										<content:encoded><![CDATA[<p><strong>Payment of DA on Pension of Ex-Servicemen</strong></p>
<p>Guidelines issued by the Department of Pension and Pensioners Welfare for payment of Dearness Relief to re-employed pensioners have been extended by this Ministry to the ex-servicemen re-employed in civil posts. These guidelines are as under:-</p>
<ul>
<li>The pay of re-employed pensioners who held posts of the ranks of Commissioned Officers at the time of their retirement is fixed at the same stage as last drawn before their retirement. These pensioners are not entitled to any Dearness Relief on pension on their re-employment in civil posts.</li>
<li>The pay of re-employed pensioners who held posts below the ranks of Commissioned Officers (PBOR) at the time of their retirement is fixed at the minimum of the pay scale of the post in which they are re-employed. Such pensioners are entitled to Dearness Relief on pension on their re-employment in civil posts.</li>
<li>If the pay of re-employed pensioners who held posts, below the ranks of Commissioned Officer (PBOR) at the time of their retirement before attaining the age of 55 years, is fixed at a higher stage because of advance increments and no protection of the last pay drawn is being given, the pay is treated as fixed at a minimum of the pay scale for the purposes of ignoring the entire pension and allowing Dearness Relief on pension.</li>
</ul>
<p>It is expected that the aforesaid guidelines are being implemented by all banks uniformly without prejudice to the ex-servicemen category. This information was given by Defence Minister Shri Arun Jaitley in a written reply to ShriMahendra Singh Mahrain Rajya Sabha today.</p>

<p>SUBJECT: <strong>Implementation of the Government decision on the recommendations of Committee on the issues related to Defence Service Personnel and Ex-Servicemen. 2012 &#8211; Minimum guaranteed pension to pre-2006 Commissioned Officers pensioners/family pensioners.</strong></p>
<p>Sir,<br />
The under signed is directed to refer to this Ministry&#8217;s letter No. 17(4)/2008(1)/D(Pen/Policy) dated 11.11.2008 as amended, issued for implementation of Government decision on the recommendations of the Sixth CPC for revision of pension/family pension in respect of pre-2006 Armed Forces pensioners/family pensioners. As per provisions contained in Para 5 therein, with effect from 1.1.2006 revised pension and revised ordinary family pension of all pre-2006 Armed Forces pensioners/family pensioners determined in terms of fitment formula laid down in Para 4.1 of above said letter dated 11.11.2008, shall in no case be lower than fifty percent and thirty percentage respectively, of the minimum of the pay in the pay band plus the Grade pay corresponding to the pre-revised scale from which the pensioner had retired/discharged/invalided out/died including Military Service Pay and ‘X&#8217; Group pay, where applicable. Accordingly, rates of minimum guaranteed pension/ordinary family pension for Commissioned Officers were notified under Annexure-II (for pensioners of regular Commission), Annexure-IIA (for pensioners of Military Nursing Services), Annexure-IIB (for pensioners of Territorial Army) and Annexure-IIC (Post-1996 Emergency/Short Service Commission pensioners) of this Ministry’s letter No.17(3)/2010/D(Pen/Policy) dated 15.11.2010 and No 17(4)/2008(1)/D(Pen/Policy)-Vol. VI dated 18.1.2011. The minimum guaranteed pension / family pension in respect of pre-1996 Emergency/Short Service Commission pensioners has, however, been notified vide this Ministry’s letter No 1(1)/2007-D(Pen/Policy) dated 3.9.2009.</p>
<p>2. In order to consider various issues on pension of Armed Forces personnel and Ex-Servicemen, the Government had constituted a Committee of Secretaries headed by Cabinet Secretary. The Committee in its Report have recommended that the minimum guaranteed pension/ordinary family pension of pre-2006 retiree Commissioned Officers pensioners/family pensioners should be determined with reference to minimum of the fitment table for the rank in the revised pay structure issued for implementation of recommendations of Sixth CPC instead of the minimum of the pay band.</p>
<p>3. The above recommendation of the Committee has been accepted by the Government and the President is pleased to decide that with effect from 24th September 2012 the minimum guaranteed pension and ordinary family pension in respect of pre-2006 Commissioned officers pensioners / family pensioners shall be determined as fifty and thirty percent respectively, of the minimum of the fitment table for the rank in the revised pay band as indicated under fitment tables annexed with SAI 2/S/2008 as amended and equivalent instructions for Navy / Air Force and SAI 4/S/2008, plus the Grade pay corresponding to the pre-revised scale from which the pensioner hod retired/discharged/invalided out/died including Military Service Pay, wherever applicable. It has also been decided that with effect from 24th September 2012 the minimum guaranteed pension and ordinary family pension in respect of pre-1996 EC/SSC pensioners / family pensioners shall be determined as fifty and thirty percent respectively, of the pay in the pay band corresponding to the pre-revised pay of Rs 10,500/- (in terms of Para 9(a)(i) of SAI 1/S/2008 as amended<br />
and equivalent instructions for Navy / Air Force) plus the Grade pay of Rs. 5400 and Military Service Pay of Rs. 6000/-.</p>
<p>4. Accordingly, revised tables indicating minimum guaranteed pension/ordinary family pension has been annexed as Annexure-A (for pensioners of Regular Commission other than AMC/ADC/RVC), Annexure-C (for pensioners of TA), Annexure-B (for pensioners of AMC/ADC/RVC), Annexurc-C (for pensioners of TA), Annexure-D (for pensioners of MNS), Annexure-E (for pre-1996 EC/SSC pensioners), Annexure-F (for post-1996 EC/SSC pensioners) and Annexure-G (for post-1996 EC/SSC pensioners of AMC/ADC/RVC) to this letter. Pension Disbursing Authorities are hereby authorized to step up the pension / family pension of the affected pre-2006 pensioners where the existing pension being paid to the pensioners in terms of this Ministry’s above quoted letter dated 11.11.2008 as amended, is less than the rate of pension indicated in above said annexures. Necessary implementation instructions to all concerned shall be issued by Principal CDA (Pensions) Allahobad on receipt of these orders.</p>
<p>5. All other terms and conditions shall remain unchanged.</p>
<p>6. The provisions of this letter shall take effect from 24th September 2012 and no arrears shall be allowed for the past period.</p>
<p>7. This issues with the concurrence of Finance Division of this Ministry vide theirI D No. PC 1/10(12)/2012/FIN/PEN dated 10.01.2013</p>

