<h3 class="wp-block-heading"><strong>Subject: Payment of amount of Ex-Gratia lump sum compensation to the families of Central Government servants who die in the performance of bona fide official duty- Provision for nominations regarding.</strong></h3>



<p>The undersigned is directed to say that the families of Central Civil Government servants, who die in harness in the performance of their bona fide official duties under various circumstances, are entitled to payment of ex-gratia lump sum compensation in accordance with this Department’s OM No. 45/55/97- P&amp;PW(C) dated 11th September, 1998. The amount of ex-gratia lump sum compensation has been revised from time to time. The existing rates of ex-gratia lump sum payment are specified in this Department’s OM No. 38/37/2016-P&amp;PW (A) dated 04.08.2016.</p>



<p>2. The existing instruction, however, do not specify the member of the family to whom such ex- gratia lump sum compensation is payable in the event of death of the Government servant in the performance of bona fide duty. Therefore, in terms of para 13 of the guiding principles mentioned in the Annexure to the OM No. 45/55/97-P&amp;PW(C) dated 11th September 1998, payment of ex-Gratia lump sum compensation is presently being made to the member of the family who is eligible for extraordinary family pension under the CCS (Extraordinary Pension) Rules, 1939.</p>



<p>3. The matter has been examined in consultation with Ministry of Finance (Department of Expenditure). On death of a Government servant, payment of other lump sum amounts, such as death gratuity, GPF balance and CGEGIS amount, is made in accordance with the nominations made by the Government servant during service. Accordingly, it has been decided that, on death of a Government servant in the performance of bona fide duty also, payment of ex-gratia lump sum compensation may be made to a member or members of the family in whose favour a nomination is made by the Government servant during service. Family for this purpose shall have the same meaning as in the case of gratuity and it shall include the members of family as mentioned in sub-rule (6) of Rule 50 of the CCS (Pension) Rules, 1972.</p>



<p>4. The Common Nomination Form in Form 1 appended to the CCS (Pension) Rules, 1972 has been amended to include the nomination in respect of the ex-gratia lump sum payment and the same is enclosed. Accordingly, nomination in respect of ex-gratia lump sum payment shall also be made in this Common Nomination Form. The nomination for ex-gratia lump sum payment shall be subject to the provisions as applicable in the case of gratuity under Rule 53 of the CCS (Pension) Rules, 1972. Since the ex-gratia lump sum payment is payable to the family only, no nomination shall be made in favour of a person who is not a member of the family, even where the Government servant has no family. If no nomination has been made or the nomination made by the Government servant does not subsist, the ex- gratia lump sum compensation will be shared equally by all eligible family members, as in the case of Gratuity, in accordance with Rule 51 of the CCS (Pension) Rules.</p>



<p>5. These instructions shall be applicable in the case of the death of a Government servant on or after the date of issue of this OM. Cases of payment of ex-gratia lump sum compensation on death of Government servants before the date of issue of this OM shall continue to be dealt with in accordance with the instructions applicable before the issue of this OM.</p>



<p>6. This OM is issued with the concurrence of Ministry of Finance, Department of Expenditure vide their ID Note No. 27(1)/E-V/2020, dated 22.07.2021.</p>



<p>7. In its application to persons belonging to Indian Audit and Accounts Department, these orders are issued under Article 148(5) of the Constitution and after consultation with the Comptroller and Auditor General of India vide their U.O. No. 211-Staff -Hak (Rule)-A.R/09-2019 dated 13.09.2021.</p>



<p>8. The Administrative Divisions of all Ministries/ Departments and attached/ subordinate offices are requested to bring the contents of these instructions to the notice of all concerned for compliance.</p>



<p>9. Formal amendment to CCS (Pension) Rules, 1972 for amending Form 1 appended to those rules shall be notified separately.</p>

In pursuance of the enhanced rates of ex-gratia to the surviving SRPF(C) retirees issued vide Board ‘s letter No. f\(E)III/98/PN l/Ex-Gr./3 dated 15.11.2006, para 1(i) of above mentioned DoP&amp;PW’s O.M dated 15.-10.2017, 19.04.2018, 08.10.2018, 27.03.2019 and 03.12.2019 may be read as under:-</p>

