<p><strong>Subject: Grant of Disability Pension/ Element/ Special Family Pension in case of death of ESM due to COVID-19 &#8211; clarification thereon.</strong></p>



<p>Sir,</p>



<p>The undersigned is directed to say that references have been received from all the three services for want of clarification regarding grant of Disability Pension/ Special Family Pension in cases of disability / death of ESM due to COVID-19. The three Services have reported that during processing of such cases, Principal Integrated Financial Advisor (PIFA) of the concerned services have desired clarification from this Ministry on grant of SFP in case of death due to COVID-19.</p>



<p>2. The matter has been examined in this Ministry in consultation with its stakeholders. The competent authority has decided to clarify the following in this regard:</p>



<ul class="wp-block-list"><li>(i) All cases of infection due to any cause do not get attributability as per existing rules and regulations, as every case is different and the rules and regulations are robust. Similarly, all cases of disability / death due to COVID-19 will not qualify for award of attributability as being explained by the Release Medical Boards or the competent medical or the competent medical authorities.</li><li>(ii) It will be difficult to bring out such a direct causal connection between the Government Service and the disease (COVID-19) since contraction of infection from other sources beyond office hours cannot be ruled out, except in cases of frontline workers where Government has made other provisions.</li><li>(iii) For award of Disability Pension / Element / Special Family pension, a causal connection between disability or death and Military Service has to be established by appropriate authority. Thus, policy for grant of SFP in case of disability or death due to a particular infection / disease already exists. But the concerned competent authority has to establish causal connection between infection / disease and Military Service. This is equally applicable in the case of COVID-19 infections.</li></ul>



<p>3. This issues with the concurrence of Finance Division of this Ministry vide their ID Note No. 10(04)/2022/ FIN/PEN dated 16.06.2022.</p>

<p>Since 1949, 07 December is observed as Armed Forces Flag Day throughout India to honour the martyrs as well as men and women in uniform, who valiantly fight on our borders to safeguard the country’s honour. It is an important occasion to remind the nation of its obligation to look after veterans, disabled soldiers, war widows and dependents of those who have sacrificed their lives for the safety, honour and Integrity of the motherland.</p>
<p>The &#8216;Armed forces Flag Day Fund&#8217; (AFFDF) has been constituted by the Government of India for the welfare and rehabilitation of the Ex-Servicemen (ESM) community. There are more than 30 lakh ESM Including 6.5 Iakh widows and around 60,000 ESM are added every year due to early superannuation. Contributions received from prospective donors of AFFDF are utillsed to provide basis sustenance needs of the ESM community through a medium of welfare schemes.</p>
<p>The aim of the campaign to generate awareness about the &#8216;<strong>Armed Forces Flag Day Fund</strong>&#8216; and encourage people to contribute generously. Several cashless payment methods have been setup and made available. <p>This year the programme MoD has planned to run has been in effect from 01 November, 2018 and would continue till December 31, 2018. <p><strong>VERIFICATION OF ONLINE APPLICATION FOR ECHS CARDS BY RECORD OFFICE</strong></p>
<p>l. The process of making of new 64 Kb ECHS Card by an EX-Servicemen is initiated by the ESM by filling an online application form. ESM fills full details of self and dependents and uploads the required documents and photographs. Then ESM is required to make online payment through the payment gateway. Alter payment is made the application is visible to respective Record Offices for verification.</p>
<p>2. The application is verified by the Record Office after which there is no human intervention and the Cards are automatically printed. Hence, incase incorrect data is uploaded emneously by the ESM and the same is verified by respective records then the Card is printed with wrong data e.g. Date of Birth. name etc. Once the ECHS Card with wrong data is used by the beneficiary in case of emergency, ESM may be for once denied treatment/admission by an empanelled hospital, which may have sever repercussion leading to litigation.</p>
<p>3. A large number of complaints have been received from the environment where new 64 Kb Cards have been printed with wrong data. it is reiterated that although the onus to fill onlinc application for ECHS Card correctly is with the ESM but from the organizational point of view Record Office is the final authority to verify the correctness of all data including photo, PPO etc.</p>
<p>4. In view of the above. it is requested that Records Offices may please ensure that all fields in the application form filled by the ESM for new 64 Kb ECHS Smart Card be scruitinized with delibration to ensure error free verification.</p>
<p>5. This letter may please be put up to respective CROs.</p>

