<p>The Government had announced Rs 1.70 lakh crore relief package under Pradhan Mantri Garib Kalyan Yojana (PMGKY) on 26.03.2020 for the poor to help them fight the battle against Corona Virus. One of the components of said package was to provide ex-gratia of Rs.1000 in two installments (Rs.500/- each) to the existing old age, widow and disabled/ Divyangjan beneficiaries of the schemes of National Social Assistance Programme (NSAP). A total of Rs.2814.50 crore as ex-gratia was released to States/UTs in two tranches in April, 2020 and May, 2020 under PMGKY for the 282 lakh beneficiaries of NSAP schemes. This included release of Rs.77.34 crore to 7.73 lakh disabled beneficiaries of Indira Gandhi National Disability Pension Scheme (IGNDPS).</p>



<p>State/UT-wise details of beneficiaries currently covered under the Indira Gandhi National Disability Pension Scheme (IGNDPS) are at Annexure.</p>

<p>As per the NSAP guidelines, persons aged between 18-79 years with severe and multiple disabilities and belonging to families living below poverty line are covered under IGNDPS.</p>

<h3 class="wp-block-heading"><strong>Subject: Payment of final instalment of Ex-Gratia in respect of retirees of <a href="https://centralgovernmentnews.com/category/bsnl/" target="_blank" rel="noreferrer noopener">BSNL</a> VRS-2019 instructions thereof.</strong></h3>



<p>Sir,</p>



<p>I am directed to refer to the above cited subject and to inform that sanction of fund for the payment of final instalment of Ex-Gratia is being released by DOT shortly. Accordingly, all circles are requested to initiate the process for release of final instalment of Ex-Gratia in ERP / SAP as per the existing guidelines. It must be ensured that Ex-Gratia is calculated as per details of PPO finalised by CCA offices i.e. last pay drawn and service particulars etc. In cases of discrepancy, Ex-Gratia may be processed strictly as per Annexure-D verified by the CCA. ERP cell may be contacted in case of any technical doubt related to running of ERP process / opening of T-code etc.</p>



<p>2. The processing of payment of Ex-Gratia may be completed by 14.01.2021. Fund request, indicating the amount to be paid VRS optees, including all kind of recoveries and TDS may be emailed to Banking Cell of BSNL Corporate Office on email address: budget.corporate[at]bsnl.co.in by 15.01.2021.</p>



<p>3. PGM(ERP), ALTTC, Ghaziabad shall also in parallel provide consolidated circle wise fund to be authorized for payment of VRS retirees and the TDS to be paid, to Banking Cell by 15.01.2021.</p>



<p>4. In case of recoveries, all the recoveries should be posted in SAP simultaneously.</p>

<p><strong>Subject: Immediate settlement of pending issues in respect of retired employees under BSNL VRS-2019.</strong></p>



<p>Sir,<br />I am directed to refer to this office letter of Even no. dated 06.08.2020 on the above cited subject and to say that the updation of service particular e.g. Last pay drawn, qualifying service etc in the ERP / SAP as per the details in PPOs generated by CCAs have not been carried out in respect of large number of retirees under BSNL VRS-2019. The task was required to be completed by 14.08.2020. Non-updation in ERP/ SAP is delaying the finalizing of the Ex-gratia amount, Leave encashment and calculation of arrears / over-payment. This activity has to be completed on top priority before the amount of 4th instalment of Ex-gratia amount is received from DOT so that total Ex-Gratia is calculated accurately before the payment of 4th installment of Ex-Gratia and there is no mismatch in the PPO data and ERP data.</p>

<p>2. Further, the ERP HCM team has reported that in respect of around 640 retirees (circlewise summary enclosed) under the <a href="https://centralgovernmentnews.com/category/bsnl/" target="_blank" rel="noreferrer noopener">BSNL</a> VRS-2019 Leave encashment has not been paid. In this regard, it is again requested to release the payment of encashment of EL / HPL immediately as per the extant instructions on the issue.</p>