<p>“The surviving Group ‘A’, ‘B’, ‘C’ and ‘D’ SRPF (Contributory) beneficiaries who had retired from service during the period from 01.04 .1957 to 31.12.1985 and have been sanctioned enhanced slab-wise ex-gratia @ Rs. 3000/-, Rs. 1000/-, Rs. 750/- and Rs.650/- per month respectively w.e.f 01.11.2006, in lieu of uniform rate of Rs. 600/­p.m are entitled to Dearness Relief at the following rates:-</p>

<p>Sub: <strong>Ex-gratia payment to the families of Railway employees who caught Covid-19 infection in the course of performing duties, hospitalized and unfortunately passed away &#8211; reg.</strong></p>



<p>Ref: NFIR’s letter No. NFIR/Covid-19/ 2020-I dated 0110712020 addressed to Hon’ble Finance Minister, copy endorsed to Hon’ble MR, Cabinet Secretary, CRB &amp; GSs of affiliated Unions.</p>



<p>The above subject was taken up by NFIR at various levels i.e. Central Government and as well at the level of Railway Minister and in this connection, affiliates attention is invited to NFIR’s letter dated 01/07/2020. cited under reference.</p>



<p>Affiliates may please take note that the case for considering ex-gratia payment to the families of <a href="https://centralgovernmentnews.com/tag/covid-19/" target="_blank" rel="noreferrer noopener">Covid-19</a> victims (<a href="https://centralgovernmentnews.com/category/railways/" target="_blank" rel="noreferrer noopener">Railway</a> employees who got infected in the course of performing duties and unfortunately passed away) is being processed by the Railway Ministry. I have also spoken to the Financial Commissioner” (Railways) today and requested for positive action for providing relief to the families. Further development, if any, on this will be conveyed to the affiliates.</p>

<p>Subject: <strong>Grant of Dearness Relief in the 5th CPC series effective from 01.07.2019 to CPF beneficiaries in receipt of ex-gratia payment &#8211; reg</strong></p>



<p>In continuation of this Department’s OM No.42/04/2019- P&amp;PW(D) dated 27.03.2019, the President is pleased to decide that the Dearness Relief w.e.f 01.07.2019 to the CPF beneficiaries in receipt of ex-gratia payment shall be paid in the following manner :-</p>



<p>(i) The surviving CPF beneficiaries who have retired from service between the period 18,11.1960 and 31.12.1985, and were sanctioned ex-gratia @, Rs, 600/ p.m. w.e.f. 1.11.1997 under this Department’s OM No. 45/52/97-P&amp;PW(E) dated 16.12.1997 and revised to Rs.3000, Rs.1000, Rs.750 &amp; Rs.650 for Group A, B, C &amp; D respectively w.e.f 4th June,2013 vide GM No.1/10/2012-P&amp;PW(E) dtd. 27th June, 2013 shall be entitled to enhanced Dearness Relief from 295% to 312% w.c.f 01.07.2019.</p>

<p>(ii) The following categories of CPF beneficiaries who are in receipt of ex-gratia payment in terms of this Department’s OM No. 45/52/97-P&amp;PW(E) dated 16.12.1997 shall be entitled to enhanced Dearness Relief from 287% to 304% w.e.f 01.07.2019.</p>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p>(a) The widows and eligible children of the deceased CPF beneficiary who had retired from service prior to 1.1.1986 or who had died while in service prior to 1,1.1986 and were sanctioned ex-gratia payment of Rs. 605/- p.m. and revised to .Rs.645/-p.m w.e.f 04 June, 2013 vide OM No 1 /10/2012-P&amp;PW(E) dated 27th June,2013.</p><p>(b) Central Government employees who had retired on CPF benefits before 18.11.1960 and are in receipt of Ex-gratia payment of Rs. 654/-, Rs.659/-, Rs.703/- and Rs.965/-</p></blockquote>



<p>2. Payment of DR involving a fraction of a rupee shall be rounded off to the next higher rupee.</p>



<p>3. It will be the responsibility of the pension disbursing authorities, including the nationalized banks, etc. to calculate the quantum of DR payable in each individual ease.</p>



<p>4. In their application to the Indian Audit and Accounts Department, these orders issue after the concurrence of 0/o Comptroller &amp; Auditor General of India.</p>



