<p>Subject: <strong>Expeditious processing of Second Appeal cases &#8211; Entitlement Rules for Casualty Pensionary Awards to the Armed Forces Personnel, 2008.</strong></p>



<p>Kindly refer to the various entitlements envisaged in the Entitlement Rules for Casualty Pensionary Awards to the Armed Forces Personnel, 2008 .</p>



<ol class="wp-block-list" start="2"><li>Entitlement Rules for <a href="https://centralgovernmentnews.com/tag/casualty-pensionary-award/" target="_blank" rel="noreferrer noopener">Casualty Pensionary Awards</a> to the Armed Forces Personnel, 2008 provide that an Armed Forces Personnel, who is boarded out on medical grounds or is discharged/ released/ retired in low medical categories, has the right to appeal against the denial of disability pension. These Rules also provide that, if a person is aggrieved by the denial of entitlement, he may, if he so desires, submit an appeal before Record Office/ Service HQrs within six months, which would be considered by the Appellate Committee for First Appeal. The Appellate Committee’s decision for upholding or rejecting the appeal will be by consensus. Any person, aggrieved by the decision in the First Appeal, may file a Second Appeal within six months of the decision of the Appellate Committee for First Appeal. The extant instructions also provide that in cases of non-consensus among the Members of the Second Appellate Committee on Pension, the Vice Chief of the respective Services shall forward the file to MoD for consideration of Hon’ble RRM.</li><li>During the processing of Second Appeal cases in this Department, It has been observed that in the majority of the cases, there has been inordinate delay at each level and the final disposal of Second Appeal applications is taking almost two years.</li><li>There is, thus, an urgent need for expeditious processing of Second Appeal cases. SHQs are, therefore, requested to not only streamline the entire process but also sensitize officials at all levels starting from the record office to examine and process such appeals in a time-bound manner so that the final decision involving the entire process is taken within 3-4 months.</li><li>This issues with the approval of the Secretary (ESW).</li></ol>

<h4 class="wp-block-heading">Sub: Implementation of Government’s decision on the recommendations of the Seventh Central Pay Commission &#8211; Revision of pension of pre-2016 retired Medical Officers of Army Medical Corps/ Army Dental Corps/ Remount &amp; Veterinary Corps-reg.</h4>



<p>Sir,</p>



<p>The undersigned is directed to refer to this Ministry’s letter No. 17(01)/2017/ (02)/D(Pension/ Policy) dated 5 September 2017. In accordance with Para-4 of this letter, the revised pension/ family pension of all Armed Forces Personnel who retired/ died prior to 01.01.2016, shall be revised by notionally fixing their pay in the pay matrix recommended by the 7t CPC in the level corresponding to the pay in the pay scale/pay band and grade pay at which they retired/ died. This will be done by notional pay fixation under each intervening Pay Commissions based on the formula for revision of pay. The revised rates of Military Service Pay, Non-Practice Allowance, where applicable, and ‘X’ Group. Pay &amp; Classification Allowance for JCO/ORs, if applicable notified in terms of 7th CPC orders, shall also be added to the amount of pay notionally arrived at under the 7th CPC pay matrix and shall be termed as notional reckonable emoluments as of 01.01.2016 while fixing pay on notional basis. It was further decided at para-6 of the letter that higher of the two formulations ice. the pension/ family pension already revised in accordance with this Ministry’s letter No. 17 (01)/ 2016-D(Pen/Pol) dated 29.10.2016 or the revised pension/family pension as worked out in accordance with Para-5 of the MoD letter dated 05.09.2017 referred above, shall be granted to pre-01.01.2016 ‘Armed Forces pensioners as revised pension/family pension w.e.f. 01.01.2016.</p>



<p>2. Department of Pension &amp; Pensioners’ Welfare vide their OM No. 38/37/16-P&amp;PW(A){iii) dated 11th September 2017 have decided that NPA at the rate as applicable as of 01.01.2016 shall be added to notional pay as of 01.01.2016 to arrive at pension/ family pension of retired medical officers w.e.f. 01.01.2016 and the <a href="https://centralgovernmentnews.com/category/pension/" target="_blank" rel="noreferrer noopener">pension</a>/ family pension of retired medical officers shall be further revised w.e.f, 01.07.2017 by adding NPA @ 20% to the notional pay as on 01.01.2016, instead of NPA admissible as on 01.01.2016 subject to the condition that the notional pay as on 01.01.2016 plus NPA does not exceed the average of basic pay of the revised scale applicable to the Apex Level and the level of Cabinet Secretary.</p>



