<p>Subject: <strong>General Election to the Legislative Assemblies of Goa, Manipur, Punjab, Uttarakhand and Uttar Pradesh, 2017 &#8211; Grant of paid holiday to employees on the day of poll &#8211; regarding</strong></p>
<p>The undersigned is directed to say that in connection with the General Elections to the Legislative Assemblies of the States of Goa, Manipur, Punjab, Uttarakhand and Uttar Pradesh, to be held during the months, of February and March, 2017, the guidelines, issued by this Department vide OM No. 12/ 14/99-JCA dated 10.10.2001, may be followed for closing of the Central Government Offices, including Industrial establishments in the above mentioned States the relevant portion of the OM as referred to above are reproduced here.</p>
<blockquote><p>(i) The relevant organizations shall remain closed in the notified areas where general elections to the State Legislative Assembly are concerned scheduled to be conducted;</p>
<p>(ii)In connection with bye-election to Lok Sabha/ State Assembly, only such of the employees who are bona-fide voters in the relevant constituency should be granted special casual leave on the day of polling. Special Casual leave may also be granted to an employee who is ordinarily a resident of a constituency and registered as a voter but employed in any Central Government Organization/ Industrial Establishment located outside the constituency having a general/ bye-election.</p></blockquote>
<p>2. The employees detailed on election duty may also be permitted to remain away from their normal duties on polling day(s) as also on the days required for performing journeys which might be undertaken in order to perform such election duty</p>
<p>3. The above instructions may be brought to the notice of all concerned.</p>

<p>This office is in receipt of various representations from different departments/ individuals and RTI applications regarding payrnent/admissibility of Travelling Allowance (from residence to temporarily place of duty) to those who were deputed for Election Duty in various cells of District Election Offices or CEO (HQ) for a longer period.</p>
<p>In this regard, this office has received an endorsement from Dte. of Training &amp; Technical Education, Govt. of NCT of Delhi vide which Finance Department, Govt. of NCT of Delhi has clarified that:-</p>
<p>“Travelling Allowance is not admissible for the journey performed by officers/officials from their residence to the temporary duty point. However, they are entitled to Travelling Allowance, provided they performed any local journey in connection with official duty from the temporary duty point, will be regulated as per SR-71”.<br />
Therefore all the Head of Departments/Nodal Officers, Govt. of India, Govt. of NCT of Delhi, all autonomous bodies, District Election Officers/SDM (Elections) are hereby requested to settle the Travelling Allowance Claims for election duty as per Opinion given by the Finance Department, Govt. of NCT of Delhi. <em><strong><span style="text-decoration: underline;">The cases already settled may also be reviewed accordingly.</span></strong></em></p>

<p><strong>68.  The Commission has decided to forward its recommendations to the President of India, for issuing 10 Notifications calling upon the Parliamentary Constituencies covered on each Poll Day in the States and Union Territories concerned to elect members to the House of the People. With this, the campaign days for the Constituencies for each Poll Day have been kept to the possible minimum.</strong></p>

EXPLANATORY NOTE ON STATEMENTS</p>
<p>The Statements appended to the Press Note contain various terms and abbreviations, which are explained<br />
below:</p>
<p><strong>Statement-A:</strong></p>
<ul>
<li>Poll Days signify the number assigned to a particular day on which Polling is to take place, in the National Schedule for Lok Sabha elections. The first Poll Day of the nation is 7th April, 2014 (Monday) and the ninth (last) Poll Day is 12thMay, 2014 (Monday).</li>
<li>    Every reference to a Poll Day in the Press Note invariably refers to the Poll Day of the National Schedule.</li>
<li>    Each Poll Day has a corresponding single Schedule except Poll Day 3, which has two Schedules 3A and 3B, necessitated due to local holiday on 22ndMarch, 2014(Saturday) in Bihar State.</li>
</ul>
<p>&nbsp;<br />
<strong>Statement-B:</strong></p>
<ul>
<li>    State/UT-wise abstract of number of Parliamentary Constituencies (PCs) voting on different Poll Days and the corresponding Date and Day of the week for all the 543 PCs.</li>

<p>Sir,<br />
The following guidelines already issued by DOPT vide OM. No. 12/14/99-JCA dated 10th October, 2001 have to be followed for closing of the Central Government Offices including Industrial Establishments in the state in accordance with the Office Memorandum No. 12/12/2013-JCA-2 dated 26th November, 2013 of Ministry of Personnel, Public Grievances and Pension (Department of Personnel and Training), in connection with the general elections to the Legislative Assemblies of some States, scheduled to be held in 2013.</p>
<p>(i) The relevant offices/organizations shall remain closed in the notified areas where General elections to the State Legislative Assembly are scheduled to be conducted on the day of poll.</p>
<p>(ii) In connection with bye-election to Lok Sabha / State Assembly, only such of the Employees who are bonafide voters in the relevant constituency should be granted special casual leave on the day of polling.</p>
<p>(iii) The Special Casual leave may also be granted to an employee who is ordinarily a resident of constituency and registered as a voter but employed in any Central Government Organization / Industrial Establishment located outside the constituency having a general / bye-election.</p>

<p>Sir,<br />
I am directed to invite your attention to Section 135B of the Representation of the People Act. 1951 which provides for the grant of paid holiday to the employees on the day of poll. The Section 135B is reproduced below:</p>
<p><strong>“135B. Grant of paid holiday to employees on the day of poll.</strong></p>
<blockquote><p>(i) Every person employed in any business trade, industrial undertaking or any other establishment and entitled to vote at election to the House of the People or the Legislative Assembly of a State shall, on the day of poll, be granted a holiday.</p>
<p>(ii) No deduction or abatement of the wages of any such person shall be made on account of a holiday having been granted in accordance with sub-section (I) and if such person is employed on the basis that he would not ordinarily receive wages for such a day, he shall nonetheless be paid for such day the wages he would have drawn had not a holiday been granted to him on that day.</p>
<p>(iii) If an employer contravenes the provisions of sub-section (1) or susedion (2), then such employer shall be punishable with fine, which may extend to five hundred rupees.</p>
<p>(iv) This section shall not apply to any elector whose absence may cause danger or substantial loss in respect of the employment in which he is engaged.”</p></blockquote>
<p>2. The above provisions recuire that all establishments and shops including those which work on shift basis shall be closed on the day of poll in the Constituency where a General/bye-election is to be held. However, there may be cases where a person is ordinanly resident of the Constituency and registered as an elector, may be serving/employed in an industrial undertaking or an establishment located outside the Constituency having a general/bye-election. It is clarified that in such a situation, even those electors including casual workers working outside the constituency concerned would be entitled to the benefit of a paid holiday extended under Section 135B(1) of the Representation of the People Act. 1951.</p>
<p>3. The daily wage/casual workers are also entitled for a holiday and wages on poll day as provided in Section 135B of the R.P. Act, 1951.</p>
<p>4. The Commission desired that suitable instructions should be issued to all concerned and a copy there of be endorsed to the Commission for its information and record.</p>