<p>3. Non completion of activity by 14.8.2020 has been viewed very seriously by DIR(HR). Therefore, CGMT concerned may bestow their personal attention to complete the task latest by 05.09.2020 without fail.</p>

<p><strong>REVISED CONSOLIDATED GUIDELINES FOR GRANT OF EX-GRATIA FINANCIAL ASSISTANCE TO DEPARTMENTAL OFFICIALS/ STAFF FROM THE CUSTOMS AND CENTRAL EXCISE WELFARE FUND IN CASE OF DEATH/PERMANENT DISABILITY OR INJURIES SUSTAINED IN PERFORMANCE OF DUTIES</strong></p>



<p>A) Death attributable to performance of enforcement functions under the Customs/ GST/ NDPS Act or any other Act of the Government of India /State(s), including anti-smuggling, anti-evasion and anti­ narcotics duties, etc.: In case of death attributable to performance of enforcement functions under the Customs/ GST/ NDPS Act or any other Act of the Government of India/State(s), including anti-smuggling, anti-evasion and anti-narcotics duties, etc., ex-gratia financial assistance amounting to Rs.25 lakhs shall be paid to the survivors of the deceased departmental officials/ staff. An illustrative list of cases falling in this category is hereunder:</p>



<p>1) Death of departmental officials/ staff during the search and seizure operations against tax evaders, smugglers, drug traffickers, economic offenders etc. attributable to attacks during search and seizure operations including attacks by parties whose premises are searched, tax evaders, law offenders etc.</p>



<p>2) Death resulting from acts of violence or assault by economic offenders, smugglers, drug traffickers etc. committed against departmental officials/ staff:</p>



<ul class="wp-block-list"><li>With an intention of obstructing or preventing the official/ staff from performing his/her official duties; or</li><li>Due to any act done or attempted to be done by the official/ staff in the lawful discharge of his/her duties; or</li><li>Attributable to the official position held by the official/ staff.</li></ul>



<p>B) Death attributable to accidents or incidents of violence by terrorists, anti-social elements, etc. while on duty: In case of death of departmental officials/ staff attributable to accidents or incidents of violence by terrorists, anti-social elements, etc. occurring while on duty, ex-gratia financial assistance amounting to Rs.15 lakhs shall be paid to the survivors of the deceased official/ staff. An illustrative list of cases falling in this category is hereunder:</p>



<p>1) Death of officials/ staff as a result of accidents including the road accidents while proceeding to or returning from anti-smuggling/anti-evasion and anti-narcotics duties, or conduct of search and seizure operations against tax evaders, economic offenders, smugglers and drug traffickers, etc.</p>



<p>2) Death of officers/ staff as a result of an accident while travelling in a public, private or official vehicle or otherwise of an erstwhile Group ‘D’ employee, Dispatch Rider, Messenger, Notice Server, etc. deputed to distribute dak, deliver notices, etc. or of Departmental officials/ staff while performing field duties.</p>



<p>3) Death in an air crash/train accident/ accident to ship, river steamers etc. resulting in the death of the officials/ staff undertaking official journeys by these modes of travel while on duty.</p>



<p>4) Death of officials/ staff occurring due to fire accidents while he/she is on duty.</p>



<p>5) Departmental officials/ staff killed while on duty in incidents of terrorist violence in Jammu &amp; Kashmir, North Eastern Region, Punjab, etc. other than in actual enforcement operations.</p>



<p>6) Death of departmental officials/ staff while on duty as an unwitting/unintended victims of bomb-blast s in public places, vehicles, indiscriminate shooting incidents occurring in public, etc. all of which are often resorted to by terrori sts, anti-social elements etc.</p>



<p>C) Death Attributable to a pandemic like corona virus disease (COVID-19) contracted while on duty:</p>



<p>1) In case of death of officials/staff attributable to infection of coronavirus contracted while on duty, an ex-gratia financial assistance amounting to Rs.7 lakhs shall be paid to the survivors of the deceased official/staff.</p>