<p>3. The matter regarding revision of all kinds of pension/ family pension of medical officers of Armed Forces who have retired/ died prior to 01.01.2016 has been examined by the Govt. and it has been decided that NPA at the rate as applicable as of 01.01.2016 shall be added to notional pay worked out in terms of Para-4 of the MoD letter No. 17(01)/2017/(02)/D (Pension/ Policy) dated 5th September 2017 to arrive at notional reckonable emoluments as on 01.01.2016 for calculation of pension/ family pension of pre-01.01.2016 retired/ died Medical Officers of Armed Forces, w.e.f. 01.01.2016. All kinds of pension/ family pension of pre-01.01.2016 retired/ died medical officers of Armed Forces Pensioners/ family pensioners shall be further revised w.e.f. 01.07.2017 by adding NPA @ 20% of notional pay in VIIth CPC scale to the notional pay as on 01.01.2016, instead of NPA admissible as on 01.01.2016 (which was 25% of pre-revised scale).</p>



<p>4. The fixation of pension/ family pension of retired Medical officers of Armed Forces in the above manner, shall be further subject to the condition that emoluments (ie. Basic Pay + MSP + NPA) to be reckoned for pension do not exceed Rs. 2,37,500/- (Rupees two lakh thirty seven thousand five hundred only). Amount of Gratuity and CVP which has already been notified, shall remain unchanged.</p>

<p>5. This issues with the concurrence of the Ministry of <a href="https://centralgovernmentnews.com/category/defence/" target="_blank" rel="noreferrer noopener">Defence</a> (Finance/ Pension) vide their ID No. 10(8)/2018/Fin/Pen dated 23.12.2020.</p>

<p>An appeal issued by Department of Ex-Servicemen Welfare, Ministry of Defence for contributions to AFFDF is forwarded. The Armed Forces Flag Day is observed on 7th December every year to honour martyrs and men in uniform who fought bravely not only to protect the borders of our nation but also fight terrorism and insurgency. On this day, donations are collected from the general public for AFFDF which are used for the welfare and rehabilitation of war widows, dependents of the martyrs and ESM including the disabled.</p>

<p>The Department of Ex-Servicemen Welfare, Ministry of Defence has been working for the welfare and rehabilitation of war widows, wards of martyred soldiers and ESM including disabled by providing financial assistance for their identified personal needs such as penury grant, children’s education grant, funeral grant, medical grant and orphan /disabled children grant. This financial assistance is provided out of the Armed Forces Flag Day Fund (<strong>AFFDF</strong>) which contributions are received from the general public on the Armed Forces Flag Day (<strong>AFFD</strong>) which is celebrated on 7th December every year. Efforts are required to increase the contribution to the Armed Forces Flag Day Fund to meet the increasing requirement of financial assistance for our ex-servicemen, their wards and war-widows.</p>

<p>Subject: <strong>Processing of Mercy Petition for grant of service pension under Pension Regulations.</strong></p>



<p>As you are aware, Regulations 29 and 41 of the Pension Regulation of Army (PRA, 2008) (Part I) (Regulations 16 and 113 of PRA, 1961) (Part I)] provide that an individual who is cashiered/dismissed from service under the provisions of the Army Act or removed under the Rules made thereunder is not eligible for pension or gratuity in respect of all previous service. However, in exceptional cases, the competent authority, on submission of an appeal to that effect by the individual, may at its discretion sanction pension/gratuity or both at a rate not exceeding that which would be otherwise admissible to him on retirement/ discharge. Such appeals are also required to be filed within two years from the date of cashiering/ dismissal/removal from service. Similar provisions exist in the Pension Regulations of both the Air Force and the Navy.</p>

