a> be granted &#8220;Old Age Parent Care Leave&#8221; on the pattern of &#8220;Child Care Leave&#8221;.</li><li>Female Government Employees be allowed 05 days extra Casual Leave to facilitate maintaining their health (specially those females of age 50 years and above), keeping in view the peculiar menopause stage leading to hormonal changes as has been granted to &#8220;Physically Challenged Employees&#8221;.</li><li><a rel="noreferrer noopener" aria-label="Child Care Leave (opens in a new tab)" href="https://centralgovernmentnews.com/child-care-leave-dopt-and-finmin-orders/" target="_blank">Child Care Leave</a> for women employees be granted with full salary in the 2nd year as against 80% of salary at present.</li><li><a rel="noreferrer noopener" aria-label="Accumulation of Earned Leave  (opens in a new tab)" href="https://centralgovernmentnews.com/lap-accumulation-of-earned-leave-leave-on-average-pay-beyond-the-ceiling-of-300-days/" target="_blank">Accumulation of Earned Leave </a>(EL / LAP) by Government employees in excess of 300 days be allowed without restriction in the light of judgement delivered by the Punjab &amp; Haryana High Court.</li><li>Family Planning Allowance, discontinued with effect from July I, 2017 should be restored and continued wherever already granted in terms of provisions made by the Government of India.</li><li>Pay re-fixation be granted to the retired Defence Forces Personnel re-employed in the Central Government Department / Organizations on the basis of last pay drawn by them at the time of retirement from Armed Forces.</li><li><a rel="noreferrer noopener" aria-label="Fixed Medical Allowance (opens in a new tab)" href="https://centralgovernmentnews.com/pensioners-eligible-for-fixed-medical-allowance-from-the-date-of-application-for-fma/" target="_blank">Fixed Medical Allowance</a> for retired Government employees be enhanced to not less than Rs. 3000 per month as against Rs. 1000 p.m. at present in view of high cost of medicines and medical treatment.</li><li>Provision be made for construction of Shelter Homes for Pensioners at various locations in the country.</li><li>Reimbursement of Tuition fee and Hostel subsidy be allowed upto Post Graduation level in the case of wards of Central Government employees.</li><li>Reimbursement of College/ Hostel fee may also be permitted in the case of wards of retired Government employees (pensioners).</li><li>Provision of accommodation for Office /recreation purposes be made to various Pensioners&#8217; Orgarizations in the country.</li></ol>

<p>Federation invites kind attention of the Railway Board to its letter of even no. dated 04/09/2017 wherein it was requested to consider continuance of Family Planning Allowance to those Railway employees who were already in receipt of the said Allowance which was sanctioned in pursuance of Government&#8217;s earlier policy decision. In its communication, the NFIR also suggested that in case the Railway Ministry (Railway Board) is not a position to allow the Allowance for want of clarification from DoP&amp;T/MoF, the matter may be referred to DoP&amp;T/MoF. Federation is however disappointed that though a period of more than 15 months passed no action seems to have been taken by the Board.</p>
<p>While enclosing copy of letter dated 04/09/2017, NFIR once again requests the Railway Board to consider for continuance of Family Planning Allowance to those Railway employees who were already in receipt of the same. In case the matter is referred to DoP&amp;T/MoF, copy of the same may he sent to the Federation early.</p>

<p>(a): The 7th Central Pay Commission recommended that Family Planning Allowance should be abolished. The Government has accepted the recommendation with effect from 1st July, 2017.</p>
<p>(b): The 7th Central Pay Commission recommended that Diet Allowance granted to deputationists in Bureau of Immigration should be abolished. The 7th Central Pay Commission (<a href="http://www.7cpc.in/" target="_blank">7th CPC</a>) in paras 8.17.22 to 8.17.24 of its report recommended, inter-alia, that Haircutting Allowance and Soap Toilet Allowance admissible to Personnel Below Officer’s Rank of Defence Forces, as components of Composite Personal Maintenance Allowance(CPMA), should be increased by 50%. The Government has accepted these recommendations with effect from 1st July, 2017.</p>
<p>(c): The Committee on Allowances was set up in July, 2016, to examine the recommendations of the 7th Central Pay Commission pertaining to allowances.</p>