<p>2) The primary cause of death of staff/official must be coronavirus disease (<strong><a href="https://centralgovernmentnews.com/tag/Covid-19/" target="_blank" rel="noreferrer noopener">COVID-19</a></strong>). (Refer Point 3/ 3(a) &amp; 7 of checklist) supported by a medical certificate.</p>



<p>3) A certificate given by the Commissioner of the Commissionerate or the ADO of the Directorate, countersigned by the Pr. Chief Commissioner or the Pr. Director General/ Director General under whom the officer was working at the time of death would be accepted as proof of the officer /staff to having contracted the disease of corona virus (COVID-19) while on duty.</p>



<p>D) Death not covered under (A), (B) or (C) above: In case of death of a departmental official/ staff which is not covered under (A), (B) or (C) above, ex-gratia financial assistance amounting to Rs.5 lakhs shall be paid to the survivors of the deceased official/ staff. Such cases include natural death, death of officials/ staff in accidents or incidents of violence by terrorists, anti-social elements, etc., otherwise than on duty.</p>



<p>E) Permanent injury or disability of departmental officials/ staff during the performance of his/her official duties: Ex-gratia financial assistance amounting to Rs.15 lakhs shall be paid to officials/ staff who sustain permanent injury or disability during the performance of their official duties.</p>



<p>A summary of the Scheme for ex-gratia financial assistance from the Customs and Central Excise Welfare Fund is mentioned below:</p>

<p>*The Ex-Gratia Financial assistance from Welfare Fund as outlined above shall be paid in addition to any assistance which may be sanctioned from the Consolidated Fund of India in terms of Department of Pension &amp; Pensioner’s O.M. No. 45/55/97-P&amp;PW(C) dated 11.09.98 as amended from time to time</p>



<p><strong>Note</strong>:<br />I.<br />i) The Commissioners/ADGs while forwarding proposals for financial assistance in this regard should critically examine the circumstances of death/ injury of the subject official/ staff and certify that the death is attributable to performance of enforcement functions under the Customs/GST/NDPS Act or any other Act of the Government of India/State(s), including anti-smuggling, anti-evasion and anti-narcotics duties, etc. categorized under (A) above or due to road accidents or incidents of violence while proceeding to or returning from anti-smuggling/ anti-evasion and anti-narcotics duties accidents or incidents of violence by terrorists, anti-social elements, etc. occurring while on duty, categorized under (B) above or the officer was working at the time of death would be accepted as proof of the officer/ staff to having contacted the disease of corona virus (COVID-19) while on duty categorized under (C) above or Permanent injury or disability sustained in performance of official duty as categorized under (E) above.</p>



<p>ii) The payment of ex-gratia financial assistance from the Customs and Central Excise Welfare Fund is not linked to the value of terminal benefits and immovable property of the deceased official/ staff. This delinking shall be applicable to all cases where death has occurred on or after 14.06.2011.</p>



<p>iii) The ex-gratia financial assistance from Welfare Fund as outlined above shall be paid in addition to any assistance which may be sanctioned from the Consolidated Fund of India in terms of Department of Pension &amp; Pensioner’s O.M. No. 45/55/97-P&amp;PW(C) dated 11.09.98 . The condition No. 12 contained in the Annexure to the afore-mentioned O.M., which provides that ex­ gratia assistance paid from different sources should not exceed Rs. 10 Lakhs in each individual case, has since been revised vide O.M. dated 16.03.2009 and the upper limit with respect to the aggregate of the relief/ex-gratia compensation from different sources in the government was raised to Rs. 20 lakhs. Subsequently, vide O.M. dated 12.07.2010 this upper limit also stands removed.</p>



<p>iv) In case of Category (C) of Table above, the primary cause of death of staff/officials must be coronavirus disease (COVID-19). (Refer point 3, 3(a) &amp; 7 of checklist) supported by a medical certificate.</p>