<ol class="wp-block-list" start="2"><li>The power of the competent authority for deciding the aforesaid appeals was delegated to the AG/AOP/ COP vide Ministry of Defence, Department of Defence, Order No.4684/Dir (PEN)/2001 dated 14.08.2001. Further, vide Ministry of Defence, Department of Ex-Servicemen Welfare Order No.4(24)/2015/D (Pen/Legal) dated 01.09.2016. Secretary, Department of Ex-Servicemen Welfare [Secretary (ESW)] has been designated as the competent authority for deciding aforesaid mercy appeals which are received beyond the period of two years of cashiering/ dismissal/ removal from service.<br /><br />Also check: <a href="https://centralgovernmentnews.com/check-list-for-permanent-duty-claim-pcdao-pune-instructions/">Check List for Permanent Duty Claim: PCDA(O) Pune Instructions</a><br /></li><li>It has been seen from the review of such cases forwarded to this Department for disposal at the level of Secretary (ESW), that due to lack of awareness and knowledge about these provisions at the level of lower formations, these appeals are rejected at subordinate levels and reach Service HQrs or Department of Ex-Servicemen Welfare after many years of filing of such appeals. In many cases, such appeals are filed at the instance of Armed Forces Tribunal (AFT), when the concerned Ex-serviceman files an OA before the AFT for grant of pension or gratuity or both in case of cashiering/ dismissal/removal from service. The objective behind the provision for mercy appeal is to provide relief to Ex-servicemen and their family in exceptional situations on compassionate grounds. However, if the process itself gets inordinately delayed, the very objective behind such provision gets defeated.</li><li>It has also been seen that though the Ex-servicemen, who have been cashiered/ dismissed/ removed from service are not entitled to pension or gratuity or both as per the provisions of the relevant Pension Regulations, tend to make an application for grant of pension or gratuity or both. It is, therefore, advised that while rejecting such applications as per the provisions of the Pension Regulations, such Ex-servicemen may be informed about the provisions of mercy appeals and may be advised to file mercy appeal, if they so desire, with relevant documents in support of their appeal. Once, such appeals are filed, as stated above, these are to be decided only at the level of Adjutant General/AOP/COP or Secretary, Department of Ex-Servicemen Welfare, as the case be.</li><li>These appeals may, therefore, be immediately forwarded by the lower formations through there relevant echelons for disposal at the level of Service Headquarters by the competent authority. Further, in cases where such appeals are filed after a period of two years of cashiering/dismissal/removal from service, the same may be forwarded to this Department for decision at the level of Secretary (ESW). Check List indicating the relevant documents to be sent along with such proposal for disposal of such appeals is enclosed. All the field level formations may be sensitised accordingly.</li><li>This issues with the approval of Secretary (ESW).</li></ol>

<p>Sir,</p>



<p>I am directed to refer to this Ministry’s letter No. 1(07/2013-D(Pension/Policy) dated 15.05.2015 regarding simplification of pension process for permanently disabled children and dependent parents/ siblings for family pension. It has been noticed that name of divorced/ widowed/ unmarried daughter has not been included in MoD letter No. 1/(07)/2013/D(Pension/Policy) dated 15.05.2015 causing delay in sanctioning of family pension to such eligible members 1.e. widowed/ divorced/ unmarried daughter, although name of such eligible members was a part of DoP&amp;PW OM No. 1/6/08-P&amp;PW(E) dated 22.06.2010.</p>



<p>2. It is, therefore, decided to issue amendment to GoI MoD letter No. 1(07)/2013-D (Pension/Policy) dated 15.05.2015 as under-</p>



<p>(a) For “disabled children/ siblings and dependent parents” read- “permanently disabled child/ children/ siblings/ dependent parents and widowed/ divorced/ unmarried daughter,” wherever it appears in GoI MoD letter dated 15.05.2015.</p>



<p>(b) New clause numbered 5(iii) “To widowed/ divorced/ unmarried daughters” may be inserted below Para-5(ii) to GoI MoD letter dated 15.05.2015 as under:-</p>



<p>(iii) “To widowed/ divorced/ unmarried daughters”</p>



<p>In case the eligibility of all the above categories of claimant mentioned in para 5(i) and 5(ii) of GoI, MoD letter no. (7)/2013-D(Pension/Policy) dated 15.05.2015 ceases to be payable, the PDA will allow family pension to such widowed/divorced/ unmarried daughter in their hierarchy of DoB after production of marriage/ re-marriage/ death certificate, as the case may be, in respect of all the categories of claimants mentioned in Sub Para &#8211; i) and (i) of para 5 of GoI, MoD letter dated 15.05.2015, if any.”</p>