<p>5. This issues in pursuance of Ministry of Finance. Department of Expenditure OM No.1/3(2)/2008- E.II(B) dated 25th October, 2019</p>

<p>Sub:- <strong>Grant of Dearness Relief in the 5th CPC series effective from 01.01.2019 to CPF beneficiaries in receipt of ex-gratia payment &#8211; reg</strong></p>



<p>In continuation of this Department’s OM No. 42/06/2018-P&amp;PW(G) dated 08.10.2018, the President is pleased to decide that the Dearness Relief w.e.f 01.0 l.20 19 to the CPF beneficiaries in receipt of ex-gratia payment shall be paid in the following manner :-</p>



<p>(i) The surviving CPF beneficiaries who have retired from service between the period 18.11.1960 and 31.12.1985, and were sanctioned ex-gratia @ Rs. 600/ p.m. w.e.f. 1.11.1997 under this Department’s OM No. 45/52/97-P&amp;PW(E) dated 16.12.1997 and revised to Rs.3000, Rs.1000, Rs.750 &amp; RS.650 for Group A, B, C &amp; D respectively w.e.f 4th June,2013 vide OM No. 11l0/2012-P&amp;PW(E) dtd. 27th June, 2013 shall be entitled to enhanced Dearness Relief from 284% to 295% w.e.f 01.01.2019.</p>



<p>(ii) The following categories of CPF beneficiaries who are in receipt of ex-gratia payment in terms of this Department’s OM No.45/52/97-P&amp;PWCE) dated 16.12.1997 shall be entitled to enhanced Dearness Relief from 276% to 287% w.e.f 01.01.2019.</p>

<p>In continuation of this Department&#8217;s OM No. 42/06/2018-P&amp;PW(G) dated 19.04.2018 the President is pleased to decide that the Deamess Relief w.e.f 01 .07.2018 to the CPF beneficiaries in receipt of ex-gratia payment shall be paid in the following manner:-</p>
<p>(i) The surviving CPF beneficiaries who have retired from service between the period 18.11.1960 and 31.12.1985. and were sanctioned ex-gratia @ Rs. 600/ p.m. w.e.f. 01.11.1997 under this Department&#8217;s OM No. 45/52/97-P&amp;PW(E) dated 16.12.1997 and revised to Rs.3000, Rs.1000. <p>In continuation of this Department&#8217;s OM No.42/15/2016-P&amp;PW(G) dated 13.10.2017, the President is pleased to decide that the Dearness Relief w.e.f 01.01.2018 to the CPF beneficiaries in receipt of ex-gratia payment shall be paid in the following manner</p>
<blockquote><p>(i) The surviving CPF beneficiaries who have retired from service between the period 18.11.1960 and 31.12.1985, and were sanctioned ex-gratia @ Rs. 600/ p.m. w.e.f. 1.11.1997 under this Department&#8217;s OM No. 45/52/97-P&amp;PW(E) dated 16.12.1997 and revised to Rs.3000, Rs.1000, Rs.750 &amp; Rs.650 for Group A, B, C &amp; D respectively w.e.f 4th June,2013 vide OM No. 1/10/2012-P&amp;PW(E) dtd. 27th June, 2013 shall be entitled to enhanced Dearness Relief from 268% to 274% w.e.f 01.01.2018.</p>
<p>(ii) The following categories of CPF beneficiaries who are in receipt of ex-gratia payment in terms of this Department&#8217;s OM No. 45/52/97-P&amp;PW(E) dated 16.12.1997 shall be entitled to enhanced Dearness Relief from 260% to 266% w.e.f 01.01.2018.</p>
<p>(a) The widows and eligible children of the deceased CPF beneficiary who had retired from service prior to 1.1.1986 or who had died while in service prior to 1.1.1986 and were sanctioned ex-gratia payment of Rs. 605/- p.m. and revised to Rs.645/-p.m w.e.f 04 June, 2013 vide OM No 1/10/2012-P&amp;PW(E) dated 27th June,2013.</p>
<p>(b) Central Government employees who had retired on CPF benefits before 18.11.1960 and are in receipt of Ex-gratia payment of Rs. 654/-, Rs.659/-, Rs.703/- and Rs.965/-</p></blockquote>
<p>2. Payment of DR involving a fraction of a rupee shall be rounded off to the next higher rupee.</p>
<p>3. It will be the responsibility of the pension disbursing authorities, including the nationalized banks, etc. to calculate the quantum of DR payable in each individual case.</p>
<p>4. In their application to the Indian Audit and Accounts Department, these orders issue after the concurrence of 0/o C&amp;AG.</p>
<p>5. This issues in pursuance of Ministry of Finance, Department of Expenditure OM No. 1/3/2008-E.II(B) dated 28th March,2018.</p>