<p>v) A certificate given by the Pr. Commissioner/Commissioner of the Commissionerate or the Pr. ADG/ADG of the Directorate, countersigned by the Pr. Chief Commissioner/Chief Commissioner or the Pr. Director General/Director General under whose jurisdiction the officer was working at the time of death would be accepted as proof of the officer /staff to having contracted the disease of corona virus (COVID-19) while on duty.</p>



<p><strong>II. The decision regarding grant of ex-gratia financial assistance from the Customs and Central Excise Welfare Fund shall be delinked from the appointment on compassionate grounds of a family member of the deceased official/ staff.</strong></p>



<p><strong>III. Time limit for submission of the proposal:</strong></p>



<p><strong>(i) A time limit of two years from the date of death of the official/ staff or the date when permanent injury or disability is sustained, as the case may be</strong>, has been prescribed for submission of a proposal for ex-gratia financial assistance.</p>



<p><strong>(ii) An officer- PRO/ Welfare Officer/ any other officer who may be designated at the Commissionerate /Directorate level</strong>&nbsp;shall be entrusted the responsibility of ensuring that the request for ex-gratia financial assistance from the Welfare Fund along with its required accompanying documents is prepared in a timely manner by providing the much needed guidance to the survivors of the deceased or the official/ staff who sustained permanent injury or disability, as the case may be, who may otherwise be ignorant of the provisions of this Scheme. This is to ensure that inordinate delays in submission of requests for consideration of the Governing Body and subsequent disbursement of the ex-gratia financial assistance are done away with.</p>



<p>(iii) However, if for some reasons, a proposal for ex-gratia financial assistance could not be submitted in the prescribed time limit of two years even though the survivor(s) of the deceased or the official/ staff who sustained permanent injury or disability, as the case may be, deserve ex­ gratia financial assistance on merits, the same may be submitted for consideration of the Governing Body,&nbsp;<strong>providing adequate justification for non submission of the proposal within the prescribed time limit of two years.</strong></p>



<p>(iv) The revised Scheme has come into effect from 21.08.2020.</p>



<h3 class="wp-block-heading">CHECK LIST FOR PROPOSALS FOR EX-GRATIA FINANCIAL ASSISTANCE</h3>



<p><strong>Check that:</strong></p>



<p>1. Application of beneficiary has been enclosed.</p>



<p>2. The date of death and age of the deceased official is mentioned.</p>



<p>3. Death certificate is enclosed. In case of death due to coronavirus disease (COVID-19), post mortem report or certificate of hospital , in which it should be mentioned that primary cause of death is corona virus disease (COVID-19) is enclosed.</p>



<p>3(a) A certificate given by the Commissioner of the Commissionerate or the ADG of the Directorate, countersigned by the Pr. Chief Commissioner or the Pr. Director General/ Director General under whom the officer was working at the time of death would be accepted as proof of the officer /staff to having contracted the disease of corona virus (COVID-19) while on duty.</p>



<p>4. In cases of death due to accident, or in mysterious circumstances, police investigation report is enclosed.</p>



<p>5. Following details of each of the surviving members of the family of deceased official are given: Name, Age, Relationship with the deceased official, in case of dependent children give their marital status, employed (mention earning/ income) or studying (mention class/course).</p>



<p>6. In case if the surviving beneficiaries are minor chi ldren, details of their legal heir ship along with copy of Court Order, if any, have been given.</p>



<p>7. A certificate issued by the concerned Commissioner/ HOD after examining the circumstances of the death/ injury of the subject official as to whether the death is attributable to the actual performance of enforcement functions such as anti-smuggling I anti-evasion/ anti-narcotics duties., etc. categorized under (A) or accidents or incidents of violence by terrorists, anti-social elements, etc. while on duty, categorized under (B) or Permanent injury or disability sustained in performance of official duty as categorized under (D) has been enclosed.</p>



<p>8. Proposal has been submitted within the prescribed time limit of 2 years from the date of death of the official/ staff or the date when permanent injury or disability was sustained by the official/ staff.</p>



<p>9. In case of proposal submitted after the prescribed period of 2 years, reasons for delayed submission of the proposal giving full justification has been enclosed.</p>