<p>(c) After inserting above clause in Gol, MoD letter dated 15.05.2015, remaining sub clauses under para -5 may be renumbered in following manner:</p>



<ul class="wp-block-list"><li>Existing Clause 5(iii) “To the dependent parents-first mother, then father” to be renumbered as 5(iv) </li><li>Existing Clause 5(iv) “To the permanently disabled siblings” to be renumbered as 5(v).</li></ul>



<p>3. The word “Farther” in first line of para 5(iii) of GoI, MoD letter no. 1(7)/2013-D (Pension / Policy) dated 15.05.2015 may be replaced by word “Father”.</p>



<p>4. The renumbered para 5(iv) referred above may be amended as follows:-</p>



<p>For: “When claimants in (i) and (ii) die or become ineligible- on production of death certificate/ re-marriage-intimation of spouse and/ or death certificates of all permanently disabled children, family pension would be allowed by PDA to dependent parents.”</p>



<p>Read: “When claimants in (i), (ii) and (iii) die or become ineligible- on production of death certificate/ marriage/ re-marriage -intimation of spouse and/ or on production/ intimation of marriage/ re-marriage/ death certificates (as the case may be) of all the eligible dependent son(s) or daughter(s) including permanently disabled child/children and widowed/ divorced/ unmarried daughter, family pension would be allowed by the PDA to dependent parents.”</p>



<p>5. All other terms and conditions shall remain unchanged.</p>



<p>6. This issues with the concurrence of the finance Division of this Ministry vide their ID No 10(01)/2015/ Fin/Pen dated 18/02/2020.</p>

<p>Subject: <strong>Clarification regarding grant of Dual Family Pension i.e. Ordinary Family Pension (OFP) from Military Side as well as Special Family Pension (SFP)/ Liberalised Family Pension (LFP) for re-employed Military service &#8211; reg.</strong></p>



<p>Sir,</p>



<p>The undersigned is directed to state that references have been received seeking clarification as to whether Special Family Pension (SFP)/Liberalised Family Pension (LFP) is admissible on death of a military pensioner re-employed in military service, and his death is attributable to military service.</p>



<p>2. Prior to 17.01.2013, the NOKs of Armed Force Pensioner who got re-employed in Civil Department/PSUs/Autonomous bodies/Local Fund of Central/State Governments after getting retired from military service were authorized to draw Ordinary Family Pension (OFP) either from military side or from civil side whichever was beneficial to them in terms of Gol, MoD letter No. 10(6)/92/D(Pens/Sers) dated 28.09.1992 and regulation 78 of Pension Regulation Part-I, 2008. Subsequently, vide GoI, MoD letter No. 01(05)/2010-D(Pen/Policy) dated 17.01.2013, two family pensions were allowed w.e.f. 24.09.2012 in the event of death of a re-employed military pensioner.</p>



<p>3. It was further clarified that dual family pension is admissible irrespective of the fact whether the re-employment was in civil or military department vide GoI, MoD letter No. 10(17)/2012-D(Pen/Pol) dated 21.03.2013. Hence, the family pensioners of military personnel re-employed in military e.g. Territorial Army/Defence Security Corps (TA/DSC) are also covered in the ambit of the Gol, MoD letter No. 01(05)/2010-D(Pen/Policy) dated 17.01.2013 for grant of dual family pension w.e.f. 24.09.2012. However, the admissibility of dual family pension was restricted to ordinary family pension (OFP).</p>



<p>4. Department of Pension and Pensioners’ Welfare vide their OM No. 1/3/2016-P&amp;PW(F) dated 24.01.2019 has clarified that the provisions of two family pensions, one in respect of military/civil service and the other for civil service after re-employment, as available in terms of CCS (Pension) Rules, is also applicable under CCS (EOP) Rules.</p>



