Subject: Conduct of adjourned poll in 03 Assembly Constituencies of West Bengal and Odisha and Bye-election in 159-Bhabanipur Assembly of West Bengal – Grant of Paid holiday to employees on the day of poll – regarding

The undersigned is directed to say that by the Election Commission of India, vide their letter No. 78/ 2021-EPS/ 969-Spl., Dated 07.09.2021, has announced schedule for the election in 03 Assembly Constituencies, namely, 56-Samserganj (AC), 58-Jangipur (AC), 110-Pipli (AC) and bye election in 159-Bhabanipur (AC) Assembly Constituency in West Bengal. The schedule of Poll is as follow.

2. In this regard, it is stated that the guidelines, have been issued by this Department, vide OM No. 12/ 14/99-JCA, dated 10.10.2001, regarding closure of Central Government Offices and grant of paid holiday on the date of election. A copy of the same is available on website www.persmin.nic.in. Accordingly, all the Central Government Offices and the Central Industrial Establishments, located in the relevant constituencies shall remain closed on the date of Poll. The employees concern shall be granted paid holiday on the date of Poll to enable them to exercise their right to vote.

In account of General Elections for 17th Lok Sabha to be held on 11th April 2019 in Telangana, the state government of Telangana has declared a public holiday for all government offices and schools.

The State Government authorize all the Collectors and District Election Officers in the State to declare local holiday on the day before the day of Poll i.e. on 10.04.2019 (Wednesday) and on the day of Poll i.e., on 11.4.2019 (Thursday).

Similar all the Collectors and District Election Officers are authrorized to declare a local holiday on the day fixed for counting i.e., on 23.05.2019 (Thursday), if necessary.

In connection with bye-election to State Assembly, only such of the employees who are bona-fide voters in the relevant constituency should be granted special casual leave on the day of polling. Special Casual leave may also be granted to an employee, who is ordinarily a resident of constituency and registered as a voter, but employed in any Central Government Organization/ Industrial
Establishment located outside the constituency having the bye-election.

ELECTION HOLIDAYS 2016 DOPT ORDERS

Election Commission has issued orders on General Election to the State Legislative Assembly of NCT of Delhi 2015, grant of paid holiday to employees on the day of poll under section 135B of Representation of the People Act 1951. The order is reproduced and given below for your ready reference…

Subject:- General Election to the State Legislative Assembly of NCT of Delhi, 2015 – Grant of paid holiday to employees on the day of poll – Regarding.

Sir,
I am directed to invite your attention to Section 135B of the Representation of the People Act, 1951 which provides for the grant of paid holiday to the employees on the day of poll. The Section 135B is reproduced below:-

“135B. Grant of paid holiday to employees on the day of poll.

(1) Every person employed in any business trade, industrial undertaking or any other establishment and entitled to vote at election to the House of the People or the Legislative Assembly of a State shall, on the day of poll, be granted a holiday.

(2) No deduction or abatement of the wages of any such person shall be made on account of a holiday having been granted in accordance with sub-section (I) and if such person is employed on the basis that he would not ordinarily receive wages for such a day, he shall nonetheless be paid for such day the wages he would have drawn had not a holiday been granted to him on that day.

(3) If an employer contravenes the provisions of sub-section (1) or sub-section (2), then such employer shall be punishable with fine, which may extend to five hundred rupees.

(4) This section shall not apply to any elector whose absence may cause danger or substantial loss in respect of the employment in which he is engaged.”

2. The above provisions require that all the electors who are employees of establishments and shops including those who work on shift basis shall be granted a paid holiday on the day of poll in the Constituency where a general election is to be held. Further, there may be cases where a person is ordinarily resident of the Constituency and registered as an elector, may be serving/employed in an industrial undertaking or an establishment located outside the Constituency having a general election. It is clarified that in such a situation, even those electors including casual workers working outside the constituency concerned would be entitled to the benefit of a paid holiday extended under Section 135B(1) of the Representation of the People Act, 1951,

3. The daily wage/casual workers are also entitled for a holiday and wages on poll day as provided in Section 135B of the R.P. Act, 1951

4. The Commission desires that suitable instructions should be issued to all concerned and a copy thereof be endorsed to the Commission for its information and record.

Subject: Closing of Central Government Offices in connection with general elections to the Legislative Assembly of NCT of Delhi, 2015.

The undersigned is directed to say that in connection with the general election to the Legislative Assembly of NCT of Delhi, to be held on 7th February, 2015, the following guidelines, already issued by DOPT vide OM No. 12/ 14/99-JCA dated 1oth October 2001, have to be followed for closing of the Central Government Offices including Industrial Establishments in NCT of Delhi.

(i) The relevant offices / organizations shall remain closed in the notified areas where general elections to the Legislative Assembly of NCT of Delhi, scheduled to be conducted.

(ii) In connection with bye-elections to State Assembly, only such of the employees who are bonafide voters in the relevant constituency should be granted special casual leave on the day of polling. Special Casual leave may also be granted to an employee who is ordinarily a resident of constituency and registered as a voter but employed in any Central Government Organization/Industrial Establishment located outside the constituency having a general/bye-election.