<p>10. Proposal has been recommended by the Advisory Committee headed by Commissioner/ HOD. The Advisory Committee should be headed by the Commissioner/ HoD and should have at least one representative each from Group- ‘A’ to ‘C’ category of officials, including one official from uniformed Group ‘C’ category (erstwhile Group-D officials). The decisions arrived at by the Advisory Committee should be forwarded, as minutes of meeting, to the Governing Body with full details/justifications for further consideration and Sanction.</p>

<p>Sub: <strong>Ex-gratia compensation to the families of Central Government employees who died due to Covid-19 infection in performance of their duties.</strong></p>



<p>Many Central Government employees (especially those of Armed and Paramilitary Forces, Police, Railways, Postal and Medical Services) have died due to Covid-19 infection caught up in performance of the duties and exigencies of their services. Their Families need to be adequately compensated for the severe loss of the caning member of the family while serving the Native in spite of the <strong><a href="https://centralgovernmentnews.com/tag/covid-19/" target="_blank" aria-label="undefined (opens in a new tab)" rel="noreferrer noopener">COVID-19</a></strong> pandemic.</p>



<p>No amount of compensation will ever be enough lo recompense for the loss of a life especially in case of the employees who are putting their lives in danger to ensure seamless implementation to Government’s policies &amp; schemes particularly during Covid-19 pandemic. The Government should ensure a life of dignity and respect for the dependent family members of the Central Government employees who die due to Conid-19 infection caught in the course of performance of their duties.</p>



<p>In the present scenario of Covid-19 <strong><a aria-label="undefined (opens in a new tab)" href="https://centralgovernmentnews.com/" target="_blank" rel="noreferrer noopener">Central Government employees</a></strong> particularly doctors, para medical staffs, Heath workers, Railway Postal employees, police, Armed &amp; Para Military forces, etc are more prone to get infected with Covid-19 in the course of performance of their duties and some of them are meeting with tragic end.</p>

<p>Thermal scanning is the only screening done for all employees during duty to the work Place, Thermal scanning is done for most of the public visiting Government offices, Railway Stations etc. All corona infected persons particularly asymptomatic persons infected with corona virus cannot be screened out by thermal scanning. There are chances of employees getting infected with corona virus from the coworker and from the public.</p>



<p>Major chances of Government employees getting infected with corona virus in the course of performance of theirs duty are, in many departments Government employees are required to have direct interaction with public, in industrial establishments it is practically not possible to maintain one meter social distance between employees on the work spot, chances of employees getting infected enroute to duty and return from duty in work exigences employees with co-morbidity conditions and above 55 year of age required to attend work. handling of files by many employees, presence of left out wastes, particularly presence of human waste in rail coaches &amp; tracks, handling of variety of materials &amp; parcels across the nation, etc. Justices needs to be done for the loss of life through ex-gratin compensation to the families of Central Government employees who died due to Covid-19 infection caught in the course of performance of their duties.</p>



<p>Some of the Government organizations have already announced compensation for its employees who died due to Covid-19 infection in the course of performance of their duties. Some of them enlisted below:</p>



<p>The Government has approved the proposal for gram of ex-gratia monetary compensation to 1.08 lakh of workers and officers of the Food Corporation of India (FCI) who are working to supply food grains across the country amidst the outbreak of Corona virus pandemic. Under its provisions, during the six month period from March 24, 2020 to 23 September, 2020 if anybody dies due to COVID-19 infection while on duty with FCI, the Regular FCI Labour will get an ex-gratia of Rupees 15 lakh, Contractual Labour will be entitled 10 Rs.10 lakh, Category-1 Officers Rx.35 lakh. Category-2 Rs.30 lakh and Category 3 &amp; 4 workers &#8211; Rs.25 lakh. (Press release issued by Ministry of Consumer Affairs, Food &amp; Public Distribution)</p>

<p>The Ministry of Shipping has decided that all she Major ports may grants compensation Ex-Gratia of Rs.50 lakh in the event of boss of life doc to Covid-19 to the dependent members/legal heirs of the port employees employed directly or through contract by the port, (Press Release issued by Ministry of Shipping.</p>