<p>5. The matter regarding extending the admissibility of Special Family Pension (SFP)/Liberalised Family Pension (LFP) in cases of death attributable to military service in terms of Gol, MoD letter No. 1(2)/97/D(Pen-C) dated 31.01.2001 in the case a of dual family pension has been examined. It has been decided that Department of Pension and Pensioners’ Welfare OM No. 1/3/2016-P&amp;PW(F) dated 24.01.2019 would apply mutatis-mutandis to military/civil pensioners re-employed in military service and it is clarified that the provision of two family pensions, one in respect of military/ civil service and Special Family Pension (SFP)/ Liberalised Family Pension (LFP) for re-employed military service is also applicable. Special Family Pension (SFP)/ Liberalised Family Pension (LFP) if any, would be admissible in terms of GoI,</p>



<p>6. Where, however, on death of the re-employed ex-serviceman if the family is eligible for Special Family Pension (SFP)/ Liberalised Family Pension (LFP) for first service, family pension for second spell of service would be Ordinary Family Pension.</p>



<p>7. Special Family Pension (SFP)/ Liberalised Family Pension (LFP) shall be granted only in respect of one service and in no case, Special Family Pension (SFP)/ Liberalised Family Pension (LFP) will be granted for both the services.</p>



<p>8. The financial benefits in the past cases will accrue with effect from 24.09.2012.</p>



<p>9. Pension Regulation of the three Services shall be amended in due course.</p>



<p>10. This issues with the concurrence of the Finance Division of this Ministry vide their ID No. 10(02)/2017/FIN/PEN dated 21.06.2019.</p>

<h2 class="wp-block-heading" style="text-align:center"><strong>Ex-servicemen Welfare</strong></h2>



<p style="text-align:center"><strong>Tipper Attachment Scheme for Widows and Disabled ESM</strong></p>



<p><strong>Salient Features</strong></p>



<p>This welfare scheme for widows/disabled soldiers is linked with the ESM Coal Loading and Transportation Scheme. Eligible candidates can avail this Scheme for a period of five years and need to deposit an amount of Rs 85,000/- with the affiliated ESM Coal Loading and Transportation Company which pays back a monthly amount of Rs 3,000/ i.e. an annual return of approximately 42 % on the principal amount.. On maturity of the Scheme the Principal Amount is refunded. A legal agreement is signed between the Ex-Servicemen Coal Loading and Transportation Company and the widow/disabled Ex-Servicemen/Dependant. The scheme is for a period of five years and on completion of five year term the principle amount will be refunded by the ESM Coal Company.</p>



<p><strong>Eligibility</strong></p>



<p>The eligibility conditions for Widows / Dependants / ESMs who can take part in Tipper Attachment Scheme are as follows:-</p>



<p><strong>Persons Eligible</strong></p>



<ul class="wp-block-list"><li>Widows (below 65 years of age) and disabled / medically boarded out service personnel in whose case the disability is more than 50% and is attributable to military service.</li><li>Orphan children of Ex-servicemen represented by legal guardians and meeting the condition of being un-employed and under 25 yrs for boys; un-employed and unmarried in case of girls.</li></ul>



<p><strong>Conditions</strong></p>



<ul class="wp-block-list"><li>Should not be presently employed / self-employed.</li><li> Should not have remarried after death of husband in case of widows.</li><li> Should not have availed of any other DGR scheme.</li><li> Benefit of the Scheme should not have been availed by any other family member. Benefit will be extended to only one member of a family for a period of five years only.</li></ul>



<p><strong>Procedure</strong></p>



<p>Desirous widows of defence service personnel, dependants of deceased serving personnel and disabled Ex-servicemen should apply to the Director (Self-Employment) on the prescribed form. The document to be submitted are as follows:-</p>



<ul class="wp-block-list"><li>Copy of Death Certificate / Disability Certificate)</li><li> Affidavit (on Rs. 10/- Non-judicial stamp paper) for giving an undertaking regarding various issues of eligibility duly attested by notary as per format.</li><li> Copy of ESM / Widow/Dependent Identity Card.</li><li> Copy of Pension Payment Order.</li><li> Proof of death / disability attributable to military service.</li><li> Proof of dependency in case of dependants.</li><li> The format of application to be submitted can be downloaded from “DGR forms download window of the DGR website www.dgrindia.com</li></ul>