<div>1. The ‘One Rank One Pension’ issue has been raised before both the V and VI pay commissions.</div>
<div></div>
<div>2. The issue is about the considerable disparity in pension between pensioners that retired pre 1996, between 1996-2006 and post 2006.</div>
<div></div>
<div>3. The tying up of pensions with the last drawn pay is applied universally to both civilian and defence personnel.</div>
<div></div>
<div>4. Since the pay scales were revised by the V and VI pay commissions, the tie up with the last drawn pay had widened the disparity in pensions (as referred in the note)</div>
<div></div>
<p>5. But for the senior officers in both the Officers cadre (e.g. Lt. General) and PBOR (Personnel Below Officers Rank) cadre (e.g.  Honorary Captain), the pensions are based on rank and not on the last drawn pay.</p>

<div>6. The V pay commission, in 1996, has recommended parity in pension between pre and post 1986 pensioners. This was a follow up to the KP Singh Deo report in 1984 and a One Time Increase in 1992 towards bringing parity in pensions.  But the V pay commission’s recommendations on the pension of ‘post 1996’ retirees, was still tied to the last drawn pay.</div>

<div>7. The V pay commission has also made provisions for neutralization of price rise.</div>

<div>8. The VI pay commission has given a ‘fitment benefit’ to all retired employees, both civilian and defense, to partially compensate for the disparities in the pre 2006 and post 2006 retirees.</div>

<div>9. Also in order to compensate for the reduced employment of defence personnel period a ‘year weightage’ is included in calculation of benefits.</div>
<div></div>
<div>10. Due to the widening disparity, the note asks for pay to be not tied to the last drawn pay but to the rank thereby making all future increases applicable to existing pensioners also.</div>
<div></div>
<div>11. It is a highly emotive issue, since the soldiers retain their titles post retirement and the financial benefits accruing to them is determined by the retirement date.</div>

<div>12. Fiscal outlay for implementing the ‘One Rank One Pension’ is going to be modest &#8212; only in the order of Rs.1500 crores.</div>
<div></div>
<div>Considering the fact that the soldiers serve the best years of their lives in defense of the country in life threatening environments and retiring early, the ‘One Rank One Pension’ demand deserves to be implemented in an expedient way to honor our soldiers. A future BJP-led government, if elected, will implement this demand without any delay.</div>