<p>State-run Bank of Boards (BOB) has announced an ex-gralia cover of Rs 50 lakh for as employees in the event of death due to Corona virus disease. While the PSU bank offers Rs 20 lakh Group Life Insurance covers to its employees, It has added additional Rs 30 Lakh that will go to the dependents of the employee in the event of’ a death.</p>



<p>Gram of ex-gratia compensation to the families of deceased employees infected with Covid-19 in the course of performance of their duties will be doing at least some justice for the supreme sacrifice made by the employees.</p>



<p>It is therefore requested that, Families of Central Government employers who died because of Covid-19 infected in the course of performance of their duties may please be granted ex-gratia compensation of Rs. 50 lakh.</p>

<p>In continuation of even numbered letters issued on the cited subject, following instructions are issued for strict compliance:</p>



<ul class="wp-block-list"><li>Notwithstanding the position that the amount of ex-gratia and leave encashment payable to the retirees of <a rel="noreferrer noopener" href="https://centralgovernmentnews.com/category/bsnl/" target="_blank">BSNL</a> VRS &#8211; 2019 scheme, has been verified by the circles, it is requested to do the checking of the master data of the employees towards eligible service, eligible number of leaves, their vigilance clearance status etc once again duly keeping in view the PPOs issued by CCA and underlying information thereto.</li><li>It is required to prepare (and keep in records) a proper statement of the amount recoverable, and recovery made on account of dues (towards Loans, advances, Pay and allowances recoveries, other recoveries etc) from the BSNL VRS-2019 retirees against the Ex-gratia, and Leave Encashment payout. The amount recoverable and recovered should be duly validated for any errors and omissions.</li><li>Establishment section has already communicated the SOP for BSNL VRS 2019, with the format of report to be submitted to DoT on Ex-Gratia. Kindly ensure that the reports / compliances in the Format given in Annexure A, B &amp; C of the DOT letter No. 1/VRS/BSNL/2019/Accounts/TA-I/170-198, dated 16.01.2020 are duly submitted to the respective CCA.</li><li>The second / subsequent instalment of the Ex-Gratia shall be paid as and when further funds and instructions are received from DoT. Therefore, you may please do the necessary preparations, well in advance so that the payout can happen without delay, as and when the funds are received in this regard.</li><li>May kindly note that the activity needs to be completed by 14.04.2020.</li></ul>

<p>Ministry of Shipping has decided that all the Major Ports may grant compensation / Ex-Gratia in the event of loss of life due to <a href="https://centralgovernmentnews.com/tag/covid-19/" target="_blank" rel="noreferrer noopener">COVID-19</a> to the dependent members / legal heirs of the port employees as under:</p>

<p>Monetary Compensation is declared to cover the risk of life due to COVID-19 contamination while discharging the Port related duty. Port Chairman is the competent authority for the settling claims / disbursement of the compensation / <a href="https://centralgovernmentnews.com/tag/Ex-Gratia/" target="_blank" rel="noreferrer noopener">Ex-Gratia</a> and verifying authority for the cause of death from COVID-19. This compensation is applicable only for the pandemic of COVID-19 and shall be in force up to 30.09.2020, subject to review thereafter.</p>

										<content:encoded><![CDATA[<p><strong>Pension Rates under CPF</strong></p>
<p>The Central Government employees who are covered by CPF Rules (India) 1962 and who retired on or after 01.01.1986 are not entitled to any monthly pension/ex-gratia amount. However, the Government employees under CPF who retired between 18.11.1960 and 31.12.1985 are entitled to monthly ex-gratia amount of the following rates:</p>

<p>Dearness ex-gratia equal to 50% of the amount of ex-gratia and Dearness Relief, as notified from time to time as per 5th Central Pay Commission series, on the sums of amount of ex-gratia and dearness ex-gratia is being paid to them. There is no proposal to increase the aforesaid rates.</p>