<p>Subject: <strong>Enhancement of rates of Marriage Grant.</strong></p>
<p>The Standing Committee on Defence (16th Lok Sabha) directed vide para 56 to 58 of its 2nd Report that rate of marriage grant to needy ESM (upto the rank of Hav/equivalent) and their widows be enhanced from Rs 16,000/- to Rs 50,000/- per daughter (for 2 daughters). The Standing Committee also desired that an additional allocation of Rs 10.30 crores may be provided to DESW to meet the requirement of enhanced Marriage Grant.</p>
<p>2. Accordingly Army, Navy &amp; Air force has agreed to provide the additional funds 011 pro-rata basis i.c. 85:5 :10, annually w.e.f. 2016-17.</p>
<p>3. Approval of competent authority is conveyed to the enhancement of the rates of marriage grant from , Rs 16,000/- to Rs 50,000/- per daughter (for 2 daughters) to ESM (upto the rank of Hav/equivalent) and their widows w.e.f. 1.4.2016.</p>

										<content:encoded><![CDATA[<p><b>Short Service Commissioned Officers</b></p>
<p>An Ex-Servicemen (ESM) means a person who has been released from such service after completing the specific period of engagement, otherwise than at his own request, or by way of dismissal, or discharge on account of misconduct or inefficiency and has been given a Gratuity; and includes personnel of the Territorial Army, namely, pension holders for continuous embodied service or broken spells of qualifying service.</p>
<p>10% of the vacancies in posts upto the level of the Assistant Commandants in all para military forces to be filled by direct recruitment in a year shall be reserved for being filled by the Ex-Servicemen.</p>
<p>For appointment to any vacancy in Group &#8216;A&#8217; and Group &#8216;B&#8217; services or posts filled by direct recruitment otherwise than on the results of an open All India Competitive Examinations, the upper age limit shall be relaxed by the length of military service increased by three years in the case of Ex-servicemen and Commissioned Officers including Emergency Commissioned Officers or Short Service Commissioned Officers.</p>
<p>For appointment to any vacancy in Group &#8216;A&#8217; and Group &#8216;B&#8217; services or posts filled by direct recruitment on the results of an All India Competitive Examination, the Ex-servicemen and Commissioned Officers including Emergency Commissioned Officers or Short Service Commissioned Officers who have rendered at least five years military service and have been released :</p>
<p>(i) On completion of assignment (including those whose assignment is due to be completed within one year) otherwise than by way of dismissal or discharge on account of misconduct or inefficiency, or</p>
<p>(ii) On account of physical disability attributable to military service or on invalidment shall be allowed maximum relaxation of five years in the upper age limit.</p>
<blockquote class="tr_bq"><p><em>DGR Resettlement Schemes for ESM Short Service Commissioned Officers are as under:-</em></p>
<p>(i) ESM Coal Loading and Transportation Scheme.</p>
<p>(ii) Allotment of Bharat Petroleum Corporation Ltd. / Indian Oil Corporation Ltd. outlets Pan INDIA.</p>
<p>(iii) Management of CNG Station by ESM (Officers) in NCR.</p>
<p>(iv) DGR Sponsored Security Scheme.</p>
<p>(v) Coal Tipper Attachment Scheme.</p>
<p>(vi) Allotment of Army Surplus Vehicles.</p>
<p>(vii) Allotment of LPG distributorship under Government Person (GP) category scheme.</p>
<p>(viii) Allotment of Retail Outlet (Petrol &amp; Diesel) under Combined Category 1 (CC1) scheme.</p></blockquote>
<p>The Short Service Commissioned Officers are offered to undergo 24 weeks management courses in IIM, Ahmedabad, IIM, Lucknow, IIM, Indore, MDI, Gurgaon and other skill upgradation courses which are National Skills Qualifications Framework compliant.</p>
<p>There is no proposal for restructuring the Short Service Commission in the Ministry.</p>

<p>The Directorate General of Resettlement (DGR), an Attached Office of the Department of Ex-Servicemen Welfare, Ministry of Defence, is responsible for rehabilitation of retired defence personnel in the country through training courses, reservations in Central / State / PSU jobs and resettlement schemes including self-employment schemes.</p>

<p>The salient features of the policy being implemented for resettlement of Ex-Servicemen (ESM) in the country are as follows:</p>

<p><b>TRAINING PROGRAMMES:</b></p>
<div data-blogger-escaped-style="text-align: justify;">
<p>Meaningful professional and vocational training to retiring Officers, Junior Commissioned Officers (JCO) and Other Ranks (OR) is imparted by DGR through various training institutes for the rehabilitation and resettlement of ESM in civil life by upgrading their skills to prepare them to take on new assignment / jobs and assisting ESM in finding re-employment. An option to undergo resettlement courses in reputed institutes pan India is provided to Officers, JCO / OR and retired personnel to enhance their educational qualifications and increase employment options post retirement. An exemption of 100% of the course fees is given to JCOs / ORs and 60% to Officers. The exempted amount against the course fees is paid by office of DGR.</p>