<div><strong>Rs.2300 crore approved to meet the demands of Ex-servicemen pensioners</strong></div>
<div></div>
<div>The Union Cabinet has approved the recommendations of the Committee headed by Cabinet Secretary for benefits to ex-servicemen on four issues.   The financial implications of the improvements made as per the Cabinet decision on the four items are broadly estimated at Rs.2300 crore per annum.  The details are as follows:</div>
<div></div>
<div>I.<strong>One Rank One Pension:</strong></div>
<div>On One Rank One Pension, the demand of the Defence Forces and Ex-Servicemen Associations is that uniform pension be paid to the Defence Forces personnel retiring in the same rank with the same length of service irrespective of their date of retirement and any future enhancement in the rates of pension be automatically passed on to the past pensioners.</div>
<div></div>
<div>The difference in the pension of present and past pensioners in the same rank occurs on account of the number of increments earned by the defence personnel in that rank.  There is also a difference between the pension of pre 1.1.06 and post 1.1.06 retirees belonging to a particular rank.  The UPA Government on two previous occasions has taken decisions to narrow the gap between the present and past pensioners, particularly those belonging to the ranks of JCOs and Other Ranks.</div>
<div></div>
<div>On the issue of One Rank One Pension, the following have been approved by the Cabinet:</div>
<div></div>
<div>(i) Bridging of the gap in the pension of pre 1.1.06 and post 1.1.06 JCO/OR retirees by determining the pension of pre 1.1.06 retirees on the basis of notional maximum for ranks and groups <strong>across the three Services</strong> as in the case of post 1.1.06 retirees.  In addition, the <strong>weightage</strong> of qualifying service in the ranks of Sepoys, Naik and Havaldar<strong> would be increased</strong> by two years for both pre and post 1.1.06 retirees.</div>

<div>(ii) The pension of pre 1.1.06 Commissioned Officer pensioners would be stepped up with reference to the <strong>minimum of fitment table</strong> for the ranks instead of the <strong>minimum of pay band</strong>.</div>
<div></div>
<div>These are expected to largely meet the demands of the defence pensioners on one rank one pension.</div>
<div></div>
<div>II. <strong>Enhancement of Family Pension</strong> :</div>
<div>(i) The pension of pre &#8211; 1.1.2006 family pensioners(Commissioned Officers, Honorary Commissioned Officers, JCOs/ORs ) be stepped up based on the minimum of the fitment table instead of the minimum of the Pay Band;</div>
<div></div>
<div>(i) Establishing linkage of the family pension with the pension of JCOs/ORs, in those cases where the death takes place after the retirement of the JCO/OR since such a JCO/OR drew a pension based on the maximum of the pay scales, 60% of the pension applicable to JCO/OR pensioners would be granted to the family pensioner in case of normal family pension calculated a 30% of last pay drawn. Accordingly, based on the rank, group and length of service of the deceased JCO/OR pensioner, his pension would first be determined on notional basis. In cases where death of JCO/OR took place after retirement, the family pensioners in receipt of normal family pension would become entitled to 60% of the said pension determined on notional basis and those in receipt of enhanced family pension will be entitled to 100% of this pension. Similar entitlements would be determined in the case of Special Family Pension; and</div>

<div>(ii) The family pensioner of the JCO/OR would be granted pension arrived at on the basis of the family pension worked out as per the formulation at (i) above or the pension on the basis of stepping up with reference to the minimum of the fitment table, whichever is beneficial. Further, the linkage of family pension with retiring pension be applied in the case of post 1.1.2006 family pensioners of JCOs/ORs also.</div>

<div>III. <strong>Dual Family Pension:</strong></div>
<div>Dual family pension would be allowed in the present and future cases where the pensioner drew, is drawing or may draw pension for military service as well as for civil employment.</div>
<div></div>
<div>IV. <strong>Family pension to mentally / physically challenged children of armed forces personnel on marriage:</strong></div>
<div>Grant of family pension to mentally/physically challenged children who drew, are drawing or may draw family pension would continue even after their marriage.</div>
<div></div>
<div>The above recommendations made by the Committee on pension issues of Ex-Servicemen may be implemented from a <span style="text-decoration: underline;">prospective dat</span>e and payment made accordingly.</div>