<p><strong>Sub:- Grant of Dearness Relief in the 5th CPC series effective from 01.07.2017 to CPF beneficiaries in receipt of ex-gratia payment-reg</strong></p>
<p>In continuation of this Department&#8217;s OM No. 42/15/2016-P&amp;PW(G) dated 12.05.2017, the President is pleased to decide that the Dearness Relief @ 5th CPC w.e.f 01.07.2017 to the following categories :-</p>
<p>(i) The surviving CPF beneficiaries who have retired from service between the period 18.11.1960 and 31.12.1985, and are in receipt of ex-gratia @ Rs. 600/ p.m. w.e.f. 1.11.1997 under this Department’s OM No. 45/52/97-P&amp;PW(E) dated 16.12.1997 &amp; revised to Rs.3000, Rs.I000, Rs.750 &amp; Rs.650 for Group A, B, C &amp; D respectively w.e.f 4th June,2013 vide OM No. 1/10/2012-P&amp;PW(E) dtd. 27th June, 2013 shall be entitled to enhanced Dearness Relief from 264% to 268% w.e.f 01.07.2017.</p>
<p>(ii) The following categories of CPF beneficiaries who are in receipt of ex-gratia payment in terms of this Department’s OM No. 45/52/97 -P&amp;PW(E) dated 16.12.1997 shall be entitled to enhanced Dearness Relief from 256% to 260% w.e.f 01.07.2017.</p>
<blockquote><p>(a) The widows and eligible children of the deceased CPF beneficiary who had retired from service prior to 1.1.1986 or who had died while in service prior to 1.1.1986 and are in receipt of Ex-gratia payment of Rs. 605/- p.m. &amp; revised to Rs.645/-p.m w.e.f 04 June, 2013 vide OM No 1/10/2012-P&amp;PW(E) dated 27th June,2013.</p>
<p>(b) Central Government employees who had retired on CPF benefits before 18.11.1960 and are in receipt of Ex-gratia payment of Rs.654/-, Rs.659/-, Rs.703/- and Rs.965/-</p></blockquote>
<p>2. Payment of DR involving a fraction of a rupee shall be rounded off to the next higher rupee.</p>
<p>3. It will be the responsibility of the pension disbursing authorities, including the nationalized banks, etc. to calculate the quantum of DR payable in each individual case.</p>
<p>4. In their application to the Indian Audit and Accounts Department, these orders issue after consultation with the C&amp;AG.</p>
<p>5. This issues in pursuance of Ministry of Finance, Department of Expenditure vide their OM No.1/3/2008-E.II(B) dated 26th September,2017.</p>

<p>In continuation of this Department&#8217;s OM No. 42/06/2016-P&amp;PW(G) dated 03.05.2016 and OMs of even no. dated 16.11.2016 and 07.04.2017, the President is pleased to decide that the Dearness Relief @ 5th CPC w.e.f 01.07.2016 and 01.01.2017 to the following:</p>
<p>(i) The surviving CPF beneficiaries who have retired from service between the period 18.11.1960 and 31.12.1985, and are in receipt of ex-gratia @ Rs. 600/ pm. w.e.f. 1.11.1997 under this Department&#8217;s OM No. 45/52/97-P&amp;PW(E) dated 16.12.1997 &amp; revised to Rs.3000, Rs.1000, Rs.750 &amp; Rs.650 for Group A, B, C &amp; D respectively w.e.f 4th June,2013 vide OM No. 1/10/2012-P&amp;PW(E) dtd. 27th June, 2013 are entitled to Dearness Relief at the following rates:-</p>