<p>Sub: <strong>Illegal withdrawal of Family Planning Allowance -withdrawal of orders -urged.</strong></p>
<p>Ref: (i)   Railway Board&#8217;s letter No. PC V/2008/A/O/2 (FPA) dated 14/10/2008 (RBE No. 151/2008).</p>
<p>(ii). Railway Board&#8217;s letter No. PC V/2017/A/FPA/1 dated 28/07/2017 (RBE No.77/2017).</p>
<p>The Railway Board vide instructions dated 28/07/2017 (RBE No. 77/2017) has discontinued Family Planning Allowance hitherto allowed to the serving employees, having undergone Family Planning Operation with effect from 1st July 2017, citing Government&#8217;s decision on the recommendation of the 7th Central Pay Commission. In this connection, NFIR invites Railway Board&#8217;s attention to the following valid points for reviewing its decision:-</p>
<p><strong>(a) The 7th CPC vide para 8.17.50 of its report has observed as follows:-</strong></p>
<p>&#8220;the level of awareness regarding appropriate family size has also gone up among the government servants, Hence, a separate allowance aimed towards population control is not required now. Accordingly, it is recommended that Family Planning Allowance should be abolished.&#8221;</p>
<p>The Ministry of Finance vide OM F.No. 12(4)/2016-EIII.A dated 7th July 2017 has decided to accept. the recommendation of 7th CPC which means that the provision for granting Family Planning Allowance stood abolished henceforth (i.e. July 1, 2017).</p>
<p>(b) Nowhere, the 7th CPC has recommended for discontinuance of Family Planning Allowance already allowed in the past in terms of Government&#8217;s decision &#8211; OM No. 7(39)E.III/79 dated 4th December, 1979. In view of this, the Railway Board&#8217;s decision vide para 2 of its letter dated 28th July 2017 (RBE 77/2017) that Family Planning Allowance, as admissible hitherto, shall cease to exist in all cases, is not only illegal but also highly unjustified. It needs to be appreciated that the said Family Planning Allowance has been allowed as a result of conscious decision taken by Government decades back. Withdrawing the said allowance for the past cases is unconstitutional, leading to avoidable litigation.</p>
<p>(c)  7th Schedule of the Constitution&#8217;s 42nd amendment, inserted (C) Entry 20-A, providing for population control and family planning is one of the constitutional provisions. As a follow up to the said constitutional provision, the Government had granted incentive in the form of Family Planning Allowance to encourage small families and several employees have fulfilled the norms prescribed for entitlement of the said incentive and got the said allowance. Withdrawing the said Family Planning Allowance allowed already, at this stage by mis-quoting 7th CPC recommendation and Government&#8217;s decision is bad in law and also immoral.</p>
<p>(d) NFIR, further reiterates that a careful reading of 7th CPC recommendation reveals that the Family Planning Allowance be abolished as the Commission has never stated that the allowance already allowed be withdrawn/discontinued or should cease to exist in all cases.</p>
<p>NFIR, therefore, requests the Railway Board to kindly correct para 2 of letter dated 28th July 2017 suitably for continuing the Family Planning Allowance in those cases where it was rightly granted pursuant to Government&#8217;s Policy decision. NFIR suggests that in case the Railway Ministry is not convinced with the logic and facts placed above, the Federation&#8217;s contentions may be sent to the Ministry of Finance for clarification. Federation may please be replied on action being taken on the subject early.</p>