<p><b>RE-EMPLOYMENT OPPORTUNITIES:</b></p>

<td colspan="3" width="92%">Placement Assistance through DGR:  Directorate General Resettlement (DGR) sponsors Ex-Servicemen (Officers) to various Government organizations, Public Sector Undertakings, Corporate Houses, Private Sector, Central Para Military Forces etc. based on their requisition for re-employment of ESM.  The DGR sponsored ESM are re-employed by the requisitioning agencies after due process of selection by them.</td>

The resettlement schemes are reviewed and upgraded from time to time and new schemes are also initiated in consultation with the concerned stake holders.</p>

<p>Details of schemes being implemented for welfare, rehabilitation and resettlement of ESM is as under:</p>
<p align="center"><strong><span style="text-decoration: underline;">TRAINING PROGRAMMES</span></strong></p>
<p><strong>Officers’ Training:</strong></p>
<ul>
<li>24 Weeks Management Courses at IIMs and other reputed B-Schools</li>
<li>Modular management courses like Project Finance, Academic Institutions, Supply Chain, Retail, Six Sigma, Seafaring etc.</li>
<li>Newly introduced courses for 2015-16 like Strategic Retail Management, Human Resource Management(HRM), Facility, Transition, Export and Import, Event Management etc, Corporate Social Responsibility and Jet Transition.</li>
</ul>
<p><strong>Junior Commissioned Officers (JCOs)/Other (OR) and Equivalents’ Training at Institutes:</strong></p>
<ul>
<li>Security, Fire &amp; Industrial Safety, Computer &amp; Information Technology including ‘O’ Level, Hospitality, Tourism, Agriculture based, Business Management, Modular Management, Vocational &amp; Technical, Medical &amp; Healthcare, Library &amp; Information Science, Legal Assistant etc</li>
<li>Newly introduced courses for 2015-16 like Logistics &amp; Transport Management, Retailing &amp; Showroom, Corporate Office, Material Management, Marine Engineering etc.</li>
</ul>
<p><strong>Courses at Regimental Centres:</strong></p>
<ul>
<li> At least two courses are planned every month at all the Regimental Centres to provide variety of courses to the retirees on pension drill.</li>
</ul>
<p align="center"><strong><span style="text-decoration: underline;">RE-EMPLOYMENT OPPORTUNITIES</span></strong></p>
<p><strong>Reservation in Government Jobs:</strong></p>
<p>The Central Government has provided for the following reservation for ESM for vacancies in the posts to be filled by direct recruitment:-</p>
<ul>
<li>10% in Group ‘C’ posts and 20% in Group ‘D’ posts. In addition 4.5% reservation in each category is meant for Disabled Soldiers and Widows/ Dependents.</li>
<li>14.5% in Group ‘C’ and 24.5% Group ‘D’ posts in Public Sector Undertakings and Nationalized Banks.</li>
<li>10% posts upto Assistant Commandants in Paramilitary Forces.</li>
<li>100 % in Defence Security Corps.</li>
</ul>
<p><strong>Placement Assistance through DGR:</strong></p>
<p>Directorate General Resettlement (DGR) sponsors Ex-Servicemen (Officers) to various Government organizations, Public Sector Undertakings, Corporate Houses, Private Sector, Central Para Military Forces etc based on their requisition for re-employment of ESM. The DGR sponsored ESM are re-employed by the requisitioning agencies after due process of selection by them.</p>

<li>Management of CNG Station by Ex-Servicemen (O) in National Capital Region.</li>

<li>Coal Tipper Attachment Scheme.</li>
<li>Allotment of Army Surplus Vehicles</li>
<li>Allotment of Regular LPG Distributorship Scheme under ‘Government Personnel’ Category</li>

<p><strong>Steps being taken to provide better opportunities to ESM are as under :-</strong></p>
<ul>
<li>dissemination of information on Directorate General Resettlement (DGR) website regarding Open Competitive Examination for various posts, dates and syllabus etc.</li>
<li>signing of a Memorandum of Understanding with Confederation of Indian Industries (CII) to conduct job fairs by Corporate Sectors to provide additional employment opportunities to ESM.</li>
<li>hosting of job portal by DGR wherein ESM can upload their Bio-data and corporate/other sectors can approach them and pick as per their requirement.</li>
<li>organizing ESM Job Fairs Pan India to provide an interface between Corporate &amp; ESM.</li>
<li>regular interaction with corporate houses to generate employment opportunities to ESM.</li>
<li>Provision of opportunities to ESM through the corporate bodies like TATA Motors, AMAZON.com etc.</li>
</ul>

<p>Several representations are received from Armed Forces Veterans relating to various issues such as pension fixation / One Rank One Pension, disbursal, rehabilitation, re-employment, effective implementation of Ex-Servicemen Contributory Health Scheme, financial assistance, grant of benefits to ESM / families by State Governments such as land / houses / flat, compensation, ex-gratia, etc. which are replied to / disposed off in accordance with the existing Government policies / Rules.</p>
