<p><strong>1. Sanction of Family pension under CCS (Extraordinary Pension) Rules after 36 years</strong></p>



<p>Naik Karam Chand of 42bn of Border Security Force died in 1987 due to an electric shock while performing his duty. His widow, Smt. Jashodan Devi, was granted and was being paid family pension at minimum rates under the CCS (Pension) Rules.</p>



<p>Smt. Jashodan Devi registered a grievance No. DOPPW/E/2022/17598 at CPENGRAMS portal on 26.05.2022 claiming family pension at higher rates under the CCS (Extraordinary Pension) Rules. The Grievance was taken up for consideration in the Pension Adalat on 17th May, 2023. The petitioner as well as representatives of BSF attended the Pension Adalat. It was revealed that the authority for revision of family pension, which was being paid under CCS (Pension) Rules (instead of CCS (Extraordinary Pension) Rules), was also not issued in the 5th, 6th and 7th Pay Commissions.</p>



<p>BSF was directed to take immediate action to sanction EOP family pension, if due, and to pay the arrears of family pension after revision in the 5th, 6th and 7th Pay Commission.</p>



<p>BSF has now informed that the case for grant of Extra Ordinary Pension has been approved by the competent authority and has been sent to DIG RR Cell for further action on 8th June, 2023.</p>

<p>Subject: <strong>Implementation of Government&#8217;s decision on the recommendation of the VIIth Pay Commission on CCS (Extraordinary Pension) Rules, 1939 &#8211; Constant Attendant Allowance &#8211; regarding.</strong></p>
<p>In continuation of this Department&#8217;s OM No.1/4/2017-P&amp;PW(F) dated 2nd August 2017, revising the Constant Attendant Allowance from the existing Rs.4500/- p.m to Rs.6750/- p.m, it has also been decided that the rate of Constance Attendant Allowance payable to the Civilian pensioners shall be increased by 25% every time the dearness allowance on the revised Pay in the Pay Matrix increases by 50%.</p>
<p>2.All other terms and conditions of this Department&#8217;s OM NO. 1/4/2017-P&amp;PW(F) dated 2nd August 2017 will remain the same.</p>
<p>3.In so far as persons belonging to Indian Audit and Accounts Department, these orders issue after consultation with the Comptroller &amp; Auditor General of India.</p>
<p>4.These orders are issued with the concurrence of the Ministry of finance (Department of Expenditure) vide, their OM No.11-1/2016-IC dated 11.07.2017 and ID NO.11-1/2016-IC/Pt dated 25.07.2017</p>

<p><strong>Subject:   Special benefits in cases of death and disability in service &#8211; regulation and payment of Disability Pension/Family pension under Central Civil Service (Extraordinary Pension) Rules in implementation of recommendations of the 7th Central Pay Commission &#8211; regarding.</strong></p>
<p>The undersigned is directed to say that orders have been issued for regulation of Pension/family pension for Government servants in implementation of recommendations of the 7th Central Pay Commission vide OM No.38/37/2016-P&amp;PW(A)(i) dated 4.8.2016. There is no change in the formula for calculating disability pension and extraordinary family pension (EOP family pension) under CCS(EOP)Rules.</p>
<p>2.The extraordinary family pension/disability pension would continue to be calculated in accordance with schedule II of Central Civil Service (Extraordinary) Pension Rules. However, minimum Extraordinary family pension/disability pension with effect from 01.01.2016 falling under various categories would be as follows:-</p>
<p><strong>I.Extraordinary Family Pension.</strong></p>
<blockquote><p>(i) For category B and C , where the deceased Government servant was not holding a pensionable post &#8211; Rs.11,700/- per month.</p>
<p>(ii) For category B and C , where the deceased Government servant was holding a pensionable post &#8211; Rs.18,000/- per month.</p>
<p>(iii)  For category D and E &#8211; Rs.18,000/- per month.</p></blockquote>
<p><strong>II. Disability Pension</strong></p>
<blockquote><p>For all categories ( ie. category 113,C,D&#8217; and E&#8221; ) Rs.18,000 per month.</p></blockquote>
<p>3. All other terms and conditions and procedure stipulated in Schedule II of Rule 9 and 10 of CCS(EOP) Rules, notified vide Notification No. S.0 410(E) dated 15.11.2011 will be the same.</p>
<p>4. This issues with the concurrence of the Ministry of Finance, Department of Expenditure ID No.30-1/33(iii)/2016-IC(Pt) dated 17/7/2017.</p>
<p>5. In so far as persons belonging to the Indian Audit &amp; Accounts Department, these orders issue after consultation with the Comptroller &amp; Auditor General of India.</p>

<p><strong>EXTRAORDINARY PENSION</strong></p>
<p><strong>F.1 How the percentage of disability computed? To whom it is applicable?</strong></p>
<p>The computing of percentage of disability is applicable only for the Government servants retiring under CCS (EOP) Rules. The extent of disability or functional incapacity is determined in the following manner for purposes of computing the disability element forming part of benefits:-</p>

<p>Provided that the above broad banding shall not be applicable to Government servants who are retained in service.</p>
<p><strong>F.2 Whether the element of disability pension and invalid pension will be combined or treated as separate identity?</strong></p>
<p>The invalid pension is granted under Rule 38 of CCS(Pension) Rules, whereas disability pension is granted under CCS(EOP) Rules. The CCS (COP) Rules provides that if a Government servant is boarded out of service on account of injury attributable to Government service he shall be granted disability pension which includes service element as well as disability element. Invalid pension and disability pension cannot be combined.</p>
<p><strong>F.3 What is the revised quantum of ex-gratia lumpsum compensation to Civilian employees who die in performance of their bonafide official duties?</strong></p>
<p>In modification of Deptt. Of Pension &amp; PW’s OM No.45/55/97-P&amp;PW(C) dated 11.9.1998 the ex-gratia lumpsum compensation to Civilian employees who die in performance of their bonafide official duties has been revised as under :</p>

No. 38/37/08- P&amp;PW(A) dated 2.9.2008</a> would also be entitled to Constant Attendant Allowance.</p>