<p>Subject: <strong>Discontinuance of Family Planning Allowance for adoption of small family norms &#8211; recommendation of the 7th Central pay Commission</strong></p>
<p>The undersigned is directed to refer to this Ministry’s No.7/20/2008-E-IIIA dated 24-9-2008 regarding the existing rates of Family Planning Allowance (FPA) admissible to Central Government employees and to say that as provided for in para 7 of this Ministry’s Resolution No.1-2/2016-IC dated 25th July, 2016, the matter regarding allowances (except Dearness Allowance) based on the recommendations of the 7th Central Pay Commission was referred to a Committee under the Chairmanship of Finance Secretary and until a final decision thereon, all allowances were required to be paid at the existing rates in the existing pay structure (the pay structure based on 6th Pay Commission) as if the pay has not been revised w.e.f. 1st January, 2016. Accordingly, FPA was also required to be paid at the existing rates specified in the aforesaid OM dated 24.9.2008.</p>
<p>2. The decisions of the Government on various allowances based on the recommendations of the 7th Central Pay Commission and in the light of the recommendations of the Committee under the Chairmanship of the Finance Secretary, have since been notified as per tie Resolution No.11-1/2016-IC dated 6th July, 2017.</p>
<p>3.  As mentioned at Sl. No.60 of the Appendix -Il of the said Resolution dated 8th July, 2017, the recommendation of the 7th Central Pay Commission to abolish Family Planning Allowance has been accepted and this decision is effective from 1st July, 2017. Accordingly, FPA Family Planning Allowance, as admissible hitherto, shall cease to exist in all cases.</p>
<p>4.  These orders shall take effect from 1st July, 2017 and hence Family Planning Allowance shall stand discontinued w.e.f, 1st July, 2017.</p>
<p>5. In their application to the employees serving in the Indian Audit &amp; Accounts Department, these orders are issued in consultation with the Office of C&amp;AG.</p>

7th Pay Commission recommended that Family Planning Allowance should be abolished.</b></p>
<p>7th Pay Commission has proposed for abolishing Family Planning Allowance. Analysis and Recommendations of 7th Pay Commission on FPA is as follows:<br />

<p>There are demands to make it equal to one increment. Representations have also been received requesting that the allowance should be double for those employees who adopt family planning norms after just one child.</p>
<p><i><b>Analysis and Recommendations</b></i></p>
<p>The Commission recognizes the fact that most of the benefits related to children, viz., Children Education Allowance, Maternity Leave, LTC, etc., are available for two children only. Moreover the level of awareness regarding appropriate family size has also gone up among the government servants. Hence, a separate allowance aimed towards population control is not required now. Accordingly, it is recommended that Family Planning Allowance should be abolished.</p>

It has since been clarified by MHRD that the PRT who has drawn F.P.A. @ Rs.125/- in the pay scale of Rs.4500- Rs.7000 is entitled for Rs.250/- only. <div>The Family Planning Allowance was revised w.e.f. 1<sup>st</sup> September 2008 as per Office Memorandum No.F.No.7(2)/2008-EIII(A) dated 24<sup>th</sup> September 2008 at double the existing amount of Family Planning allowance subject to a minimum amount of Rs.210 per month as indicated in column 7 of Annexure to the Office Memorandum(Copy enclosed for ready reference).</div>

<div>A Primary School teacher had adopted Family Planning Allowance in the Pay scale of Rs.4500-7000 and was drawing Family Planning Allowance of Rs.125. The AG Audit in one of the observations has pointed out that the Family Planning Allowance in respect of this Primary Teacher w.e.f. 1.9.2008 will be admissible @ Rs.250 per month at double the rate of Rs.125, being the amount of family Planning Allowance drawn by her and not at Rs.400 per month.</div>

<div>In view of above, I am to request you to get the matter examined in detail and to clarify if the observation by AG Audit is in order or if the Family Planning Allowance is payable @ Rs.400 per month corresponding to the Grade Pay of Rs.4200 drawn by the teacher w.e.f. 1.1.2006.</div>
